The Primitive Lawyer Speaks!: Thoughts On The Concepts Of International And Rabbinic Laws, Harlan G. Cohen Jan 2019

The Primitive Lawyer Speaks!: Thoughts On The Concepts Of International And Rabbinic Laws, Harlan G. Cohen

Faculty Scholarship

Inspired by Chaim Saiman’s brilliant book, Halakhah: The Rabbinic Idea of Law, this essay draws connections between the lived experiences of international law and Jewish law, focusing in particular on (1) the centrality of practice, (2) the search for and construction of authority in communities of practice (the “invisible college”), (3) the challenges and opportunities of fragmentation and pluralism, and (4) the difficulty translating their methods to more state-like institutions, like courts and legislation. The hope is that this testimony of one of H.L.A. Hart’s primitive lawyers can provide a fuller, more textured picture of how law might operate or …

Many will read Samuel Moyn’s powerful history of the quest for social and material justice as an intended wake-up call. Rather than as a blaring alarm though, Not Enough is better read as an invitation to dream.

Untapped Communicative Resources In Multilingual Classroom Settings: Possible Alternatives, Lydiah Kananu Kiramba, James Alan Oloo Jan 2019

Untapped Communicative Resources In Multilingual Classroom Settings: Possible Alternatives, Lydiah Kananu Kiramba, James Alan Oloo

Department of Teaching, Learning, and Teacher Education: Faculty Publications

This paper presents a critical review of literature relating to language policy and literacy practices in education, with a particular focus on multilingual Kenya. Existing research on schooling in Kenya often draws attention to the use of languages that are distanced from students’ daily realities and localities. This article synthesizes research on literacy practices in Kenyan primary classrooms to explicate the current language-in-education policy and practices, and, to discuss their impacts on literacy access and knowledge production in the classroom. We argue that Kenya’s language-in-education policy, which informs curricula and teaching, and is itself grounded in monoglossic orientations, inhibits students’ …

Why The Gospel Of John Is Fundamental To Jesus Research (Chapter One Of Jesus Research: The Gospel Of John In Historical Inquiry), Paul N. Anderson Jan 2019

Why The Gospel Of John Is Fundamental To Jesus Research (Chapter One Of Jesus Research: The Gospel Of John In Historical Inquiry), Paul N. Anderson

Faculty Publications - George Fox School of Theology

The constellation of the Johannine riddles—theological, historical, literary—and their implications for understanding the Jesus of history as well as the Christ of faith, and thus the historical and religious basis of western civilization, comprises arguably the most difficult set of biblical critical issues and discussions in the modern era: full stop. Just as John’s theological tensions precipitated and contributed to the most intensive and extensive of theological discussions in the patristic era, so John’s literary and historical tensions have contributed to most intensive and extensive literary and historical biblical discussions in the modern era. Understandably, the issues are complex. The …

John Bellers (1654–1725): ‘A Veritable Phenomenon In The History Of Political Economy’, Paul N. Anderson

Faculty Publications - George Fox School of Theology

What sort of a person would be an inspiration to Karl Marx and a champion of free trade, an advocate of gainful employment and hard work, a herald of providing education and medical care for the poor while also seeing their labor as the greatest resources of the rich, a prophetic voice seeking to curb the ills of heavy drinking and the developing of worthy living quarters for workers, a challenger of dishonesty in public service and in Parliament while also calling for a unified state of Europe and Christian unity, an exhorter of Friends to spiritual discipline, anger management, …

Elizabeth Fry—A Note-Worthy Friend, Paul N. Anderson

Faculty Publications - George Fox School of Theology

Her picture is on the five-pound British note. She brought about prison reform in Britain. Her school of nursing inspired Florence Nightingale. She was the first woman to address Parliament. She was visited in her prison-reform work by the King of Prussia. She was a recorded Friends minister who provided Bibles for people, established organizations for social reform, pioneered women’s suffrage, and who was sponsored by Queen Victoria. Her name was Elizabeth Fry—a note-worthy Friend, indeed!.

Supporting Representation-Rich Problem-Solving In High School Physics, Lyrica L. Lucas, Elizabeth B. Lewis

Department of Teaching, Learning, and Teacher Education: Faculty Publications

Findings from physics education research strongly point to the critical need for teachers’ use of multiple representations in their instructional practices such as pictures, diagrams, written explanations, and mathematical expressions to enhance students' problem‐solving ability. In this study, we explored use of problem‐solving tasks for generating multiple representations as a scaffolding strategy in a high school modeling physics class. Through problem‐solving cognitive interviews with students, we investigated how a group of students responded to the tasks and how their use of such strategies affected their problem‐solving performance and use of representations as compared to students who did not receive explicit, …

In Whose Image? Travis Pickell On Mckenny's Biotechnology, Human Nature, And Christian Ethics, Travis Ryan Pickell

Faculty Publications - George Fox School of Theology

Last semester, a single, hypothetical, issue haunted all our discussions in my co-taught class, “Engineering Humanity: The Promise and Perils of Biotechnology.” “Hypothetical,” that is, until the penultimate week of class when we received word that a Chinese scientist named He Jiankui crossed an ethical red-line, allegedly using CRISPR-cas9 technology to bring the planet’s first gene-edited babies into the world. These twins, Lulu and Nana, had undergone “gene-surgery” (He’s preferred term) as embryos to edit-out a single gene, CCR5, without which He hoped they might become immune to HIV (their father carries the virus). Suddenly, all of our previous hedging, …

Is Coming Into Existence Always A Harm? Qoheleth In Dialogue With David Benatar, Jesse M. Peterson Jan 2019

Is Coming Into Existence Always A Harm? Qoheleth In Dialogue With David Benatar, Jesse M. Peterson

Faculty Publications - George Fox School of Theology

Contemporary philosopher David Benatar has advanced the self-evidently controversial claim that “coming into existence is always a harm.” Benatar’s argument turns on the basic asymmetry between pleasure and pain, an asymmetry he seeks to explain by the principle that those who never exist cannot be deprived. Benatar’s import is almost incredible: humans should cease to procreate immediately, thereby engendering the extinction of the species—a view known as “anti-natalism.” According to many of his readers, the ancient Hebrew sage Qoheleth expresses a pessimistic nihilism that runs as thick as Benatar’s. Prima facie grounding for this assertion is that Qoheleth, like Benatar, …

Soft And Hard Strategies: The Role Of Business In The Crafting Of International Commercial Law, Susan Block-Lieb Jan 2019

Soft And Hard Strategies: The Role Of Business In The Crafting Of International Commercial Law, Susan Block-Lieb

Faculty Scholarship

Part I returns to the classic definition of hard international law initially put forward by Kenneth Abbott and Duncan Snidal and related IR scholars and analyzes existing commercial law treaties in light of this definition. It concludes that virtually none of these commercial law treaties constitute “hard” international law because nearly all commercial law treaties rely on national courts for enforcement. But Abbott and Snidal’s focus on the extent to which international law is legalized—and especially the extent to which it is enforced by international actors—may matter less with commercial than other more public international lawmaking. This is because the …

The Arbitration-Litigation Paradox, Pamela K. Bookman Jan 2019

The Arbitration-Litigation Paradox, Pamela K. Bookman

Faculty Scholarship

The Supreme Court’s interpretation of the Federal Arbitration Act is universally touted as favoring arbitration. Its arbitration cases and decisions in other areas are also viewed as supporting the Court’s more general hostility to litigation. These pro-arbitration and anti-litigation policies can be mutually reinforcing. Moreover, they appear to be mutually consistent, in part because the Court describes the essential features of arbitration as being “informal,” “speedy,” “efficient”—in short, the categorical opposite of litigation.

This Article contends that the Court’s approach is not as “pro- arbitration” as it appears. On the contrary, the Court’s pro-arbitration and anti- litigation values sometimes conflict. …

Barnette And Masterpiece Cakeshop: Some Unanswered Questions, Abner S. Greene Jan 2019

Barnette And Masterpiece Cakeshop: Some Unanswered Questions, Abner S. Greene

Faculty Scholarship

This symposium piece addresses three issues stemming from the Court’s Masterpiece Cakeshop case and that case’s relationship to West Virginia v. Barnette. First, it discusses the relationship between claims for exemption from laws of general applicability and as-applied claims. Second, it addresses the issue most discussed in the Cakeshop briefs and oral argument, but not ultimately resolved by the Court: what counts as compelled speech in the setting of provision of services such as custom-made wedding cakes? Third, it intervenes in the fascinating sidebar between Justice Kagan and Justice Gorsuch regarding the state commission’s refusal to sanction bakers who wouldn’t …

Social And Cultural Factors Influencing The Management Of Type 2 Diabetes Among African American Men, Lavetta W. Lopez

Walden Dissertations and Doctoral Studies

African American men are more likely to have diagnosed or undiagnosed diabetes than non-Hispanic White Americans and are less likely to adhere to treatment. Culture in the African American community plays a key role in how this community copes with illness and the health care system. The purpose of this study was to examine the lived experiences of social and cultural determinants of Type 2 diabetes self-management among African American men. Bandura's social cognitive theory provided the theoretical framework for the study. The research question sought to identify cultural and social factors that contribute or protect how African American men …

Late-Stage Breast Cancer Diagnosis Among Haitian Women In The United States, Marie-Hortence Prosper

Walden Dissertations and Doctoral Studies

Breast cancer is the 2nd leading cause of death among women. While a significant amount of research has been done to understand the different disparities related to this disease, there is still more to learn about the relationship between a person's nationality and the staging of breast cancer. Using the Surveillance, Epidemiology, and End Results Program as the data source, this retrospective cohort study was aimed at assessing late-stage breast cancer among Caribbean immigrants, specifically comparing Haitian women with Americans and other immigrant populations in the United States. The research questions addressed the link between nationality and the likelihood of …

Knowledge Management System And Tools Required For Effective Km Take-Up And Activities In Organisations In Nigeria, Abdurrahman Bello Onifade, Kazeem Abiodun Akinwade

Library Philosophy and Practice (e-journal)

Knowledge management (KM) has become an integral and invaluable asset to organisational productivity in the 21st century. Observations have, however, shown that many organisations in Nigeria do not have knowledge management system (KMS) and do no practise KM; and in cases where KM practices exist, there seems to be indifference on the part of members in using the KMS. Perhaps, this could be due to lack of adequate awareness about the importance of KM practices and or the KM tools required for its effective take-up. This study, therefore, seeks to highlight and examine KMS and the tools required for effective …

Human Resources Management Professionals' Experience With Online Degree Holders In Recruitment, Dominic Ugochukwu Isaac

Walden Dissertations and Doctoral Studies

Online degree holders in Nigeria have poor acceptability during recruitment and promotion decisions because of reliability and legality perceptions of online degrees. There is little knowledge about how human resource (HR) managers identify employability skills in online degree holders. Guided by Bills's screening conceptual framework, the purpose of this case study was to explore how Nigerian recruiters identify employability skills in online degree holders. The participants for this study consisted of 2 participants from each of 10 sectors covering the government and nongovernmental organizations; participants had at least 5 years' experience in working with online degree holders. Barriers To Implementing Urban Plans In Kenya, Rose Chelangat Kitur Jan 2019

Barriers To Implementing Urban Plans In Kenya, Rose Chelangat Kitur

Walden Dissertations and Doctoral Studies

Despite a long history of urban planning, Kenyan towns are still characterized by informality, uncoordinated development, urban sprawl, and congestion. Government documents and reports acknowledge that, despite planning, no deliberate effort has been made to implement plans. Little is known about what impedes plan implementation in Kenya. This study sought to develop an in-depth understanding of the barriers to plan implementation from the perspectives of public officials responsible for planning. Using path dependency theory, forwarded by Pierson, and force field analysis, advanced by Lewin, the research questions focused on legal and institutional development, as well as on the nature of …

Stakeholder Perspectives On Teacher Attrition In Private Early Childhood Schools In India, Swathi Sandesh Menon

Walden Dissertations and Doctoral Studies

Teacher attrition is a problem that has consequences for children and schools in many countries; children are affected negatively both emotionally and intellectually, while schools suffer setbacks, such as financial stress and disruption of the learning environment. This multiple case study explored the perspectives of stakeholders in India regarding how teacher attrition in private early childhood schools influenced students, teachers, parents, school leaders, and schools, as well as the factors that stakeholders identified as important for teacher retention in private early childhood education. The conceptual framework was Bronfenbrenner's ecological systems theory. Data were collected through interviews with teachers and school …

Strategies For Implementation Of Electronic Health Records, Carlene Vassell-Webb Jan 2019

Strategies For Implementation Of Electronic Health Records, Carlene Vassell-Webb

Walden Dissertations and Doctoral Studies

Implementation of electronic health records (EHRs) is a driver for the improvement of health care and the reduction of health care costs. Developing countries face substantial challenges in adopting EHRs. The complex adaptive system conceptual framework was used to guide this single case study to explore strategies that health care leaders used to successfully implement the EHR system. Data were collected from 6 health care leaders from an island in the Caribbean using a semistructured interview technique. Data were analyzed using the Bengtsson's 4-stage data analysis process, which includes decontextualization, recontextualization, categorization, and compilation. The results of the study yielded …
