The Holy See's Compliance With The United Nations Convention On The Rights Of The Child, Kaleigh Mcmanus Feb 2019

The Holy See's Compliance With The United Nations Convention On The Rights Of The Child, Kaleigh Mcmanus

DePaul Journal for Social Justice

In recent years, the Holy See has been called upon to address the systematic and epidemic clerical child sexual abuse that has affected children worldwide. However, in spite of the egregious human rights violations that have occurred under the auspices of the Vatican, the Holy See continues to prioritize protection of church’s reputation and impunity of the perpetrators. Policies such as priest shifting and interference with civil investigations have allowed sexual abuse of children to continue. Thus, the Holy See is not in compliance with its legal obligations under the Convention on the Rights of the Child to act in …

Offers, Threats, And Unconstitutional Conditions, Kenneth W. Simons Feb 2019

Offers, Threats, And Unconstitutional Conditions, Kenneth W. Simons

San Diego Law Review

In this Article, Professor Simons suggests that the hoary threat/offer distinction helps explain and justify the continued survival of the unconstitutional conditions doctrine, but only a narrow version of that doctrine. At the same time, the threat/offer distinction also helps explain and justify the continued survival of a narrow version of the "greater includes the lesser" argument. The author provides a careful analysis of what constitutes a "threat" and an "offer" and suggests that in its pure form, it is morally and constitutionally significant. A "threat" is a government proposal to make the citizen worse off than she would otherwise …

Chief Justice Leadership: A Brief Sketch Of Its Landscape, Structure, And Operation, David A. Root Feb 2019

Chief Justice Leadership: A Brief Sketch Of Its Landscape, Structure, And Operation, David A. Root

Journal of the Indiana Academy of the Social Sciences

This article examines chief justice leadership of the United States Supreme Court during the judicial decision-making process and develops a model of such leadership in three distinct parts: landscape, structure, and operation. The landscape consists of five interactive stages in the judicial decision-making process: certiorari, oral argument, conference, majority opinion assignment, and opinion drafting. Structurally, three prevailing conditions on the Court create a “democratic default”: life tenure, equal vote, and free voice. In terms of operation, the office employs small-group leadership and its twin pillars of task and social leadership in conjunction with behavioral leadership and its three types of …

Statement Of Betsy Ginsberg, Clinical Associate Professor Of Law & Director, Civil Rights Clinic, Benjamin N. Cardozo School Of Law U.S. Commission On Civil Rights Public Briefing: Women In Prison: Seeking Justice Behind Bars, Betsy Ginsberg

Testimony

Although men make up a significant majority of the country’s prison population, the United States has the highest rate of incarceration of women in the world.1 In recent years, women have been the fastest growing segment of our population in jails and prisons. The significant but insufficient decline we have seen with respect to the overall prison population eclipses or obscures the trend we have seen in the imprisonment of women. While the trends vary from state to state, the overall picture for women has been far worse than for men. In most states the women’s population has either grown, …

Parental Incarceration And Social Status Attainment Of Hispanic Young Adults, Igor Ryabov Feb 2019

Parental Incarceration And Social Status Attainment Of Hispanic Young Adults, Igor Ryabov

Sociology Faculty Publications

The fact that parental incarceration has become a common event in the life course of many children is troubling. Using structural equation modeling, the present study investigates how immigrant generational status and family socioeconomic background interact with parental incarceration to influence status attainment for Hispanic young adults. Three indicators of status attainment in young adulthood are used as outcome variables—educational attainment, wage, and job quality. Results indicate that parental incarceration has a strong and negative influence on all three indicators of attained status. Most importantly, we found that parental incarceration mediates influence of immigrant generational status and family socioeconomic background …

Protecting The Fifth Amendment: The Residual Clause In The Mandatory Guidelines Is Void For Vagueness, Olivia M. Tourgee

St. John's Law Review

(Excerpt)

The first part of this Note will address the specific problem the Mandatory Guidelines present. First, the Mandatory Guidelines will be defined, and the mandatory and binding nature of these Mandatory Guidelines will be explored in depth. Second, this Note will explain the significance of the Supreme Court’s opinion in Booker that declared the Mandatory Guidelines unconstitutional. Third, this Note will evaluate Beckles, where the Supreme Court held that the Advisory Guidelines were not subject to vagueness challenges. Thus, the first part of this Note will set the stage for the problem that the Mandatory Guidelines present.

The second …

Cost-Benefit Analysis And Human Rights, William J. Aceves Feb 2019

Cost-Benefit Analysis And Human Rights, William J. Aceves

St. John's Law Review

(Excerpt)

This Article considers whether cost-benefit analysis can provide the human rights movement with the answers it seeks. It offers an instrumentalist and empirical approach to complement the normative arguments that are most often used by the human rights movement. If human rights could be fully monetized, states could consider the full range of benefits that arise from protecting rights and the costs that occur when rights are violated. This approach could provide states with a more accurate methodology for making decisions that affect human rights. In fact, protecting human rights may prove to be costeffective, particularly when second order …

Rule 1.1 Duty Of Competency And Internet Research, Sharon Bradley

Continuing Legal Education Presentations

Basically the world has changed and technology is the primary driver. The legal industry has changed and yet many lawyers still brag about their lack of technology skills. These skills are not advanced programming and software design. I am talking about the competent use of basic office applications. Service providers like RocketLawyer and LegalZoom prepare wills, contracts and articles of incorporation. It’s estimated that these providers are now at least an $8 billion industry. People that used to hire local attorneys are now using these services. Potential clients are also using online service to find and evaluate lawyers. The days …
