Melodrama ‘à la française’: Feyder and French cinema of the 1930s

By the end of 1934, Jacques Feyder had led a distinguished career in French silent cinema, had directed a critically acclaimed adaptation of Émile Zola’s Thérèse Raquin (1928) in Berlin, had returned from a three-year contract in Hollywood, had brought Le Grand Jeu to the screen (the greatest box-office success of the 1933–34 season), and appeared to be virtually unstoppable as he proceeded to direct his next film, Pension Mimosas. The film was described by one critic as ‘sans aucun doute l’une des œuvres les plus attendues …

Risk Taking And Rights Balancing In Intellectual Property Law, Clark Asay Jan 2019

Risk Taking And Rights Balancing In Intellectual Property Law, Clark Asay

Faculty Scholarship

Scholars have long worried that risk aversion can have significant negative effects in the marketplace. In the intellectual property law domain, some have worried that risk-averse actors can negatively influence the development of important intellectual property law doctrines, which can ultimately hamper innovation. For instance, risk-averse actors may frequently choose to obtain licenses for rights that the relevant laws do not actually require of them. When they do so, they inadvertently increase the scope of intellectual property rights because their risk-averse activities inform courts’ development of key intellectual property law doctrines. In this Article, prepared as part of the IP …

The 2017 tax legislation brought sweeping changes to the rules for taxing individuals and business, the deductibility of state and local taxes, and the international tax regime. The complex legislation was drafted and passed through a rushed and secretive process intended to limit public comment on one of the most consequential pieces of domestic policy enacted in recent history. This Article is an effort to supply the analysis and deliberation that should have accompanied the bill’s consideration and passage and describes key problem areas in the new legislation. Many of the new changes fundamentally undermine the integrity of the tax …

Citizenship Gaps, D. Carolina Nuñez Jan 2019

Citizenship Gaps, D. Carolina Nuñez

Faculty Scholarship

The concept of citizenship is undeniably powerful. The terms “citizenship” and “citizen” evoke notions of belonging, participation, equality, civic duty, democracy, and virtually any other term associated with a well-functioning polity. In fact, the term “citizenship” often serves as a shorthand reference to an abstract sense of civic virtue and the right to exercise that civic virtue to shape the polity. Citizenship, as popularly imagined, is a fundamental element of our democracy.

These noble ideals, however, do not necessarily map onto any legal definition of citizenship, nor do they accurately depict the experience of many U.S. citizens who find themselves …

On August 17, 2017, the Advanced LIGO and Advanced Virgo gravitational-wave detectors observed a low-mass compact binary inspiral. The initial sky localization of the source of the gravitational-wave signal, GW170817, allowed electromagnetic observatories to identify NGC 4993 as the host galaxy. In this work, we improve initial estimates of the binary's properties, including component masses, spins, and tidal parameters, using the known source location, improved modeling, and recalibrated Virgo data. We extend the range of gravitational-wave frequencies considered down to 23 Hz, compared to 30 Hz in the initial analysis. We also compare results inferred using several signal models, which …

Applying The First Amendment To The Internal Revenue Code: Minnesota Voters Alliance And The Tax Law’S Regulation Of Nonprofit Organizations’ Political Speech, Edward A. Zelinsky Jan 2019

Applying The First Amendment To The Internal Revenue Code: Minnesota Voters Alliance And The Tax Law’S Regulation Of Nonprofit Organizations’ Political Speech, Edward A. Zelinsky

Articles

On its face, Minnesota Voters Alliance v. Mansky is about which T-shirts, hats and buttons voters can wear at the polls. However, the U.S. Supreme Court’s First Amendment analysis in Minnesota Voters Alliance extends beyond apparel at polling places. That decision impacts the ongoing debate about the Johnson Amendment, the now controversial provision of the Internal Revenue Code which forbids Section 501(c)(3) organizations from intervening in political campaigns. Minnesota Voters Alliance also affects the proper construction of Section 501(c)(3)’s ban on lobbying by tax-exempt entities as well as other provisions of the tax law taxing and precluding campaign intervention by …

Getting Past The Imperial Presidency, Deborah Pearlstein Jan 2019

Getting Past The Imperial Presidency, Deborah Pearlstein

Articles

In an age in which the “imperial presidency” seems to have reached its apex, perhaps most alarmingly surrounding the use of military force, conventional wisdom remains fixed that constitutional and international law play a negligible role in constraining executive branch decision-making in this realm. Yet as this Article explains, the factual case that supports the conventional view, based largely on highly selected incidents of presidential behavior, is meaningless in any standard empirical sense. Indeed, the canonical listing of presidential decisions to use force without prior authorization feeds a compliance-centered focus on the study of legal constraint rooted in long-since abandoned …

Erie Doctrine, State Law, And Civil Rights Litigation, Alexander A. Reinert Jan 2019

Erie Doctrine, State Law, And Civil Rights Litigation, Alexander A. Reinert

Articles

How should state law questions and claims be resolved when they arise in federal civil rights litigation? In prior work, I have criticized the given wisdom that the Erie doctrine, while originating in diversity cases, applies in all cases whatever the basis for federal jurisdiction. In that work, I proposed a framework, “Erie Step Zero,” to place Erie questions in their jurisdictional context. As I have argued, the concern with forum shopping and unequal treatment that prompted Erie have less salience in federal question cases. Different concerns emerge when one focuses on the presence of state law issues in …

Reliability Of Smartphone Inclinometry To Measure Upper Cervical Range Of Motion., Paul A. Ullucci, Frank Tudini, Matthew F. Moran

Physical Therapy Faculty Publications

Context: Assessment of upper cervical range of motion (UCROM) and mobility is commonly performed in the clinical setting for patients suffering from headache, neck pain and vestibular dysfunction. Reliable and reproducible measurement of this motion is often difficult or too expensive to perform in the clinical setting. Smartphone applications, utilizing the device's internal gyroscope, offer an easy and inexpensive means of measuring UCROM, but their reliability has not been reported in the literature.

Objective: Assess the reliability of an inclinometer application, installed on two different devices (iPhone6 (IP), Andriod (AN)), to measure UCROM in a healthy population.

Design: Two examiners …

Physics & Astronomy Faculty Publications

We analyze the impact of a proposed tidal instability coupling p modes and g modes within neutron stars on GW170817. This nonresonant instability transfers energy fromthe orbit of the binary to internal modes of the stars, accelerating the gravitational-wave driven inspiral. We model the impact of this instability on the phasing of the gravitational wave signal using three parameters per star: an overall amplitude, a saturation frequency, and a spectral index. Incorporating these additional parameters, we compute the Bayes factor (lnBpg !pg) comparing our p-g model to a standard one. We find that the observed signal is consistent with waveform models …

We present the results of a search for long-duration gravitational-wave transients in the data from the Advanced LIGO second observation run; we search for gravitational-wave transients of 2–500 s duration in the 24–2048 Hz frequency band with minimal assumptions about signal properties such as waveform morphologies, polarization, sky location or time of occurrence. Signal families covered by these search algorithms include fallback accretion onto neutron stars, broadband chirps from innermost stable circular orbit waves around rotating black holes, eccentric inspiral-merger-ringdown compact binary coalescence waveforms, and other models. The second observation run totals about 118.3 days of coincident data between November …

Higher-Order Differential Cross Section Calculation For The Associated Production Ofa W Boson And Jets In The Electron Decay Channel At A Center-Of-Mass Energy Of 13tev In Proton-Proton Collisions, Kadi̇r Öcalan

Turkish Journal of Physics

Higher-order cross sections for the production of a W boson in association with jets in the electron decay channel are presented in this study. Cross sections were calculated in a fully differential way using a computational framework based on proton-proton collisions at a center-of-mass energy of 13 TeV. The differential cross section predictions in the fiducial phase-space were compared at next-to-leading order (NLO) and next-to-NLO (NNLO) in perturbative quantum chromodynamics (pQCD). The differential results are reported for the variables including the jet multiplicity, the invariant mass of the W boson, transverse momentum, the jet rapidity, and the electron pseudorapidity that …

Dispersive Parameters Of Oxidized Pva-Pvp Blend Films, Goputta Veena, Blaise Lobo

Turkish Journal of Physics

Oxidized (ox) polyvinyl alcohol (PVA)-polyvinyl pyrrolidone (PVP) blend films were prepared by solution casting technique, with doping levels of the oxidizer, potassium permanganate (KMnO4) , varying from 0.01 up to 4.70 weight percent (wt.%). Optical (UV-Vis) spectral measurements in the wavelength range varying from 190 nm to 1000 nm were used to extract the band gap information and to calculate various optical parameters of the ox-PVA-PVP blend films. The electronic transitions on absorption of photons of suitable energy are of indirect allowed type. The corresponding optical band gap (Eg) has been determined. Optical dispersion parameters for ox-PVA-PVP films were determined …

The Behaviour Of The Diamagnetic Current Modified Mri In Different Rotationprofiles, Suzan Doğan Jan 2019

The Behaviour Of The Diamagnetic Current Modified Mri In Different Rotationprofiles, Suzan Doğan

Turkish Journal of Physics

Magnetohydrodynamic turbulence driven by magnetorotational instability (MRI) has been widely accepted as an efficient mechanism for transporting angular momentum radially outward in the discs. Previously, we have shown the triggering effect of the magnetization currents and the gradients produced by these currents on MRI for Keplerian discs. In this work, we examine the properties of the diamagnetic current modified MRI for the discs where the epicyclic frequencies deviate from Keplerian behaviour. We show that the diamagnetic effect modifies the instability both for an increasing and for a decreasing angular momentum with radius. The novel unstable region produced by magnetization effects …

Relativistic Dynamics Of A Scalar Boson Confined By Woods-Saxon Potential In Anucleus, Nuray Candemi̇r

Turkish Journal of Physics

We undertook a theoretical study of a scalar boson confined by Woods-Saxon potential in a nucleus via the Duffin-Kemmer-Petiau equation. We analytically obtained the eigenvectors and energy levels through the hypergeometric functions. Single-particle energy levels of a boson in the ${}^{208} {Pb}$ nucleus were calculated numerically.

Retinoic Acid Receptors In Acute Myeloid Leukemia Therapy, Orsola Di Martino, John S Welch Jan 2019

Retinoic Acid Receptors In Acute Myeloid Leukemia Therapy, Orsola Di Martino, John S Welch

Open Access Publications

Retinoic acid (RA) signaling pathways regulate fundamental biological processes, such as cell proliferation, development, differentiation, and apoptosis. Retinoid receptors (RARs and RXRs) are ligand-dependent transcription factors. All-trans retinoic acid (ATRA) is the principal endogenous ligand for the retinoic acid receptor alpha (RARA) and is produced by the enzymatic oxidation of dietary vitamin A, whose deficiency is associated with several pathological conditions. Differentiation therapy using ATRA revolutionized the outcome of acute promyelocytic leukemia (APL), although attempts to replicate these results in other cancer types have been met with more modest results. A better knowledge of RA signaling in different leukemia contexts …
