Zoning, Race, And Marijuana: The Unintended Consequences Of Proposition 64, Alexis Holmes Jan 2019

Zoning, Race, And Marijuana: The Unintended Consequences Of Proposition 64, Alexis Holmes

Lewis & Clark Law Review

This Article revisits the campaign to legalize cannabis in California with Proposition 64. It then dissects the localism within the new California regulations and how it conflicts with the social justice goals central to the spirit of Proposition 64’s passage. With local governments retaining control over marijuana in their jurisdictions, land use takes on new importance with respect to how marijuana will be controlled. The problem is that the land use system, like the criminal law apparatus, has yet to overcome systemic racism that is inherently part of its design. Proposition 64 wrongly relied on local control to regulate marijuana …

Reefer Madness In Federal Court: An Overview Of How Federal Courts Are Dealing With Cannabis Litigation And Why It Is Necessary To “Dig Into The Weeds”, Blake Marvis Jan 2019

Reefer Madness In Federal Court: An Overview Of How Federal Courts Are Dealing With Cannabis Litigation And Why It Is Necessary To “Dig Into The Weeds”, Blake Marvis

Lewis & Clark Law Review

Litigation stemming from the state-legal cannabis industry has presented many unique questions for federal courts to grapple with. Can federal courts provide equitable relief to state-legal cannabis litigants, despite being in violation of federal law? Can workers in the state-legal cannabis industry sue their employers to recover required minimum wage under federal statutes? Is a contract that is made in a state-legal cannabis market automatically void? This Comment examines the precarious nature of state-legal cannabis litigation in federal courts through a dissection of how litigation has progressed. It also examines the framing of the arguments made in cannabis disputes. Although …

If It Looks Like A Duck: Equal Protection, Selective Prosecution, And Geographic Differences In The Federal Prosecution Of Marijuana Crimes Under The Controlled Substances Act, Zachary Nelson Jan 2019

If It Looks Like A Duck: Equal Protection, Selective Prosecution, And Geographic Differences In The Federal Prosecution Of Marijuana Crimes Under The Controlled Substances Act, Zachary Nelson

Lewis & Clark Law Review

State legalization of marijuana for medical purposes has skyrocketed since California first authorized medical marijuana in 1996. Today, citizens in 33 states can use marijuana for medical purposes. While each state maintains distinct regulatory systems and eligibility requirements, the core result of these state medical marijuana programs is that citizens in 33 states can lawfully possess and use marijuana. Yet federal law makes any use of marijuana illegal under the Controlled Substances Act (CSA). Through the Supremacy Clause, this illegality is controlling and preemptive in every state; that is, even if a state makes marijuana legal for certain purposes, an …

Cannabis Law, The Constitution, And The Aba Model Rules, Hayley Hollis Jan 2019

Cannabis Law, The Constitution, And The Aba Model Rules, Hayley Hollis

Lewis & Clark Law Review

Though a growing number of states have legalized recreational or medical cannabis use, cannabis is still categorized as a Schedule I substance under the Controlled Substances Act, and its use, possession, and cultivation are federal offenses. This conflict between state and federal law creates a unique challenge for the legal community. Unless states with legalized cannabis programs have amended their state rules of professional conduct or provided advisory opinions on the matter, local attorneys assume a great deal of risk when representing clients within the cannabis industry.

To further complicate matters, what happens when a lawyer, who is licensed to …

Alpha1a-Adrenergic Receptor Modulation Of Epileptiform Activity And Seizures, Joseph Patrick Biggane Jan 2019

Alpha1a-Adrenergic Receptor Modulation Of Epileptiform Activity And Seizures, Joseph Patrick Biggane

Theses and Dissertations

The research herein aimed to increase our understanding about potential roles of adrenergic receptor subtypes in epileptic seizures and seizure-like (epileptiform) phenomena. Previous observations in our laboratory led us to hypothesize that the alpha1A-adrenergic receptor is a critical component of the modulatory role of the alpha1-adrenergic receptor, and more broadly, norepinephrine, on epileptiform and seizure activity. We utilized a combination of genetic and pharmacological manipulation to elucidate specific effects of the alpha1A-adrenergic receptor subtype on altering hyperactivity in models of epilepsy, both in slice and in vivo. This research sought to address three main research questions: (1) What are the …

Supercritical Water Desalination: Model-Predicted Nacl Concentration Comparison, Sebastian David Gardner Jan 2019

Supercritical Water Desalination: Model-Predicted Nacl Concentration Comparison, Sebastian David Gardner

Theses and Dissertations

Freshwater availability is increasingly becoming a concern for various parts of the world. Seawater desalination is becoming more commonplace as a source for freshwater in water-stressed regions such as California and the Middle East. Reverse osmosis is the most commonly employed technology for seawater desalination thanks to its ability to operate at a large scale, producing freshwater from seawater with relative ease. There are other sources of water which need to be desalinated, however, which reverse osmosis systems cannot effectively treat.

Unconventional oil and gas extraction, commonly known as fracking, produces vast amounts of wastewater with high TDS levels (approximately …

On Satyrs: Brutes, Monsters, And Demons: Of Their Nature And Worship: François Hédelin's Des Satyres As A Defense Of God And Humankind, Danielle Skjelver

Theses and Dissertations

Best known for his 1657 La Pratique du Theatre, François Hédelin was a cleric with a keen interest in the stage. As the abbé d’Aubignac, he wrangled in debate with the most respected scholars of his day, and Hédelin’s contacts extended to the crown itself. His Des Satyres, brutes, monstres et démons is an attempt to do with a species what he did with the stage - to bring disorder and immorality to heel.

This dissertation provides historical context, analysis, and translation of François Hédelin’s 1627 Des Satyres, brutes, monstres et démons. De leur nature et adoration Contre l'opinion de …

Characterization Of Dopamine Transporter Amino Terminal Palmitoylation And Neurotoxic Substrate Activity, Daniel Jacob Stanislowski Jan 2019

Characterization Of Dopamine Transporter Amino Terminal Palmitoylation And Neurotoxic Substrate Activity, Daniel Jacob Stanislowski

Theses and Dissertations

The projects described in this dissertation revolve around the functional consequences experienced by the transport protein for the neurotransmitter dopamine resulting from alterations to its palmitoylation condition or exposure to Parkinson disease-inducing transport substrates. This membrane-resident transport protein, pragmatically termed the dopamine transporter, relocates dopamine from extracellular areas of receptor sites of action to intracellular sequestration; the dopamine transporter is a powerful mediator of dopamine signaling. As such, genetic, toxicant, or chronic breakdown of dopamine transporter function is associated with multiple psychological abnormalities. Biomedical research has produced several pharmacotherapies for maladies like depression, attention deficit/hyperactivity disorder, and addiction, some of …

“And He Was Anti-Christ”: The Significance Of The Eighteenth Year Of The Reign Of The Judges, Part 2, Daniel Belnap, Daniel L. Belnap, Daniel Belnap, Dan Belnap Jan 2019

“And He Was Anti-Christ”: The Significance Of The Eighteenth Year Of The Reign Of The Judges, Part 2, Daniel Belnap, Daniel L. Belnap, Daniel Belnap, Dan Belnap

Faculty Publications

For the Nephites, the sixteenth year of the reign of the judges was tremendously difficult. The arrival of the people of Ammon, in itself an incredible disruption of Nephite society, precipitated a battle, which Mormon describes as a “tremendous battle; yea, even such an one as never had been known among all the people in the land from the time Lehi left Jerusalem” (Alma 28:2). The dead, we are told, were not counted due to their enormous number. These events compounded the pre-existing struggles that resulted from the sociopolitical fallout from the reforms of Mosiah2 . 1 Though Alma 30:5 …

Research outputs 2014 to 2021

A series of Ti-25Nb-8Zr-xCr (x = 0, 2, 4, 6, 8 wt%) alloys were designed based on DV-Xα cluster method and e=a-Δr diagram with an anticipation to obtain high plasticity and significant strain hardening. The designed alloys were produced through cold crucible levitation melting technique in order to effectively investigate their micro-structures and mechanical properties. The addition of Cr significantly enhances the β stability in the microstructures of the Ti-25Nb-8Zr-xCr alloys. Both yield strength and hardness of the studied alloys increase due to the effect of solid-solution strengthening. By contrast, the plasticity, maximum strength and strain hardening rate are influenced …

Barriers To Grassroots Innovation: The Phenomenon Of Social-Commercial-Cultural Trilemmas In Remote Indigenous Art Centres, Janice Jones, Pi-Shen Seet, Tim Acker, Michelle Whittle Jan 2019

Barriers To Grassroots Innovation: The Phenomenon Of Social-Commercial-Cultural Trilemmas In Remote Indigenous Art Centres, Janice Jones, Pi-Shen Seet, Tim Acker, Michelle Whittle

Research outputs 2014 to 2021

Despite substantial research on grassroots innovation, there is a lack of understanding on the barriers to grassroots innovation. We examine paradoxes that arise as a consequence of multiple, often conflicting, objectives in remote art centres, social enterprises that are key sites for grassroots innovations. We investigate how social, commercial and cultural logics in remote Indigenous art centres contribute to an on-going trilemma that acts as a barrier to the development of grassroots innovation. We also explore the challenges and opportunities managers encounter in reconciling these multiple, often conflicting, logics. The results indicate that although art centres have dual social and …

Methods: Medical attention injury data was prospectively collected for 42 elite water polo players over an 8 month surveillance period. The SIC-1.0 and SIC-2.0 models were retrospectively applied to the injury data. The injury categorisation from the two models was compared using …

Identity, Language And Collaboration In Indigenous Music, Clint Bracknell Jan 2019

Identity, Language And Collaboration In Indigenous Music, Clint Bracknell

Research outputs 2014 to 2021

I begin this chapter by arguing against any sort of prescriptive definitions for Indigenous Australian music. I will then illustrate change in public discourse on Indigenous music by examining the Australian Recording Industry Association (ARIA) awards for Best Indigenous Release (1987-1998) and for Best World Music Album (1999-2016). The chapter then proceeds to highlight two increasingly common features of the work of Indigenous musical artists: reference to one's specific Indigenous cultural identity (e.g. Noongar, Bundjalung, Yorta Yorta) in popular music performance, and writing and performing popular music in Indigenous languages. The chapter concludes by illustrating how frequently Indigenous artists collaborate …

Transition To Grandparenthood And Subjective Well-Being In Older Europeans: A Within-Person Investigation Using Longitudinal Data, Antti O. Tanskanen, Mirkka Danielsbacka, David A. Coall, Markus Jokela

Research outputs 2014 to 2021

The transition to grandparenthood, that is the birth of the first grandchild, is often assumed to increase the subjective well-being of older adults; however, prior studies are scarce and have provided mixed results. Investigation of the associations between grandparenthood and subjective well-being, measured by self-rated life satisfaction, quality of life scores, and depressive symptoms, used the longitudinal Survey of Health, Ageing and Retirement in Europe from 13 countries, including follow-up waves between 2006 and 2015 (n = 64,940 person-observations from 38,456 unique persons of whom 18,207 had two or more measurement times). Both between-person and within-person (or fixed-effect) regression …

Research outputs 2014 to 2021

Policies aiming to preserve vegetated coastal ecosystems (VCE; tidal marshes, mangroves and seagrasses) to mitigate greenhouse gas emissions require national assessments of blue carbon resources. Here, we present organic carbon (C) storage in VCE across Australian climate regions and estimate potential annual CO2 emission benefits of VCE conservation and restoration. Australia contributes 5–11% of the C stored in VCE globally (70–185 Tg C in aboveground biomass, and 1,055–1,540 Tg C in the upper 1 m of soils). Potential CO2 emissions from current VCE losses are estimated at 2.1–3.1 Tg CO2-e yr-1, increasing annual CO …

The Owner-Manager’S Role As A Facilitator Of Informal Learning In Small Businesses, Alan Coetzer, Andreas Wallo, Henrik Kock Jan 2019

The Owner-Manager’S Role As A Facilitator Of Informal Learning In Small Businesses, Alan Coetzer, Andreas Wallo, Henrik Kock

Research outputs 2014 to 2021

Few studies have examined the owner-manager as a facilitator of learning in small businesses. Furthermore, these studies are typically not framed by distinctive characteristics of small businesses. These limitations of the literature stimulated us to ask: How do the situational opportunities and constraints that emanate from the distinctive characteristics of small businesses affect the small business owner-manager’s role as a facilitator of learning? To address this question, we first conducted a narrative review of existing research on the owner-manager as facilitator of learning in small businesses (10–49 employees). Four themes emerged from our analysis of research findings, including a theme …

Assessing The Utility Of Multiplexed Liquid Chromatography-Mass Spectrometry For Gluten Detection In Australian Breakfast Food Products, Haili Li, Utpal Bose, Sally Stockwell, Crispin A. Howitt, Michelle Colgrave Jan 2019

Assessing The Utility Of Multiplexed Liquid Chromatography-Mass Spectrometry For Gluten Detection In Australian Breakfast Food Products, Haili Li, Utpal Bose, Sally Stockwell, Crispin A. Howitt, Michelle Colgrave

Research outputs 2014 to 2021

Coeliac disease (CD) is an autoimmune disorder triggered by the ingestion of gluten that is associated with gastrointestinal issues, including diarrhea, abdominal pain, and malabsorption. Gluten is a general name for a class of cereal storage proteins of wheat, barley, and rye that are notably resistant to gastrointestinal digestion. After ingestion, immunogenic peptides are subsequently recognized by T cells in the gastrointestinal tract. The only treatment for CD is a life-long gluten-free diet. As such, it is critical to detect gluten in diverse food types, including those where one would not expect to find gluten. The utility of liquid chromatography-mass …

Research outputs 2014 to 2021

BACKGROUND: Blood markers indicative of neurodegeneration (neurofilament light chain; NFL), Alzheimer's disease amyloid pathology (amyloid-β; Aβ), and neuroinflammation (kynurenine pathway; KP metabolites) have been investigated independently in neurodegenerative diseases. However, the association of these markers of neurodegeneration and AD pathology with neuroinflammation has not been investigated previously. Therefore, the current study examined whether NFL and Aβ correlate with KP metabolites in elderly individuals to provide insight on the association between blood indicators of neurodegeneration and neuroinflammation.

METHODS: Correlations between KP metabolites, measured using liquid chromatography and gas chromatography coupled with mass spectrometry, and plasma NFL and Aβ concentrations, measured using …

A Review Of The Putative Causal Mechanisms Associated With Lower Macular Pigment In Diabetes Mellitus, Grainne Scanlon, James Loughman, Donal Farrell, Daniel Mccartney Jan 2019

A Review Of The Putative Causal Mechanisms Associated With Lower Macular Pigment In Diabetes Mellitus, Grainne Scanlon, James Loughman, Donal Farrell, Daniel Mccartney

Articles

Macular pigment (MP) confers potent antioxidant and anti-inflammatory effects at the macula, and may therefore protect retinal tissue from the oxidative stress and inflammation associated with ocular disease and ageing. There is a body of evidence implicating oxidative damage and inflammation as underlying pathological processes in diabetic retinopathy. MP has therefore become a focus of research in diabetes, with recent evidence suggesting that individuals with diabetes, particularly type 2 diabetes, have lower MP relative to healthy controls. The present review explores the currently available evidence to illuminate the metabolic perturbations that may possibly be involved in MP’s depletion. Metabolic co-morbidities …

Regression Tree Construction For Reinforcement Learning Problems With A General Action Space, Anthony S. Bush Jr Jan 2019

Regression Tree Construction For Reinforcement Learning Problems With A General Action Space, Anthony S. Bush Jr

College of Graduate Studies: Theses & Dissertations

Part of the implementation of Reinforcement Learning is constructing a regression of values against states and actions and using that regression model to optimize over actions for a given state. One such common regression technique is that of a decision tree; or in the case of continuous input, a regression tree. In such a case, we fix the states and optimize over actions; however, standard regression trees do not easily optimize over a subset of the input variables\cite{Card1993}. The technique we propose in this thesis is a hybrid of regression trees and kernel regression. First, a regression tree splits over …

Building A Classification Model Using Affinity Propagation, Christopher R. Klecker Jan 2019

Building A Classification Model Using Affinity Propagation, Christopher R. Klecker

College of Graduate Studies: Theses & Dissertations

Regular classification of data includes a training set and test set. For example for Naïve Bayes, Artificial Neural Networks, and Support Vector Machines, each classifier employs the whole training set to train itself. This thesis will explore the possibility of using a condensed form of the training set in order to get a comparable classification accuracy. The technique explored in this thesis will use a clustering algorithm to explore with data records can be labeled as exemplar, or a quality of multiple records. For example, is it possible to compress say 50 records into one single record? Can a single …

Effects Of Mental Health Programs On School Violence, Lillian R. Gray Jan 2019

Effects Of Mental Health Programs On School Violence, Lillian R. Gray

College of Graduate Studies: Theses & Dissertations

Bullying, defined as any unwanted aggressive behavior(s) by another youth or group of youths who are not siblings or current dating partners that involves an observed or perceived power imbalance and is repeated multiple times or is highly likely to be repeated, is becoming an epidemic in our schools, with rates of victimization rising (Donegan, 2012). This thesis examines mental health programs already established within schools, as well as schools where students do not have access to mental health resources and compares the amount of violence that is perpetrated within these schools. Next, this study explores the relationship between bullying …

From Wanderer To Warrior: Martin's Journey To Sainthood In Brian Jacques's Redwall Series, Marie A. Bliemeister

College of Graduate Studies: Theses & Dissertations

Children’s fantasy series have been set in the Medieval Era, a way to explore contemporary themes. This use of the Medieval Era is known as medievalism, where authors can explore contemporary issues by comparing them to the past (Bradford 3). Brian Jacques, the author of the popular children’s series Redwall, uses many aspects of the Medieval Era such as prophecies, glory, and battle, and visions or dreams to effectively spin a good yarn while commenting on the religious development of England in the late twentieth century. English moral was down due to the devastation of World War Two and …

College of Graduate Studies: Theses & Dissertations

In this thesis, a finite element modeling of Mechanically Stabilized Earth (MSE) walls using welded wire wall panels was performed. The implementation of finite element modeling and analysis proved to be quite efficient in simulating the three-dimensional behavior of wall panels that are a part of MSE walls. The comprehensive finite element model included defined concrete and steel material properties in order to present both the realistic behaviors of each component in the model as well as better facilitating and increasing the accuracy of the simulation of numerous finite element analysis (FEA) cases. FEA was employed to simulate welded wire …

In-Between Epistemic Paradigms Of Disablement: A Reflective Journey, Daniel James Mcnair Jan 2019

In-Between Epistemic Paradigms Of Disablement: A Reflective Journey, Daniel James Mcnair

College of Graduate Studies: Theses & Dissertations

The author explores feelings of in-betweenness, hybridity, and dislocation (Aoki, 2005; Bhabha, 2007/1994; Saïd, 1994) as he contemplates the meaningfulness of a liminal placement between two epistemic worlds—that of his more recent experiences as a curriculum studies scholar and his previous training as a postpositivist practitioner of school psychology. This self-study engages pedagogical possibilities of in-between spaces (Aoki, 2005; He & Ross, 2012; Baszile, 2006) to construct a lived curriculum that challenges traditional stereotypes of autism and postsecondary disability services. To guide this critical self-reflective inquiry, the author applies the concepts of Joseph Schwab’s (1973) curriculum commonplaces along with William …

The Role Of Family Context In Family Health History Communication Surrounding Chronic Disease, Kendall M. Williams

College of Graduate Studies: Theses & Dissertations

Communication about family health history related to chronic disease are important to health promotion and prevention and associated with better health outcomes, yet for African Americans, they do not happen until after a family member has been diagnosed with a specific disease or condition (Hovick, 2016; Rodriguez, 2016). The purpose of the study was to examine the occurrence of family communication surrounding chronic disease in a sample of African American women in the rural Southeastern United States. Secondly, the study sought to examine whether frequency of communication was a factor in the communication (gathering or sharing) of family health history. …

Poetically Composed, Educationally Imposed: Exploring Imagination And Poetics In Curriculum—A Memoir, Whitney J. Presnal Jan 2019

Poetically Composed, Educationally Imposed: Exploring Imagination And Poetics In Curriculum—A Memoir, Whitney J. Presnal

College of Graduate Studies: Theses & Dissertations

Through the use of memoir, my work centers on how poetry is situated within public education curriculum. I explore the curricular context of poetry through the lenses of my lived experiences in early childhood, as a K-12 student, and as an early career classroom teacher. My dissertation draws upon a wide array of literature, honing in on the poetic perspectives of philosophers (Aristotle, 1996; Heidegger, 1947 & 1971/2013; Plato, 1955/2007), poets (Hall, 2003; Eliot, 1920 & 2009), and curriculum theorists (Leggo, 1997 & 2018; Pinar, 1994; Sameshima, 2007). The foundation of my work is drawn from my own circular experiences, …
