Harlem Shake Meets The Chevron Two Step: Net Neutrality Following Mozilla V. Fcc, Christopher R. Terry, Scott Memmel Jun 2020

Harlem Shake Meets The Chevron Two Step: Net Neutrality Following Mozilla V. Fcc, Christopher R. Terry, Scott Memmel

Washington Journal of Law, Technology & Arts

In October 2019, the D.C. Circuit handed down its much-anticipated decision in Mozilla v. FCC, relying heavily on Chevron Deference and the Supreme Court’s 2005 Brand X decision. The per curiam opinion upheld large portions of the FCC’s 2018 Restoring Internet Freedom Order, but also undermined the FCC’s preemption of state law while also remanding issues related to public safety, pole attachments, and the Lifeline Program to the agency, assuring that the legal and policy battles over net neutrality will continue. This Article traces the history of the FCC’s efforts on net neutrality as it has moved in and out …

U.S.-U.K. Executive Agreement: Case Study Of Incidental Collection Of Data Under The Cloud Act, Eddie B. Kim

Washington Journal of Law, Technology & Arts

In March 2018, Congress passed the Clarifying Lawful Overseas Use of Data Act, also known as the CLOUD Act, in order to expedite the process of cross-border data transfers for the purposes of criminal investigations. The U.S. government entered into its first Executive Agreement, the main tool to achieve the goals of the statute, with the United Kingdom in October 2019. While the CLOUD Act requires the U.S. Attorney General to consider whether the foreign government counterpart has a certain level of robust data privacy laws, the relevant laws of the United Kingdom have generally been questioned numerous times for …

Latin America 2020: Challenges To U.S. National Security Interests, Craig A. Deare

Strategic Monographs

U.S. national security interests in Latin America are undermined by three key threats: transnational criminal organizations, which exploit weak levels of governance across the majority of countries in the region; extra-regional actors, which fill the vacuum created by U.S. distraction and inattention to its neighborhood; and finally, a number of regional political actors embracing ideological positions opposed to open political systems and free markets, which undermine progress toward democratic governance and stability.

Criminal Law, Thomas D. Church Jun 2020

Criminal Law, Thomas D. Church

Mercer Law Review

Last year was another busy year for the United States Court of Appeals for the Eleventh Circuit. While the court continued developing federal criminal law within the circuit, the court was also forced to adjust its own precedents in light of several landmark opinions by the Supreme Court of the United States.

In United States v. Davis, for example, the Supreme Court struck down the residual clause in 18 U.S.C. § 924(c), thus overruling the Eleventh Circuit's en banc decision in Ovalles v. United States. Another one of the Supreme Court's most noteworthy opinions came on appeal directly from …

Shoot At Me Once: Shame On You! Shoot At Me Twice: Qualified Immunity. Qualified Immunity Applies Where Police Target Innocent Bystanders, Jameson M. Fisher Jun 2020

Shoot At Me Once: Shame On You! Shoot At Me Twice: Qualified Immunity. Qualified Immunity Applies Where Police Target Innocent Bystanders, Jameson M. Fisher

Mercer Law Review

Qualified immunity is a judicially created doctrine that has resulted in expansive protections for lower-level state officials for constitutional violations. Guidance from the Supreme Court of the United States regarding the interpretation of "clearly established rights" has been scarce and vague at best. As a result, district courts faced with qualified immunity assertions regarding a § 1983 claim take a restrictive approach to the doctrine's analysis often by relying on factually similar cases from binding authorities. Historically, innocent bystanders have had no clearly established right to be free from excessive force where force was applied to subdue the target of …

Crime Reporting Through Social Media: Potential Opportunities In Community Policing, Kimberly Washington Jun 2020

Crime Reporting Through Social Media: Potential Opportunities In Community Policing, Kimberly Washington

College of Education Theses and Dissertations

The popularity and usage of social media over the years has increased. Due to this increase there has now been an influx of information shared on a global platform. This information that has been shared can be as superficial as daily activities, food eaten or as sensitive as graphic crimes committed. The Perceived Social Media Anonymity Effect is a concept that I am introducing and seek to explore. It is based on the premise that allows one to relinquish the fear of being in large crowds and speaking up when crimes have been committed while also being able to seek …

International Megan's Law As Compelled Speech, Alexandra R. Genord Jun 2020

International Megan's Law As Compelled Speech, Alexandra R. Genord

Michigan Law Review

“The bearer was convicted of a sex offense against a minor, and is a covered sex offender pursuant to 22 United States Code Section 212b(c)(l).” International Megan’s Law (IML), passed in 2016, prohibits the State Department from issuing passports to individuals convicted of a sex offense against a minor unless those passports are branded with this phrase. The federal government's decision to brand its citizens’ passports with this stigmatizing message is novel and jarring, but the sole federal district court to consider a constitutional challenge to the passport identifier dismissed the plaintiffs’ First Amendment claim, deeming the provision government speech. …

Historic Building Renovation In San Francisco; A Business Plan, Robert Michael Courtney, Brendan Kha Hoang Jun 2020

Historic Building Renovation In San Francisco; A Business Plan, Robert Michael Courtney, Brendan Kha Hoang

Construction Management

This report explores the history and thought process behind an idea for a historical restoration company based out of San Francisco, California. This is a vital service for both building owners and the public, as historical buildings with deferred maintenance pose a threat to the lives and safety of civilians in the streets below. The city of San Francisco recognized that historical buildings may pose a threat to public safety and recently put an ordinance in place to mandate inspections and repairs of these buildings. There seems to be a gap between firms that profess the ability to assign qualified …

Journal of Extension

The excessive number of terms associated with invasive species, and their often incorrect usage, hinders stakeholder education about the threats of invasive species. Here we introduce seven terms (native, nonnative, introduced, established, invasive, nuisance, and range change) that are applicable across invasive taxa, understandable, typically interpreted correctly, and useful for describing most situations regarding invasive species. We also list six terms to avoid (native invasive, invasive exotic, invasive weed, alien, foreign, and nonindigenous) that create confusion via their misuse and misinterpretation. The terms we propose …

Getting To The Heart Of Professional Development And Employee Engagement Among Non-Teaching Personnel In Higher Education: An Appreciative Inquiry Into The Influential Role Of A Staff Development Center, Rowena Casis-Woidyla Jun 2020

Getting To The Heart Of Professional Development And Employee Engagement Among Non-Teaching Personnel In Higher Education: An Appreciative Inquiry Into The Influential Role Of A Staff Development Center, Rowena Casis-Woidyla

Electronic Theses, Projects, and Dissertations

Despite the importance and incorporation of staff development in higher education, there is limited research on the availability and use of learning opportunities for non-teaching personnel (NTP) in the form of professional development. Work performed by NTP in higher education is critical to university operations. Without professional development and engagement opportunities, NTP lack visibility, disengage and ultimately may separate from institutions of higher education. Deliberate organizational efforts to provide access to new learning opportunities and promote personal growth among NTP is the development and institutionalization of centers for professional development, also called staff development centers and staff training and professional …

Wildland Fire Location Management System (Wflms), Robert G. Goldie, Jack A. Gallegos Jun 2020

Wildland Fire Location Management System (Wflms), Robert G. Goldie, Jack A. Gallegos

Electrical Engineering

Wildland firefighters work in complex, dangerous environments where effective communication is key to developing situational awareness. Currently, the only communication firefighters have is with Very High Frequency (VHF) 160 MHz band analog radios. While digital radio protocols could potentially allow location data and commands to be sent to field crews, the technology is primarily for voice communication. This project presents a new system that frees up voice channels and uses LoRa transceivers for robust communication. The system allows for emergency and location reports to be sent to a dispatcher via an airborne repeater. The entire system is software-defined, so it …

Cultural Humility: Racial Disparity And Disproportionality How It Relates To Child Welfare And Mandated Reporter Training And Preparedness, Jennifer A. Perry, Ashley L. Castro

Electronic Theses, Projects, and Dissertations

The research problem was mandated reporters’ in a public assistance setting and child welfare social workers’ perception of cultural humility and cultural training. The research proposed that the lack of cultural humility training for both mandated reporters in public social service sectors and child welfare social workers has an impact of on the disparity and disproportionality in child welfare cases. A critical theory approach was adopted, and qualitative data was collected via face-to-face interviews. A snowball sampling strategy was used to select study participants. Study findings suggested that there is a cultural humility training provided to child welfare social workers, …

Dreaming Revolutionary Futures: Critical Race’S Centrality To Ending White Supremacy, Sofia Y. Leung, Jorge R. López-Mcknight

Communications in Information Literacy

Critical Library Instruction: Theories and Methods dangerously lacked a centering, and critique, of white supremacy, as a structure of domination; we see the continuation of that active avoidance, or a progress approach through liberal or multicultural frameworks that do not precisely identify roots of racialized oppression in critical librarianship currently. In this essay, we reject progress narratives depicting the profession as having arrived, or even moved further, to a critical space, paying particular close attention to the absence of white supremacy, not only in the text Critical Library Instruction: Theories and Methods but in critical library instruction. We then explore …

The Correlation Between County Expenditures And Ab109 Recidivism: A Cross-Sectional Analysis, Maya Crim Jun 2020

The Correlation Between County Expenditures And Ab109 Recidivism: A Cross-Sectional Analysis, Maya Crim

Electronic Theses, Projects, and Dissertations

In response to a federal mandate, California passed Public Safety Realignment policies in 2011 to reduce its prison population. Popularly known as Assembly Bill 109 (AB109), these policies sought to reform the prison system on multiple fronts. One of these fronts is preventing recidivism among offenders. Most studies on recidivism look at individual factors or specific micro interventions. However, the aim of this research was to examine the relationship between external factors and recidivism rates across 55 California counties. Using Spearman’s Correlation, this study tested the hypothesis that external factors such as county funding/expenditure, poverty level, and unemployment level monotonically …

Passing Vs Non-Passing: Latina/O/X Experiences And Understandings Of Being Presumed White, Francisco Rodriguez Jun 2020

Passing Vs Non-Passing: Latina/O/X Experiences And Understandings Of Being Presumed White, Francisco Rodriguez

Electronic Theses, Projects, and Dissertations

Latinos do not associate with a specific race, yet we are often homogenized into groups and stereotypes far from representing our diverse and ever-changing cultures and communities. How does the growth of Latinos affect the already existing and upcoming Latina/o/x communities in the United States? Due to my own lived experiences, I have dived into the layers of whiteness and colorism that exists within Latino communities in the United States. The idea that Latinos have a specific appearance is false and many assumptions associated to our complexion derive from stereotypes that affect the way we treat those around us, simply …

Prioritization Of Non-Functional Requirements In A Mobile Application For Panic Button System Using Neutrosophic Decision Maps, Marco Antonio Checa Cabrera, Byron Javier Ipiales Chasiguano, Ana Lucía Sandoval Pillajo, Rita Díaz Vázquez

Neutrosophic Sets and Systems

Several countries around the world have implemented systems to preserve public safety. Taking advantage of technological advances that are available to all citizens, in Ecuador it has been implemented a system called panic button, which consists of a cell phone network with geo-location, which can assist every citizen who needs to ask for help and the authorities will respond efficiently. This research proposes to improve this system in order to increase its efficiency and effectiveness. This requires the use of prioritization of non-functional requirements. In this paper we use the static analysis of Neutrosophic Cognitive Maps to determine, evaluate, and …

State-Owned Enterprises And Threats To National Security Under Investment Treaties, Mark Mclaughlin Jun 2020

State-Owned Enterprises And Threats To National Security Under Investment Treaties, Mark Mclaughlin

Research Collection Yong Pung How School Of Law

The internationalization of investment by State-owned enterprises is driving the evolution of foreign investment regulation throughout the Western world. National security lies at the heart of host State concerns, yet the contours of the concept remain indistinct. Consequently, State-owned enterprises are subject to differential legal standards that can be vague and ambiguous. This article considers whether, and under what circumstances, host State security measures targeting State-owned enterprises comply with obligations under investment treaties. Provision for pre-establishment national treatment and security exceptions will be crucial in balancing the autonomy afforded to host States to protect their national security, and guarding State-owned …
