African-American Male Perceptions On Public Schooling After Discipline: A Contextual Portrait From The Inner City, Kevin William Smith Jr. Apr 2019

African-American Male Perceptions On Public Schooling After Discipline: A Contextual Portrait From The Inner City, Kevin William Smith Jr.

LMU Theses and Dissertations

Literature shows that one of the major issues affecting the achievement of inner-city African- American male students in public-schools is the ineffectiveness of disciplinary procedures. These studies have shown a direct positive relationship between student behavioral problems and academic failure. This study was an attempt at answering Noguera’s (2008) call for understanding more fully how African-American males come to perceive schooling, in particular their discipline experiences, and how environmental and cultural forces impact this perception of their behavior and performance in school. This was a qualitative study that heard the stories of inner-city African-American male students who were pushed out …

Silenced Voices: Remedying The Historical Suppression Of Felons And The Black Vote, Isabel Tayag Apr 2019

Silenced Voices: Remedying The Historical Suppression Of Felons And The Black Vote, Isabel Tayag

Creative Activity and Research Day - CARD

The disenfranchisement of felons in the United States evolved from a historical precedent brought to the Americas during colonization. Our country adopted the political philosophy that shaped criminal voting laws around the country—criminals are unable to govern themselves and therefore unable to govern a country; their participation in our government would be danger to the purity of the ballot box. With rising racial tensions after Reconstruction, preserving the purity of the ballot box became a preservation of the white vote. This paper argues that felon disenfranchisement became a tool to further suppress African American after poll taxes, literacy tests, and …

The Evolution Of The Criminal Justice System Through Dna Sequencing, Ashley Driscoll Apr 2019

The Evolution Of The Criminal Justice System Through Dna Sequencing, Ashley Driscoll

Academic Festival

Deoxyribonucleic acid or DNA stores all of the genetic information that is unique to each individual. Scientists have long since discovered DNA, however without the proper technology it has been of little use in forensic analysis. In 1970 the first method of DNA sequencing had been developed which had great promise amongst many fields including biology, psychology, and even forensics. Specifically, with respect to the criminal justice system investigators now had the ability to accurately convict guilty criminals as well as to exonerate those who have been wrongfully convicted. Although DNA sequencing is very commonly used across many different disciplines, …

Equitable Gateways: Toward Expanded Federal Habeas Corpus Review Of State Court Criminal Convictions, Eve Brensike Primus Apr 2019

Equitable Gateways: Toward Expanded Federal Habeas Corpus Review Of State Court Criminal Convictions, Eve Brensike Primus

Articles

State prisoners who file federal habeas corpus petitions face a maze of procedural and substantive restrictions that effectively prevent almost all prisoners from obtaining meaningful review of their convictions. But it is a mistake to think that habeas litigation is just a Kafkaesque nightmare with no constructive potential. Federal courts do sometimes cut through the doctrinal morass to consider state prisoners’ claims, relying on what this Articleterms "equitable gateways" to federal habeas relief. Litigants and courts generally underestimate the potential these gateways offer, with the result that habeas litigation does not focus on them as often as it should. Here …

System Accountability And Sexual Assault: The Past And Future Of The Criminal Justice System, Alta Viscomi

Richmond Public Interest Law Review

The #MeToo Movement and the rise in the public consciousness of the impact of sexual violence has made abundantly clear that the legal rape reform movement that began in the 1970s was largely unsuccessful in stemming the tide of sexual violence. That movement was directed at the procedures in criminal justice system that make rape prosecutions easier for the state, but it failed to address the state’s role in enabling and perpetuating sexual violence. By failing to address those issues and by actively turning to carceral feminism, the state implemented a system in which sexual violence reporting remains low while …

Vicarious Trauma In Public Service Lawyering: How Chronic Exposure To Trauma Affects The Brain And Body, Megan Zwisohn, Wayne Handley, Danielle Winters, Alyssa Reiter

Richmond Public Interest Law Review

Each day, attorneys and other service providers are subject to trauma. By the nature of the profession, they work with victims of crime, victims of poverty, and victims of discrimination. While attorneys do not personally experience this victimization, they do often internalize it and revisit it in case preparation. As a result, attorneys, particularly those in public interest roles, regularly experience, burnout, compassion fatigue, and vicarious trauma. These factors can negatively impact attorneys neurological and physiological functioning, causing them harm and potentially causing harm to their client or their client’s case. For these reasons, it is critically important for attorneys …

To The Survivors Of Childhood Sexual Abuse- Whenever You’Re Ready: Eliminating The Criminal Statute Of Limitations On Childhood Sexual Assault Crimes In Light Of Pennsylvania’S Catholic Dioceses Grand Jury Investigation, Rebecca Schultz Apr 2019

To The Survivors Of Childhood Sexual Abuse- Whenever You’Re Ready: Eliminating The Criminal Statute Of Limitations On Childhood Sexual Assault Crimes In Light Of Pennsylvania’S Catholic Dioceses Grand Jury Investigation, Rebecca Schultz

Richmond Public Interest Law Review

It is exceptionally difficult for many survivors of sexual assault to come forward to tell their story. This is particularly the case where the perpetrator is someone in a position of power who the survivor trusted. The statute of limitations for cases of childhood sexual abuse can serve as another barrier preventing survivors from coming forward because it prevents any semblance of justice for those individuals. This is currently most evident in states like Pennsylvania that still impose a statute of limitations on crimes of sexually assaulting children. Pennsylvania is reeling from its most recent Catholic clergy sex abuse scandal, …

Publications and Research

Proactive policing, the strategic targeting of people or places to prevent crimes,is a well-studied tactic that is ubiquitous in modern law enforcement. A 2017 National Academies of Sciences report reviewed existing literature, entrenched in deterrence theory, and found evidence that proactive policing strategies can reduce crime. The existing literature, however, does not explore what the short and long-term effects of police contact are for young people who are subjected to high rates of contact with law enforcement as a result of proactive policing. Using four waves of longitudinal survey data from a sample of predominantly black and Latino boys in …
