Domestic violence is a universal public health concern (VicHealth, 2011; World Health Organisation [WHO], 2013). Domestic violence cuts across all countries, regardless of economic, social, cultural or religious differences (Ali et al., 2020; VicHealth, 2011; WHO 2013). Men are often responsible for perpetrating domestic violence against women (Australian Bureau of Statistics [ABS], 2019; Australia Institute of Health and Welfare [AIHW], 2018).

The effects of domestic violence on victims can be serious and long-term; affecting their physical and mental wellbeing, and lingering even after the exposure to violence has ended (Mitchell, 2011). That is, the effect on victims’ mental health is …

Introduction: Medical-legal partnerships (MLPs) provide civil legal services in concert with healthcare services to mitigate complex social conditions with health-harming effects. Currently, there are 333 MLPs in 46 states. Thomas Jefferson Health System (TJHS) does not have a systemwide MLP. (Magee Rehabilitation Hospital does have an MLP used by qualifying Magee patients). This project sought to identify the core components of an MLP and to demonstrate the value an MLP would provide TJHS.

Methods: Assessed existing literature. Interviewed an existing MLP director. Patients from the Jefferson Hospital Ambulatory Practice (JHAP) clinic completed a written survey regarding health-harming social-legal …

Overrepresented Yet Overlooked: Lgbtq Survivors Of Trafficking And The Imperative For The Nordic Approach To Sex Trafficking Laws In The United States, Claire Mooney

Cardozo Journal of Equal Rights & Social Justice

The note argues that LGBTQ survivors of human trafficking are disproportionately affected by inadequate legal frameworks and societal discrimination. It advocates for the adoption of the Nordic Model in the U.S., which criminalizes the purchase of sex while decriminalizing its sale, to better address the needs of LGBTQ survivors and align with international human rights standards.

วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์ที่จะศึกษาถึงการกำหนดโทษทางอาญาในกฎหมายควบคุมมลพิษของประเทศไทย โดยโรงงานอุตสาหกรรมก่อให้เกิดทั้งมลพิษทางอากาศ มลพิษทางน้ำและมลพิษที่เกี่ยวกับของเสียอันตราย อันก่อให้เกิดผลกระทบและความเสียหายต่อสิ่งแวดล้อมและมนุษย์ในวงกว้าง ซึ่งถือได้ว่าการที่โรงงานอุตสาหกรรมก่อให้เกิดมลพิษดังกล่าวเป็นการก่ออาชญากรรมสิ่งแวดล้อมขึ้นแล้ว จึงสมควรแก่การนำโทษทางอาญามาบังคับใช้ในการป้องกันและปราบปรามกรณีที่โรงงานอุตสาหกรรมได้ก่อให้เกิดมลพิษขึ้น จากการศึกษาเป็นที่ประจักษ์ว่า ลักษณะการกระทำความผิดทางอาญาที่ปรากฏในกฎหมายควบคุมมลพิษของทั้งประเทศไทย ประเทศสาธารณรัฐฝรั่งเศส ประเทศสหพันธ์สาธารณรัฐเยอรมนีและประเทศสหรัฐอเมริกาประกอบด้วย 3 ประการ โดยการกำหนดโทษทางอาญาสำหรับความผิดเนื่องจากการก่อให้เกิดมลพิษและความผิดฐานละเว้นไม่ปฏิบัติตามมาตรการเกี่ยวกับสิ่งแวดล้อมมีบทบาทสำคัญในการป้องกันและปราบปรามการก่อมลพิษของโรงงานอุตสาหกรรมได้อย่างมีประสิทธิภาพ แต่ในขณะเดียวกันการกำหนดโทษทางอาญาสำหรับความผิดฐานไม่ปฏิบัติตามเงื่อนไขหรือคำสั่งที่เจ้าหน้าที่รัฐกำหนดนั้นไม่เหมาะสมต่อความรุนแรงของการกระทำความผิดและไม่เป็นไปตามแนวคิดอาชญากรรมสิ่งแวดล้อมแต่อย่างใด ด้วยเหตุตามที่กล่าวข้างต้น ผู้เขียนจึงขอเสนอแนะให้ประเทศไทยสมควรกำหนดโทษทางปกครองหรือกำหนดค่าปรับเป็นพินัยสำหรับความผิดฐานไม่ปฏิบัติตามเงื่อนไขหรือคำสั่งที่เจ้าหน้าที่รัฐกำหนดแทนโทษทางอาญาที่ปรากฏอยู่ในกฎหมายควบคุมมลพิษในปัจจุบัน เพื่อให้สอดคล้องกับความร้ายแรงของการกระทำและตามแนวทางของกฎหมายควบคุมมลพิษของต่างประเทศ

In the aftermath of the 2016 election, the shortcomings of existing sanctuary protections came sharply into focus.1 Historically, cities enacted sanctuary protections to extricate their law enforcement agencies from activities related to federal immigration enforcement. In sanctuary cities, local government agencies are typically restricted from sharing information with federal immigration authorities or from cooperating in apprehending individuals targeted for removal.2 After the White House issued an Executive Order (EO) in late January 2017, many immigrant rights advocates recognized that external facing policies that proscribed direct cooperation would not suffice.3 The EO announced that Immigration and Customs Enforcement (ICE) would prioritize …

In his confirmation hearings, Chief Justice Roberts analogized judges to baseball umpires who only call balls and strikes.1 That is a questionable analogy in general, given that judges’ oversight of court proceedings goes beyond applying the law. But most especially, it is belied by judges’ role in regulating law practice, including judicial practice. With respect to lawyers, judges not only apply the law but make and enforce it. Although education scholars have recently focused greater attention on the experiences of undocumented youth in schools, few studies have examined educators' perceptions of their roles and responsibilities with regards to this population. Since the 1982 Supreme Court decision Plyler v. Doe guaranteed education to this group and barred schools from inquiring about immigration status, little additional policy has offered guidance on how schools can support this group while also refraining from identifying it's members. Policies are particularly lacking in new destination areas where there are fewer resources and less infrastructure for new immigrant populations. The debt burden is growing, and there is a strong likelihood that state courts will see corresponding increases in debt collection caseloads. To meet the challenge, state courts need to implement policies, rules, procedures, and business practices to manage consumer debt collection cases in a more consistent and coherent manner. As part of the Civil Justice Institute Implementation Plan, the National Center for State Courts and Institute for the Advancement of the American Legal System conducted preliminary research to document the impact of rules enacted in New York State on consumer debt litigation. Policymakers need to rediscover the organizational form of business entity as a tool of financial regulation. Recent and classic scholarship has produced evidence that financial institutions organized as alternative entity forms – including investment bank partnerships and banks and insurance companies organized as mutual or cooperatives – tend to take less risk, exploit customers/consumer less, or commit less misconduct compared to counterparts organized as investor-owned corporations. Without accurate measurement of phenomena, it can be difficult to enact targeted corrective policies. While measurement in the social sciences is always challenging, it becomes infinitely more so when the phenomena under study are multifaceted and, thus, cannot easily be assessed by reference to a single factor. Phenomena of this latter variety might include governance, empowerment, or rule of law. Multidimensional measurement techniques have sought to capture such phenomena. Legal scholarship utilizing multidimensional measurement has, to date, generally focused on techniques treating each factor independently, which fails to reveal the interdependency of different factors.

There are many familial and social disparities, including drug addiction and use, incarceration, abandonment, and sometimes the death of a biological parent, that cause grandparents to acquire custody of their grandchildren. Current public welfare policies in some states, however, may not adequately address the needs of custodial grandparents caring for grandchildren and little academic literature exists that explores the unique experiences of custodial grandparents. In the United States there has been an increase of grandmothers caring for their grandchildren in the absence of their parents. Researchers have found that grandmothers are in a constant struggle with grandchildren exhibiting antisocial behavior. The gap in research does not address this issue. The present study explored the lived experiences of grandmothers in hopes of learning more about their past experiences, seeking to make a connection between generational parenting practices and poor coping skills. Using an interpretative phenomenological analysis, 11 grandmothers participated who were the sole provider for their grandchildren exhibiting delinquent behavior. Human Resource Management Departments (HRMDs) drive organizational change by implementing effective and efficient policies. This study explored staff perceptions in Ghana's Nursing and Midwifery Council (N&MC), a public-service institution, regarding the extent to which their HRMD could stimulate change by implementing the Human Resource Management Policy Framework and Manual (HRMPF&M). May and Finch's theory of normalization propelled this qualitative case study, which consisted of interviewing 23 purposively selected participants and examining secondary data from the N&MC, the Public Services Commission, HRMPF&M, other relevant legal documents, as well as relevant literature on the subject. AbstractWhenever a mass shooting occurs, it impacts the immediate families of the perpetrator, victims, and the whole nation: emotionally and financially. The research on the association between mental illness (MI) and mass shooting fatalities is limited. The purpose of this quantitative, cross-sectional study was to explore the association between MI and mass shooting using the archival data of the Stanford University database of mass shootings in America from 2000 to 2016. The theoretical framework was based on Bronfenbrenner’s social-ecological theory and the cognitive-behavioral theory to explain socio-environmental factors that impact human growth and development. This article describes our experiences and "lessons learned" providing degree-based distance (online) education to graduate students (studying business, law, and policy related to government contracts or public procurement). Temporal note: our pilot, and the five years of experience described in this case study, predate the 2020 Coronavirus Pandemic emergency distance teaching transition.

Among other things, we discuss our experiences with regard to fundamentally rethinking our pedagogical approach, "flipping the classroom," chunking, and scaffolded learning. We extol the benefits of working with, and being open to, advice from experienced instructional designers.

Our country is in crisis. The inequality and oppression that lies deep in the roots and is woven in the branches of our lives has been laid bare by a virus. Relentless state violence against black people has pushed protestors to the streets. We hope that the legislative and executive branches will respond with policy change for those who struggle the most among us: rental assistance, affordable housing, quality public education, comprehensive health and mental health care. This comment explains how and why the Texas Disciplinary Rules of Professional Conduct (the “Texas Disciplinary Rules”) should be updated to reflect the modernization of technology. Lawyers must keep abreast of changes in the law and its practices; including those which are technological in nature. The American Bar Association (the “ABA”) recently amended the “technology provisions” of its Model Rules of Professional Conduct (the “Model Rules”); namely Rule 1.1 “Competence” and Rule 1.6 “Confidentiality of Information” in order to keep up with the benefits and risks associated with technology in the legal profession.
