This Article presents a mixed-methods study of misdemeanor bail practice across Georgia in the wake of reform. We observed bail hearings and interviewed system actors in a representative sample of fifty-five counties in order to assess the extent to which pretrial practice conforms to legal standards clarified in Senate Bill 407 and Walker v. Calhoun. We also analyzed jail population data published by county jails and by the Georgia Department of Community Affairs. We found that a handful of counties have made promising headway in adhering to law and best practices, but that the majority have some distance to …

Tools For Regulators In A Changing Climate: Proposed Standards, State Policies, And Case Studies From The Western Grid, Adam D. Orford

Scholarly Works

With climate change a present reality, governments are confronting the need to adapt their regulatory planning processes to withstand new and uncertain climate risks. This Article provides three new resources to support this essential work. First, it develops a new standard for assessing the quality of climate adaptation decisionmaking, focusing on defining the problem, quantifying adaptation benefits, and evaluating equitable distribution of risk. Second, it reviews California's climate adaptation policy development efforts between 1988 and 2018-from the state's early efforts to study the problem, to later attempts at statewide strategic planning, until more recent work to integrate adaptation into existing …

Environmental Law, Travis M. Trimble Jan 2020

Environmental Law, Travis M. Trimble

Scholarly Works

Notable cases decided in the United States Court of Appeals for the Eleventh Circuit in 2019 all arose out of disputes that originated under the Clean Water Act (CWA). The Eleventh Circuit held that, in preparing an Environmental Impact Statement (EIS) in connection with its decision to issue a dredge and fill permit under Section 404 of the CWA, the Corps of Engineers (Corps) was not required to consider potentially negative environmental effects resulting from activity made possible by the permit where the agency had no authority independently to regulate the effects. The court also held that the Environmental Protection …

The Modern Fight For Media Freedom In The United States, Jonathan Peters Jan 2020

The Modern Fight For Media Freedom In The United States, Jonathan Peters

Scholarly Works

The First Amendment as a subject is challenging and provocative, and scholarly and popular understandings of it are changing. New communication technologies are pushing lawyers, judges, and scholars to revisit, and sometimes rethink, old legal doctrines and concepts. In the area of privacy, we have to think today about encryption and a website's terms of service. In the area of copyright, we have to think about peer-to-peer file sharing and the licenses granted by iTunes. In the area of sexual expression, we have to think about sexting, revenge porn, and deep fakes.'

This is the emerging state of play for …

The best piece of advice I received when I began teaching law was to adopt Charlie Sullivan's and Mike Zimmer's casebook for my Employment Discrimination class. Before I became a law professor, I had no clue how important choosing the right textbook is, not only for the students but for the teacher. I also was unaware of how much I had to learn about a subject I thought I knew well. I had been litigating employment discrimination cases for several years, but when I began teaching, I quickly learned how much I did not know. Charlie's and Mike's casebook, through …

Chevron Abroad, Kent H. Barnett, Lindsey Vinson Jan 2020

Chevron Abroad, Kent H. Barnett, Lindsey Vinson

Scholarly Works

This Article presents our comparative findings of how courts in five other countries review agency statutory interpretation. These comparisons permit us to understand and participate better in current debates about the increasingly controversial Chevron doctrine in American law, whereby courts defer to reasonable agency interpretations of statutes that an agency administers. Those debates concern, among other things, Chevron 's purported inevitability, functioning and normative propriety. Our inquiry into judicial review in Germany, Italy, the United Kingdom, Canada, and Australia provides useful and unexpected findings. Chevron, contrary to some scholars' views, is not inevitable because only one of these countries has …

The Concept Of Criminal Law, Sandra Mayson Jan 2020

The Concept Of Criminal Law, Sandra Mayson

Scholarly Works

What distinguishes “criminal law” from all other law? This question should be central to both criminal law theory and criminal justice reform. Clarity about the distinctive feature(s) of criminal law is especially important in the current moment, as the nation awakens to the damage that the carceral state has wrought and reformers debate the value and the future of criminal law institutions. Foundational though it is, however, the question has received limited attention. There is no clear consensus among contemporary scholars or reformers about what makes the criminal law unique. This Essay argues that Antony Duff’s The Realm of Criminal …

Judicial Adjuncts In Multidistrict Litigation, Elizabeth Chamblee Burch, Margaret S. Williams Jan 2020

Judicial Adjuncts In Multidistrict Litigation, Elizabeth Chamblee Burch, Margaret S. Williams

Scholarly Works

Peeking under the tent of our nation's largest and often most impactful cases reveals that judges often act like ringmasters: They delegate their authority to a wide array of magistrate judges, special masters, and settlement administrators. Some, like the American Bar Association, see this as a plus that promotes efficiency and cost savings. Critics, however, contend that delegating judicial power especially to private citizens, removes adjudication from public scrutiny, injects thorny ethical questions about ex parte communications, and risks cronyism and high costs. By constructing an original dataset of ninety-two multidistrict products liability proceedings centralized over fourteen years, we introduce …

Using Prosody To Spot Location Mentions, Gerardo Cervantes Jan 2020

Using Prosody To Spot Location Mentions, Gerardo Cervantes

Open Access Theses & Dissertations

Identifying location mentions in speech is important for many information retrieval and information extraction tasks; here I explore the use of prosody for location spotting. While previous work has explored the use of prosody for spotting named entities, including locations, the specific value of prosody for finding locations in spontaneous speech has not been measured. Using the Switchboard corpus and LSTM modeling I obtain results indicating that prosody is useful in spotting location mentions. Further, I identify specific prosodic

features that tend to mark locations in American English.

Predicting Competency In Motivational Interviewing Through An Objective Empathy Task, Kylah Moneek Clark Jan 2020

Predicting Competency In Motivational Interviewing Through An Objective Empathy Task, Kylah Moneek Clark

Open Access Theses & Dissertations

In the process of disseminating motivational interviewing (MI) it is important to identify who benefits from initial workshops and which trainees would benefit from an extended training model that involves coaching and performance feedback, which has recently been advocated. Prior research attempting to determine who benefits from training has failed to show associations between baseline self-reported empathy and training outcomes. However, the use of an objective empathy task may address the shortcoming of prior research. The purpose of the present study was to predict competency in motivational interviewing skills following training using an objective empathy task. In addition, we investigated …

Open Access Theses & Dissertations

Around 80 percent of undergraduates enrolled in U.S. higher education institutions are employed (Carnevale et al., 2015; Kena, Musu-Gillette, Robinson, Wang, Rathbun, Zhang, & Velez, 2015). Research shows that student employment is one of the most critical activities that affect students' post-secondary experiences and decisions while enrolled (Pascarella & Terenzini, 2005; Perna 2010; Riggert et al., 2006; Tinto, 1993). The present study aimed at understanding how employing organizations and workplace environments of first-generation Latinx on-campus student employees influenced their ability to build social capital and navigate through higher education.

A social capital lens was used to help understand student participants' …

Uranium Series Dating And Geochemistry Of Fault Zone Precipitated Secondary Carbonates: Insights Into Paleo Fluid Sources, Tectonics And Climate In The Rio Grande Rift, Victor Higareda Garcia Jan 2020

Uranium Series Dating And Geochemistry Of Fault Zone Precipitated Secondary Carbonates: Insights Into Paleo Fluid Sources, Tectonics And Climate In The Rio Grande Rift, Victor Higareda Garcia

Open Access Theses & Dissertations

Fault zones in the shallow crust impact a variety of geological processes including mineral deposition, fluid flow patterns in shallow and deep groundwater aquifers, and most importantly seismic activity. The specific interplays of fault zones, seismicity, and groundwater flows are complex and not well understood despite the importance they have to society. The Rio Grande rift is a region impacted by seismic and volcanic activity that place the first order control on mineral formation and fluid flow patterns. It is also a region that is often disregarded as a seismic hazard due to its inferred low tectonic rates and long …

Independent And Simultaneous Control Of Electromagnetic Wave Properties In Self-Collimating Photonic Crystals Using Spatial Variance, Jesus Javier Gutierrez Jan 2020

Independent And Simultaneous Control Of Electromagnetic Wave Properties In Self-Collimating Photonic Crystals Using Spatial Variance, Jesus Javier Gutierrez

Open Access Theses & Dissertations

Photonic crystals are engineered periodic structures that provide great control over electromagnetic waves. One of these mechanisms is self-collimation, in which the electromagnetic wave travels through the photonic crystal along an axis of the lattice without diffracting or spreading. This mechanism of self-collimation is a dispersion phenomenon, which is dependent on the unit cell's physical and geometrical characteristics. An algorithm for generating spatially variant lattices (SVL) was developed that can change geometrical properties in photonic crystals as a function of position, like unit cell orientation, fill fraction, symmetry, and others in a manner that is smooth, continuous, and virtually free …

Self-Similar Models: How Close The Diffusion Entropy Analysis And The Detrended Fluctuation Analysis Are From Other Models, William Kubin Jan 2020

Self-Similar Models: How Close The Diffusion Entropy Analysis And The Detrended Fluctuation Analysis Are From Other Models, William Kubin

Open Access Theses & Dissertations

Financial and seismic data, like many other high frequency data are known to exhibit memory effects. In this research, we apply the concepts of L ́evy processes, Diffusion Entropy Analysis (DEA) and the Detrended Fluctuation Analysis (DFA) to examine long-range persistence (long memory) behavior in time series data. L ́evy processes describe long memory effects. In other words, L ́evy process (where the increments are independent and follow the L ́evy distribution) is self-similar. We examine the relationship between the L ́evy parameter (α) characterizing the data and the scaling exponent of DEA (δ) and that of DFA (H) characterizing …

Self-determination theory (SDT) provides a potentially useful framework to understand motivations for responsible drinking, which is operationalized in the present study as PBS use. In the present study, the relation of motivations for responsible drinking, as assessed by the Treatment Self-Regulation Questionnaire (TSRQ), with other SDT constructs (psychological need satisfaction and dispositional autonomy) and PBS use, alcohol use, and alcohol-related problems were examined among college students drinkers. A sample of 507 college students who reported consuming alcohol at least …

Bio-Inspired Method For Close-Proximity Operations On A Near-Earth Asteroid, Rene Alberto Valenzuela Najera Jan 2020

Bio-Inspired Method For Close-Proximity Operations On A Near-Earth Asteroid, Rene Alberto Valenzuela Najera

Open Access Theses & Dissertations

Space maneuvers in the vicinity of small celestial bodies and achieving a soft landing over the surface of small celestial bodies are essential movements to advance the status of exploration, collection of geographical data, measurement of physical properties among other on-orbit tasks. Before a spacecraft reaches hovering position over an asteroid in order to perform orbital tasks, close-proximity operations must be done. Since the movements of the spaceships depend on the acceleration forces provided by the thrusters and external disturbances forces, the correct planning of execution of the close-up trajectories on the celestial body orbit and trajectory to land on …

A Hermeneutic For The Aqedah Test: A Way Beyond Jon Levenson's And Terence Fretheim's Models, Arlyn Sunshine Drew

Dissertations

Problem

The works of Jon Levenson and Terence Fretheim highlight the problem of determining which interpretations of the biblical worlds of meaning around the text are congruent with the text of the Aqedah (also known as the Sacrifice of Isaac, Genesis 22: 1-19) and which should be disclaimed. A hermeneutical model is needed for Abraham's test that provides a text-based paradigm for sound interpretation of the narrative world (in the text), the historical world (behind the text), the theistic world (above the text), the cosmological world (below the text), and the present world (in front of the text).

A Re-Examination Of Pentateuchal Hamartiology And Atonement As A Hermeneutical Framework For Interpreting The Laying On Of Hands, Slavisa Milodar Jankovic

Dissertations

The ritual gesture of laying on of hands in Scripture has generated significant interest among theologians from rabbinic times until now. Still today, scholars assign various meanings to the ritual. In the second half of the 20th century, the fresh interest that put forward new meanings for this gesture came primarily through the introduction of the new sub-discipline of Ritualistics within Old Testament studies. This relatively new discipline is not founded upon premises found in biblical texts, but rather, upon those found in various secular social, philosophical sciences, and other disciplines such as sociology, philosophy, anthropology, literary criticism, and the …

Select entrepreneurs are successful for a reason. One reason being, they have been able to use their skills to execute during times of chaos and panic, sometimes using these times as an opportunity to identify and exploit new or existing opportunities. Now and then, the external business environment changes in a manner that was never imagined or planned, therefore creating unintended impacts or new opportunities. During times of chaos, will these entrepreneurs pursue newly present opportunities that were not planned, or will they stick to their comfort zone? While several studies have been conducted looking at the characteristics of the …

Economic Strength And Micropolitan Statistical Areas: Looking Beyond Generalities, W. Frank Thompson Jr., Ayesha Tariq, Connie Nott

Atlantic Marketing Journal

Facility location decisions serve an important role in setting up efficient and cost-effective supply chains. While metropolitan areas may appear an obvious choice for many companies, nonmetropolitan areas deserve consideration. In the past, nonmetropolitan areas have been broadly classified as “rural” with reports of economic decline. This research looks beyond the general category of nonmetropolitan by dividing the area into micropolitan statistical areas and non-core statistical areas. The authors use U.S. Census data from the years 2010 to 2016 to analyze changes in population, median household income, retail employment, and retail salaries in Alabama, Georgia, and Mississippi. Companies can use …
