Translating National Standards Into Practice: Supporting Social Care Professionals, Victoria O'Dwyer, Laura Behan, Linda Weir, Deirdre Connolly, Rachel Flynn

Journal of Social Care

The Health Information and Quality Authority [HIQA] was established in 2007 to drive high quality and safe care for people using health and social care services in Ireland. One of the functions of HIQA is to set national standards for services. When developing standards HIQA conducts a thorough review of evidence and extensively engages stakeholders through focus groups, advisory groups and public consultations. To validate the robustness of its processes HIQA distributed a survey to key stakeholders with experience of the standards development processes in 2018. It also undertook an international review of how other organisations approach the development of …

Lessons Learned From Designing A Health Monitoring System To Improve First Responders Safety User Interface, Janaki Devi Naveena Akula, Jackson Urrutia, Hitesh Kumar Khatri, Anusha Manda, Jacob C. Grothe

UNO Student Research and Creative Activity Fair

Every day, first responders put their own lives at risk to help individuals, families, and communities. They experience many safety and health hazards on the front-line that can lead to injuries, chronic illnesses, and even death. Chronic illnesses include cancer, heart diseases, and behavioral health issues that often cause first responders life expectancy to be significantly shortened.

According to the National Fire Protection Association, there were 64 on-duty firefighter deaths in 2018. Sudden cardiac death accounted for about 40% of the on-duty fatalities. During 2017, there were an estimated 44,530 documented exposures to hazardous conditions (e.g. chemicals, fumes, radioactive materials) …

Intratextual And Intradoctrinal Dimensions Of The Constitutional Home, Gerald S. Dickinson Mar 2020

Intratextual And Intradoctrinal Dimensions Of The Constitutional Home, Gerald S. Dickinson

Duke Journal of Constitutional Law & Public Policy

The home has been lifted to a special pantheon of rights and protections in American constitutional law. Until recently, a conception of special protections for the home in the Fifth Amendment Takings Clause was under-addressed by scholars. However, a contemporary and robust academic treatment of a home-centric takings doctrine merits a different approach to construction and interpretation: the intratextual and intradoctrinal implications of a coherent set of homebound protections across the Bill of Rights, including the Takings Clause.

Intratextualism and intradoctrinalism are interpretive methods of juxtaposing non-adjoining and adjoining clauses in the Constitution and Supreme Court doctrines to find patterns …

Domestic Violence And The Home-Centric Second Amendment, Joseph Blocher Mar 2020

Domestic Violence And The Home-Centric Second Amendment, Joseph Blocher

Duke Journal of Gender Law & Policy

The most prominent line-drawing debate in Second Amendment law and scholarship is whether and to what degree the right to keep and bear arms extends outside the home. Inside the home, the right is thought to be strongest, as private interests are at their apex and governmental interests are correspondingly weaker. But an uncritical acceptance of this home-centric Second Amendment is not well-equipped to account for the intersection between guns and domestic violence (DV). For women in particular, domestic violence in the home is a more significant threat than assault by a stranger, and studies have shown that the availability …

The Path Forward For States To Integrate Uam, Darshan Divakaran M.S. Mar 2020

The Path Forward For States To Integrate Uam, Darshan Divakaran M.S.

National Training Aircraft Symposium (NTAS)

Urban air mobility is an exciting next step in the area of urban transportation. While it faces many significant challenges, many states like Ohio, North Carolina, Utah, etc. are working hard to overcome them. With ground transportation in many cities stretched to the limit, UAM could provide a much-needed alternative. By utilizing 3D airspace, UAM could reduce congestion on the ground, lower pollution, cut travel times and even reduce traffic accidents. To operate in dense urban areas, vertical takeoff and landing capabilities are a must, eliminating the need for runways, making them ideal for short inner-city hops and deliveries. While …

Horseshoes And Hand Grenades: Frank V.Gaos And The Problem With Class Action Cy Pres Distributions, Jorge Galavis Mar 2020

Horseshoes And Hand Grenades: Frank V.Gaos And The Problem With Class Action Cy Pres Distributions, Jorge Galavis

University of Miami Business Law Review

Nearly Just

Frank v. Gaos is a case that weighed the merits of cy pres, a pesky complex doctrine left applied to my dismay. When in class action settlements, there are remaining funds, Defendants seem to benefit from what the Plaintiffs won.

Worse still the doctrine is applied in cases such as this; when direct payments to a class are deemed de minimus. Counsel decided class members were fine with what they got, Then phoned their favorite charities to divvy the whole pot.

Once courts agree that’s close enough to benefit the class, They seem to turn a blind eye …

Homelessness And Nonrecreational Camping On National Forests And Grasslands In The United States: Law Enforcement Perspectives And Regional Trends, Lee K. Cerveny, Joshua W.R. Baur Mar 2020

Homelessness And Nonrecreational Camping On National Forests And Grasslands In The United States: Law Enforcement Perspectives And Regional Trends, Lee K. Cerveny, Joshua W.R. Baur

Faculty Research, Scholarly, and Creative Activity

National forest law enforcement officers regularly encounter "nonrecreational"campers whose tenure exceeds established stay limits (generally 2 weeks). Some long-term occupants are homeless and seek use of the forest as a temporary or long-term residence. Long-term nonrecreational campers present myriad concerns for forest officials, who seek to balance public access and resource conservation. In addition to biophysical impacts because of waste, disposal of chemicals, soil compaction, and damage to vegetation, nonrecreational campers can alter the social environment being shared with other forest visitors. For this exploratory study, US Forest Service law enforcement officers (n = 290) were surveyed to assess officer …

Leadership In Extremis: Authentic Leadership In Recreational Scuba Instructors, Geoffrey E. Sutton Mar 2020

Leadership In Extremis: Authentic Leadership In Recreational Scuba Instructors, Geoffrey E. Sutton

Doctor of Management

In the aftermath of the 9/11 attacks, the operational environment was chaotic and uncertain. Effective leadership in these circumstances was internally centered and values-based, rather than externally centered and rule-based. Theorists named this leadership style authentic leadership. Research into leadership in dangerous circumstances revealed that effective in extremis leaders display authentic leadership. Dangerous circumstances include not only military combat and traditional occupations such as law enforcement and firefighting, but also dangerous sports such as parachuting and mountain climbing. This investigation extended the existing research to a different dangerous sport, scuba diving. Data collection consisted of a single stage cross-sectional survey …

Artificial Intelligence And The Problem Of Autonomy, Simon Chesterman Mar 2020

Artificial Intelligence And The Problem Of Autonomy, Simon Chesterman

Notre Dame Journal on Emerging Technologies

Artificial intelligence (AI) systems are routinely said to operate autonomously, exposing gaps in regulatory regimes that assume the centrality of human actors. Yet surprisingly little attention is given to precisely what is meant by “autonomy” and its relationship to those gaps. Driverless vehicles and autonomous weapon systems are the most widely studied examples, but related issues arise in algorithms that allocate resources or determine eligibility for programs in the private or public sector. This article develops a novel typology of autonomy that distinguishes three discrete regulatory challenges posed by AI systems: the practical difficulties of managing risk associated with new …

Broken Records: Reconceptualizing Rational Basis Review To Address “Alternative Facts” In The Legislative Process, Joseph Landau Mar 2020

Broken Records: Reconceptualizing Rational Basis Review To Address “Alternative Facts” In The Legislative Process, Joseph Landau

Vanderbilt Law Review

In 2016, North Carolina passed “HB2,” also known as the “bathroom ban”—a law prohibiting transgender individuals from accessing public restrooms corresponding to their gender identity—based on the unfounded fear that cisgender men posing as transgender women would assault women and girls in bathrooms. Around the same time, Alabama enacted a punishing immigration law in which sponsors distorted statistics regarding the undocumented population by using the terms “Latino/Hispanic” and “illegal immigrant” interchangeably. These laws are reflective of a larger pattern. In our increasingly polarized political climate, policymakers are affirmatively distorting legislative records and promoting dubious justifications for their policy goals—that is, …

Law Enforcement “Journalism” In The Modern Age: How Does Social Media Erode Journalistic Authority?, Beth Potter Mar 2020

Law Enforcement “Journalism” In The Modern Age: How Does Social Media Erode Journalistic Authority?, Beth Potter

Society for the Academic Study of Social Imagery

In the age of social media, more than 30,000 residents are signed up to receive “news alerts” on Twitter from a local county sheriff’s office (2) in the Denver metro area, while about 3,000 receive “news alerts” from the community newspaper in that county(1).

What does this say about eroding journalistic authority, if anything? Specifically, how are journalist interactions with police sources changing in today’s social media-heavy environment? This study finds that journalists continue to follow industry norms of objectivity and verification - especially sourcing - while using social media tools to help them find information they need to do …

Are Collateral Consequences Deserved?, Brian M. Murray Mar 2020

Are Collateral Consequences Deserved?, Brian M. Murray

Notre Dame Law Review

While bipartisan passage of the First Step Act and state reforms like it will lead to changes in sentencing and release practices, they do little to combat the collateral consequences that exoffenders face upon release. Because collateral consequences involve the state’s infliction of serious harm on those who have been convicted or simply arrested, their existence requires justification. Many scholars classify them as punishment, but modern courts generally diverge, deferring to legislative labels that classify them as civil, regulatory measures. This label avoids having to address existing constitutional and legal constraints on punishment. This Article argues that although collateral consequences …

Bellsouth V. Cobb County And The 9-1-1 Act: Taxation Without A Right Of Action, Davis Lackey Mar 2020

Bellsouth V. Cobb County And The 9-1-1 Act: Taxation Without A Right Of Action, Davis Lackey

Mercer Law Review

The State of Georgia has long recognized the importance of providing emergency services for its citizens. The on-call availability of medical services in our communities is a vital resource for those in need. The Georgia Legislature enacted the Emergency Telephone Number “911” Service Act of 1977 (9-1-1 Act or Act), which streamlined the emergency services phone number into a single, three-digit emergency number that would effectively reduce response time. Specifically, the Georgia General Assembly was concerned with the existence of too many phone numbers for emergency services throughout the state. In 2005, the Georgia General Assembly amended the Act that …

On Beauty And Policing, India Thusi Mar 2020

On Beauty And Policing, India Thusi

Articles by Maurer Faculty

“To protect and serve” is the motto of police departments from Los Angeles to Cape Town. When police officers deviate from the twin goals of protection and service, for example by using excessive force or by maintaining hostile relations with the community, scholars recommend more training, more oversight, or more resources in policing. However, police appear to be motivated by a superseding goal in the area of sex work policing. In some places, the policing of sex workers is connected to police officers’ perceptions of beauty, producing a hierarchy of desirable bodies as enforced by those sworn to protect and …
