A Tale Of Two Portlands: How Port Cities Can Survive Dormant Commerce Clause Challenges To Fossil Fuel Shipping Restrictions, Kayla Race
UC Law Environmental Journal
Five port cities—Portland, Oregon; South Portland, Maine; Oakland, California; Longview, Washington; and Salt Lake City, Utah—have something in common: they all restricted the handling of fossil fuels at their shipping terminals. Moreover, impacted industries have responded with nearly identical dormant Commerce Clause-based lawsuits against the first four of those localities. This Article examines how much latitude cities have under the dormant Commerce Clause to restrict the handling of fossil fuels at their ports, using as case studies two recent court decisions upholding the ordinances of Portland, Oregon and South Portland, Maine under the dormant Commerce Clause. In addition, because the …

Nebraska Rural Poll
Most rural Nebraskans have farming or ranching history in their family. In fact, one-half of rural Nebraskans are one generation or less removed from the farm or ranch. Rural Nebraskans’ connection to agriculture has not changed much in the last ten years.
Most rural Nebraskans view their economic well-being as being dependent on both production agriculture in general and animal agriculture in particular. Furthermore, most rural Nebraskans say the economic well-being of their community or county is very much dependent on the economic success of both production agriculture and animal agriculture.
Most rural Nebraskans are supportive of new livestock development …

An Evaluation Of The Montgomery County Reentry Career Alliance Academy, Catherine Marliese Driver
Browse all Theses and Dissertations
As a result of a deterrence and incapacitation focused criminal justice system in the United States, reentry programming has become integral to both reduce criminal justice spending and mass incarceration. Reentry programming assists those released from prison with reintegration into society to prevent recidivism and allow the returning citizen to become a productive member of society. This study evaluated one such reentry program in Montgomery County Ohio. The Reentry Career Alliance Academy (RCAA) is a career focused work readiness curriculum that also includes workshops with community stakeholders. Evaluation was completed through paired T Test analysis in pre- and post-questionnaire responses. …

Is There A Difference Between Democrat And Republican States In The Percentage Of Male High School Students Who Carry Weapons On School Property?, Stephen Church, Wayne L. Davis
Lincoln Memorial University Journal of Humanities and Social Sciences
Compared to other industrialized countries, America is a relatively violent country. The impact of violent crime on America’s youth is alarming and there is no clear solution. School violence is a serious problem that threatens American youth, and politicians are concerned about the high number of violent crimes committed by teens. However, Democrats and Republicans have very different policy platforms on dealing with violent crimes. On the one hand, Republicans support Stand-Your-Ground laws and believe that individuals have a right to protect themselves. On the other hand, Democrats oppose Stand-Your-Ground laws and believe the government is the best source for …

Justice-Free Zones: U.S. Immigration Detention Under The Trump Administration, Eunice Hyunhye Cho, Tara Tidwell Cullen, Clara Long
United States Department of Homeland Security
In the last three years, the Trump administration has grown the immigration detention system in the United States to an unprecedented size, at times holding more than 56,000 people per day. Since 2017, Immigration and Customs Enforcement (ICE) has anchored this growth in places where immigrants are most likely to be isolated from legal counsel, remain in detention without real opportunity for release, and are more likely to lose their cases. These new detention centers also exhibit patterns of mistreatment and abuse, including medical and mental health care neglect, that have been present since the inception of ICE’s detention system …

The Common Law And The Right Of The People To Bear Arms: Carrying Firearms At The Founding And In The Early Republic, Stephen Halbrook
Lincoln Memorial University Law Review Archive
I. Introduction
To what extent does “the right of the people to . . . bear Arms, shall not be infringed” as guaranteed by the Second Amendment protect the liberty to carry firearms outside the home for self-defense or other lawful purposes?[1] While most states recognize a right to do so, either with or without a license and subject to place restrictions, some states grant discretion to a law enforcement agency to decide whether a specific person “needs” or has “good cause” to carry a firearm and restricts licenses to such persons. These discretionary licensing schemes have become a …

Lincoln Memorial University Law Review Archive
This Article provides a summary of federal circuit court cases decided in 2018. By the end of 2018, every circuit except for the Eighth has adopted a Two-Part Test for Second Amendment cases. In Part One, the court determines whether the challenged law burdens the Second Amendment right. If so, the court applies heightened scrutiny in Part Two. Courts in Second Amendment cases almost always apply intermediate scrutiny, but strict scrutiny and categorical invalidation are also available.
The Two-Part Test is detailed in our article, The Federal Circuits’ Second Amendment Doctrines.[1] That article reviews every federal circuit Second …

Immigrants And Interdependence: How The Covid-19 Pandemic Exposes The Folly Of The New Public Charge Rule, Medha D. Makhlouf, Jasmine Sandhu
Faculty Scholarly Works
On February 24, 2020, just as the Trump administration began taking significant action to prepare for an outbreak of COVID-19 in the United States, it also began implementing its new public charge rule. Public charge is an immigration law that restricts the admission of certain noncitizens based on the likelihood that they will become dependent on the government for support. The major effect of the new rule is to chill noncitizens from enrolling in public benefits, including Medicaid, out of fear of negative immigration consequences. These chilling effects have persisted during the pandemic. When noncitizens are afraid to (1) seek …

In the wake of nationwide demonstrations for racial justice prompted by the murders of Breonna Taylor, Ahmaud Arbery, George Floyd, and countless other Black individuals, Los Angeles has become a focal point for critical discussions around police and community relations.
StudyLA’s 2020 Police and Community Relations Survey focuses on the attitudes and opinions of adult city of Los Angeles residents toward the Los Angeles Police Department (LAPD) following this period of nationwide demonstrations. Residents were asked a range of questions to measure public opinion regarding policing. Specifically, we gauge how residents feel the LAPD is doing with respect to the …
