App Permissions And The Third-Party Doctrine, Michael Gentithes Jan 2020

App Permissions And The Third-Party Doctrine, Michael Gentithes

Con Law Center Articles and Publications

Apple’s trademarked catchphrase “there’s an app for that”1 suggests that every app on a modern digital device is perfectly tailored to provide a specific, necessary convenience. Whether the user wants to check the weather, get updates on her favorite baseball team, find a coupon for her next purchase, or track her fitness and activity levels, she can use an app to fill gaps in her life that she may not have known existed. What the user might also not know, however, is that “permissions” either she or the phone’s operating system have granted to the app allow it to access …

More Than The Vote: The Nineteenth Amendment As Proxy For Gender Equality, Tracy Thomas Jan 2020

More Than The Vote: The Nineteenth Amendment As Proxy For Gender Equality, Tracy Thomas

Con Law Center Articles and Publications

The original idea behind the Nineteenth Amendment was never just about the vote. Instead, the first women's rights movement 175 years ago, like the modern movement for the Equal Rights Amendment, sought comprehensive equality for women in all avenues of life. The constitutional text for women’s full equality and emancipation has changed over the centuries; first embodied in the grant of the vote as a proxy for structural change, and now incorporated into the demand for “equal rights.” Yet women have been consistent over time in understanding the radical idea that systems of governance, family, industry, and church need dismantling …

Accounting For The Local Field When Determining The Dielectric Loss Spectra Of Metals In The Region Of The Frequencies Of Volume, Surface And Localized Plasmon Oscillations, Tatiana Perova, Igor Shaganove, Kevin Berwick Jan 2020

Accounting For The Local Field When Determining The Dielectric Loss Spectra Of Metals In The Region Of The Frequencies Of Volume, Surface And Localized Plasmon Oscillations, Tatiana Perova, Igor Shaganove, Kevin Berwick

Articles

The optical constant of bulk metal is used to determine the dispersion of the local field under one-dimensional (1D), two-dimensional (2D) and three-dimensional (3D) confinement. 3D confinement, expressed as ε mic 2 (ω3D), corresponds to the dielectric loss spectra of spherical particles with a diameter, d, much less than the wavelength of the beam used to measure the spectrum (d << λ). Excellent agreement with the results of Mie theory and experimental data for solid colloids within alkali halide crystals was observed. The function expressed as ε mic 2 (ω1D) allows the measurement of spectral micro-characteristics in the frequency range of the longitudinal collective motion of the free electrons. This corresponds to the spectrum of dielectric losses of bulk plasma oscillations. The function ε mic 2 (ω2D) describes the spectra of the dielectric losses of surface plasma oscillations in thin metal films. It is shown that the peak positions of ε mic 2 (ω3D), ε mic 2 (ω2D) and ε mic 2 (ω1D) spectra for simple metals, viz. alkali metals as well as Al, Be, Mg, Ga, In, Sn and Si, are in agreement with experimental results from electron-energy-loss spectroscopy and various optical techniques.

Resolving Tensions Between Disability Rights Law And Covid-19 Mask Policies, Elizabeth Pendo, Robert Gatter, Seema Mohapatra Jan 2020

Resolving Tensions Between Disability Rights Law And Covid-19 Mask Policies, Elizabeth Pendo, Robert Gatter, Seema Mohapatra

Articles

As states reopen, an increasing number of state and local officials are requiring people to wear face masks while out of the home. Grocery stores, retail outlets, restaurants, and other businesses are also announcing their own mask policies, which may differ from public policies. Public health measures to stop the spread of the coronavirus such as wearing masks have the potential to greatly benefit millions of Americans with disabilities, who are particularly vulnerable to the impact of COVID-19. But certain disabilities may make it difficult or inadvisable to wear a mask.

Mask-wearing has become a political flashpoint, putting people with …

Law Students And Cell Phone Use: Results Of A Six-School Survey, Hugh D. Spitzer, Robert M. Jarvis, Cindy I.T. Archer, Linda Galler, Jodi L. Wilson, Mark E. Wojcik

Articles

The sight of a law student using his or her cell phone now is so common that law professors do not give it a second thought. But what, exactly, is the student doing? Texting with friends? Shopping? Watching a movie? To try to find out, during the Fall 2019 semester we asked our six diverse law schools to take an online survey consisting of eighteen questions. To our knowledge, this is the first phone survey of law students.

This paper presents the results of the survey, exploring applications used (text, social media, email, etc.) and differences by audience (e.g., whether …

Ailing In Place: Environmental Inequities And Health Disparities In Appalachia, Michele Morrone Jan 2020

Ailing In Place: Environmental Inequities And Health Disparities In Appalachia, Michele Morrone

Ohio University Press Open Access Books

In Ailing in Place, Michele Morrone explores the relationship between environmental conditions in Appalachia and health outcomes that are too often ascribed to individual choices only. She applies quantitative data to observations from environmental health professionals to frame the ways in which the environment, as a social determinant of health, leads to health disparities in Appalachian communities. These examples—these stories of place—trace the impacts of water quality, waste disposal, and natural resource extraction on the health and quality of life of Appalachian people.

Public health is inextricably linked to place. Environmental conditions such as contaminated water, unsafe food, and polluted …

Baseball, Hot Dogs, And Raspas: The Prospect Hill Yellow Jackets Athletic Club During The 1960s In San Antonio, Tx, Adam M. Nerio

Capstone Projects

The Prospect Hill Yellow Jackets Athletic Club was an important institution in San Antonio’s West Side in the 1960’s. It was a vehicle through which the emerging Mexican American middle-class families integrated and acculturated into the American mainstream. Using images, maps, archival photographs, newspaper articles, obituaries, and oral histories, this project presents evidence on how organized youth sports played a major role in helping shape and define the identity of a Mexican American community in San Antonio and provided the foundation that spawned an engaged generation of achievers.

The Java SE declarations of this case are simply a language of commands. As an application programming interface, or API, they exhibit features common to any language: a structured vocabulary and grammatical syntaxes, which a computer system understands as instructions to perform predefined tasks. What Oracle accuses as infringement is “reimplementation,” namely the building of a system, in this case Google’s Android platform, that repurposes the same words and syntaxes of the Java declarations.

The Future (Public Company Boardroom) Is Female: From California Sb 826 To A Gender Diversity Listing Standard, Sunitha Malepati

American University Journal of Gender, Social Policy & the Law

Introduction

The issue of board diversity has received an unusual amount of attention in recent years as corporations face an increasing amount of pressure to add more women to their boards. In 2017, State Street Corporation, the world’s third-largest asset manager, made headlines when it announced its board gender diversity campaign by placing a statue of the Fearless Girl staring down the Charging Bull of Wall Street in New York City’s Financial District. At the beginning of 2020, Goldman Sachs announced that it would require companies it helps take public to have at least one diverse board member, with a …

Precedent, Non-Universal Injunctions, And Judicial Departmentalism: A Model Of Constitutional Adjudication, Howard Wasserman Jan 2020

Precedent, Non-Universal Injunctions, And Judicial Departmentalism: A Model Of Constitutional Adjudication, Howard Wasserman

Faculty Publications

This Article proposes a model of constitutional adjudication that offers a deeper, richer, and more accurate vision than the simple “courts strike down unconstitutional laws” narrative that pervades legal, popular, and political discourse around constitutional litigation. The model rests on five principles:

1) an actionable constitutional violation arises from the actual or threatened enforcement of an invalid law, not the existence of the law itself;

2) the remedy when a law is constitutionally invalid is for the court to halt enforcement;

3) remedies must be particularized to the parties to a case and courts should not issue “universal” or “nationwide” …

Mphaea & Marble Cake: Parity & The Forgotten Frame Of Federalism, Taleed El-Sabawi Jan 2020

Mphaea & Marble Cake: Parity & The Forgotten Frame Of Federalism, Taleed El-Sabawi

Faculty Publications

Federal parity laws, and their state equivalents, have been shown to increase access to substance use disorder (SUD) treatment, by decreasing the cost of SUD treatment borne by the insured, and has resulted in little increase in health plan costs. Despite these improvements, the effects of parity on access to SUD treatment have been lower than expected. Recent reports suggest that states have varied in their enforcement parity, failures which may explain why persons surveyed still report having inadequate insurance coverage for SUD treatment despite the parity legislation. While other articles have offered suggestions for improving parity, most have lumped …

Standing by my bedroom window, looking out at the ocean, a huge wave comes and swallows up my building. Everything around me is gone, including me. I wake up. I am 13 years old and living in the Coney Island Houses on Surf Avenue, Brooklyn, New York. With ongoing anthropogenic changes to the natural environment such as sea level rise and intensifying storms, coastal communities, especially ones segregated by class and culture, are particularly vulnerable in this context that challenges a way of life, and in some instances, threatens that life's survival. This dissertation focuses specifically on what one massive …

Examining Optimism And Caregiver Strain In Parents With Youth And Young Adults Diagnosed With Anxiety And Unipolar Mood Disorders, Jennifer M. Gross

Antioch University Dissertations & Theses

An anonymous online survey investigated optimism and caregiver strain in parents of youth and young adults diagnosed with anxiety and unipolar depression. Caregiver strain is a

well-researched phenomenon where the experience of parenting youth with serious psychological disorders has a potentially negative impact on parents and caregivers. Optimism is a trait that confers resiliency and improved coping to the individual. The relationship between caregiver strain and optimism is not well understood. This inquiry utilized the Caregiver Strain Questionnaire (CGSQ) to measure caregiver strain and the Life Orientation Test, Revised

(LOT-R) to measure optimism. Participants endorsed significantly higher scores on the …
