Pace International Law Review

International economic agreements increasingly touch on fundamental principles of corporate governance. The trend contrasts with existing scholarship, which assumes corporate law evolves via domestic mechanisms. This Article introduces the EU-Japan Economic Partnership Agreement, with its dedicated chapter on corporate governance, as a case study. At the normative level, the emergence of corporate governance in international agreements represents a positive development by enabling countries to signal and put into action commitments for better governance. Given these recent developments, the field of comparative corporate governance should incorporate international agreements as an emerging source of law.

Similar to most international and hybrid criminal tribunals, the International Criminal Tribunal for the former Yugoslavia used the doctrine or theory of Joint Criminal Enterprise (JCE) as a mode of liability when prosecuting and convicting those most responsible, namely, state and non-state political and military leaders, in cases of international crimes. Against such background, the main research questions of this article are whether JCE should be applied in cases of those most responsible for international crimes and whether JCE should be replaced by the “control over the crime” approach. Paul Otlet (1868-1944) has left information science a vast written legacy. He imagined future developments of documentation around new devices. His anticipations have attracted some misunderstandings and criticism. Otlet’s more daring projections were considered utopian but they are best studied in the historical context of his time. We present the relationship between the concepts of documentation and hyperdocumentation, the ultimate prospect of documentation, and the proximity between Otlet’s work and current conceptions of transhumanism in view of his Mundaneum project.

Agricultural Service Firms: Organizational Characteristics And Linkages To Production Agriculture, Thomas A. Lyson

Using data from the 1978 Census of Agriculture and the 1978 Census of Agricultural Services, this paper examines some of the organizational characteristics of firms in seven agricultural service industry subgroups. Using the 48 contiguous states as units of analysis, an ecological analysis attempts to identify structure characteristics of farm systems that give rise to, and foster development of, off-farm agricultural service firms. Results show that considerable variation exists in the organizational and labor force characteristics across the seven industry subgroups. This study presents a broader construct of ethical leadership as an alternative to existing understanding of the term. The study divides the existing literature into classical and contemporary thoughts. The study brings forth limitations of the existing classical conceptualization based on several shortcomings. Synthesis and development of existing studies lead to a broader narrative that essentially addresses the limitations posed in this study. This broader viewpoint is based on the categorization of ethical theories by Van Wart (2014). Online education with its asynchronous nature and adult student populations need to hold faculty accountable for student performance in the classroom. This case study examined the effect of enhanced faculty requirements developed for online teaching on student academic performance and satisfaction. Using a Multimodal Critical Discourse Study (MCDS), the research explores the HRE discourse proposed by the Defensoría del Pueblo de Ecuador (DPE), the National Human Rights Institution (NHRI) in charge of designing, approving and implementing contents, methodologies and resources of HRE initiatives nationwide. It suggests that through the communication platform of the environmental documentary, environmental education can further one's understanding of the environment and the human relationship with nature. Almost three quarters of American college students use loans to fund their college education, although according to public discourse student debt is a critical problem. Grounded in social reproduction theory and consumer socialization theory this study examines the influence of financial literacy on students’ college financing decisions, perceptions of student loan debt, and education-related behavior. A sample of 429 undergraduate students selected using systematic cluster sampling from a large public university in the southeast completed a survey containing closed and open ended questions. Participants reported moderate levels of financial literacy (72.3%) and student loan awareness (62.7%). Only 20% of students …

In the midst of political turmoil surrounding the Portuguese Revolução dos Cravos (Carnation Revolution), Sophia de Mello Breyner Andresen wrote the anthology O Nome das Coisas [“The Name of Things”] (1977). With this historically significant period as the background of her poetry, Andresen addresses the politics of the time with repeated metaphor, particularly the symbol of paper in various forms, such as a poster or a blank page. In Nuclear Deviance, the author analyzes why some states are harshly treated by the nonproliferation regime, while others are granted exceptionalism in the existing nuclear order. Michal Smetana, with a new theory of nuclear deviance, describes a complex relationship of stigma politics with power and poses an interesting question for scholars to analyze if “deviance” is a neutral concept. Impact Of Ischemic Time On Functional Exercise Capacity After Orthotopic Heart Transplantation, Katelyn D. Brown

Purpose: Ischemic time (IT) is an independent risk factor for poor functional exercise capacity (FEC) following orthotopic heart transplantation (OHT). The OHT recipient’s post-transplant FEC (peak VO₂₎ is directly associated with improved quality of life. However, there is debate in the literature about the deleterious impact of extended IT on FEC following OHT.

Methods: Fifteen OHT recipients (14 men and 1 woman; < 3 months from OHT) performed a symptom-limited graded CPET where peak VO₂ was measured in an outpatient cardiac rehabilitation. IT was obtained from the anesthesia post-operative note. VO₂ and IT values were dichotomized based on previous literature; high, ≥14 mL/kg/min (or ≥12 mL/kg/min if taking a beta …
