One consequence of the widespread adoption of mobile communication device use is an increase in connectivity. This increase in connection has led to a shift in interpersonal relationships. People now must be aware of when to connect and disconnect to develop meaningful relationships in private, public, and social realms. This project seeks an understanding of how the consequence of increased connectivity and the development of …

Analyzing The Onset And Resolution Of Nonstate Conflict In The Middle East & North Africa, Emily A. Barbaro May 2020

Analyzing The Onset And Resolution Of Nonstate Conflict In The Middle East & North Africa, Emily A. Barbaro

Senior Honors Projects, 2020-current

By applying structural-functionalist theories of deviance and opposition, this thesis deconstructs nonstate mobilization in the Middle East, North Africa, Afghanistan, and Pakistan. Using data from the Armed Conflict Location and Event Dataset, the quantitative analysis interpreted both group and leader behavior in conflict situations to determine factors that influenced conflict onset and resolution. The quasipoisson regression analysis of group behavior suggested that polity and state capacity were both significant predictors of violent and nonviolent mobilization. The negative binomial regression of regime behavior suggested that civilian casualties were the most significant predictor of a government response to nonstate mobilization. Ultimately, the …

“We Can’T Just Throw Our Children Away”: A Discussion Of The Term-Of-Years Sentencing Of Juveniles And What Can Be Done In Texas, Anjelica Harris May 2020

“We Can’T Just Throw Our Children Away”: A Discussion Of The Term-Of-Years Sentencing Of Juveniles And What Can Be Done In Texas, Anjelica Harris

Texas A&M Law Review

In the words of Supreme Court Justice Elena Kagan, children are different. The issue of how to sentence juvenile offenders has long been controversial. Although psychology acknowledges the connection between incomplete juvenile brain development and increased criminality, the justice system lags behind in how it handles juvenile offenders. A prime example is the case of Bobby Bostic, who at the age of sixteen was charged with eighteen offenses and sentenced to 241 years in prison. This sentence, known as a term-of-years or virtual life sentence, essentially guarantees that no matter what Bobby does or who he proves himself to be …

Tyranny Plagued The French Revolution, Christy Leigh Salinari

Honors Theses

Liberty, equality, and fraternity were the three original pillars of the French Revolution at the start in 1789. The slogan became the rallying cry for the embittered French people in their initial pursuit for political and social transformation. The French Revolution is perhaps the most prominent contemporary illustration of a violent revolution which ultimately was successful, resulting in a model of democratic government. The French Revolution reached a decade in length wherein there were countless demonstrations, massacres, wars, civil unrest, and political enlightenment. The disorganized nature of the revolution cultivated a vast array of political beliefs, which ranged from radical …

Importing Prescription Drugs From Canada — Legal And Practical Problems With The Trump Administration's Proposal, Rachel E. Sachs, Nicholas Bagley

Articles

As Americans report ever-growing difficulty affording their prescription drugs, President Donald Trump has come under increasing pressure to act. To date, the Trump administration has attempted to advance a number of policy initiatives by means of executive action, but it has not yet adopted a program that would meaningfully assist patients. Most recently, the administration proposed a rule that, if finalized, would allow states to develop programs to import lower-priced prescription drugs from Canada, with the intent of reducing spending on drugs by U.S. patients and states and increasing access for patients.

Evaluating The Impact Of Gun Involved Violence Elimination (Give) Initiative Within The City Of Rochester, Michael Nicholas Surtel

Theses

Within the city of Rochester, gun violence has become something of a common occurrence within local neighborhoods and streets where violent crime continues to flourish. Between 2010 and 2018 the recorded number of shootings that have occurred in the city of Rochester were around 1,679, with around 200 being categorized as fatal shootings (https://data-rpdny.opendata.arcgis.com/). Many of the issues plaguing the Rochester Police Department in addressing the issue of gun violence are due to a misperceived idea of what causes gun violence in the first place and how to go about it without having to waste their resources on ineffective tactics. …

Some public health measures, such as stay-at-home orders, restrict the exercise of personal freedoms ranging from the rights to travel and freely associate to the ability to gather in places of worship for religious services. This Essay explores several completing doctrines that might justify the authority of law enforcement to stop people who are out of …

The safety and health of children are essential issues not only for households but also for society. Missing Child is a severe strike to a family. It causes severe trauma memory and affects family members both psychologically and physically. Incidents like this also spread a feeling of fear among the local community. Many efforts have been made to help with this problem, such as the Amber Alert system, the location-tracking functions in the operating system in smartphones. There are also many safety apps in the app stores trying to prevent this kind of incident. However, there are still things that …

Keep Kids Out Of Prison: Community-Based Alternatives For Nonviolent Juvenile Offenders, Anessa L. Pennington May 2020

Keep Kids Out Of Prison: Community-Based Alternatives For Nonviolent Juvenile Offenders, Anessa L. Pennington

Intuition: The BYU Undergraduate Journal of Psychology

Abstract

While juvenile crime has dropped over the past 20 years, tens of thousands of juvenile offenders are still incarcerated around the country, many of whom are nonviolent offenders. Researchers have found that detention centers, sometimes indistinguishable from adult prisons, do little to reduce recidivism and rehabilitate the offender. Rather, detention brings about more adverse effects than it does benefits. If incarceration isn’t working, how are the United States and other countries to deal with and deter juvenile crime? Community-based programs are a promising alternative to incarceration; instead of jumpsuits and cramped cells, community-based programs rely on community resources and …

Digital Court Records Access: Social Justice And Judicial Balancing, Peter J. Guffin May 2020

Digital Court Records Access: Social Justice And Judicial Balancing, Peter J. Guffin

Maine Law Review

With its transition from paper to electronic records, the state court system in Maine is entering new, uncharted territory. In drafting rules regarding public access to electronic court records, a critical issue facing the court system is how to go about balancing the privacy interests of the individual and the state’s interest in providing transparency about the court’s operations. Both interests are important in our democracy, and it is critical that we take measures to preserve both. The purpose of writing this essay is to show that Judge Coffin’s judicial philosophy and rights-sensitive balancing process, although the product of a …

Presidential Ideology And Immigrant Detention, Catherine Y. Kim, Amy Semet May 2020

Presidential Ideology And Immigrant Detention, Catherine Y. Kim, Amy Semet

Duke Law Journal

In our nation’s immigration system, a noncitizen charged with deportability may be detained pending the outcome of removal proceedings. These individuals are housed in remote facilities closely resembling prisons, with severe restrictions on access to counsel and contact with family members. Due to severe backlogs in the adjudication of removal proceedings, such detention may last months or even years.

Many of the noncitizens initially detained by enforcement officials have the opportunity to request a bond hearing before an administrative adjudicator called an immigration judge (“IJ”). Although these IJs preside over relatively formal, on-the-record hearings and are understood to exercise “independent …
