In Part I of this essay I interpret this unique moment in history through a retelling of the folk story La Llorona in order to identify the monsters and ghosts of the past and the present. Domino Renee Perez describes her own critical reflection of La Llorona as reinforcing 'a valuable lesson about power and authority' because her family’s 'storytelling circle was more than simply an arbitrary setting; it was a safe place for them to create, however problematically, a world of words, where they faced the dangers and challenges of life, embodied by a woman, and survived.' The lore …

Planning For A Managed Retreat: Moving In A New Direction, Caitlin Parry, Michael Heard Snow, Ryan Franklin
Virginia Coastal Policy Center
Climate change is altering the United States’ coastline in both subtle and extreme ways. The threat is especially pressing in the Commonwealth of Virginia, which is experiencing sea levels rising faster than the global average. As global sea level rise continues to increase, coastal communities across the country must make difficult decisions about their futures. Instead of waging an endless war with the tide, one option for them to consider is the process of managed retreat, which provides a long-term solution by relocating communities away from vulnerable areas. Low to moderate income communities face a variety of additional social and …

Tourism-Related Business Owners Speak Out About Covid-19 Impacts, Glenna Hartman, Norma P. Nickerson
Institute for Tourism and Recreation Research Publications
The coronavirus (COVID-19) pandemic has been sweeping the globe for the past few months, leading to worldwide travel restrictions, including a shelter in place order and closure of non-essential businesses in Montana. The Institute for Tourism and Recreation Research (ITRR) at the University of Montana emailed a survey to tourism-related business owners around Montana. Two separate rounds of the COVID-19 business survey were emailed during March. The purpose of this report was to analyze and synthesize open ended responses written by tourism-related business owners and managers on a COVID-19 survey as it pertains to Montana, and is based on comments …
The Impact Of The Legalization Of Marijuana In Colorado On Education Funding And Car Crash Fatality Rates, Lauren Mcdonald
The Impact Of The Legalization Of Marijuana In Colorado On Education Funding And Car Crash Fatality Rates, Lauren Mcdonald
Undergraduate Theses and Capstone Projects
The objective of this thesis is to investigate and report the impact of the legalization of marijuana on the funding of education and car crash fatality rates in the state of Colorado. Legalization has been a controversial topic, and marijuana has already been legalized for recreational use in 11 states, and medically in 22 states across the United States. The tax revenues from marijuana are used in school funding, though the allocations of these funds have varied in different years. As we approach the impact that legalization has had on Colorado, it will be interesting to see if the newly …
The Real Id Act: Real Consequences Involving Immigration Status & Eligibility Requirement Concerns For Immigrants, Rachael Marvin
The Real Id Act: Real Consequences Involving Immigration Status & Eligibility Requirement Concerns For Immigrants, Rachael Marvin
Cardozo Journal of Equal Rights & Social Justice
The REAL ID Act of 2005 imposes federal documentation standards for state-issued drivers' licenses, requiring proof of lawful immigration status, which critics argue burdens immigrants and heightens government scrutiny. The Act raises constitutional concerns, including Fourth Amendment violations and interference with the fundamental right to travel, as established in Saenz v. Roe. While the Supreme Court in Arizona v. United States upheld federal preemption over state licensing authority, the Act's implementation has disproportionately affected immigrants, particularly under the Trump administration, which revived its enforcement. The article critiques the Act as an unconstitutional tool for immigration enforcement, undermining civil liberties …
Strategic Planning In Emergency Management: Evaluating The Impacts On Local Program Quality, Scott Robert Manning
Strategic Planning In Emergency Management: Evaluating The Impacts On Local Program Quality, Scott Robert Manning
Research, Publications & Creative Work
This study examined the strategic planning practices of county-level emergency management agencies (EMAs), with a specific focus on strategic planning adoption and its relationship to local program quality. The study utilized a descriptive, cross-sectional survey design to collect planning- and programrelated data from more than 300 county-level EMAs across the United States. The study findings revealed that most of the county EMAs included in the final sample had previously engaged in strategic planning activities, with nearly all of them continuing to use strategic planning as part of their general management practice. The study findings further revealed that strategic planning had …
Children's Equality Rights: Every Child's Right To Develop To Their Full Capacity, Nancy E. Dowd
Children's Equality Rights: Every Child's Right To Develop To Their Full Capacity, Nancy E. Dowd
Cardozo Law Review
Children are born equal. Yet as early as eighteen months, hierarchies emerge among children. These hierarchies are not random butfall into patterns by race, gender, and class. They are not caused nor voluntarily chosen by children or their parents. The hierarchies grow, persist, and are made worse by systems and policies created by the state, perpetuating the position of the privileged and continuing the disadvantage of the subordinated. Children's equal right to develop to their capacity is severely undermined by policies and structures that hamper and block the development of some by creating barriers and challenges or failing to support …

How Effective Are Police? The Problem Of Clearance Rates And Criminal Accountability, Shima Baradaran Baughman
How Effective Are Police? The Problem Of Clearance Rates And Criminal Accountability, Shima Baradaran Baughman
Faculty Scholarship
In recent years, the national conversation in criminal justice has centered on police. Are police using excessive force? Should they be monitored more closely? Do technology and artificial intelligence improve policing? The implied core question across these national debates is whether police are effective at their jobs. Yet we have not explored how effective police are or determined how best to measure police effectiveness.
This Article endeavors to measure how effective police are at their principal function—solving crime. The metric most commonly used to measure police effectiveness at crime-solving is a “clearance rate:” the proportion of reported crimes for which …

The Misplaced Trust In The Doj's Expertise On Criminal Justice Policy, Shon Hopwood
Georgetown Law Faculty Publications and Other Works
As should be clear, this is less a book review and more an in-depth exploration of a key point Professor Barkow makes in Prisoners of Politics as applied to the federal criminal justice system. Sure, we need expertise in order to make data-driven criminal justice policy decisions--as Barkow puts it, “[t]he key is to create and foster an institutional framework that prioritizes data” and “expertise” so as to “create incentives for key decisionmakers to be accountable for real results” (pp. 14-15). But in creating reforms, the kindof expertise is also important. Many federal policymakers currently view the DOJ and …
Nadir And Oblique Uav Photogrammetry Techniques For Quantitative Rock Fall Evaluation In The Rimrocks Of South-Central Montana, Micah Gregory-Lederer
Nadir And Oblique Uav Photogrammetry Techniques For Quantitative Rock Fall Evaluation In The Rimrocks Of South-Central Montana, Micah Gregory-Lederer
Graduate Theses & Non-Theses
As our cities expand into geologically sensitive areas across the greater Rocky Mountain region and beyond, quantitative methods of assessment are increasingly critical for the development of evidence-based alternatives to avoid or mitigate geologic hazards. Unmanned Aerial Vehicle (UAV) photogrammetry can improve these geologic investigations by enabling remote visual inspection, measurement, and spatial analysis while eliminating many of the physical access limitations that contribute to field sampling bias and human error. UAV photogrammetry technology was employed to evaluate fragmental rock fall hazards at two locations in the Rimrocks region of south-central Montana, Zimmerman Trail Road and Phipps Park. At these …
Clergy & Police A Semiotic Analysis Of Clergy On Patrol, Ricardo Estevan Reyes
Clergy & Police A Semiotic Analysis Of Clergy On Patrol, Ricardo Estevan Reyes
Communication & Theatre Arts Theses
The Clergy On Patrol (COP) program is a collaboration between the Norfolk Police Department and community faith leaders of the Norfolk Urban Renewal Center. This study analyzed themes and patterns in the communicative relationship between police and clergy members, using a semiotic approach and the scholarship of intergroup communication. Additionally, an added secondary analysis of media coverage helped focus the results of the study using themes. This thesis merged the two semiotic analyses to examine a style of community policing that has lacked a closer eye.
This thesis guided itself by the argument that clergy-police collaborative programs structure …
Transparency Deserts, Christina Koningisor
Transparency Deserts, Christina Koningisor
Northwestern University Law Review
Few contest the importance of a robust transparency regime in a democratic system of government. In the United States, the “crown jewel” of this regime is the Freedom of Information Act (FOIA). Yet despite widespread agreement about the importance of transparency in government, few are satisfied with FOIA. Since its enactment, the statute has engendered criticism from transparency advocates and critics alike for insufficiently serving the needs of both the public and the government. Legal scholars have widely documented these flaws in the federal public records law.
In contrast, scholars have paid comparatively little attention to transparency laws at the …
Class Standing And Student Perceptions Of Safety In Christian Higher Education: A Causal-Comparative Study, Bradley Carlton Bowen
Class Standing And Student Perceptions Of Safety In Christian Higher Education: A Causal-Comparative Study, Bradley Carlton Bowen
Doctoral Dissertations and Projects
Campus safety has become a significant topic in higher education. A dynamic environment including regulatory changes and notable criminal incidents has resulted in rapid changes in campus policy in the United States. Limited research has been conducted regarding stakeholder perceptions of campus safety, though research is lacking regarding campus safety in Christian higher education. Research is especially lacking among Christian institutions in the southeastern United States and in comparing student perceptions based on class standing. This causal-comparative study examined the results of a survey presented to undergraduate students at a Christian university to answer the question as to whether there …

Abstract The problem addressed within this qualitative study involved exploring the limited research regarding kindergarten through fifth grade teachers’ perceptions of the implementation of the school’s Comprehensive School Safety Plan (CSSP). The purpose of this study was to explore six kindergarten through fifth grade teachers’ perspectives of their school’s safety plan. First, the study described how elementary teachers perceived the professional development or training received in preparation for implementing their school’s safety plan. Second, the study explored six elementary teachers’ perceptions of their ability to implement their school’s safety plan using semi-structured interviews. Finally, areas where elementary teachers perceive they …

This research identifies key state and local government stakeholders in California for drone policy creation and implementation, and describes their perceptions and understanding of drone policy. The investigation assessed stakeholders’ positions, interests, and influence on issues, with the goal of providing potential policy input to achieve successful drone integration in urban environments and within the national airspace of the United States. The research examined regulatory priorities through the use of a two-tiered Stakeholder Analysis Process. The first tier consisted of a detailed survey sent out to over 450 local agencies and jurisdictions in California. The second tier consisted of an …

Masterpiece Cakeshop: A Formula For Legislative Accommodations Of Religion, Matthew A. Brown
Akron Law Review
When two core identities clash, such as sexual orientation and religious belief, which one should prevail? I argue that, rather than picking a winner and a loser, the Supreme Court in Masterpiece Cakeshop allowed for a much broader solution than the Court was able to provide—legislative accommodations rooted in tolerance that protect the dignity of same-sex couples and respect sincere religious beliefs.
In Masterpiece Cakeshop, a Colorado baker refused to design a cake for a same-sex wedding based on his religious beliefs. Instead of picking a broad winner and loser, the Supreme Court ruled narrowly by finding the Colorado …

Driven To Failure: An Empirical Analysis Of Driver’S License Suspension In North Carolina, William E. Crozier, Brandon L. Garrett
Driven To Failure: An Empirical Analysis Of Driver’S License Suspension In North Carolina, William E. Crozier, Brandon L. Garrett
Duke Law Journal
A person’s interest in a driver’s license is “substantial,” and as the U.S. Supreme Court has observed, the suspension of a license by the state can result in “inconvenience and economic hardship suffered,” including because a license may be “essential in the pursuit of a livelihood.” However, forty-four U.S. states currently require indefinite suspension of driver’s licenses for non-driving-related reasons, such as failure to appear in court or pay fines for traffic infractions. There are no systematic, peer-reviewed analyses of individual-level or county-level data regarding such suspensions. This study describes North Carolina’s population of suspended drivers and assesses how driver’s …

Nostalgia And (In)Authentic Community: A Bataillean Answer To The Heidegger Controversy, Patrick Miller
Nostalgia And (In)Authentic Community: A Bataillean Answer To The Heidegger Controversy, Patrick Miller
USF Tampa Graduate Theses and Dissertations
Heidegger’s relationship with Nazism has been debated since the 1930s. In the late 1930s, Georges Bataille wrote an incomplete text that would have added to these debates, “Critique of Heidegger: Critique of a philosophy of fascism.” I draw on this fragment and Bataille’s writings from this era in order to develop a fuller critique of Heidegger and his relationship to fascism. This expanded critique completes the promise of Bataille’s original fragment, offering a full Bataillean criticism of Heidegger and displaying the connections between his philosophy and Bataille’s understanding of fascism. This critique hinges on Heidegger’s concept of authenticity and community, …

Dna Is Different: An Exploration Of The Current Inadequacies Of Genetic Privacy Protection In Recreational Dna Databases, Jamie M. Zeevi
St. John's Law Review
(Excerpt)
Part I of this Note discusses the fundamental science behind DNA and defines and explains the process of familial DNA searching. Part I also discusses how Carpenter v. United States provides a framework to begin thinking about the unique nature of DNA and privacy implications for its use, and why the revealing nature of this type of data warrants protection. Part II of this Note delves into the lack of constitutional and statutory protections for DNA in recreational DNA databases. First, Part II explains that traditional Fourth Amendment concepts, like search warrants, probable cause, reasonable expectation of privacy, third-party …
