Modernity And The Law: A Late Twentieth Century View, Robert P. Burns Jun 2020

Modernity And The Law: A Late Twentieth Century View, Robert P. Burns

Notre Dame Journal of International & Comparative Law

This Article explores Roberto Unger’s understanding of the specific significance that modernity has for law. It provides an account of the distinctions among customary law, bureaucratic law, the modern liberal rule of law ideal, and the unraveling of the rule of law in postliberal societies. It compares his views with those of other major theorists of modernity and with legal theorists. Finally, it discusses his speculations about then future developments and the relationship between central institutional and philosophical issues.

Animal Magic, Secret Spells, And Green Power: More-Than-Human Assemblages Of Children's Storytelling, Angela Molloy Murphy Jun 2020

Animal Magic, Secret Spells, And Green Power: More-Than-Human Assemblages Of Children's Storytelling, Angela Molloy Murphy

Dissertations and Theses

Early childhood settings have become contested spaces, or sites of struggle, between economic and sociocultural interests disputing their purpose. Recent years have shown increased pressure on children in early education settings to demonstrate predetermined learning outcomes, which (a) limits the scope of what is possible in the classroom, (b) narrows the range of what learning is considered valid, and (c) privileges the experience and values of the dominant culture, thereby determining who and what matters in early childhood settings. Thus, in the current education climate where conventional knowledges are routinely privileged, unconventional knowledges and small stories from children's lives are …

Understanding Attraction, Behavior, And Identity In The Asexual Community, Corey Doremus Jun 2020

Understanding Attraction, Behavior, And Identity In The Asexual Community, Corey Doremus

Theses and Dissertations

Models of sexuality have evolved substantially in the past several decades through the inclusion of new aspects which were previously overlooked. Components such as romantic attraction and behavior have also traditionally been included in models of sexuality. However, romantic and sexual orientations do not coincide for all individuals. A population for which this is true and one that has developed a robust language for discussing romantic orientation is the asexual community. The current study aims to examine romantic and sexual orientation through patterns found within the factors of attraction, behavior, and identity in the asexual community. Within this sample, aspects …

Policy Storms At The Central Office: Conflicting Narratives Of Racial Equity And Segregation At School Committee Meetings, Serena M. Wilcox Jun 2020

Policy Storms At The Central Office: Conflicting Narratives Of Racial Equity And Segregation At School Committee Meetings, Serena M. Wilcox

Educational Policy Studies and Evaluation Faculty Publications

This article reports findings from a multiyear critical ethnography that examined race talk dilemmas of school leaders at the central office at a small urban school district to understand why racialized educational policies and practices still persist against African American students. This study takes a structural approach to investigating the impact that race talk has on educational policymaking at the local district level. The guiding research question in this paper examines how we can understand educational reform and policy implementation and the unintended consequences of those interventions through the local from a historical context.

Choice‐Based Reminder Cues: Findings From An Mhealth Study To Improve Tuberculosis (Tb) Treatment Adherence Among The Urban Poor In India, Debasree Das Gupta, Amit Patel, Deepak Saxena, Naoru Koizumi, Poonam Trivedi, Krupali Patel, Devang Raval, Andrew King, Kerianne Chandler

Kinesiology and Health Science Faculty Publications

Poor treatment outcomes due to nonadherence and consequent high levels of drug resistance continue to challenge efforts to combat tuberculosis (TB) in India. Mobile health‐ or mHealth‐based reminder cues have been considered in multiple health behavior modification interventions, including TB treatment nonadherence. We conducted a quasi‐experimental study in Ahmedabad, India, to examine the effectiveness of mHealth‐based reminder cues customized to meet diverse patient needs. Results from this experiment indicate that the potential of customized mHealth reminder cues may remain unrealized unless addressed in conjunction with the multifaceted drivers of TB treatment nonadherence. The perspective we present here has broad relevance …

A Quest To Understand The Literacy Practices Of Homeless Children Who Are Living In Extended-Stay Motels, Suzanne Curry Thomason Jun 2020

A Quest To Understand The Literacy Practices Of Homeless Children Who Are Living In Extended-Stay Motels, Suzanne Curry Thomason

Theses and Dissertations

This qualitative ethnographic study was conducted to explore the literacy practices of children who are homeless. Participants included six emergent readers from four families living in extended-stay motels. The participants were observed during interactive writing and shared reading lessons during a summer program hosted at a cooperating nonprofit agency. Three research questions were used to explain the phenomenon: 1) What literacy activities are a part of families who are homeless? 2) How does a child who is homeless respond to the structure and availability of a summer literacy program as a writer? 3) How will a homeless child’s attitudes towards …

Evidentiality, Epistemic Modality And Mirativity: The Case Of Cantonese Utterance Particles Ge3, Laak3, And Lo1, Ka Fai Law Jun 2020

Evidentiality, Epistemic Modality And Mirativity: The Case Of Cantonese Utterance Particles Ge3, Laak3, And Lo1, Ka Fai Law

Theses and Dissertations

This thesis examines a set of three utterance particles—ge3, laak3, and lo1—in Hong Kong Cantonese in terms of evidentiality, epistemic modality, and mirativity. Cantonese utterance particles have long been studied; however, close investigation of evidentiality and mirativity on a small set of particles is relatively rare. Previous accounts claim that ge3 and laak3 convey certainty. On the other hand, linguists also claim that the use of the utterance particle lo1 assumes a high level of knowledge from a hearer. This thesis has two main purposes: to untangle the differences between the utterance particles ge3 and laak3 in terms of epistemic …

Challenges To, And Manifesto For, Fact-Finding In A Time Of Disinformation, Agnés Callamard

Notre Dame Journal of International & Comparative Law

Liberal and democratic values are in jeopardy, as is the rules-based international system and the norms it embodies, both being subject to multiple attacks that, once taboo, now, quite to the contrary, are both claimed and carried out with pride. This Article assesses the current human rights environment from the perspective of a United Nations factfinder. The impact of technological advancement on the human rights framework and the process of evidence-gathering is discussed, particularly regarding the spread of misinformation. The Article concludes with a manifesto for fact-finding as a pathway to knowledge and justice.

The Rise Of Hybrid Warfare, Waseem Ahmad Qureshi Jun 2020

The Rise Of Hybrid Warfare, Waseem Ahmad Qureshi

Notre Dame Journal of International & Comparative Law

In the twenty-first century, wars are not declared or waged conventionally; instead, conflicts are instigated by clandestine agents using cyber tools, information operations, NGOs, nonstate actors, economic tools, propaganda, ambiguity, terrorism, and insurgency or rebel movements. In hybrid warfare, the lines between peacetime and wartime and between combatants and civilians are blurred. Further, systemic aggression is imposed on a targeted state using gray zones, nonlinear warfare, unrestricted warfare, unconventional warfare, and color revolutions to avoid attribution and possible retribution for the aggression. Hybrid warfare employs a wide array of power tools, ranging from political, economic, military, and civil to informational. …

Legal System Network Effects And Global Legal Development, David C. Donald Jun 2020

Legal System Network Effects And Global Legal Development, David C. Donald

Notre Dame Journal of International & Comparative Law

Law originates in local environments, yet can be transmitted globally or over time to new contexts and foreign or future users. At its origin, law arises in response to social needs, but once formalized it takes on a semantic life of its own in a network of users. A rule created in response to a random New York plaintiff could—with sufficient popularity—end up as the standard norm applied globally, regardless of its underlying suitability for specific local needs.

To better understand the consequence of these legal system network effects on global legal development, this Article applies Klausner’s network theory of …

Radar Emitter Signal Identification Based On Slide+Svm, Yingkun Huang, Weidong Jin Jun 2020

Radar Emitter Signal Identification Based On Slide+Svm, Yingkun Huang, Weidong Jin

Journal of System Simulation

Abstract: For the deficiency of traditional techniques of emitter signal feature extraction which heavily rely on experience, a model of radar emitting signal identification based on feature self-learning was proposed. This model consists of following 2 parts. Firstly, transform radar signal into frequency domain, then reduce signal dimension by using improved Piecewise Aggregate Approximation (PAA) method. Secondly, create the model of multi-layer Liner Denoiser (LIDE) to feature learning by using unsupervised training method. The validity of model was verified by simulating 5 different kinds of emitting signal with the outcome that excellent identification accuracy could be achieved at …

Research Of Chinese Diphthongs Pronunciation Based On Diva Model, Shaobai Zhang, Yanli Chen, Liwen He Jun 2020

Research Of Chinese Diphthongs Pronunciation Based On Diva Model, Shaobai Zhang, Yanli Chen, Liwen He

Journal of System Simulation

Abstract: DIVA (Directions Into Velocities of Articulators) is a kind of adaptive neural network model which is used to simulate and describe some associative functions in brain regions involved speech production and understanding. DIVA takes 29 essential English phonemes as its language background. Since the number of Chinese pronunciation phonemes is much larger than English and the pronunciation brain mechanisms of both also make a big difference, the adaptability of DIVA model for Chinese background has to be studied specially, in order that the model can “read out” the thinking processes in Chinese brain. Based on DIVA, the Chinese pronunciation …

أفضلية الاستبدال غير القواعديّ في لغة الحديث النبويّ الشريف The Preference For Non-Grammatical Substitution In The Language Of The Holy Hadith, Muhammad Nizwan Bin Musling

Jordan Journal of Islamic Studies

This study aims to find out issues of the ungrammatical substitution in Hadith's structure through Ibn Malik's book (Šawāhid Al-Tawdīḥ). It is to measure the degree of structure's agreement with grammar, based on the two criterions: Grammaticality Optimality and Linguistic Usage Optimality. By the analytical descriptive method, the result shows this substitution appears in four issues: the first two issues are related to the subject-predicate elements, the third is the attachment of the "Nun Wiqāyah" to the noun, and the fourth is the transformation form from the adjective structure into the Iḍāfa structure. All Grammaticality Optimality …

Two-Headed Serpents And Rayed Heads: Precedents And Reinterpretations In Paracas Necropolis Imagery, Ann H. Peters Jun 2020

Two-Headed Serpents And Rayed Heads: Precedents And Reinterpretations In Paracas Necropolis Imagery, Ann H. Peters

PreColumbian Textile Conference VIII / Jornadas de Textiles PreColombinos VIII (2019)

The Necropolis of Wari Kayan and other tombs of the Paracas Necropolis mortuary tradition present an astonishing diversity of textile styles, and an even greater diversity of imagery. More than 100 different motifs can be distinguished and tracked among the documented mortuary contexts. While is it not likely that our sample of 45 mummy bundles includes all important variants of any particular motif, in many cases it is possible to propose a sequence of reinterpretations of a key icon. By documenting the known assemblage of images and artifacts we can perceive what icons and styles are predominant, recurrent or unusual. …

The More We Do, The Less We Gain? Balancing Effort And Efficacy In Managing The Solidago Gigantea Invasion, Dávid U. Nagy, Emily S.J. Rauschert, Tamás Henn, Kevin Cianfaglione, Szilvia Stranczinger, Robert W. Pal

Biological, Geological, and Environmental Faculty Publications

Developing invasive plant management strategies is an important task in modern ecology, conservation biology and land management. Solidago gigantea is considered a problematic invader in Europe and Asia, where it forms dominant stands that can decrease species diversity. There is, therefore, an urgent need for effective management to reduce S. gigantea infestations and their negative impacts. We examined the efficacy of multiple approaches to S. gigantea management in Hungary. In our study, we evaluated the effect of several long-term management techniques such as grazing, mowing and periodic flooding on the invader's density as well as native community diversity. In addition, …

Divine Impassibility: A Comparison Of Weinandy's And Culpepper's Perspectives On Whether God Suffers, Elizabeth Flynn Jun 2020

Divine Impassibility: A Comparison Of Weinandy's And Culpepper's Perspectives On Whether God Suffers, Elizabeth Flynn

Aristos

From being generally regarded as a philosophical and theological impossibility, since the late nineteenth century the idea that God suffers has become popular and attractive among a vast array of Christian theologians. Due to this shift, many theologians no longer see the need to argue for it and divine passibility has even been called the ‘new orthodoxy.’ The matter has not yet been laid to rest and is made more complex because the terms ‘suffering’ and ‘impassibility’ are used with a variety of connotations.

At the heart of the debate is the desire to assert God’s personalised love for all …

An Examination Of The Significance Of The Trinitarian Theology Of St. Augustine, Zolt Salontai Jun 2020

An Examination Of The Significance Of The Trinitarian Theology Of St. Augustine, Zolt Salontai

Aristos

Despite the noble efforts of modern Christian theologians in attempting to revive popular level interest in the classical Christian doctrine of the Trinity, there has been within the everyday praxis of the individual Christian a discernible neglect and ignorance of this cardinal doctrine. However, with the 20th century advent of Freudian and Jungian psychology, a new opportunity has arisen for a Trinitarian revival in the popular consciousness of the faithful.

Due to an increasing level of interest in the notion of understanding the conscious and unconscious cognitive processes that govern the human psyche, there arose an indubitable opportunity for …

© 2020 The Authors. Maize is a cultigen of global economic importance, but when it first became a staple grain in the Americas, was unknown and contested. Here, we report direct isotopic dietary evidence from 52 radiocarbon-dated human skeletons from two remarkably well-preserved rock-shelter contexts in the Maya Mountains of Belize spanning the past 10,000 years. Individuals dating before ∼4700 calendar years before present (cal B.P.) show no clear evidence for the consumption of maize. Evidence for substantial maize consumption (∼30% of total diet) appears in some individuals between 4700 and 4000 cal B.P. Isotopic evidence after 4000 cal B.P. …

This report presents findings from a 2020 survey of individuals across New York State (NYS) to gather information on statewide System of Care (SOC) implementation. All county Children’s Single Points of Access Coordinators (C-SPOAs) were asked to provide a list of individuals who are leaders in each child-serving system of their SOC. These individuals received the SOC Implementation Survey (adapted from Stroul, Dodge, Goldman, Rider, & Friedman, 2015) which is designed to “…assess progress in a community or region implementing the SOC approach for children, youth, and young adults with behavioral health challenges and their families.” This tool measures level …

Interacting With The Other: Culturally Responsive Approaches Toward Intercultural Competence, Tamara Devine Jun 2020

Interacting With The Other: Culturally Responsive Approaches Toward Intercultural Competence, Tamara Devine

MA TESOL Collection

Traditional language teaching approaches assume a strong focus on linguistic proficiency, syntax, and grammar. This thesis makes the case that culture and language must be given equal consideration in a language curriculum, and educators must approach their work with a critical eye for the cultural identities of each of their students. The author examines the ways that learner identity, most notably as it pertains to race and sexual orientation, is a crucial element to consider as teachers build in areas of representation to mirror their learners. The author lays out the theoretical foundation of culturally responsive teaching and points out …

Before “Fire And Fury”: The Role Of Anger And Fear In U.S.–North Korea Relations, 1968–1994, Benjamin Young

Research & Publications

Since the beginning of the Korean War, the North Korean and U.S. governments have been involved in emotional warfare. From North Korea’s stated “eternal hatred” of the U.S. imperialists to Washington’s demonization of Pyongyang as an insidious Soviet pawn, emotions have been at the heart of this hostile bilateral relationship. Using three case studies (the 1968 Pueblo incident, the 1976 axe murder incident, and the 1994 nuclear crisis), I examine the ways in which the two sides have elicited emotional responses from their populations for their respective political goals. By portraying the U.S. as the source of all evilness in …
