In Ex Parte Levitt, the Supreme Court denied standing to a pro se litigant making esoteric claims against the appointment of Justice Hugo Black. The Court’s short opinion is now an unremarkable mainstay of modern federal courts doctrine. But the case merits closer examination. Indeed, Levitt’s challenge was probably meritorious, and Hugo Black’s appointment unconstitutional. Moreover, the Court’s standing analysis was probably wrong – though there might have been other reasons to deny the challenge. And finally, the case’s aftermath raises intriguing questions about the Supreme Court’s role in politics and constitutional law. But don’t worry – his opinions are …

When abortion is discussed in the context of destigmatizing disability, it is usually in connection with the potential disabilities of the fetus. Disability rights activists increasingly encourage both lawmakers setting abortion policy and women contemplating abortion to think that a life with disabilities is worth living. In particular, they argue that a fetus diagnosed with Down syndrome, let alone one with a cleft palate, should not for that reason be aborted.While taking this line of argument into account, this Chapter will shift the frame of reference to various ways in which the law and bioethics of abortion treat pregnant women …

When individuals and firms fail to invest in adequate care, the government often steps in, taking costly measures to restore safety or mitigate harm. Under such circumstances, a question arises as to whether the government can demand recovery for its costs. For many years, the answer has been negative; tort law has persistently refused to render negligent individuals and firms liable for governmental expenditures. Yet recently, the law changed markedly. Recognizing that the no-liability regime subsidizes faulty behavior, an increasing number of jurisdictions have established the right of public entities to sue for reimbursement of costs. Property rights have long been associated with a simple and distinctive technology: exclusion. But technologies can become outdated as conditions change, and exclusion is no exception. Recent decades have featured profound changes that have made exclusion a less useful, less necessary, and more expensive way of regulating access to resources. This Article surveys the prospects for a post-exclusion understanding of real and personal property. It proceeds from the premise that property is built upon complementarities, the nature and scale of which have undergone seismic shifts. “How much ambiguity is enough?” was the deceptively simple question repeatedly put forward by Justice Neil Gorsuch in oral argument for American Hospital Association v. Becerra. Silly as the question was meant to seem, much turns on the response. Most obvious are the effects on the practice of administrative agencies and the implications for years of precedent surrounding the Chevron doctrine. But far beyond administrative law, the response also has substantial ramifications for the law of interpretation since it is centered in the complementary notion of clarity. Orgasms and ejaculation are important for relationships and contribute significantly to life satisfaction. There is, however, a lack of research in the current literature regarding orgasm perception. This study tested the effects of endogenous oxytocin on subjective orgasm intensity, ejaculation latency, and ejaculate volume in men. At two separate test sessions, the participants were either stroked on the forearm (to release endogenous oxytocin) or tapped on the hand (to act as a control) with a cosmetic brush. The forearm contains C-tactile afferents that are believed to release oxytocin centrally and peripherally in response to slow, soft stroking stimulation. Then a …

This study explores the collaborative process of members of DIY art collectives in the Pacific Northwest as understood through a collective action lens focused on the cooperative links and motivations of the art collectives. Participant observation and in-depth interviews were used to gather data showing the process of establishing and maintaining membership in a DIY art collective, and the values that motivate the collective’s continuation. Drawing on Howard Becker’s art world framework as well as literature on social movements and art activism, I show how the DIY art world of this study is fluid, open, and driven by values of …

This thesis conducts a techno-economic feasibility analysis of tiny homes. Scenarios generated using a mathematical and physical model of energy use of zero-net energy tiny homes in coastal Humboldt County are compared with conventional energy systems powered by fossil-fuels for lifecycle economic cost, energy efficiency, greenhouse gas emissions, and energy use. A residence of 2,425 ft.2 (near the regional average) is simulated to offer a broader standard of comparison. A tiny home village model with outlying bedrooms and a central building for cooking, laundry and shower facilities is compared to a standalone tiny home model. A community services building …

This study explores the issue of unequal representation of women artists in the art-world (museums, galleries, auctions and texts) as well as in Studio Art, Art Education and Art-Historical pedagogy. This study examines how student knowledge and attitudes are impacted by the lack of exposure to art made by women. There are various stressors that exist in different natural environments. The function of a stress response is to provide an organism with a better chance at survival. A functional stress response is essential to the survival of many species, but the influence of ecology on these behaviors is poorly understood. Astyanax mexicanus provides an effective model to study this relationship. In this thesis we used variations of the novel tank assay to investigate the connection between ecology and behavior. We found that cave fish exhibit a diminished stress response relative to their surface conspecifics. These findings provide a baseline for …

The golden age of smuggling occurred in and around the British Isles in the 18th and 19th centuries. As a result of increases in regulations and taxes the government instituted to pay for a series of costly wars at the end of the 17th century, smuggling greatly increased. With the implementation of major punishments for smuggling, such as the death penalty, the smuggling trade grew more violent. Armed smugglers sought to achieve a balancing act between violent acts and public acceptance. In 1868, the leadership of Florida, faced with the emancipation and enfranchisement of its slave population, amended the state’s Constitution to disenfranchise those convicted of a felony. Criminal statutes were written criminalizing actions that were believed to be committed most often by African Americans. The original 60,000 population at risk of disenfranchisement would grow to 1,400,000 people over the course of the next 150 years. In November 2018, voters in Florida voted to once again amend the State’s Constitution, this time to restore the franchise to previously convicted felons. The 8th Amendment forbids excessive bail, but this essential Constitutional protection has been undermined. The Supreme Court held in U.S. v. Salerno that the Constitution does not entitle defendants to bail and allowed federal courts to deny bail if they deem the defendant a threat to the community. However, both history and the current problems in the bail system demonstrate the Court erred in its ruling. Contrary to Salerno, the 8th Amendment was intended to provide a right to bail for all defendants who posed no threat to the judicial process. In order to protect essential rights of due process …

In moments of great societal change the pastoral poem motif always seems to reemerge. Although the pastoral poem's intrinsic formulation—a latent yearning for a lost time and space—has stayed constant, the minuscule shifts in what constitutes this idyllic respite reveal a great deal about the era it was written. The notion of a Golden Age illustrates society's ideals and as such juxtaposes the banality of quotidian life with highly idealized aesthetical aspirations that the poet is attempting to escape through pastoral poetry. To treat neurological diseases and disorders, the drug must cross the blood-brain barrier (BBB). Polar and high molecular weight molecules, such as peptides, are impeded by the BBB. Alternatively, intranasal administration allows the delivery of these molecules to the brain by bypassing the BBB. To improve intranasal delivery to the brain, novel cyclic opioid peptides DADLE-OL I and II were created as a proof-of-concept using a novel strategy that involved grafting a bioactive sequence into the scaffold of a cyclic peptide. In Fall 2018, John D. MacArthur Beach State Park’s estuary was surveyed to determine the health and distribution of their oysters. These organisms provide important ecological functions, so their populations are an important reflection on the health of the estuary. Hypothesis one is to determine oyster health by comparing environmental conditions, oyster densities, shell heights, and condition indexes today to a 2010 survey. The second hypothesis is to determine where oysters congregate, either on soft or hard substrates or in different estuary zones. The practice of trainhopping has historical roots in the post-Civil War period and during the Great Depression, when large migrations of penniless individuals caught rides on freight cars to find employment or adventure. Trainhopping is still widely practiced, however modern day trainhopping culture has not received appropriate scholarly attention as a specific subculture. To understand the choices and motivations of members of this subculture, I undertook an ethnographic project wherein I interviewed trainhoppers, in addition to analyzing the historical precedent set for contemporary trainhopping practice. Researchers are currently designing RNAs for diagnostic and therapeutic applications, and an understanding of the factors that affect stability of these RNAs could inform the design of new RNA constructs. This project involved the use of in silico experiments to investigate the effects of different nucleotide substitutions on the stability of RNAs using EteRNA, a publicly available, online computer modeling software developed by researchers at Carnegie Mellon and Stanford Universities to study RNA folding. Autism Spectrum Disorders (ASDs) are a group of diverse neuropsychiatric ailments, with a broad spectrum of severity, characterized by social deficits, absence or delay in language development, and a pattern of restricted and repetitive behaviors. The focus of this thesis is to study the SD3 mouse model of ASD, in which normal cleavage of the NLGN1 isoform is prevented. Temporary Protected Status (TPS) is granted in the United States to individuals from countries undergoing armed conflicts, environmental disasters, or other extraordinary conditions. TPS holders may obtain employment authorization but the status does not come with any specific pathway to permanent residency and may be revoked by the Department of Homeland Security. Asylum status may be granted to individuals in the United States who can demonstrate a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion. Contemporary debates within the Marxist tradition continue to revolve around questions regarding the proper attitude toward humanism and its universalizing implications. The controversial debate over Affirmative Action in higher education institutions center on the constitutionality of legislative public policies to enact steps to create racially diverse campuses. Concerns arise from Affirmative Action policies in undergraduate and graduate college admission that those policies cause further harm than good for all prospective students. Citizens comment that racialized preferential treatment in public policies steer society from becoming equal and continues racial tension. I argue that Affirmative Action is constitutional under the Equal Protection Clause in the Fourteenth Amendment and essential for minorities as a legal remedy for past wrongs.

This paper examines the impact of crime rates, immigrant populations, and previous policies on the decision by law enforcement agencies to participate in the 287(g) program. Through the program, state, county, and local police and sheriff’s departments sign agreements with the Department of Homeland Security to give officers authorization to interrogate and detain people while they are checked against a database for an ICE detainer. Critics argue that the 287(g) program causes discrimination against Latinos and Hispanics, does not prioritize deportation of violent criminals, and undermines police-community relations. Despite efforts by the United Nations, UNICEF, and the International Labor Organization (ILO), among others, child labor remains a widespread concern. In 2016, 152 million children were in child labor worldwide. Though child labor is widely recognized as a global health problem, research on the health effects of child labor is limited. Summary measures of population health provide a way to present information about both mortality and morbidity of a given population as a single metric.
