Choice Of Law In Takings Cases, Thomas W. Merrill Jan 2019

Choice Of Law In Takings Cases, Thomas W. Merrill

Faculty Scholarship

This Article considers what law should apply in resolving subsidiary questions that arise in the course of deciding takings cases under federal constitutional law. It argues that there are three choices: federal constitutional law, state law, or a federal-patterning definition that lays down certain general parameters as a matter of federal constitutional law but otherwise follows state law if it is consistent with these parameters. The article illustrates these choices by considering a recent Supreme Court decision, Murr v. Wisconsin, which held that the horizontal dimensions of a “parcel of land” should be determined, for takings purposes, as a …

The Price Isn't Right: How Libraries Can Overcome The Invisible Cost Of Education, Krystie Wilfong, Christina Bell, Zane Omohundro Jan 2019

The Price Isn't Right: How Libraries Can Overcome The Invisible Cost Of Education, Krystie Wilfong, Christina Bell, Zane Omohundro

ILS Scholarship

The rising cost of textbooks is a growing concern among students, faculty, and administrators at institutions across the country. According to the College Board, the average student spends approximately $1,200 per year on textbooks and supplies. This price point can be a roadblock for many students and can potentially change the course of their academic pursuits. Certain disciplines have higher material costs, which can impact student retention and success in those fields.

Reserve programs are a common occurrence in academic libraries, however variable and non-standard. Historically, few libraries purchase textbooks for reserves given their high cost and frequent edition revisions. …

Complete Mitochondrial Genome Of Callogorgia Cf. Gracilis (Octocorallia: Calcaxonia: Primnoidae), Erin E. Easton, David Hicks

School of Earth, Environmental, & Marine Sciences Faculty Publications

We report the first complete mitochondrial genome of Callogorgia. Callogorgia cf. gracilis isolate DFH32_518B was collected by a remotely operated vehicle at 98 m on McGrail Bank (27.9840725°N, 92.604242°W). The complete mitogenome is 18,937 bp (27.8% A, 18.3% C, 19.8% G, and 34.1% T) and has the ancestral octocoral gene order for its 14 protein-coding genes, two rRNA genes, and one tRNA gene. It is sister to and ∼96.6% similar (uncorrected) to Narella hawaiiensis, the only other complete mitogenome reported for Primnoidae. The cox1 + igr1 + mtMutS region differs by two base pairs (0.12%) from the only reported …

A High-Latitude, Mesophotic Cycloseris Field At 85 M Depth Off Rapa Nui (Easter Island), Bert W. Hoeksema, Javier Sellanes, Erin E. Easton

School of Earth, Environmental, & Marine Sciences Faculty Publications

Published records of mesophotic zooxanthellate corals from Rapa Nui (Easter Island) are rare and so far based only on dredged specimens and observations during scuba dives (Wells 1972, Glynn et al. 2003, 2007). During recent remotely operated vehicle (ROV) surveys off Rapa Nui (March 2016), a large and dense aggregation of zooxanthellate Cycloseris corals (Scleractinia: Fungiidae) with a density of approximately 500 ind m−2 was discovered (27°08΄55˝S, 109°26΄46˝W) on black sand in a depth range of approximately 79–85 m (Panels A, B). A few corals were overturned, exposing their white (azooxanthellate) undersides and sutures along which self-fragmentation took place (Panel …

His Friend Judas: Why Didn't He Betray His Messiah?, Trevan Hatch Jan 2019

His Friend Judas: Why Didn't He Betray His Messiah?, Trevan Hatch

Faculty Publications

A question that Christians might ask is, if Jesus was so entrenched within and embracive of Judaism, then why did he condemn Jewish leaders and why was he ultimately rejected and killed by his fellow Jews? In this and the next four chapters (chapters 6–10) we will challenge the assumptions of that very question and illustrate that “the Jews” did not reject and kill Jesus, and that Jesus did not reject and condemn “the Jews.” We will explore the relationship between Jesus and his peers. We start in this chapter by looking at Judas, whose story is perhaps Exhibit A …

EKU Faculty and Staff Scholarship

The island of Pantelleria is one of the best known localities of bimodal mafic-felsic magmatism (alkali basalt and trachyte-pantellerite). Among the felsic rocks, the coexistence in a single eruption of products of both trachyte and pantellerite compositions is limited to few occurrences, the Green Tuff (GT) ignimbrite being one of these. The GT is compositionally zoned from pantellerite (70.1 wt% SiO2, mol Na+K/Al = 1.86, 1871 ppm Zr) at the base to crystal-rich (>30 vol%) comenditic trachyte (63.4 wt% SiO2, mol Na+K/Al = 1.10, 265 ppm Zr) at the top, although the pantellertic compositions dominate the erupted volume. We …

Hardball And/As Anti-Hardball, David E. Pozen Jan 2019

Hardball And/As Anti-Hardball, David E. Pozen

Faculty Scholarship

Talk of constitutional hardball is in the air. Ever since Brett Kavanaugh’s confirmation to the Supreme Court, liberal commentators have been pondering tactics such as impeachment, jurisdiction stripping, and especially “packing the court” to a degree that would have been unthinkable a few years ago. Senate Republicans have played vigorous hardball on Supreme Court appointments in the past two Congresses, most obviously by refusing to consider Merrick Garland’s nomination, and there is a strong desire among many Democrats to respond with equal or greater vigor.

© 2019 The Authors. Published by Elsevier B.V. Growing threats and attacks to online banking security (e.g. phishing, identity theft) motivates most banks to look for and use stronger authentication methods instead of using a normal username and password authentication. The main objective of the research is to identify the most common online authentication methods used widely in international banks and compare it with the methods used in six banks operating in UAE. In addition, this research will cover the current authentication threats and attacks against these methods. Two well-defined comparison matrices [15], one based on characteristics and second one …

Violence Is As American As Cherry Pie: Mass Incarceration And Juvenile Violence, Stephen C. Stanko, Gordon A. Crews Jan 2019

Violence Is As American As Cherry Pie: Mass Incarceration And Juvenile Violence, Stephen C. Stanko, Gordon A. Crews

Criminal Justice Faculty Publications

The purpose of this chapter is to offer “food for thought” regarding an under researched area of juvenile violence causation: the possible connection between steadily increasing incarceration rates and steadily increasing incidents of school violence. Unfortunately, the negative, and sometimes violent, traits individuals develop while incarcerated are often brought out into their lives in society and personal lives, which often involve the raising of children. Research has documented the impacts that being incarcerated can have upon an individual. There is growing research supporting that these newly developed traits and behaviors can easily be imbedded in the children in which they …

Sex, Drugs, And Rock 'N' Roll: What Shall We Ban Next?, Gordon A. Crews, Samantha Leigh Crews

Criminal Justice Faculty Publications

Music, literature, movies, and all forms of entertainment play an important role in the socialization of adolescents. Present everywhere and easily available, this allows children almost limitless access to questionable entertainment alone or with friends. Parents are unaware of the content of what their children are absorbing because of the use of downloaded music, videos, and literature, and the use of headphones. Research on popular culture/entertainment has explored its effects on schoolwork, social interactions, and particularly behavior. Lyrics have become more explicit in their references to drugs, sex, and violence over the years, particularly in certain genres. And, in turn, …

When A Little Goes A Long Way: Expanding Home Care Services To Adults With Disabilities, Serena Hasworth, Jaclyn Winfree, Ozcan Tunalilar, Diana L. White

Institute on Aging Publications

Policy makers are increasingly interested in reducing public spending while maintaining quality of life. Since 1975, Oregon Project Independence (OPI) has supported community-based adults aged 60 and older to avoid or delay the need for residential long-term care services by increasing access to personal and home care services. The program also aims to prevent the need for Medicaid by optimizing personal resources and natural supports. In 2014, the OPI Expansion (OPI-E) pilot project began to serve adults aged 18-59 with disabilities in seven of Oregon’s seventeen Area Agencies on Aging (AAAs). This poster describes the evaluation of the expansion using …

Indirect Relatedness, Evaluation, And Visualization For Literature Based Discovery, Sam Henry Jan 2019

Indirect Relatedness, Evaluation, And Visualization For Literature Based Discovery, Sam Henry

Theses and Dissertations

The exponential growth of scientific literature is creating an increased need for systems to process and assimilate knowledge contained within text. Literature Based Discovery (LBD) is a well established field that seeks to synthesize new knowledge from existing literature, but it has remained primarily in the theoretical realm rather than in real-world application. This lack of real-world adoption is due in part to the difficulty of LBD, but also due to several solvable problems present in LBD today. Of these problems, the ones in most critical need of improvement are: (1) the over-generation of knowledge by LBD systems, (2) a …

The Nail That Sticks Up Isn't Always Hammered Down: Women, Employment Discrimination, And Litigiousness In Japan, Kristen Luck

Theses and Dissertations

Much recent scholarship is devoted to projecting Japan’s future and analyzing its prospects as a global power. After two decades of economic stagnation, alarming demographic trends, and the 3/11 triple disaster, some scholars argue that Japan is grappling with an era of precarity, marked with instability and anxiety. Prime Minister Shinzo Abe returned to office in 2012, promoting his economic reform policy, “Abenomics” and within the third “arrow" of this approach targeting structural reforms, he promoted “womenomics”, a term coined by Kathy Matsui of Goldman-Sachs. Prime Minister Abe’s objective is to create a society where "women can shine” and women …

Effects Of Reference Image Selection On The Alignment Of Free-Breathing Lung Cancer Patients During Setup Imaging: Average Intensity Projection Versus Mid-Ventilation, Samantha Conrad Jan 2019

Effects Of Reference Image Selection On The Alignment Of Free-Breathing Lung Cancer Patients During Setup Imaging: Average Intensity Projection Versus Mid-Ventilation, Samantha Conrad

Theses and Dissertations

Abstract

Purpose: The purpose of this paper is to quantify if using an average intensity projection (AIP) scan or a 30% phase (mid-ventilation surrogate, MidV) scan as the reference image for patient position verification affects reproducibility of lung cancer patient alignment under free-breathing cone beam computed tomography (CBCT) image guidance and to analyze the effects of common clinical issues on registration variability.

Methods: AIPs were retrospectively created for 16 lung patients (14 SBRT, 2 conventional treatments) originally planned/treated using the 30% phase MidV surrogate scan as reference. The study included 3-5 CBCTs from each patient. Registrations were performed …

Aeg-1 Knockout Sensitizes Hepatocellular Carcinoma (Hcc) Cells To Ionizing Radiation, Maheen Khan

Theses and Dissertations

Liver cancer is the fourth leading cause of cancer-associated deaths globally, and among primary liver cancers, hepatocellular carcinoma (HCC) encompasses 75-85% of all cases. HCC is a highly lethal disease due to limited treatment options – only a small subset of patients qualify for surgical resection or transplantation; the remaining patients often display resistance to radiation therapy or chemotherapy. Overexpression of the oncogene astrocyte elevated gene-1 (AEG-1) is associated with poorer survival and increased tumor recurrence in HCC, and numerous studies show its role in initiation of hepatocarcinogenesis. A prior study also demonstrated AEG-1 expression inhibits senescence by diminishing the …

Regenerative Potential Of Mesenchymal Stem Cell Derived Exosomes, Andrew P. Wong Jan 2019

Regenerative Potential Of Mesenchymal Stem Cell Derived Exosomes, Andrew P. Wong

Theses and Dissertations

Bone defects are a pervasive complication arising from many clinical conditions, both mechanical and pathological. Current treatments for large bony defects focus on applying bone grafts or synthetic materials to the defect area. Cell-based—and especially stem-cell—therapies have advanced greatly thanks to increasing attention focused on their ability to generate new tissues in situ with biomechanical properties approaching that of native tissue, but they suffer from their own shortcomings as well. Exosomes have been shown to play critical roles in cell-signaling and tissue regeneration and are therefore potentially ideal therapeutic vehicles for treating bone defects. Exosomes are small microvesicles counted amongst …
