School And Work Experiences Of Adults With Adhd: A Qualitative Case Study, Julieta E. Robello
CUP Ed.D. Dissertations
This study focused on learning about the life experiences of individuals with attention deficit hyperactivity disorder (ADHD). ADHD has three major traits: hyperactivity, impulsivity, and inattention. This phenomenological study focused on adults ages 18 to 40. The questions posed were: (a) What barriers or successful strategies do individuals with ADHD encounter as they make their way through the educational system and into the workplace? (b) How do these individuals perceive their academic success or failure? (c) How is or was parental support a factor in their academic success or failure? (d) How is or was teacher support a factor in …

When Self-Care Is Not Enough: Reflections On How To Make Trauma-Intensive Clinical Work More Sustainable, Brianna C. Delker
When Self-Care Is Not Enough: Reflections On How To Make Trauma-Intensive Clinical Work More Sustainable, Brianna C. Delker
Dignity: A Journal of Analysis of Exploitation and Violence
As a psychology resident on the psychiatry consultation-liaison service at a trauma center, I was asked by another trainee how I cope with the devastating cases of traumatic injury and abuse that we witnessed regularly on the service. This trainee’s courageous question about how we as providers cope sustainably with bearing witness to trauma coincided with my own reflection on the limits of “self-care” as it is often discussed and practiced in human service professions. In this article, I argue that an activity-based approach to self-care is not enough for providers in trauma-intensive service settings and must be complemented with …
Honoring Innocent Until Proven Guilty: Switching The Default Rule From Pretrial Detention To Pretrial Release In Texas's Bail System, Stephen Rispoli
Honoring Innocent Until Proven Guilty: Switching The Default Rule From Pretrial Detention To Pretrial Release In Texas's Bail System, Stephen Rispoli
Texas A&M Law Review
Texas’s current prison population consists of far more pretrial detainees than convicted criminals. Despite United States and Texas constitutional protections, the default rule in many jurisdictions, including Texas, detains misdemeanor and non-violent felony defendants unless they can post a monetary bond or get a surety to post the bond for them (“bail bond”) to obtain their release. Most pretrial detainees remain detained due not to their alleged dangerousness, but rather because they simply cannot afford to post bail (or get someone to post it for them). As a result, many pretrial detainees find themselves choosing between hamstringing their financial future …

© The Author(s) 2019. The improvement of public services is an important public policy objective, and several approaches have been proposed and implemented across all levels of government to achieve this goal. A recent policy in Florida (FL) fosters collaboration between local and state governments by allowing local tax collector (TC) offices to receive and support applications for the state’s concealed weapons (CW) license program. We use 80,020 application records to estimate process improvements brought about by this policy. Our analysis shows that by using TCs, the time for the application to be processed was one third the time it …

Weed Whacking Through The Tenth Amendment: Navigating A Trump Administration Threat To Withhold Funding From Marijuana-Friendly States, Arlen Gharibian
Loyola of Los Angeles Law Review
The Trump administration has taken a firm stance against marijuana legalization at the state level. While an official federal policy is still pending, this Article focuses on whether the Trump administration’s threats to preventCalifornia from pursuing its duly enacted marijuana legalization law violates the Tenth Amendment. This Article then addresses how the federal government could achieve its goal while remaining within the bounds of the Constitution.

Rigor And Relationships: The Positive Case For Integration In Schools And Neighborhoods, Rachel D. Godsil
Rigor And Relationships: The Positive Case For Integration In Schools And Neighborhoods, Rachel D. Godsil
Cardozo Law Review
This Essay first explores the current conditions of schools and neighborhoods and the impediments to achieving successful integration in schools- implicit bias, racial anxiety, and stereotype threat. Second, the Essay then identifies the strategies that are being employed in some schools to overcome these impediments and create quality schools that educate all students in a just and effective manner. Finally, the Essay explains how integrated neighborhoods would be the most effective long-term solution to the stereotyping and biases that underlie racial injustices across the board.
The Coming Out Of Memory: The Holocaust, Homosexuality, And Dealing With The Past, Arnaud Kurze
The Coming Out Of Memory: The Holocaust, Homosexuality, And Dealing With The Past, Arnaud Kurze
Department of Justice Studies Faculty Scholarship and Creative Works
This research discusses the challenges of establishing a collective memory for gay victims of the Nazi terror in World War II and examines the introduction of gay victimhood into the public sphere through memorialization efforts. While scholarly accounts on gays and the Holocaust emerged in the 1970s, little is known about the emergence and consolidation of a public narrative on gay persecutions under the Nazis. It raises important questions, including why a public voice for crimes against sexual minorities in World War II emerged only hesitantly? Drawing on historical gay memorialization processes in Germany, the author maps the obstacles for …
The Demise Of § 1983 Malicious Prosecution: Separating Tort Law From The Fourth Amendment, Erin E. Mcmannon
The Demise Of § 1983 Malicious Prosecution: Separating Tort Law From The Fourth Amendment, Erin E. Mcmannon
Notre Dame Law Review
The common-law tort of malicious prosecution originally developed to provide a remedy for plaintiffs who were unjustly prosecuted in a criminal proceeding. Today, malicious prosecution actions can be brought to redress wrongful civil actions as well. The “central thrust” of an action for malicious prosecution is a right not to be involved in an unjustified litigation.
This Note suggests that the confusion in this area of law derives from the use of the language of malicious prosecution tort law to describe what really amounts to a Fourth Amendment seizure claim under § 1983. There is no constitutional right to be …

Advancing Racial Justice And Human Rights: Rights-Based Strategies For The Current Era, Human Rights Institute
Human Rights Institute
On June 1, 2018, the Human Rights Institute convened its 15th annual CLE Symposium on Human Rights in the United States, a signature event of the Human Rights Institute’s Bringing Human Rights Lawyers’ Network. The day-long event brought together more than 150 leading U.S. lawyers, activists, and academics, along with federal and local government representatives to share strategies to advance racial justice within a domestic and global context increasingly hostile to human rights.
This report highlights key takeaways and themes from the Symposium, drawing from speakers’ remarks and their advocacy. It also serves as a basic human rights primer, describing …

Burning A Hole In The Pocket Of Justice: Prop. 66'S Underfunded Attempt To Fix California's Death Penalty, Flavia Costea
Loyola of Los Angeles Law Review
California has struggled with the administrative and financial burdens of a flawed death penalty system for decades. In an effort to save the death penalty, the voters of California enacted Proposition 66, which promised to deliver a quicker and more cost-effective system. This Article focuses on the provision of Prop. 66 that expands the number of lawyers who can act as defense lawyers for inmates on death row. While this provision superficially seems to solve the shortage of defense attorneys willing to take on death penalty cases, without significant funding, the shortage of resources and pressure to speed up executions …

No Evidence Of “Weaponized Title Ix” Here: An Empirical Assessment Of Sexual Misconduct Reporting, Case Processing, And Outcomes, Tara N. Richards
Criminology and Criminal Justice Faculty Publications
Little is known about actual incidents of gender-based violence reported by college students or the campus adjudication process or outcomes of reported cases. Data from Annual Security Reports (ASRs) and Title IX Coordinators was used to examine the context, processes, and outcomes of reported incidents of sexual misconduct (n=1,054) at Institutions of Higher Education (IHEs) in a Mid-Atlantic state. Results showed that ASRs undercounted incidents of sexual misconduct. Few incidents reported to Title IX Coordinators resulted in a formal Title IX complaint, and fewer still resulted in a finding of responsibility or suspension/expulsion of the responsible student. The primary outcome …

The Obama Criminal Justice Doctrine And International Criminal Justice, Biko Agozino
African Journal of Criminology and Justice Studies
This papyrus reviews the doctrine of the Obama presidency on criminal justice administration and abstracts the principles for the evaluation of the foreign policy records of the Obama administration. W.E.B. Du Bois theorized the potential role of America in world peace and conflict based on a double victory strategy that also addresses injustice at home. A brief review of theories of international relations leads to the conclusion that Obama is a realist who subscribes to the democratic theory of international relations and not the socialist or radical that his opponents want to paint him. The popular democratic revolutions in the …

Challenges Of Lagos State Child’S Rights Law: Social Welfare Officers’ Perspective, Chinwe R. Nwanna, Iyabode Ogunniran
African Journal of Criminology and Justice Studies
Child’s Rights Law (CRL) was introduced in Lagos State in 2007. Six years after its domestication, it became imperative to assess the challenges in the application of the justice provisions by different child justice administrators such as social welfare officers, the police, non-governmental organization (NGO) workers, Nigerian Bar Association (NBA) lawyers, International Federation of Women Lawyers (FIDA), family court judges and magistrates. The focus of this paper is, therefore, to present the findings from social welfare officers working in family courts in Lagos State. As at the time of the study, there were six family courts but only four were …

Awareness And Perception Of Cybercrimes And Cybercriminals, Hannarae Lee, Hyeyoung Lim
Awareness And Perception Of Cybercrimes And Cybercriminals, Hannarae Lee, Hyeyoung Lim
International Journal of Cybersecurity Intelligence & Cybercrime
Awareness is a starting point to recognize, understand, or know a situation or fact, and the perception makes a difference in how to deal with it. Although the term cybercrime may not be new to the most public and the police, not all of them are well aware of the nature and extent of cybercrimes, cybercriminals, and cyber-victims, which in turn affects their perceptions of matters. The four papers in this issue of the International Journal of Cybersecurity Intelligence and Cybercrime empirically examine these important topics and discuss policy implications.

Phishing And Cybercrime Risks In A University Student Community, Roderic Broadhurst, Katie Skinner, Nicholas Sifniotis, Bryan Matamoros-Macias, Yuguang Ipsen
International Journal of Cybersecurity Intelligence & Cybercrime
In an exploratory quasi-experimental observational study, 138 participants recruited during a university orientation week were exposed to social engineering directives in the form of fake email or phishing attacks over several months in 2017. These email attacks attempted to elicit personal information from participants or entice them into clicking links which may have been compromised in a real-world setting. The study aimed to determine the risks of cybercrime for students by observing their responses to social engineering and exploring attitudes to cybercrime risks before and after the phishing phase. Three types of scam emails were distributed that varied in the …

Cybercrime And Digital Forensics: Bridging The Gap In Legislation, Investigation And Prosecution Of Cybercrime In Nigeria, Kabiru H. Mohammed, Yusuf D. Mohammed, Abiodun A. Solanke
International Journal of Cybersecurity Intelligence & Cybercrime
The advancement of Information and Communication Technologies (ICT) opens new avenues and ways for cybercriminals to commit crime. The primary goal of this paper is to raise awareness regarding gaps that exist with regards to Nigeria’s capabilities to adequately legislate, investigate and prosecute cases of cybercrimes. The major source of cybercrime legislation in Nigeria is an act of the National Assembly which is majorly a symbolic legislation rather than a full and active legislation. In perusing these avenues of inquiry, the authors seek to identify systemic impediments which hinder law enforcement agencies, prosecutors, and investigators from properly carrying out their …
