Perceptions Of Elementary School Parents, Principals, And School Resource Officers Regarding Visitor Management Systems And School Safety, Janalee Olhausen-Kaylor
Perceptions Of Elementary School Parents, Principals, And School Resource Officers Regarding Visitor Management Systems And School Safety, Janalee Olhausen-Kaylor
Dissertations
Currently, three out of 10 parents fear for their students’ safety while attending classes within the public school setting (McCarthy, 2015). This study focused on two elements that directly affect safety within schools: visitor management and intruder prevention. To analyze each of these two elements, qualitative methodology was utilized through four focus groups to determine the perceptions of Elementary school administrators, parents, and school resource officers on school safety. After conducting multiple interviews, four common themes emerged. The first theme was monitoring access to school buildings. Participants asserted taking an active approach in this area would increase the overall safety …
A Self-Study Of A Special Educator’S Teaching Practices In A Prison Setting: Promoting The Self-Efficacy For Literacy Tasks Of Adult Learners Who Are Incarcerated, Brandon M. Selling
A Self-Study Of A Special Educator’S Teaching Practices In A Prison Setting: Promoting The Self-Efficacy For Literacy Tasks Of Adult Learners Who Are Incarcerated, Brandon M. Selling
All NMU Master's Theses
For students and teachers in prison classrooms, success with reading and literacy tasks does not come easily. To teach within the correctional setting, an educator must get used to teaching with tension. These tensions must be balanced for the teacher to continue focus on instruction and to continue proper teaching practices. For students, reading proficiency is necessary for passing the 2014 computer version of the GED test. Passing the GED test is an exit goal of corrections education. The purpose of this qualitative self-study was to explore and describe my teaching practices to better understand how to apply my knowledge …
Discipline And Policing, Kate Levine
Discipline And Policing, Kate Levine
Duke Law Journal
A prime focus of police-reform advocates is the transparency of police discipline. Indeed, transparency is one of, the most popular accountability solutions for a wide swath of policing problems. This Article examines the “transparency cure” as it applies to Police Disciplinary Records (“PDRs”). These records are part of an officer’s personnel file and contain reported wrongdoing from supervisors, Internal Affairs Bureaus, and Citizen Complaint Review Boards.
This Article argues that making PDRs public is worthy of skeptical examination. It problematizes the notion that transparency is a worthy end goal for those who desire to see police-reform in general. Transparency is …
The New Amy, Vicky, And Andy Act: A Positive Step Towards Full Restitution For Child Pornography Victims, Paul Cassell, James R. Marsh
The New Amy, Vicky, And Andy Act: A Positive Step Towards Full Restitution For Child Pornography Victims, Paul Cassell, James R. Marsh
Utah Law Faculty Scholarship
In this article, we review some of the valuable steps forward found in the AVAA, as well as the work that remains to be done. But in closing, it may be useful to remember that the legal issues swirling around restitution decisions have real world consequences, both for the defendants who must pay the restitution awards and the victims who need and deserve compensation. As between these two groups, however, the equities tip decisively in favor of victims. To be sure, large restitution awards have financial consequences for criminal defendants. But the stark fact remains that criminals have a choice …
Life, Death, And Corporeal Resistance In Immigration Detention, Jana Michelle Moss
Life, Death, And Corporeal Resistance In Immigration Detention, Jana Michelle Moss
Theses and Dissertations
This thesis analyzes corporeal strategies of resistance used by immigration detainees in the global North. Corporeal resistance is defined as an act of protest that physically harms the actor but is not intended to harm anyone else. Examples include hunger strikes, lip sewing, self-immolation, and other forms of public suicide. In response to the prevailing public opinion that detainees' acts of self-harm or suicide are simply acts of desperation by disenfranchised people who have nothing to lose, I argue that they can be a logical and strategic response to state necropolitics. Detainees take back corporeal necropower by reasserting control of …
Brace For Impact: The Effects Of Victim Impact Evidence And Judicial Instructions On Juror Memory Distortion And Sentencing Decisions In Capital Trials, Auset E. Alexander
Brace For Impact: The Effects Of Victim Impact Evidence And Judicial Instructions On Juror Memory Distortion And Sentencing Decisions In Capital Trials, Auset E. Alexander
Student Theses
The utilization of visual evidence in the courtroom has increased exponentially in an effort to portray additional information that cannot otherwise be established via forensic evidence and expert testimony. According to Rule 403 of the Federal Rules of Evidence (1984), visual evidence may be permitted in court if the prejudicial value does not significantly outweigh the probative value. The admissibility of visual evidence however, becomes controversial when combined with victim impact statements (VIS) during the penalty phase of capital trials.
Previous research has indicated that jurors are often unable to perceive emotional testimony and subsequently make objective sentencing decisions that …
Graffiti, Speech, And Crime, Jenny E. Carroll
Graffiti, Speech, And Crime, Jenny E. Carroll
Faculty Scholarship
Graffiti resides at the uncomfortable intersection of criminal law and free speech rhetoric. It is not the shout of revolution to the gathered, protesting masses, or the political pamphlet flung from a 1920s window. Graffiti is not the obscene-rendered-political-jacketed protest of war, or a flag set aflame in the name of reclaiming patriotism. It is an illicit scrawl. It is damage and defiance rolled into one from the moment of its creation. Graffiti is a crime.
Unlike more celebrated examples of free speech, graffiti earns no safe harbor from the First Amendment. When asked to choose between the tag that …
Moving Toward A Holistic Understanding Of Recidivism, Michael Thomas Wilber
Moving Toward A Holistic Understanding Of Recidivism, Michael Thomas Wilber
All Theses And Dissertations
The United States incarcerates more individuals per capita than any other nation. According to Porter, Bushway, Tsao, & Smith (2016), “There are currently 2.1 million individuals detained in the correctional institutions in the United States. Young adults, individuals between the ages of 18 and 25, represent the smallest portion of the general population yet comprise the largest portion of the incarcerated population. Furthermore, African Americans comprise 13% of the general population of the United States but comprise 58% of the prison populations in the United States. Finally, the recidivism rate, the rate at which former inmates recriminalize and return to …

"All The Flowers May Die, But The Thistles Will Live": Sex Trafficking Through The Eyes Of A Police Officer-Researcher, Robert Chrismas
Dignity: A Journal of Analysis of Exploitation and Violence
This article is a description of the research I conducted on the sex industry in Manitoba, Canada, from 2016-2017. I interviewed 61 people, of which six were political leaders, 23 were social workers, 24 were police officers, and eight were sex industry survivors. About half of the practitioners I interviewed are also sex industry survivors. As a veteran police officer with 35 years of law enforcement experience, my research journey was unique from conducting the interviews to reporting my findings. These are some of my experiences and the lessons I learned about gathering and sharing the stories of sex industry …
Knowledge, Principal Support, Self-Efficacy, And Beliefs Predict Commitment To Trauma-Informed Care, Stephanie A. Sundborg
Knowledge, Principal Support, Self-Efficacy, And Beliefs Predict Commitment To Trauma-Informed Care, Stephanie A. Sundborg
School of Social Work Faculty Publications and Presentations
Objective: Organizations are identifying trauma-informed care (TIC) as a priority yet implementation is slow. Research suggests commitment to a change effort is an important predictor for change behavior; however, there is little theoretical or empirical evidence exploring commitment to TIC. This study examines the variables that predict affective commitment to TIC including foundational knowledge, principal support, self-efficacy, and beliefs about trauma. Does foundational knowledge independently predict affective commitment to TIC or is this relationship mediated by other variables? Method: Data were collected from 118 participants working in human services, using cross-sectional survey design. Participants completed self-report measures of affective commitment …
Turning In The Widening Gyre: History, Corporate Accountability, And Transitional Justice In The Postcolony, Jeffrey Atteberry
Turning In The Widening Gyre: History, Corporate Accountability, And Transitional Justice In The Postcolony, Jeffrey Atteberry
Chicago Journal of International Law
This Article argues that transitional justice, by increasing efforts to include corporate accountability within its various mechanisms, may confront the global structures of rule that systematically produce conditions of violence within formerly colonized nation-states. Building on work by Giorgio Agamben and Homi Bhabha, I demonstrate that the very notion of a “transition” around which transitional justice is articulated derives from a nineteenth-century understanding of history that reflects the ideology of development which supported the colonial system. Moments of violent historical discontinuity, legally conceptualized as “states of exception,” provide the paradigmatic bases for models of transitional justice. But, in the history …

Between Reparations And Repair: Assessing The Work Of The Icc Trust Fund For Victims Under Its Assistance Mandate, Anne Dutton, Fionnuala Ní Aoláin
Chicago Journal of International Law
The practice of international justice has made a significant shift from narrowly focused criminal accountability to a broader and more holistic understanding encompassing the totality of victims’ justice needs. In particular, international criminal justice is concerned with victims of mass atrocity crimes, whose needs are profound and whose capacities are limited by the experiences of gross and systematic violence. These needs include individual and communal capacity building to engage in criminal processes as well as remedy and repair in the aftermath of criminal procedures. The Trust Fund for Victims represents, in many ways, the epicenter of this shift in international …

Neighborhood Ecology And Recidivism: A Case Study In Nyc, Sarah Picard Fritsche
Dissertations, Theses, and Capstone Projects
The last decade has witnessed unprecedented efforts to reform the criminal justice system and stem the tide of mass incarceration in the United States. Persistently high rates of recidivism among justice-system involved individuals, however, present a significant obstacle to the success of these efforts. Thirty years of research in the fields of social psychology and criminology has produced a shared understanding of the individual characteristics that drive recidivism, but less is known regarding the influence of social environment. This research makes several unique contributions to a growing body of scholarship examining recidivism in the context of neighborhood, including being one …
Shared Deliberations: Learning From The Voices Of Social Justice Lawyers On Their Aspirations, Challenges And Roles, Ian Head
Dissertations, Theses, and Capstone Projects
Lawyers in the U.S. who attempt to advocate for social justice issues, often on behalf of those communities most targeted by government institutions and oppressive legal systems, have unique perspectives into the challenges of using the law to create transformative change. This thesis examines the voices of over a dozen attorneys fighting not only on behalf of their clients, but also wrestling with how to best use a set of legal tools not meant for dismantling systems of power. Listening to how these legal advocates navigate their roles inside a system of laws created to consolidate rather than distribute power …

The Contested Terrain Of The Louisiana Carceral State: Dialectics Of Southern Penal Expansion, 1971–2016, Lydia Pelot-Hobbs
Dissertations, Theses, and Capstone Projects
“The Contested Terrain the Louisiana Carceral State” examines the development of the Louisiana carceral state as produced from above and contested from below from 1971 to 2016. Through a combination of archival research, oral history interviews, and in-depth ethnographic fieldwork, I argue that Louisiana has expanded, consolidated, and adapted its carceral infrastructure in response to multiscalar political economic crises tied to global oil booms and busts, federal state interventions, and when oppositional movements gain traction. “Carceral infrastructure” refers to both the literal building of new state prisons and parish jails alongside passage of draconian sentencing laws, and bulking up of …
Intimate Partner Violence Among Expectant Adolescent Couples: Psychological And Relational Predictors And Sexual Risk, Jessica Lewis
Intimate Partner Violence Among Expectant Adolescent Couples: Psychological And Relational Predictors And Sexual Risk, Jessica Lewis
Dissertations, Theses, and Capstone Projects
BACKGROUND/PURPOSE: Intimate partner violence (IPV) is prevalent and tends to be bilateral in adolescent relationships. Expectant adolescent couples are at even higher risk. Using the Actor-Partner Interdependence Model (APIM), this study sought to: (1) describe the patterns of physical/sexual and psychological IPV victimization of women and men in expectant adolescent couples from pregnancy through twelve months postpartum; (2) examine the associations between psychosocial and relational factors during pregnancy and postpartum IPV; and (3) investigate the relationship between IPV victimization and later sexual risk across the perinatal period.
METHODS: Data were collected from pregnant adolescents and their male partners (N=296) recruited …
A Study Of The Impact Of The Physical Properties Of Blood On The Interpretation Of Bloodstain Patterns In Forensic Investigations, Ira S. Dubey
Dissertations, Theses, and Capstone Projects
There are many situations when the value of the physical characteristics of blood far outweighs the information gained from DNA analysis of the bloodstain (Brodbeck, 2012; Raymond, Smith and Liesegang, 1996). Analysis of bloodstain patterns at crime scenes or on clothing often provides significant information and serves both as investigate aids and as evidence presented in court. There has been limited work done to evaluate the potential impact of variation in the physical properties of blood on the interpretation of blood spatter patterns. This dissertation will expand on previous work and investigate how changes in the physical properties of blood, …

Identity Shifts Among Cis- And Trans- Females Who Sell Sex On The Streets Of New York City, Amalia S. Paladino
Dissertations, Theses, and Capstone Projects
The Deviant Identity Shift (DIS) Model that is introduced in this dissertation provides a framework for making sense of how sex workers come to understand their own place in the world, including the experiences of violence that often accompany their lives, and it shifts our attention away from static models that focus on unidimensional or even multidimensional factors that impact the lives of sex workers, to a far more dynamic view of the evolution of their distinctive forms of cultural identity. A series of themes emerge from the life histories of 18 cis- and 15- trans women between the ages …

Why Is The Black Population Of Central Brooklyn, The Mecca Of Black Nyc, Diminishing?, Jamell N.A. Henderson
Dissertations, Theses, and Capstone Projects
This research looks at three possible reasons that might help to explain this unfortunate exodus. The first approach is through health and examines trends in environmental, mental and physical (general) health. I will explore statistics involving the health and well-being of Central Brooklyn, how the environment plays a disparate role in the poor health and lack of access to services of its African-American residents in comparison to other regions in Brooklyn. The second task is to ask how economics or “racial capitalism” plays a role by looking at gentrification, cooperative economics, and the income inequality in Black Central Brooklyn. The …
Police Reform In Ukraine Since The Euromaidan: Police Reform In Transition And Institutional Crisis, Nicholas Pehlman
Police Reform In Ukraine Since The Euromaidan: Police Reform In Transition And Institutional Crisis, Nicholas Pehlman
Dissertations, Theses, and Capstone Projects
Why does reform of law enforcement remain so elusive in post-communist countries like Ukraine, despite political upheaval, a public mandate for reform and substantial international assistance? Which components contribute to the success and sustainability of a police reform and which factors produce political will from political leaders to implement the difficulties of police reform? This dissertation argues that in addition to massive corruption and the politics of insecurity, the greatest challenges to reform of Ukraine’s law enforcement system is political competition, resulting in the politicization of law enforcement institutions and law enforcement policy. Political competition is based in Ukraine’s fractured …

The Post-9/11 Lgbtq Human Rights Struggle In Egypt, Donna K. Huaman
The Post-9/11 Lgbtq Human Rights Struggle In Egypt, Donna K. Huaman
Dissertations, Theses, and Capstone Projects
Since the turn of the twenty-first century, the struggle for LGBTQ human rights has become a leading standard that depicts whether or not a state can be considered modern and progressive. Yet, while this new criterion seems to be supported by Global North states, other nations in other regions, like Egypt from the Middle East, North Africa (MENA) has criticized the international pressure to implement this standard as neo-imperialist and inauthentic to its Muslim-Arab culture. Egypt claims to be the universal Arab-Muslim voice for the MENA region and has become one of the greatest challengers to the international campaign for …
Obfuscating Authorship: Results Of A User Study On Nondescript, A Digital Privacy Tool, Robin Camille Davis
Obfuscating Authorship: Results Of A User Study On Nondescript, A Digital Privacy Tool, Robin Camille Davis
Publications and Research
For those who write anonymously, particularly for safety reasons, authorship attribution poses a threat. Nondescript, my web app, guides writers in achieving stylometric obfuscation in order to preserve anonymity. The app runs simulations of authorship attribution scenarios by analyzing the user’s linguistic features. In this paper, I will describe the conception of the Nondescript app; discuss related work; and present the results of a user study. Most users in the study were able to anonymize their writing in at least 5 out of 10 authorship attribution scenarios. Users rated the anonymization process an average of 3.6 out of 5 in …
Guilty By Association: A Critical Analysis Of How Imprisonment Affects The Children Of Those Behind Bars, Whitney Q. Hollins
Guilty By Association: A Critical Analysis Of How Imprisonment Affects The Children Of Those Behind Bars, Whitney Q. Hollins
Dissertations, Theses, and Capstone Projects
As 2.2 million individuals in the United States are currently incarcerated and an additional 5 million are under some form of correctional surveillance, the push for prison reform has reached new heights. Intimately and inextricably connected to mass incarceration and the push for its reform (and in some cases abolition) are the children have been impacted by incarceration. About half of the individuals currently incarcerated are parents to at least one child under the age of 18. Current estimates suggest that 2.7 million children currently have an incarcerated parent and that 10 million children in the United States have experienced …
Challenges In Measuring Firearm Prevalence: A Test Of Cook's Index Across The Rural–Urban Continuum, Noah R. Cypher
Challenges In Measuring Firearm Prevalence: A Test Of Cook's Index Across The Rural–Urban Continuum, Noah R. Cypher
Dissertations, Theses, and Capstone Projects
Cook's Index is the most commonly used proxy for firearm prevalence. This research uses New York's Pistol Permits to measure legitimate firearm prevalence and compare it to Cook's Index. In this study, Cook's Index predicted impossible values for several counties that together contained a clear majority of New York State citizens. Cook's Index was also shown to be unreliable across types of counties. Rural and Urban counties had significantly different ratios of Cook's Index to Pistol Permits in New York. The models show a general finding that the relationship between Cook's Index and legitimate firearm ownership varies depending on the …

A Study Of Factors Influencing Hiring Decisions In The Context Of Ban The Box Policies, Ronald F. Day
Dissertations, Theses, and Capstone Projects
This dissertation investigates whether NYC employers adhered to Ban the Box by removing the question about criminal history from employment forms, by refraining from inquiring about an applicant’s criminal record during the interview process, and by complying with other aspects of the policy. The study also documents employer perspectives on Ban the Box and on the hiring of individuals with criminal convictions, and examines whether more individuals with a criminal record were hired after the policy was implemented.
Using a mixed-methods approach, surveys were administered to companies in the nonprofit and private sectors, and semi-structured interviews were conducted with a …
Police Officers And College Education: The Association Of Police Officer College Education And The Level Of Force Used By A Police Officer In Gaining Compliance In Arrest Situations, John Vespucci
Dissertations, Theses, and Capstone Projects
The objective of this study was to research the association between a police officer’s college education and the level of force a police officer uses to gain compliance when making an arrest. There is a strong agreement in existing literature that the college education of a police officer has positive effects upon police officer skill sets including the use of force. However, this study seeks to update existing literature as most studies are over a decade old, which is problematic due to the fact that they are outdated and may not represent the challenges in contemporary policing. This study collected …
