The Noisy "Silent Witness": The Misperception And Misuse Of Criminal Video Evidence, Aaron M. Williams Oct 2019

The Noisy "Silent Witness": The Misperception And Misuse Of Criminal Video Evidence, Aaron M. Williams

Indiana Law Journal

This Note examines recent developments in the research of situational video evidence biases. Part I examines the current and growing body of psychological research into the various situational biases that can affect the reliability of video evidence and the gaps in this research that require further attention from researchers and legal academics. Because these biases do not “operate in a vacuum,” Part I also examines some of the recent and exciting research into the interaction between situational and dispositional biases. Part II examines the development of camera and video processing technology and its limitations as a means of mitigating such …

Biennial Convention (CONV)

Traumatic experiences across the lifespan can impact an individual's physical, social and emotional health, and cognitive development. There has been an increased focus on trauma informed initiatives in various public and healthcare sectors, but these initiatives are lacking in higher education. Creating a trauma-informed culture will positively impact academic success.

The Art Of Occupation : Crime And Governance In American-Controlled Germany, 1944–1949, Thomas J. Kehoe Oct 2019

The Art Of Occupation : Crime And Governance In American-Controlled Germany, 1944–1949, Thomas J. Kehoe

Ohio University Press Open Access Books

The literature describing social conditions during the post–World War II Allied occupation of Germany has been divided between seemingly irreconcilable assertions of prolonged criminal chaos and narratives of strict martial rule that precluded crime. In The Art of Occupation, Thomas J. Kehoe takes a different view on this history, addressing this divergence through an extensive, interdisciplinary analysis of the interaction between military government and social order.

Focusing on the American Zone and using previously unexamined American and German military reports, court records, and case files, Kehoe assesses crime rates and the psychology surrounding criminality. He thereby offers the first comprehensive …

Zero Tolerance And The Impossibilities Of Discipline--Findings From The Field, Anne Scheer Phd Oct 2019

Zero Tolerance And The Impossibilities Of Discipline--Findings From The Field, Anne Scheer Phd

Societies Without Borders

At School James, a high-poverty, high-minority inner-city elementary school in the Midwestern United States, a highly detailed system of rules and punishments is supposed to control students. The official rationale underlying this system of zero-tolerance discipline is to create environments conducive to learning. In practice, however, the meticulous system of rules, rewards, and punishments fails to achieve the desired levels of control and the realities at the school are dominated by disorder. My research sought to explain this failure and explore the consequences it has for this already marginalized student population. The present article outlines how the design of the …

A Qualitative Exploration Of The School Resource Officer’S Role In Two K-12 School Districts, Christopher T. Muench Oct 2019

A Qualitative Exploration Of The School Resource Officer’S Role In Two K-12 School Districts, Christopher T. Muench

Dissertations

The researcher conducted a qualitative exploration on the role of the School Resource Officer (SRO) specifically on safety/security, law enforcement duties, and interaction with students. The idea of an SRO was present in school systems since the 1950s and over the decades showed considerable expansion. On the surface, the SRO position seemed to need little definition but attempting to clarify the role led to conflicts, vagueness, and confusion among organizations served, the community, and the SROs themselves. The research was diverse concerning the roles and responsibilities of the SRO whether it be from a legal, educational, or tactical standpoint. This …

Physical Violence And Vulnerable Adolescents: The Roles Of School Climate And Presence Of Similar Peers, Igor Ryabov Oct 2019

Physical Violence And Vulnerable Adolescents: The Roles Of School Climate And Presence Of Similar Peers, Igor Ryabov

Sociology Faculty Publications

Using nationally representative data from the National Longitudinal Study of Adolescent Health (a.k.a., Add Health), this study examines the impact of school climate and share of vulnerable groups of students on self-perceived discrimination and violence involvement in high school. Violence involvement is operationalized as victimization and perpetration of physical violence. Five categories of vulnerability status are analyzed: the emotionally disabled, learning disabled, physically disabled, obese and LGB. Results suggest that relatively higher odds of violence involvement for individuals who were members of vulnerable groups as adolescents are fully explained by school climate and an extensive set of individual-level controls. While …

Students Of Black Or African American Ancestry In Grades 10th -12th Perceptions Of Their Schooling Experiences, Annette Renee Kennedy Oct 2019

Students Of Black Or African American Ancestry In Grades 10th -12th Perceptions Of Their Schooling Experiences, Annette Renee Kennedy

Dissertations

California continues to tackle blatant racist acts within school systems across the state as recent headlines read, “Deeply offensive blackface video of California high school student sparks backlash” (Yancey-Bragg, Guynn, & Rhor, 2019, n.p.) and “Four teachers and their principal placed on leave after cheerfully posing for photo with noose” (Lunning, 2019, n.p.). Gaining a greater awareness of the non-headlining actions that take place on a day-to-day basis that have an equally powerful adverse effect on the school experiences of black learners was the focus of this study. Microaggressions are “subtle, stunning, often automatic, and non-verbal exchanges which are put …

Unusual Deference, William W. Berry Iii Oct 2019

Unusual Deference, William W. Berry Iii

Florida Law Review

Three Eighth Amendment decisions—Harmelin v. Michigan, Pulley v. Harris, and McCleskey v. Kemp—have had enduring, and ultimately, cruel and unusual consequences on the administration of criminal justice in the United States. What links these cases is the same fundamental analytical misstep—the decision to ignore core constitutional principles and instead defer to state punishment practices. The confusion arises from the text of the Eighth Amendment where the Supreme Court has read the “cruel and unusual” punishment proscription to rest in part on majoritarian practices. This is a classical analytical mistake—while the Amendment might prohibit rare punishments, it …

Convictions Based On Character: An Empirical Test Of Other-Acts Evidence, Michael D. Cicchini, Lawrence T. White Oct 2019

Convictions Based On Character: An Empirical Test Of Other-Acts Evidence, Michael D. Cicchini, Lawrence T. White

Florida Law Review

Despite the time-honored judicial principle that “we try cases, rather than persons,” courts routinely allow prosecutors to use defendants’ prior, unrelated bad acts at trial. Courts acknowledge that jurors could improperly use this other acts evidence as proof of the defendant’s bad character. However, courts theorize that if the other acts are also relevant for a permissible purpose—such as proving the defendant’s identity as the perpetrator of the charged crime—then a cautionary instruction will cure the problem, and any prejudice is “presumed erased from the jury’s mind.”

We put this judicial assumption to an empirical test. We recruited 249 participants …

Drugs Of Abuse: A Review Of Tramadol Abuse, Brittany Crowe, Tiffany Kneuss, Benjamin Finley, Kelsey Fink, Manoranjan S. D'Souza Oct 2019

Drugs Of Abuse: A Review Of Tramadol Abuse, Brittany Crowe, Tiffany Kneuss, Benjamin Finley, Kelsey Fink, Manoranjan S. D'Souza

Pharmacy and Wellness Review

Prescription drug abuse is the fastest growing drug problem in America. Among the different prescription drugs being abused, analgesics are the most commonly abused group of drugs. In the last few years, there is increasing evidence of abuse of tramadol, which is an atypical, centrally acting opioid analgesic. The increasing abuse of tramadol has prompted regulatory authorities to strengthen the product labeling of tramadol with respect to its abuse potential. Furthermore, several states have added tramadol to their controlled substances list. In this article, we will review the pharmacology of tramadol and some of the preclinical and clinical studies that …
