The Unmet Legal Needs Of The Poor In Maine: Is Mandatory Pro Bono The Answer?, Wendy F. Rau
The Unmet Legal Needs Of The Poor In Maine: Is Mandatory Pro Bono The Answer?, Wendy F. Rau
Maine Law Review
In 1989, the Maine Commission on Legal Needs was formed to study the civil legal needs of Maine's poor population and to develop a plan for meeting those needs. Similar projects have been undertaken in a number of other states and by the American Bar Association in recent years. Each study has revealed a significant unmet need among the poor for assistance with legal problems. There seems little doubt that the situation is serious and widespread. The difficulty lies in finding a solution. One proposal that has been advanced is mandatory pro bono, a program that would require attorneys to …

Public-School Systems Are Criminalizing Our Young People: Giving Voice To The Marganilized, Carrie Stoltzfus
Public-School Systems Are Criminalizing Our Young People: Giving Voice To The Marganilized, Carrie Stoltzfus
Graduate Theses & Dissertations
A phenomenological qualitative study using Critical Race Theory and counter-storytelling was completed to investigate what K-12 public schools should be doing to keep young people out of the school-to-prison pipeline (STPP). This study took place in a large city in the Mid-Atlantic region of the United States. Interviews were completed with former students of the researcher who were previously incarcerated, educational professionals, and justice system professionals. Additionally, observations of the court systems and document reviews were completed in order to triangulate findings. Themes emerged around factors that lead to incarceration and the preferred practices to support young people to avoid …

Refugees And Neighborhood Design, Elizabeth Hadden
Refugees And Neighborhood Design, Elizabeth Hadden
Student Research Symposium
Around the world, there are many people who have been forced to flee their country because of persecution, war, or violence. In 2018 there were 25.9 million refugees around the world, and only a minuscule fraction of those individuals will be relocated to the United States (UNHCR, 2019). Utah welcomes approximately 1,100 refugees each year. The majority of refugees in Utah represent countries such as Somalia, the Democratic Republic of Congo, Syria, Iraq, Vietnam, the former Soviet Union, and Burma (Gardner, 2017). Arriving in the United States for the first time can be overwhelming as so many experiences are new, …

Your Body Owns The Tattoo!, Habeeb Sheikh
Your Body Owns The Tattoo!, Habeeb Sheikh
Cardozo Arts & Entertainment Law Journal (AELJ) Blog
Put yourself in the shoes of someone who receives a new tattoo. Eager to share the design with friends, you start snapping pictures of the fresh body art. You send a text alongside the pictures saying, “Check out my new tattoo!” Ordinarily, one may not question your ownership here. But legal questions may arise in a situation where a videogame company profits off the videogame avatar of a tattooed celebrity like LeBron James. The issue becomes whether the tattoo artist has copyright protections over the art, or does it belong to the individual whose body bears the ink. There is …

Emerging Privacy Legislation In The International Landscape: Strategy And Analysis For Compliance, Jonathan Mcgruer
Washington Journal of Law, Technology & Arts
Big data is a part of our daily reality; consumers are constantly making decisions that reflect their personal preferences, resulting in valuable personal data. With the European Union’s General Data Protection Regulation ushering in a new age of data privacy regulation, international jurisdictions have begun implementing comparable comprehensive legislation, affecting businesses globally. This Article examines the similarities between emerging U.S. state data privacy laws and the General Data Protection Regulation, with suggestions for businesses implicated …

Join With Me, Won't You? Civic Engagement, Covid-19, And The Millennial Generation Of Law Professors, Joseph A. Schremmer
Faculty Scholarship
My goals in this essay are to place legal education’s COVID-19 crisis into this broader context and illuminate the unique opportunity that millennial law professors have to create the conditions for more robust community participation within and outside of our law schools. Part I summarizes the decline of civic engagement and social capital in preceding decades and its consequences for law, public discourse, and quality of life. Part II outlines how this deficit of social capital exacerbates the challenges facing law schools and professors in delivering legal education and constructing community during the coronavirus pandemic. Part III explores the unique …
