Medical-Legal Collaboration And Community Partnerships: Prioritizing Prevention Of Human Trafficking In Federally Qualified Health Centers, Kimberly S.G. Chang Md, Mph, Hamida Yusufzai, Anna Marjavi

Georgia State University Law Review

Human trafficking (HT) is increasingly recognized as a public health issue, and its severe consequences affect some of society’s most vulnerable members. Prioritizing prevention is a critical component of a public health framework when addressing HT, and the health care delivery system plays a crucial role in operationalizing primary, secondary, and tertiary prevention interventions. As a significant part of the primary care system in the U.S., Federally Qualified Health Centers (FQHCs) are uniquely positioned to be the first point of contact with the health care system for people at risk for and affected by HT. FQHCs provide many preventive services, …

The Regulation Of Lawyers In Compliance, Jennifer M. Pacella Jun 2020

The Regulation Of Lawyers In Compliance, Jennifer M. Pacella

Washington Law Review

The field of compliance has exploded in interest, attention, and growth over recent years. It has emerged as a popular career path for those trained in the law, giving rise to an influx of job opportunities for new law school graduates and seasoned attorneys alike. Additionally, compliance has tightened the essential interplay between business and law. Numerous compliance officers hold J.D. degrees and many also serve simultaneously as both an organization’s chief compliance officer and general counsel, thereby muddying the lines between which service constitutes the “practice of law,” requiring adherence to professional rules of responsibility, or non-legal work, where …

Facilitators And Barriers For Home Health Aides Detecting And Reporting Elder Abuse In New York City, Agnieszka K. Halarewicz

Dissertations, Theses, and Capstone Projects

Elder abuse impacts close to 13 percent of older adults in the US. It exists in secret, with only about one in 24 cases becoming known to the systems that can provide intervention. As baby boomers age and the general population lives longer, for example New York City is expecting to have up to 1.3 million adults by year 2030, the number of people impacted by abuse is expected to drastically increase. A gap exists in the current span of knowledge and practice applications about the issue, particularly around homecare services. Home health aides, a rapidly growing profession, provide direct …

Departing From Confidentiality In International Dispute Resolution, Ben Juratowich Qc Jun 2020

Departing From Confidentiality In International Dispute Resolution, Ben Juratowich Qc

Indian Journal of International Economic Law

This article considers the degree of confidentiality that applies to three forms of international dispute resolution: interState, investor-State and international commercial arbitration. The degree of confidentiality associated with investment arbitration led to calls for reform, which have led to new mechanisms and proposals to increase transparency. Problems are, however, still generated by the degree of confidentiality that persists. International commercial arbitration retains a higher degree of confidentiality, but it is now increasingly a forum for the resolution of disputes in which the parties are not the only ones to have a legitimate interest. Furthermore, prominent judges have expressed the view …

Developing Privacy Best Practices For Direct-To-Public Legal Apps: Observations And Lessons Learned, Teresa Scassa, Amy Salyzyn, Jena Mcgill, Suzanne Bouclin

Canadian Journal of Law and Technology

Canada’s access to justice problem is undeniable. Too many people are unable to get the help they need when they experience legal issues. The reasons underlying this problem are multi-faceted and complex. One major barrier to effectively accessing justice is the cost of legal services; the fees associated with hiring a lawyer are often prohibitive. Increasingly, technology is advanced as a potential solution to the unaffordability of conventional legal services. Courts have tried to create efficiencies by, for example, allowing for e-filing and video- conferenced testimony, where appropriate. For lawyers, new technology products emerge almost daily to help streamline tasks …

The Incomplete Process Of Fixing Alaska’S Domestic Violence Protective Order Statute, Samuel R. Buchman Jun 2020

The Incomplete Process Of Fixing Alaska’S Domestic Violence Protective Order Statute, Samuel R. Buchman

Alaska Law Review

The Alaska legislature has codified, in section 18.66.100 of the Alaska Statutes, a process through which petitioners can seek a domestic violence protective order. Such an order offers petitioners a range of protections against a household member who has committed a crime of domestic violence. Most of the protections afforded under these orders last one year, and the means by which a petitioner could renew a domestic violence protective order has, until recently, remained unclear. In Whalen v. Whalen, decided in August 2018 by a three to two margin, the Alaska Supreme Court clarified that renewal process. The court …

The Alaskan Variable: A Call For Education Clause Analysis In School Funding Cases, Sarah Laws Jun 2020

The Alaskan Variable: A Call For Education Clause Analysis In School Funding Cases, Sarah Laws

Alaska Law Review

The provision of public education in Alaska is a task as monumental as the state itself, requiring innovative solutions to unique challenges faced within the state. The drafters of the Alaska Constitution understood this dilemma and granted the state legislature broad power under the education clause. Early supreme court jurisprudence interpreted this mandate broadly and granted considerable deference. However, recent school funding cases have seen the court’s jurisprudence shift to focus on different constitutional provisions and neglect an education clause analysis. The supreme court now has an opportunity to change this. Alaska Legislative Council v. Dunleavy is currently pending before …

Analyzing Service Barriers And Risk Factors For Reentry Among Formerly Incarcerated Adults, Agustina Alejandra Sepulveda

Electronic Theses, Projects, and Dissertations

Recidivism is a growing problem affecting formerly incarcerated adults struggling with reentry into society. After release, most individuals are dealing with barriers in their environment that affect their access to substance abuse and mental health treatment, which can be important to reducing recidivism. Thus, this study sought to understand the various service barriers and risk factors to reentry among formerly incarcerated individuals to help increase awareness of some of the challenges the reentry population is facing.

Self-administered surveys focusing on housing, employment, public assistance, and mental health barriers were collected among formerly incarcerated individuals from Southern California (n=103). Bivariate chi-square …

The Evolving Concept Of Access To Justice In Singapore’S Mediation Movement, Dorcas Quek Anderson Jun 2020

The Evolving Concept Of Access To Justice In Singapore’S Mediation Movement, Dorcas Quek Anderson

Research Collection Yong Pung How School Of Law

This article examines the key societal developments underpinning the growth of mediation in Singapore with the view to analysing the evolving conceptualisation of justice within mediation. The introduction of mediation corresponded with a shift from adversarial justice to an indigenous form of conciliatory justice, in which a respected mediator played an advisor role to the disputants and was trusted to ensure the fairness of the process. However, this trajectory was tempered by the need to ensure that Singapore mediation practice conformed with international practices concerning the protection of parties’ autonomy. The ambivalence concerning the mediator’s role has resulted in uncertainty …

Background:

Women and children suffer disproportionately in armed-conflicts. Since 2011, the protracted Syrian crisis has fragmented the pre-existing healthcare system. Despite the massive health needs of women and children, the delivery of key reproductive, maternal, newborn, child and adolescent health and nutrition (RMNCAH&N) interventions, and its underlying factors are not well-understood in Syria. Our objective was to document intervention coverage indicators and their implementation challenges inside Syria during conflict.

Methods:

We conducted 1) a desk review to extract RMNCAH&N intervention coverage indicators inside Syria during the conflict; and 2) qualitative interviews with decision makers and health program implementers to …

Community Trust In Their Local Police Force, Pamela M. Low May 2020

Community Trust In Their Local Police Force, Pamela M. Low

Silicon Valley Notebook

While the ideal model of policing includes community collaboration to define and provide safety, the reality of the relationship is strained due to the distinct divide in community-police social boundaries. The gendered impacts of police militarization, community-police familiarity, and race heterogamy on community trust in the local police force were assessed, using a sequential mixed methods approach. The 2011 national “Police-Public Contact Survey” data were supplemented with a content analysis of journalistic writings and interviews with community organizers. Together, the findings partially supported Strain and Social Boundaries theories. Irrespective of gender social boundaries, militarization led to higher levels of mistrust …
