Visions Of The Republic Symposium: The People: A Pre-Primer For Critically Reevaluating Representation & Court Power In The Present, Marvin L. Astrada

Fordham Law Review Online

What exactly is an American? Who or what are the People? Is there an authentic, viable American political identity or community? Or do the deep ruptures and balkanization that seem to pervade law and politics— ranging from pandemics, national security, impeachment, and the environment, to issues of an everyday, local nature—indicate a crisis of legitimacy, cohesion, and national community?

Novel Perspectives On Due Process Symposium: Constructing The Original Scope Of Constitutional Rights, Nathan S. Chapman Aug 2020

Novel Perspectives On Due Process Symposium: Constructing The Original Scope Of Constitutional Rights, Nathan S. Chapman

Fordham Law Review Online

This response argues that Wuerth’s paper illustrates the most persuasive way to go about the task—one question at a time, with an emphasis on conventional legal materials and forms of argumentation. Some questions will call for especially imaginative constructions. This does not render them irrelevant, but it does caution some modesty about the extent to which they ought to trump competing constructions arising from practice and precedent. Despite her reluctance, then, Wuerth’s methods are entirely consistent with a confident originalism.

Spoken Language Recognition On Open-Source Datasets, Brady Arendale, Samira Zarandioon, Ryan Goodwin, Douglas Reynolds Aug 2020

Spoken Language Recognition On Open-Source Datasets, Brady Arendale, Samira Zarandioon, Ryan Goodwin, Douglas Reynolds

SMU Data Science Review

The field of speaker and language recognition is constantly being researched and developed, but much of this research is done on private or expensive datasets, making the field more inaccessible than many other areas of machine learning. In addition, many papers make performance claims without comparing their models to other recent research. With the recent development of public multilingual speech corpora such as Mozilla's Common Voice as well as several single-language corpora, we now have the resources to attempt to address both of these problems. We construct an eight-language dataset from Common Voice and a Google Bengali corpus as well …

Bringing Bilingualism To The Center Of Guided Reading Instruction, Laura Ascenzi-Moreno, Rebecca Quiñones Aug 2020

Bringing Bilingualism To The Center Of Guided Reading Instruction, Laura Ascenzi-Moreno, Rebecca Quiñones

Publications and Research

Educators consider guided reading one of the most powerful instructional tools in a reading teacher’s arsenal. Yet, when it comes to emergent bilinguals in both monolingual English and bilingual settings, guided reading is implemented monolingually, or in one language at a time. As the field of reading instruction has moved toward a more asset‐based take on students’ bilingualism, integrating a bilingual approach to guided reading is necessary. The authors offer educators a lens to understand how emergent bilinguals’ resources and bilingualism can be incorporated into guided reading, along with concrete examples that can assist teachers in enacting these practices in …

International Journal of Exercise Science

International Journal of Exercise Science 13(3): 1228-1241, 2020. Women in rural settings are at increased risk for adverse pregnancy outcomes. One potential way to improve pregnancy outcomes in rural settings is through physical activity promotion. However, given the disparities in prenatal care, women in rural areas may not receive information from their health care provider regarding physical activity during pregnancy. Therefore, the purpose of this study was to examine patient and provider communication in a rural setting (both patients’ and providers’ perspectives) regarding physical activity during pregnancy. A mixed methods study was performed among patients and providers in an obstetrical …

The Politics Of Seeds And Their Effects On Small-Scale Paraguayan Farmers, Maeve Mallozzi-Kelly Aug 2020

The Politics Of Seeds And Their Effects On Small-Scale Paraguayan Farmers, Maeve Mallozzi-Kelly

Capstone Collection

International corporate seed companies have manipulated Paraguay’s politics and agricultural development since 1995, increasing Paraguay’s use and protection of genetically modified seeds, while also undermining farmers’ control over their production and financial stability by almost eliminating markets for heirloom varieties. Paraguay continues to be excluded from research critiquing the effects of neoliberal policies on global agricultural systems. Therefore, this study aims to illuminate small-scale farmers’ experiences and bring Paraguay into the global conversation on seed sovereignty by critically examining the effects Paraguay’s national seed policies have on small-scale farmer’s development opportunities and resilience to climate change. This question guides the …

Thermal Control Development Of A Proton Exchange Membrane Fuel Cell System, Ola Mohammed Taha Al-Shalash Aug 2020

Thermal Control Development Of A Proton Exchange Membrane Fuel Cell System, Ola Mohammed Taha Al-Shalash

Mechanical Engineering Theses

A fuel cell is an electrochemical energy conversion device that uses fuel to generate electricity. It basically converts the chemical energy of reactants directly into electricity without combustion. In a Proton Exchange Membrane Fuel Cell (PEMFC), the reactants, hydrogen and oxygen, are fed into the two electrodes, anode and cathode, respectively. A reaction takes place at each electrode and produces electricity, as well as water, and heat as the by-products. In order to maximize performance of a fuel cell, many factors can be considered for tuning and control. Temperature management is one of these factors.

A thermal-fluid model of a …

Cryptography, Passwords, Privacy, And The Fifth Amendment, Gary C. Kessler, Ann M. Phillips

Journal of Digital Forensics, Security and Law

Military-grade cryptography has been widely available at no cost for personal and commercial use since the early 1990s. Since the introduction of Pretty Good Privacy (PGP), more and more people encrypt files and devices, and we are now at the point where our smartphones are encrypted by default. While this ostensibly provides users with a high degree of privacy, compelling a user to provide a password has been interpreted by some courts as a violation of our Fifth Amendment protections, becoming an often insurmountable hurdle to law enforcement lawfully executing a search warrant. This paper will explore some of the …

Hebron University Research Journal-B (Humanities) - (مجلة جامعة الخليل للبحوث- ب (العلوم الانسانيه

This qualitative study explores the pragmatic functions of ritual refusal as used in Palestinian Society. The significance of this paper rises from the fact that it attempts to highlight potential causes of pragmatic failure and breakdown in cross-cultural communication. Brown and Levinson’s (1987) and Leech’s (1983) models of linguistic politeness are considered as a theoretical framework of the study.
Naturally occurring data were collected ethnographically from two situations. Analysis of data shows that ritual refusals by Palestinians are rooted in maintaining face which is oriented toward a person’s public image. In Palestinian Arabic, it is necessary to preserve the interlocutor’s …

Various Approaches To The Study Of English Set Expressions And The Problems Of Classification, Mohigul Yusufovna Qahharova

Scientific reports of Bukhara State University

Speech is what the speaker speaks about, expressing his/her feelings and interaction with the audience. The speaker tries to make his speech effective in one way or another and to attract the listener. A word has its own lexical and complementary meaning. For example, the lexical meaning of the words "expressive", "emotional", "affective" means "affective", and the additional meaning "emotional". In English, it is permissible to take into account syntactic, melodic and lexical features for expressing emotional expressions. By lexical feature, we mean adding additional meaning to words. The complementary meaning of words can be constant or variable. We must …

A Simple, Ecologically Rational Rule For Settling Found Property Disputes, Bart J. Wilson Aug 2020

A Simple, Ecologically Rational Rule For Settling Found Property Disputes, Bart J. Wilson

ESI Publications

Who has property in a found item X, which is contained in Y? The finder of X or the person who has property in Y? The common law says it depends. It depends upon whether the owner of Y knew about X, or whether X was lost or mislaid, or how small the weight of X is relative to Y (as compared to its value), or whether the finder was an employee of the owner of Y, to name just a few. Wilson (2020) hypothesizes that humans universally cognize property as being contained in a …

Electrical and Computer Engineering Faculty Research & Creative Works

Background: Patient distances can be calculated based on signs and symptoms derived from an ontological hierarchy. There is controversy as to whether patient distance metrics that consider the semantic similarity between concepts can outperform standard patient distance metrics that are agnostic to concept similarity. The choice of distance metric can dominate the performance of classification or clustering algorithms. Our objective was to determine if semantically augmented distance metrics would outperform standard metrics on machine learning tasks.

Methods: We converted the neurological findings from 382 published neurology cases into sets of concepts with corresponding machine-readable codes. We calculated patient distances by …
