Getting Past Possession: Subsurface Property Disputes As Nuisances, Joseph Schremmer Jan 2020

Getting Past Possession: Subsurface Property Disputes As Nuisances, Joseph Schremmer

Faculty Articles

Property rights in the subsurface of land are adapting to accommodate modern activities like massive hydraulic fracturing (fracing). Property rights will need to continue adapting if they are to accommodate other developing activities like large-scale carbon capture and storage (CCS). Courts and commentators rarely approach the nature of subsurface property directly. They tend instead to discuss appropriate standards for tort liability when disputes arise — for example when artificial fissures from a frac treatment extend into and drain oil or gas from a neighbor’s land. The case law and literature generally approach unauthorized subterranean invasions as trespasses. Because the tort …

Population Demographics: Predictors Of The Relationship Between Alcohol Use Disorder And Major Depression, Mei Grace Behrendt Jan 2020

Population Demographics: Predictors Of The Relationship Between Alcohol Use Disorder And Major Depression, Mei Grace Behrendt

Honors Program: Senior Projects (Public)

This thesis examines both biological and social explanations of alcohol use disorder (AUD) and major depression (MD) through a thorough review of current literature. Using multiple logistic regression analyses exploring the sociodemographic and alcohol use factors that contribute to reporting of major depression symptoms with data from the 2017 National Survey on Drug Use and Health, this thesis demonstrates how there are health disparities that exist among different demographic populations. Specifically, certain demographic characteristics such as racial or ethnic identity, gender, and socioeconomic status may contribute to increased risk of developing and reporting episodes of lifetime and past year major …

Young, Dumb, And Broke: How Family Communication Affects Financial Literacy, Brenna Micek

Honors Program: Senior Projects (Public)

Thousands of Americans carry debt, whether it be a mortgage, student loans, or auto loans. The average American graduates with at least $35,000 in debt (Kurt, 2019). Many Americans are not confident in their financial capabilities (Godsted & McCormick, 2007). Research has shown that learning from parents leaves a larger impact than learning in the classroom (Lucas & Buzzanell, 2011). The purpose of this study is to explore how family communication – specifically conversation and conformity orientation – and relational closeness within a parent-child relationship affect messages about finances and the emerging adult’s financial literacy. Conversation orientation, conformity orientation, and …

The Impact Of State Legislative Term Limits On Descriptive Representation, Matt Baldwin Jan 2020

The Impact Of State Legislative Term Limits On Descriptive Representation, Matt Baldwin

Honors Program: Senior Projects (Public)

Do term limits make state legislatures more descriptively representative of their population? If the composition of a state legislature is a function of its ruleset and design, then term limits—a major shift in the rules—would change who is running for office and who is getting elected. In order to explore this question, a dataset was created by contacting a number of states to solicit responses on the demographics of their state legislatures from 1990-2018. In addition, information regarding some control variables (partisanship, time, economy) was gathered. A gap variable was created to see what difference existed between the proportion of …

Facebook's Speech Code And Policies: How They Suppress Speech And Distort Democratic Deliberation, Joseph Thai Jan 2020

Facebook's Speech Code And Policies: How They Suppress Speech And Distort Democratic Deliberation, Joseph Thai

Faculty Articles

With nearly two and a half billion users-a third of the world's population- Facebook far and away hosts the largest speech platform in the history of humanity. In the United States, seven out of ten adults use it, and nearly half get news from it. It is therefore no exaggeration to observe that Facebook's self-promulgated rules for "what is and is not allowed on Facebook," its content-based Community Standards, rival if not exceed the First Amendment's importance in shaping discourse in the United States. Yet, unlike the First Amendment, which only protects against government censorship, no scholarship has scrutinized the …

Disaggregating Corporate Liability: Japanese Multinationals And World War Ii, Timothy Webster Jan 2020

Disaggregating Corporate Liability: Japanese Multinationals And World War Ii, Timothy Webster

Faculty Scholarship

The past two decades have witnessed unprecedented attention to corporate legal liability for human rights abuses. Yet the supporting jurisprudence is relatively thin. Scholars generally agree that corporations can incur legal liability for serious violations of international human rights law. But courts find any number of ways to avoid such a result. This Article finds qualified support for an emergent norm of corporate civil liability from recent litigation in Japan. Specifically, the transnational war reparations litigation of the past three decades has yielded a consistent jurisprudence of qualified liability. Courts detail the abuses committed by Japan's largest multinational corporations, and …

Dna-Detection Based Diagnostics For Taenia Solium Cysticercosis In Porcine, Maxwell Wambua Waema, Gerald Misinzo, John M. Kagira, Eric L. Agola, Helena A. Ngowi

All Rsif Scholars' Publications

Porcine cysticercosis is a neglected and underestimated disease caused by metacestode stage of the tapeworm, Taenia solium(T. solium). Pigs are the intermediate hosts of T. solium while human are the only known definitive host. The disease has an economicconsequence because the affected farmers lose 50−100 percent of the value of pigs if they are infected. Lack of affordable, easy touse, sensitive, and specific molecular diagnostic tools for detection of infections at the farm level hinders the control of porcinecysticercosis in endemic areas. A number of DNA based diagnostic assays for the detection of T. solium infections in pigs havebeen developed …

Glucosinolates (GSs) are common anionic plant secondary metabolites in the order Brassicales. Together with glucosinolate hydrolysis products (GSHPs), they have recently gained much attention due to their biological activities and mechanisms of action. We review herein the health benefits of GSs/GSHPs, approaches to improve the plant contents, their bioavailability and bioactivity. In this review, only literature published between 2010 and March 2020 was retrieved from various scientific databases. Findings indicate that these compounds (natural, pure, synthetic, and derivatives) play an important role in human/animal health (disease therapy and prevention), plant health (defense chemicals, biofumigants/biocides), and food industries (preservatives). Overall, much …

Conservation Grazing With Native Irish Cattle In High Nature Value Environments, Kilian Kelly Jan 2020

Conservation Grazing With Native Irish Cattle In High Nature Value Environments, Kilian Kelly

Theses

Marrying conservation objectives with farming practices is a challenging necessity in the current era of anthropogenically-driven biodiversity loss. Upland habitats created by traditional farming are havens for wildlife but face multiple threats, including overgrazing and abandonment. Extensive cattle farming in the uplands has been mooted as a useful conservation measure, but Irish evidence supporting this approach is lacking. This thesis examines home range, habitat preferences and activity budgets for Dexter cattle in an extensive upland setting in southwest Ireland. It investigates the effects of the grazing regime on EU-protected habitats and ground beetles. Free-ranging cattle grazed the site over three …

Understanding The “Gut Instinct” Of Expert Coaches During Talent Identification, Alexandra H. Roberts, Daniel Greenwood, Mandy Stanley, Clare Humberstone, Fiona Iredale, Annette Raynor

Research outputs 2014 to 2021

Coaches are an integral part of talent identification in sport and are often used as the “gold standard” against which scientific methods of talent identification are compared. However, their decision-making during this process is not well understood. In this article, we use an ecological approach to explore talent identification in combat sports. We interviewed twenty-four expert, international-level coaches from the Olympic disciplines of boxing, judo, and taekwondo (age: 48.7 + 7.5 years; experience: 20.8 + 8.3 years). Findings indicated that when coaches identify talent they rely on “gut instinct”: intuitive judgements made without conscious thought, used to direct attention to …

Socio-Hydrological Modelling To Assess Reliability Of An Urban Water System Under Formal-Informal Supply Dynamics, Rakhshinda Bano, Mehdi Khiadani, Stephen Burian Jan 2020

Socio-Hydrological Modelling To Assess Reliability Of An Urban Water System Under Formal-Informal Supply Dynamics, Rakhshinda Bano, Mehdi Khiadani, Stephen Burian

Research outputs 2014 to 2021

Increasing water scarcity in developing world cities combined with poor performance of water supply systems has led to an increasing reliance on informal water supply systems. Although the availability of informal supply provides a coping mechanism that enables water consumers to be resilient to failures in water supply, the longer-term effects on formal water supply systems (FWSS) are uncertain, with a potential reduction of tariff recovery (RT), and in turn a service provider’s financial sustainability. This motivates an analysis of the coevolving dynamics and feedbacks involved in water systems where formal and informal components co-exist. Investigating Hyderabad, Pakistan …

School Librarians As Literacy Educators Within A Complex Role, Margaret K. Merga Jan 2020

School Librarians As Literacy Educators Within A Complex Role, Margaret K. Merga

Research outputs 2014 to 2021

Librarians in schools are expected to play an important role as literacy educators, and have a positive impact on young people’s literacy learning. However in the context of their diverse workload, relatively little is known about how this aspect of their role sits within its competing demands, and the exact scope of the literacy educator requirements. Using a hybrid approach to content analysis, this article analyses 40 recent job description documents to identify the nature and prevalence of different aspects of the role, and to explore the literacy educator aspect of this profession. Findings suggest that while the literacy educator …

Research outputs 2014 to 2021

© 2020 The Author(s) In this brief correspondence, we evaluate the potential impact of pivoting from face-to-face supervised to unsupervised home-based exercise programmes to contextualise the coronavirus disease 2019 (COVID-19) pandemic in prostate cancer patients. A meta-analysis was undertaken in fatigue, quality of life, and lean and fat mass outcomes in the four studies included. Our analysis indicates that unsupervised home-based exercise maintains patient-reported outcomes, except for fat mass. In summary, changing to unsupervised exercise is unlikely to provide further benefits on patient-reported and body composition outcomes, but may help maintain initial gains during physical distancing restrictions. Patient summary: We …

Research outputs 2014 to 2021

BRAF inhibitors revolutionised the management of melanoma patients and although resistance occurs, there is a subgroup of patients who maintain durable disease control. For those cases with durable complete response (CR) it is not clear whether it is safe to cease therapy. Here we identified 13 patients treated with BRAF +/− MEK inhibitors, who cease therapy after prolonged CR (median = 34 months, range 20–74). Recurrence was observed in 3/13 (23%) patients. In the remaining 10 patients with sustained CR off therapy, the median follow up after discontinuation was 19 months (range 8–36). We retrospectively measured ctDNA levels using droplet …
