City Of New York V. Tominovic
All Decisions
The City of New York brought a motion seeking a preliminary injunction under Multiple Dwelling Law §306 to prohibit certain individuals and companies from permitting the use or occupancy of specified buildings for less than thirty consecutive days. The defendants, including both individuals and corporations, were accused of advertising and renting accommodations for illegal short-term periods, violating housing laws and creating numerous safety hazards. Despite enforcement efforts, the defendants continued their illegal activities, prompting the city to seek injunctive relief. The court found ample statutory basis for the injunction and granted the motion, noting the city's prima facie showing of …

Background: Arriving at and implementing an appropriate patient centered treatment plan for early stage breast cancer requires significant dialogue between healthcare providers and patients. How language barriers affect this process has not been thoroughly explored in the literature. The aim of this paper is to examine the effect of language barrier on variation and receipt of early stage breast cancer treatment.
Methods: Rates of lumpectomy, mastectomy, and contralateral prophylactic mastectomy (CPM) with or without reconstruction were compared between English speaking and Low English Proficiency (LEP) cohorts. Kansas V. Glover And The Issue Of Reasonable Suspicion, Zach Kumar
Kansas V. Glover And The Issue Of Reasonable Suspicion, Zach Kumar
Duke Journal of Constitutional Law & Public Policy Sidebar
It is settled law that an officer may initiate a traffic stop when there is articulable and reasonable suspicion that the person stopped has committed, is committing, or is about to commit a crime. In Kansas v. Glover, the Supreme Court has an opportunity to clarify what constitutes “reasonable suspicion.” The Court will determine whether it is reasonable for an officer to seize a vehicle if the registered owner has a revoked license and there is no information to suggest that the person driving is not the owner of the car. This Commentary argues that the Court should uphold …

Dr. Beth Nagy, Assistant Lecturer of Urban Planning Practice at the Levin College, worked with her UST 489 Senior Seminar class to produce a report for the City of East Cleveland on community benefit agreements (CBAs). Students examined CBAs across major cities throughout the United States to provide the City of East Cleveland with case studies on the different ways CBAs are utilized in other communities, while exploring the successes and limitations such efforts have encountered. The final report was presented to East Cleveland Mayor Brandon L. King in February 2020.

Servant Leadership And Presidential Immigration Politics: Inspiration From The Foot-Washing Ritual, Victor C. Romero
Servant Leadership And Presidential Immigration Politics: Inspiration From The Foot-Washing Ritual, Victor C. Romero
Washington and Lee Journal of Civil Rights and Social Justice
President Donald Trump’s immigration agenda has been criticized by pundits and scholars alike and has been thwarted by courts concerned about executive overreach. This Article contributes to this chorus of critics by viewing the current immigration regime from a Christian perspective on servant leadership, contrary to the stereotype that Christianity necessarily aligns with any one particular political brand. Jesus Christ’s entreaty that his disciples wash each other’s feet provides a useful lens through which to evaluate whether this Administration’s work effectively advances communitarianism, a value consistent with Christian immigration ethics. An examination of a range of immigration policies—from the Muslim …

This Review discusses two timely and insightful books examining the changing relationship between privacy and the Fourth Amendment in the digital era. Part I discusses the tensions between the need to protect privacy rights and the slowly evolving legal landscape during a time of rapidly changing technology, to introduce David Gray’s The Fourth Amendment in an Age of Surveillance. His book explains how the Fourth Amendment, though embattled, can have a prominent role in twenty-first century discussions of privacy, technology, and surveillance.
