Rethinking The Impact Of Third-Party Funding On Access To Civil Justice, Victoria Sahani
Rethinking The Impact Of Third-Party Funding On Access To Civil Justice, Victoria Sahani
Faculty Scholarship
Third-party funding indisputably puts a gold-weighted thumb on the scales of justice in favor of funded parties for two main reasons: (1) funded cases already tend to be calculable winners on the merits, and (2) third-party funders seeking a profit generally do not fund cases that are demonstrably likely to lose on the merits. Thus, we are left with both the promising potential for winners to be more likely to win with third-party funding and the alarming realization that not all winners are offered this same chance. This provokes a larger, fundamental question: If funders are picking winners among the …
The Automated Administrative State: A Crisis Of Legitimacy, Danielle K. Citron, Ryan Calo
The Automated Administrative State: A Crisis Of Legitimacy, Danielle K. Citron, Ryan Calo
Faculty Scholarship
The legitimacy of the administrative state is premised on our faith in agency expertise. Despite their extra-constitutional structure, administrative agencies have been on firm footing for a long time in reverence to their critical role in governing a complex, evolving society. They are delegated enormous power because they respond expertly and nimbly to evolving conditions.
In recent decades, state and federal agencies have embraced a novel mode of operation: automation. Agencies rely more and more on software and algorithms in carrying out their delegated responsibilities. The automated administrative state, however, is demonstrably riddled with concerns. Legal challenges regarding the denial …

Firefighters performed a timed maximal effort simulated fireground test (SFGT) in personal protective equipment. SFGT air depletion was represented by change in cylinder pressure. Work economy was quantified as: (1/(SFGT completion time x air depletion))x104. Bivariate and multiple linear regression analyses were used to identify anthropometric and physical fitness predictors of …
Methodological Considerations For The Determination Of The Critical Resistance For The Deadlift, Alexander C. Moss
Methodological Considerations For The Determination Of The Critical Resistance For The Deadlift, Alexander C. Moss
Theses and Dissertations--Kinesiology and Health Promotion
This study determined if plate movement during conventional deadlifting affects critical resistance (CR) estimates derived from the linear work limit (Wlim) versus repetitions relationship. Eleven subjects completed 1-repetition maximum (1RM) deadlift testing followed by 8 visits, to determine the number of repetitions to failure at 50%, 60%, 70%, and 80% 1RM for both reset (RS) and touch-and-go (TG) methods, respectively. The CR was calculated as slope of the line of total work completed (repetitions × load [in kilograms]) versus total repetitions for each of four intensities (50-80% 1RM). The number of repetitions to failure were determined at CR …

Theses and Dissertations--Curriculum and Instruction
According to the literature on student achievement, the classroom teacher and effective feedback are two of the most influential factors that affect students’ performance (Hattie and Timperley, 2007). Teacher feedback is an effective and efficient instructional strategy that can bridge the gap between a student’s actual level of understanding and the level required to become independently successful. There are multiple types and levels of feedback that teachers may employ to support students’ work. It is important that a teacher utilizes various levels of feedback, particularly levels that pertain to the task (FT), the process (FP), and student regulation (FR) skills …

Binge drinking is a dangerous pattern of behavior. We tested whether chronically manipulating nucleus accumbens (NAc) activity (via clozapine-N-oxide (CNO) and Designer Receptors Exclusively Activated by Designer Drugs (DREADD)) could produce lasting eects on ethanol binge-like drinking in mice selectively bred to drink to intoxication. We found chronically increasing NAc activity (4 weeks, via CNO and the excitatory DREADD, hM3Dq) decreased binge-like drinking, but did not observe CNO-induced changes in drinking with the inhibitory DREADD, hM4Di. The CNO/hM3Dq-induced reduction in ethanol drinking persisted for at least one week, suggesting adaptive neuroplasticity via transcriptional and epigenetic mechanisms. Therefore, we defined this …

A Simple Predictive Model For Estimating Relative E-Cigarette Toxic Carbonyl Levels, Shawna Vreeke, Xijing Zhu, Robert Strongin
Chemistry Faculty Publications and Presentations
E-cigarette devices are wide ranging, leading to significant differences in levels of toxic carbonyls in their respective aerosols. Power can be a useful method in predicting relative toxin concentrations within the same device, but does not correlate well to inter-device levels. Herein, we have developed a simple mathematical model utilizing parameters of an e-cigarette’s coil and wick in order to predict relative levels of e-liquid solvent degradation. Model 1, which is coil length/(wick surface area*wraps), performed in the moderate-to-substantial range as a predictive tool (R2 = 0.69). Twelve devices, spanning a range of coil and wick styles, were analyzed. Model …

Accessibility And Equity Analysis Of Common Carrier Parcel Lockers At Transit Facilities In Portland, Oregon, Katherine Keeling, Jaclyn S. Schaefer, Miguel Figliozzi
Civil and Environmental Engineering Faculty Publications and Presentations
Transit goals have typically focused on commuter trips but facilitating urban last-mile freight logistics is a potential strategy to increase transit ridership and mitigate the demands of parcel distribution on the transportation network. Presently, most parcel lockers operate out of private businesses, but consumer surveys have found that transit users may be interested in locker facilities at transit connections. The implementation of an unmanned, secure, common carrier parcel locker system could have benefits for non-transit users as well. Consolidation of deliveries is expected to benefit courier companies by allowing operations at increasingly competitive rates, and retailers and consumers benefit from …
