All Faculty Publications

In rural, remote, and northern parts of Canada, the pre-existing vulnerability and risk for intimate partner violence has been exacerbated by COVID-19. The purpose of this commentary is to identify the unique impact of COVID-19 on intimate partner violence both in terms of the bearing on those experiencing abuse and on the service sector in rural, remote and northern communities where the rates of intimate partner violence and intimate partner femicide pre-pandemic are higher than in larger cities. The recommendations offered in this paper include enhanced safety planning, alternate housing for victims fleeing violence, and suggestions for service providers. We …

The Value Of An Academic Law Library In The 21st Century, Anne Klinefelter Jan 2020

The Value Of An Academic Law Library In The 21st Century, Anne Klinefelter

Faculty Publications

Law school deans and university provosts may ask how law libraries can deliver value as new technologies, practices, and economic pressures inspire reassessment of legal education and of higher education more generally. The proliferation of information delivery systems, trends towards centralized management of higher education infrastructure, and changes in the law practice market suggest that the traditional law library may not meet current needs. But law libraries have the potential and opportunity to deliver strong value in this environment due largely to the sophistication of today's law librarians. The law library can be a center for expertise that can advance …

The Paradox Of Automation As Anti-Bias Intervention, Ifeoma Ajunwa Jan 2020

The Paradox Of Automation As Anti-Bias Intervention, Ifeoma Ajunwa

Faculty Publications

A received wisdom is that automated decision-making serves as an anti-bias intervention. The conceit is that removing humans from the decision-making process will also eliminate human bias. The paradox, however, is that in some instances, automated decision-making has served to replicate and amplify bias. With a case study of the algorithmic capture of hiring as a heuristic device, this Article provides a taxonomy of problematic features associated with algorithmic decision-making as anti-bias intervention and argues that those features are at odds with the fundamental principle of equal opportunity in employment. To examine these problematic features within the context of algorithmic …

The Ends And Means Of Decarbonization: The Green New Deal In Context, Jonas J. Monast Jan 2020

The Ends And Means Of Decarbonization: The Green New Deal In Context, Jonas J. Monast

Faculty Publications

Disputes about climate policy involve much more than whether or not to reduce greenhouse gas emissions. There is general agreement among proponents of climate policy that strategies should be cost effective, address distributional impacts, and incentivize investments in low-carbon technologies. Yet disagreements abound regarding additional goals of climate policy design.

Decarbonizing the economy means changing the sources of energy we use, how we transport people and products, how we produce food, and which resources we consume. Yet even among proponents of federal climate legislation there is strong disagreement regarding policy instruments. Recent proposals for a revenue-neutral carbon tax and a …

Legal Writing's Harmful Psyche, Kevin Bennardo Jan 2020

Legal Writing's Harmful Psyche, Kevin Bennardo

Faculty Publications

This essay proceeds in four parts. It first supports the descriptive claim that many in the legal writing discipline perceive themselves as victims of unfair treatment within legal academia. Second, it explores the consequences of that self-perception, including the norm of protectionism that has developed within the discipline. The narrative that legal writing professors are mistreated by those outside the discipline has resulted in an internal culture in which many members of the discipline support their own no matter what.

Third, the essay explores how such protectionism is harmful to the development of the legal writing discipline. An academic discipline …

Bot Contracts, Deborah R. Gerhardt, David Thaw Jan 2020

Bot Contracts, Deborah R. Gerhardt, David Thaw

Faculty Publications

In this Article, we explain why the transactions commonly known as “smart contracts” are better understood as “bot contracts.” Taking an interdisciplinary approach, we show why the “smart contracts” moniker is misdescriptive in two important ways. First, these transactions are automated, not smart. Second, they do not afford parties many enforcement rights and defenses that one expects from common law contractual relationships. To fully understand these transactions, it is important to appreciate how the term “smart contracts” differs from what the technology delivers.

Our review of the technology explains that these transactions have tremendous practical utility in reducing risk and …

This Article will examine the constitutionality of deceptive campaign practices acts under the First Amendment. It will also take the analysis one step further by analyzing whether Internet service providers may be held liable for the deceptive campaign messages posted by their customers and users, similar to the way that providers can be held liable for instances of copyright infringement posted by their customers and users.

Automated Legal Guidance, Leigh Z. Osofsky, Joshua D. Blank Jan 2020

Automated Legal Guidance, Leigh Z. Osofsky, Joshua D. Blank

Faculty Publications

Through online tools, virtual assistants, and other technology, governments increasingly rely on artificial intelligence to help the public understand and apply the law. The Internal Revenue Service, for example, encourages taxpayers to seek answers regarding various tax credits and deductions through its online “Interactive Tax Assistant.” The U.S. Army directs individuals with questions about enlistment to its virtual guide, “Sgt. Star.” And the U.S. Citizenship and Immigration Services suggests that potential green card holders and citizens speak with its interactive chatbot, “Emma.” Through such automated legal guidance, the government seeks to provide advice to the public at a fraction of …

Copyright Publication On The Internet, Deborah R. Gerhardt Jan 2020

Copyright Publication On The Internet, Deborah R. Gerhardt

Faculty Publications

This Article tackles the question of when a work distributed over the Internet is published as a matter of copyright law. Copyright publication doctrine retains significant practical importance and can have a dispositive impact on the economic value of a work. Publication can also determine whether a court has jurisdiction over a copyright claim. For many twentieth century works, publication with observance of formalities was required if copyrights were to attach to creative works at all. Publication remains relevant in determining the length of copyright protection, but duration is far from the only copyright issue that turns on this concept. …

“I Don’T Want To Hear Your Language!” White Social Imagination And The Demography Of Roman Corinth, Ekaputra Tupamahu Jan 2020

“I Don’T Want To Hear Your Language!” White Social Imagination And The Demography Of Roman Corinth, Ekaputra Tupamahu

Faculty Publications - Portland Seminary

This article aims to deconstruct the hidden pervasive whiteness in biblical scholarship and to propose another way to reimagine the linguistic dynamic of Roman Corinth from an Asian American perspective. It highlights the legal and historical interconnectedness of whiteness and the dominance of English. English is a critical marker of whiteness in the United States. In this context, immigrants are expected to conform to and assimilate themselves with whiteness by performing English. This particular racialized context has influenced and resulted in a scholarly historical reconstruction of immigrants in Roman Corinth as “Greek speaking im/migrants.” Immigrants can come from many different …

Odd Generalized N-H Generated Family Of Distributions With Application To Exponential Model, Zubair Ahmad, M. Elgarhy, Gholamhossein Hamedani, Nadeem Shafique Butt

Mathematical and Statistical Science Faculty Research and Publications

A new family of distributions called the odd generalized N-H is introduced and studied. Four new special models are presented. Some mathematical properties of the odd generalized N-H family are studied. Explicit expressions for the moments, probability weighted, quantile function, mean deviation, order statistics and Rényi entropy are investigated. Characterizations based on the truncated moments, hazard function and conditional expectations are presented for the generated family. Parameter estimates of the family are obtained based on maximum likelihood procedure. Two real data sets are employed to show the usefulness of the new family.

Building The Aboriginal Conference Settlement Suite: Hope And Realism In Law As A Tool For Social Change, Toby S. Goldbach Jan 2020

Building The Aboriginal Conference Settlement Suite: Hope And Realism In Law As A Tool For Social Change, Toby S. Goldbach

All Faculty Publications

In 2014, the provincial government unveiled a new courthouse in Thunder Bay, Ontario, featuring a conference area designed to emulate an Anishinaabe roundhouse. The “Aboriginal Conference Settlement Suite” epitomizes efforts to support Indigenous justice within the criminal justice system. However, despite similar efforts in the past, the circumstances of Indigenous peoples in Canada have not improved. This ongoing commitment to legal solutions is emblematic of mainstream views of law as a problem-solving instrument. Notwithstanding awareness of its failings, law reformers remain dedicated to using law as a tool for social change. Employing a case study method focusing on the new …

Watermarks In The Psu Codex Fasciculus Temporum And The Paper Trade, Christian Graham Jan 2020

Watermarks In The Psu Codex Fasciculus Temporum And The Paper Trade, Christian Graham

Extra-Textual Elements

Medieval watermarks were introduced into early printed works during the production process of the paper. It is not known exactly when or why they came into common use, but they did come to identify specific paper suppliers.

As the number of paper suppliers grew enormously in concert with the growth of popularity of printed books, identifying the watermarks of specific producers can provide the modern scholar with valuable information about an early printed work, including dating editions and providing insight into trading relationships and connections between paper-makers and printers.

This paper examines some of the watermarks present in the PSU’s …

Detailed Energy Efficiency Strategies For Converting An Existing Office Building To Nzeb: A Case Study In The Pacific Northwest, Ali Alajmi, Abby Short, Janna Ferguson, Kalina K. Vander Poel, Corey T. Griffin Jan 2020

Detailed Energy Efficiency Strategies For Converting An Existing Office Building To Nzeb: A Case Study In The Pacific Northwest, Ali Alajmi, Abby Short, Janna Ferguson, Kalina K. Vander Poel, Corey T. Griffin

Mechanical and Materials Engineering Faculty Publications and Presentations

This paper is an attempt to identify a methodology for converting conventional energy consumption buildings to net-zero energy buildings (NZEB). The first step was rather different from the usual energy audit, which is to analyze a facility’s energy consumptions from both macro- and micro-scales. To implement such an approach, a governmental office building (Metro) in Portland, OR, was chosen as a case study. After a building model was validated against a real measurement, it was then used to evaluate different energy efficiency strategies (EESs) so as to reduce the energy consumption. The EESs showed a reduction in energy use intensity …

A Dynamic Neural Network Designed Using Analytical Methods Produces Dynamic Control Properties Similar To An Analogous Classical Controller, Wade William Hilts, Nicholas Szczecinski, Roger Quinn, Alexander Hunt Jan 2020

A Dynamic Neural Network Designed Using Analytical Methods Produces Dynamic Control Properties Similar To An Analogous Classical Controller, Wade William Hilts, Nicholas Szczecinski, Roger Quinn, Alexander Hunt

Mechanical and Materials Engineering Faculty Publications and Presentations

Human balance is achieved using many concurrent control loops that combine to react to changes in environment, posture, center of mass and other factors affecting stability. Though numerous engineering models of human balance control have been tested, no methods for porting these models to a neural architecture have been established. It is our hypothesis that the analytical methods we have developed, combined with classical control techniques will provide a reasonable starting point for developing dynamic neural controllers that can reproduce classical control capabilities. In previous work, we tested this hypothesis and demonstrated that a biologically-constrained neural controller that replicates human …

Strengthening The Capacity To Serve Undocumented Students In A Rural California State University, Carlos Alvarado Sanchez Jan 2020

Strengthening The Capacity To Serve Undocumented Students In A Rural California State University, Carlos Alvarado Sanchez

Cal Poly Humboldt theses and projects

Undocumented students face many obstacles while seeking a higher education degree. As undocumented students apply and are accepted to colleges and universities, they should have the means and resources to complete their higher education degree like all students. An array of strategies can be considered and implemented to have educators and school administrators in higher education be better equipped to serve all students, but specifically undocumented students.

Educators and administrators could continue their acquisition of knowledge base and comfortability about the different implications that surround undocumented students. Therefore, this thesis seeks to examine the efficacy of self-reports on a pre- …

Habitat Use And Prey Selection By Mountain Lions In An Altered Sagebrush Steppe Environment, Jonathan Ewanyk Jan 2020

Habitat Use And Prey Selection By Mountain Lions In An Altered Sagebrush Steppe Environment, Jonathan Ewanyk

Cal Poly Humboldt theses and projects

Throughout the American West there is an increasing trend of encroachment of woody vegetation on previously open sagebrush steppe habitat. The Modoc Plateau in northeastern California has not been excluded from this encroachment trend and has seen an increase in western juniper (Juniperus occidentalis) densities, likely as a result of long-term fire suppression. Mountain lions (Puma concolor) have not previously been studied on the Modoc Plateau, and there is potential for an increase in cover due to juniper encroachment to benefit the hunting behavior of lions. To better understand if the presence of cover is being …

Multiple Criteria Decision-Making Approach To Support Timber Transportation Planning – Case Study In Brazil, Marinna Lopes Ferreira Gomes Jan 2020

Multiple Criteria Decision-Making Approach To Support Timber Transportation Planning – Case Study In Brazil, Marinna Lopes Ferreira Gomes

Cal Poly Humboldt theses and projects

Timber transportation is one of the costliest activities for a forest company in Brazil and in many other countries, and it is a determining factor for the success of the forest enterprise. Thus, decision support tools are commonly used as methods to reduce these costs. The purpose of this study was to develop and analyze mathematical models to define the weekly timber transport schedule based on the monthly demands of the customers. The goal is to minimize the operational costs of forest transportation related to distances, timber freshness and road qualities. The decision process was made in two steps; the …

Effects Of Multiple Stressors: Hydroperiod, Introduced Bullfrogs, And Food Limitation On Northern Red-Legged Frogs (Rana Aurora), Lindsey L. Gordon Jan 2020

Effects Of Multiple Stressors: Hydroperiod, Introduced Bullfrogs, And Food Limitation On Northern Red-Legged Frogs (Rana Aurora), Lindsey L. Gordon

Cal Poly Humboldt theses and projects

As human activities reach every corner of the globe, climate change, invasive species, habitat destruction, and other stressors causing species’ declines no longer act alone. Climate change has the potential to exacerbate (or mitigate) other stressors (e.g. invasive species or pathogens) affecting amphibian populations. I assessed the combined effects of increased pond drying rates (potential impact of climate change), invasive bullfrogs (Lithobates catesbeianus) presence, and food availability on northern red-legged frog (Rana aurora) survival and body size after metamorphosis by rearing tadpoles under incrementally shortened hydroperiods with and without the presence of invasive bullfrog tadpoles in …

Ethnic Identity And Stress Appraisal As Acculturative Stress Processes Among Armenian Americans, Tsolak Michael Kirakosyan Jan 2020

Ethnic Identity And Stress Appraisal As Acculturative Stress Processes Among Armenian Americans, Tsolak Michael Kirakosyan

Cal Poly Humboldt theses and projects

The current study examined the role of ethnic identity and stress appraisal as buffers of the relationship between acculturative stress and wellbeing in a national sample of Armenian American adults between eighteen and thirty-nine years old (N = 159; 62.89% women, 32.08% men; mean age = 25.59, SD = 5.30). Acculturative stress positively correlated with depressive symptoms, and negatively with self-esteem and positive stress appraisal. Stronger ethnic identity affirmation and belonging was related to less depressive symptoms, more positive stress appraisal, and greater self-esteem and life satisfaction. In hierarchical linear regression analyses, acculturative stress significantly predicted more depressive symptoms, …

The Ability Of Fragmented Kelp Forests To Mitigate Ocean Acidification And The Effects Of Seasonal Upwelling On Kelp-Purple Sea Urchin Interactions, Kindall A. Murie Jan 2020

The Ability Of Fragmented Kelp Forests To Mitigate Ocean Acidification And The Effects Of Seasonal Upwelling On Kelp-Purple Sea Urchin Interactions, Kindall A. Murie

Cal Poly Humboldt theses and projects

Bull kelp (Nereocystis leutkeana) forests along the coast for northern California have decreased dramatically as a result of a ‘perfect storm’ of multiple environmental stressors. The disappearance of a predatory sea star and subsequent increase in purple sea urchins (Strongylocentrotus purpuratus) and the recurrence of marine heat waves have caused these once diverse ecosystems to be rapidly converted into relative species-depauperate urchin barrens. By examining the interactive effects of both a rapidly changing abiotic environment and the increase in urchin grazing pressure that is affecting this vital ecosystem, we can better understand its ultimate fate and …

Apparent Survival Of Snowy Plovers Varies Across Years And Between Sexes In Coastal Northern California, Justin A. Windsor Jan 2020

Apparent Survival Of Snowy Plovers Varies Across Years And Between Sexes In Coastal Northern California, Justin A. Windsor

Cal Poly Humboldt theses and projects

Adult survival is one of the most influential vital rates affecting population growth of iteroparous organisms. Survival often varies annually due to environmental stochasticity. However, drastic variations in annual adult survival rates can have overwhelmingly negative impacts on population viability and growth. In many wild avian populations, adult survival varies between sexes and may owe to unequal risks associated with reproductive roles or predation; this is particularly true among shorebirds. I used mark-resight data from a 19-year study of Western Snowy Plovers (Charadrius nivosus nivosus) in coastal northern California to investigate sex-specific apparent survival of the adult population …

Making Connections To The Filipino American Community Using Culturally Responsive Music Pedagogy, Jared Thomas Coyle Jan 2020

Making Connections To The Filipino American Community Using Culturally Responsive Music Pedagogy, Jared Thomas Coyle

Cal Poly Humboldt theses and projects

Positive connections between school and home have been shown to increase student achievement. Currently there are few resources available in the United States that allow teachers to incorporate aspects of Filipino American culture into their instruction practices. Through the use of traditional children’s songs and singing games, the K-6 classroom music curriculum can serve as an effective vehicle to establish these connections.

In interviews with members of the California Filipino American community, we discussed the musical culture of the Philippines. Informants shared how musical traditions are transmitted and shared in the Philippines and United States. Participants also discussed possible ways …

Assessing Convergent Validity Of The Qabf And Tbh Fa Intake Form With Results Of A Functional Analysis, Melissa Cisneros Jan 2020

Assessing Convergent Validity Of The Qabf And Tbh Fa Intake Form With Results Of A Functional Analysis, Melissa Cisneros

Cal Poly Humboldt theses and projects

The current study looked to compare and analyze the convergent validity of the Questions About Behavioral Function (QABF) with Trumpet Behavioral Health’s current form, the Functional Assessment Intake Form. Both forms were compared with results gathered from a functional analysis conducted on individuals with identified challenging behaviors (e.g. body dropping and self- injurious behaviors). A multi-element design was used to conduct a functional analysis, and identified functions from the indirect assessments were compared to the results found in the functional analysis. Results indicated that there was no correspondence between the indirect assessments used with the results from the functional analysis. …

Phylogenetic And Population Genetic Analysis Of The Humboldt's Flying Squirrel Using High-Throughput Sequencing Data, Stella Chi Yuan Jan 2020

Phylogenetic And Population Genetic Analysis Of The Humboldt's Flying Squirrel Using High-Throughput Sequencing Data, Stella Chi Yuan

Cal Poly Humboldt theses and projects

The intraspecific genetic variation and diversity within the Humboldt’s flying squirrel (Glaucomys oregonensis) has not yet been characterized despite its elevation to full species in 2017. The San Bernardino flying squirrel (G. o. californicus) is thought to be the southernmost population of G. oregonensis and is restricted to the San Bernardino and San Jacinto Mountains in California, but recent surveys indicate they have been extirpated from the latter locality. In order to provide baseline genetic data across the geographic range of G. oregonensis, I had the following objectives: 1) investigate the intraspecific molecular variation in …

Estimates Of Calf Survival And Factors Influencing Roosevelt Elk Mortality In Northwestern California, Erin Nigon Jan 2020

Estimates Of Calf Survival And Factors Influencing Roosevelt Elk Mortality In Northwestern California, Erin Nigon

Cal Poly Humboldt theses and projects

Survival of juvenile ungulates is known to be highly variable, yet it is fundamental to understanding the dynamics and trends of wildlife populations. Factors influencing calf survival are poorly understood in northwestern California where Roosevelt elk (Cervus canadensis roosevelti) are known to exist. The objectives of this study were 1) to estimate summer and annual survival rates and determine recruitment rates for Roosevelt elk calves in the area, 2) to evaluate differences in calf survival by examining the effects of individual and population level covariates on summer and annual calf survival, 3) to identify factors influencing the timing …
