Judging Judges Fifty Years After—Was Judge Julius Hoffman’S Conduct So Different?, Bennett L. Gershman Jan 2019

Judging Judges Fifty Years After—Was Judge Julius Hoffman’S Conduct So Different?, Bennett L. Gershman

Loyola University Chicago Law Journal

In Chicago, Illinois—and in courtrooms across the United States—judicial misconduct has affected trial outcomes as long as there have been trials. While Judge Julius Hoffman’s conduct in the “Chicago Eight” trial is an egregious example of judicial behavior toward criminal defendants, this piece’s examination of at least ten different categories of misconduct in dozens of cases makes the argument that misbehavior by judges is less of an exception to the rule of impartiality than the thinking public might know. In considering these brazen examples, practitioners and academics alike can evaluate how to best confront the extent to which conduct like …

Moral Decision Making, Baylie Fowler, Tommi Donnelly-Julian Jan 2019

Moral Decision Making, Baylie Fowler, Tommi Donnelly-Julian

Undergraduate Psychology Research Methods Journal

This study was conducted to assess the association between implicit biases and moral decision making. Implicit biases can control how we treat people and who we choose to associate ourselves with. We sought to determine if triggering those biases would cause a quantitative increase in moral decision making. We asked participants in the experimental group to complete the Implicit Association Test (IAT; Greenwald, Banajo, & Nosek, 1998a), two parts of the Moral Foundations Questionnaire (Graham, Haidt, & Nosek, 2008) and a demographics questionnaire. No statistically significant differences were found in control vs experimental groups in terms of their morality scores …

Judicial Education, Private Violence, And Community Action: A Case Study In Legal Participatory Action Research, Kristin (Brandser) Kalsem

Faculty Articles and Other Publications

In this Article, I present a case study of a legal PAR project involving judicial training on best practices in domestic violence cases. This judicial education project started over coffee and waffles, involved an award-winning documentary film Private Violence, and resulted in the training of more than 375 judges on best practices developed from two years of collaborative research conducted by a community action group. In 2014, I coauthored an article titled It's Critical: Legal Participatory Action Research with my colleague Emily Houh. In this piece, we introduced legal scholars to the field of PAR, including its origins, complementary relationship …

Reviving Escobedo, Janet Moore Jan 2019

Reviving Escobedo, Janet Moore

Loyola University Chicago Law Journal

This Symposium Essay reflects on the fifty years that have passed since the Chicago Eight trial by highlighting a new development in criminal procedure that has drawn little scholarly attention: Judges are reviving the right of stationhouse access to defense counsel along lines previously envisaged in Escobedo v. Illinois. The Essay also offers fresh historical and theoretical perspective on the need for stationhouse counsel. First, the Essay draws on a series of events occurring during and after the Chicago Eight trial to illustrate the interrelationship of violence and silence in criminal legal systems, the distinctive coerciveness of custodial interrogation …

Disrupting Narrow Conceptions Of Justice: Exploring And Expanding "Bullying" And "Upstanding" In A University Honors Course, Jennifer Farley, Jennifer Gallagher, Katherine Richardson Bruna Jan 2019

Disrupting Narrow Conceptions Of Justice: Exploring And Expanding "Bullying" And "Upstanding" In A University Honors Course, Jennifer Farley, Jennifer Gallagher, Katherine Richardson Bruna

University of Nebraska Public Policy Center: Publications

The term "upstanding" encompasses actions and behaviors grounded in one’s defense of their own beliefs and others. While such broad application of the term has merit, from a critical education perspective it lacks direction. To efficaciously address injustice, upstanding action must go beyond one’s beliefs. A directional application of upstanding behavior, or the notion of "upstanding for justice," frames upstanding as action to address chronic social victimization via systems of oppression. In this article, we describe the development of a new heuristic to support students’ understanding of upstanding and detail the university honors course in which we used the heuristic …

Fixing The Broken System Of Assessing Criminal Appeals For Frivolousness, Andrew S. Pollis Jan 2019

Fixing The Broken System Of Assessing Criminal Appeals For Frivolousness, Andrew S. Pollis

Faculty Publications

This article seeks to end fifty years of confusion over how to proceed when a criminal defendant wants to appeal but appointed counsel sees no basis for doing so.

Practices vary among jurisdictions, but most require counsel to explain the predicament to the court—often at a level of detail that compromises the duty of loyalty to the client. Most also require the court to double-check counsel’s conclusion by conducting its own independent review of the record, thus burdening judges and blurring the important line between judge and advocate. And at no point in this process does the defendant have a …

Eroding The Barrier Between Peace And Justice: Transitional Justice Mechanisms And Sustainable Peace, Jeffery D. Pugh Jan 2019

Eroding The Barrier Between Peace And Justice: Transitional Justice Mechanisms And Sustainable Peace, Jeffery D. Pugh

International Journal of Peace Studies

The expansion of international trials over the last decades has reinvigorated the debate surrounding the efficacy of retributive justice over restorative justice in response to mass humanitarian crises. This study examines the ways different transitional justice models contribute to stable peace. It suggests that a hybrid utilization of both restorative justice mechanisms (e.g., amnesty) and retributive justice mechanisms (e.g., trials) is most effective in achieving a stable peace in a post-accord state, and that context is an important intervening factor. Using a mixed method approach, I first examine a group of 25 test cases, analyzing the relationship between restorative and …

Legal Remedies To Address Stigma-Based Health Inequalities In The United States: Opportunities And Challenges, Valarie K. Blake, Mark L. Hatzenbuehler Jan 2019

Legal Remedies To Address Stigma-Based Health Inequalities In The United States: Opportunities And Challenges, Valarie K. Blake, Mark L. Hatzenbuehler

Scholarly Works

Stigma is an established driver of population-level health outcomes. Antidiscrimination laws can generate or alleviate stigma and, thus, are a critical component in the study of improving population health.

Currently, antidiscrimination laws are often underenforced and are sometimes conceptualized by courts and lawmakers in ways that are too narrow to fully reach all forms of stigma and all individuals who are stigmatized.

To remedy these limitations, we propose the creation of a new population-level surveillance system of antidiscrimination law and its enforcement, a central body to enforce antidiscrimination laws, as well as a collaborative research initiative to enhance the study …

Critical Theory And Clinical Stance, Wendy A. Bach Jan 2019

Critical Theory And Clinical Stance, Wendy A. Bach

Scholarly Works

Clinicians, unlike their peers in the legal academy, are embedded in their clients’ experiences of the legal system. Because of their location in the academy, “they have the potential to transform the study of law into the study of a culture that deploys law for various purposes,” in the words of Phyllis Goldfarb. In this short essay, we highlight a thread of clinical scholarship which we identify as growing from clinicians’ unique and embedded stance. We seek to convince, using a few examples of clinical scholarship, that our collective critical stance has yielded, over the last several decades, a growing …

Sa Climate Ready: A Pathway For Climate Action & Adaptation, Sa Climate Ready, Alfred Montoya

Sociology & Anthropology Faculty Research

San Antonio is one of the fasted growing cities in the nation. Every day, we are working to plan for and accommodate the estimated one million additional residents that will arrive in San Antonio by 2040. In much the same way, it’s our collective responsibility to prepare for a future that is projected to have hotter temperatures, longer droughts and more intense rain events, as a result of our changing climate. That is why working with the City Council, one of my first acts as your Mayor was to sign the Paris Climate Agreement.

Throughout the SA Climate Ready process, …

A Rule 11 For Prosecutors, Yuri R. Linetsky Jan 2019

A Rule 11 For Prosecutors, Yuri R. Linetsky

Tennessee Law Review

This Article suggests a novel approach to allow victims of frivolous prosecutions to hold prosecutors accountable. Unique among American lawyers, prosecutors enjoy absolute immunity from civil suits alleging professional misconduct. In cases of frivolous prosecutions, where charges are dismissed by the judge or the defendants are acquitted, the former defendants are prevented from seeking damages. This is so despite former defendants often suffering significant consequences-from legal fees to loss of employment. Victims of frivolous prosecutions should be afforded a mechanism to seek redress against prosecutors who bring or maintain meritless actions.

By enacting a rule of criminal procedure that mirrors …
