The Hurricane Exposure, Adversity, And Recovery Tool (Heart): Developing And Validating A Risk Screening Instrument For Youth Exposed To Hurricane Harvey, Cody G. Dodd Ph.D., Ryan M. Hill Ph.D., Benjamin Oosterhoff Ph.D., Christopher M. Layne Ph.D., Julie B. Kaplow Ph.D., A.B.P.P.
Journal of Family Strengths
Given the increasing regularity with which severe (named) hurricanes arise, there is a need for valid, practically useful measures that facilitate child-centered post-hurricane situation analysis and needs assessment. Measures that accurately assess the most potent hurricane-related risk factors are essential to identifying youth at risk for developing posttraumatic stress reactions and providing them with effective post-disaster support. With feedback from community stakeholders (e.g., school personnel, physicians and hospital staff, community clinicians), we developed the Hurricane Exposure, Adversity, and Recovery Tool (HEART), a 29-item self-report measure of hurricane risk factors. Test development procedures included: (1) Reviewing the literature regarding hurricane exposure-related …
The Impact Of Pretrial Supervision Conditions: Evaluating Pretrial Release Orders Of One Colorado County, Anthony Mark Azari
The Impact Of Pretrial Supervision Conditions: Evaluating Pretrial Release Orders Of One Colorado County, Anthony Mark Azari
Master's Theses
Pretrial risk assessments are tools that have been created to address concerns associated with monetary bail in the United States. A pretrial risk assessment tool provides an objective analysis of an arrested person to determine whether he or she will reappear in court or will be rearrested upon being released from jail. One of the goals of pretrial risk assessments is to reduce the financial bail burden the criminal justice system poses on suspected defendants by providing a tool to determine the relative risk defendants pose in the community. Another goal of pretrial risk assessments is to reduce jail overcrowding. …
From Justice To Injustice: Lowering The Threshold Of European Consensus In Oliari And Others Versus Italy, Nazim Ziyadov
From Justice To Injustice: Lowering The Threshold Of European Consensus In Oliari And Others Versus Italy, Nazim Ziyadov
Indiana Journal of Global Legal Studies
Oliari and Others v. Italy, decided by the European Court of Human Rights (ECHR) in 2015, changed its case law. The ECHR changed its position stated in Schalk and Kopf v. Austria (2010) when evaluating an alleged violation of Article 8 of the European Convention on Human Rights. It concluded that Italy has a positive obligation under the convention to guarantee alternative legal recognition for same-sex couples. The same conclusion was not reached in Schalk. In Oliari and Others, the ECHR heavily relied on the European consensus doctrine and eventually deepened formalization of two different institutions (marriage and civil unions). …
The Sea Of The Universe: How Maritime Law's Limitation On Liability Gets It Right, And Why Space Law Should Follow By Example, Rachel Rogers
The Sea Of The Universe: How Maritime Law's Limitation On Liability Gets It Right, And Why Space Law Should Follow By Example, Rachel Rogers
Indiana Journal of Global Legal Studies
"Space law," much like outer space itself, still remains largely unnavigated in some aspects. "Space law" is a term loosely used to dictate the body of law that refers to the international rules and regulations surrounding exploration and behavior while in outer space; while it quite uniformly covers questions of general damage control, international relations, and resource exploration, some areas of this body of law remain ambiguous and only partially implemented across the globe. One of these broad areas is the role of tort law in outer space-liability stemming from spacecraft collision and the resulting damage that occurs between the …
Cybersecurity Paradigm Shift, The Risk Of Net Neutrality Repeal To Energy Reliability, Public Safety, And Climate Change Solutions, Catherine J. K. Sandoval
Cybersecurity Paradigm Shift, The Risk Of Net Neutrality Repeal To Energy Reliability, Public Safety, And Climate Change Solutions, Catherine J. K. Sandoval
Faculty Publications
This Article contends that the Federal Communications Commission’s (FCC) January 2018 repeal of net neutrality rules creates cybersecurity vulnerabilities for the energy sector and other critical infrastructure. Unbridled from enforceable net neutrality rules, Internet Service Providers (ISPs) create systemic supply chain risks as the Internet has become embedded into the energy sector’s distributed ecosystem. This Article argues that cybersecurity has been primarily viewed from a “hacker paradigm” that obscures systemic threats such as those posed by an ISP since firewalls and traditional cybersecurity techniques do not protect against ISP conduct. The Article contends that the FCC’s failure to consider the …

Impartiality, Social Network Effects And Collective Memory: Three Essays On Trust In Police., Matthew Robert Fischer
Electronic Theses and Dissertations
This dissertation is an historical and empirical examination of police organizational efforts at influencing public perceptions of trust in police. It begins with an historical overview of police organizational reform, focusing on the various strategies employed by police reformers have attempted to influence public perceptions of police trustworthiness and legitimacy. It uses Rothstein’s impartiality as Quality of Government thesis and the theory of collective memory to argue for an understanding of the importance of the normative context in which police tactics and strategies are deployed for garnering trust in police and how the presence of social network effects for trust …

Cisgender Fragility, Zachariah Graydon Oaster
Cisgender Fragility, Zachariah Graydon Oaster
Masters Theses
Cisgender people in the United States are socialized in an environment that shields them from gender-identity-based stress. Like the construct of white fragility (DiAngelo, 2011), cisgender persons exhibit defensive behavior in response to encountering any gender-identity-based discomfort. Once triggered, defensive acts and false claims are deployed in an attempt to return to a state of comfort and normalcy. The stress that cisgender persons feel, and the defensive actions that they take upon encountering such gender-identity-based discomfort is what I refer to herein as Cisgender Fragility.
This theoretical construct of Cisgender Fragility is nuanced through intersectional synthesis of queer and race …

Leadership Styles And Perceived Organizational Competencies At A Nonprofit Organization, John L. Perry
Education Doctoral
Amidst increased demands for accountability and scrutiny over operational performance, nonprofit executive leaders are being asked to deliver more effective measures to address complex social issues largely ignored by government and business entities. Research indicates the nonprofit sector has the greatest opportunity in shaping the quality of life in America, yet the literature on the leadership and competencies needed to propel these organizations forward is limited. The purpose of this quantitative study was to examine the leadership styles of executive, management, and staff personnel, and the alignment to perceived organizational competencies concerning the areas of capacity for change, communication, strategic …
Federal Jurisdiction For Above-Ground Oil Storage Tanks: A Practical Analysis For Navigating Federal Regulations, Kathryn Hussong
Federal Jurisdiction For Above-Ground Oil Storage Tanks: A Practical Analysis For Navigating Federal Regulations, Kathryn Hussong
St. Mary's Law Journal
Clear, consistent, and concise jurisdictional boundaries will aid pipeline operators to determine which regulations apply to their operations and associated facilities. This will help alleviate legal and financial risk to pipeline operators, who may be liable for noncompliance regardless of whether the pipeline operator or the associated refinery commits the violation. Overlapping state and federal regulations of pipelines and refineries has created confusion amongst operators regarding what regulations apply to their facilities. Three federal agencies—the Pipeline and Hazardous Safety Administration (PHMSA), the Occupational Safety and Health Administration, and the Environmental Protection Agency (EPA) respectively—and a myriad of state agencies simultaneously …

Comparison Of Environmental And Social Costs Of Trenchless Cured-In-Place Pipe Renewal Method With Open-Cut Pipeline Replacement For Sanitary Sewers, Vinayak Kaushal
Civil Engineering Dissertations - Archive
The development of underground infrastructure, environmental concerns, and economic trends is influencing society, resulting in the advancement of technology for more efficient, environment-friendly, and cost-effective pipeline installation and renewal. Comparison of environmental and social costs of a pipeline renewal and replacement is an essential element when considering sustainable development of underground infrastructure. Project owners, decision makers, design and consulting and contractors commonly take into consideration the construction costs only, and overlook the environmental and social cost aspects while making a choice between trenchless and open-cut pipeline installation. Trenchless Cured-in-Place Pipe (CIPP) involves a liquid thermoset resin saturated material that is …

National Capacities And Residual Contamination (Croatia), Gichd
Global CWD Repository
Croatia is affected by explosive ordnance (EO) contamination that consists of mines and, to a lesser extent, explosive remnants of war (ERW), including cluster munition remnants, caused by the legacy of four years of armed conflict associated with the break-up of the former Socialist Federal Republic of Yugoslavia in the early 1990s.
This case study documents Croatia’s experience of developing national systems and capacities to address residual contamination and to identify and present good practices and lessons learnt. In addition, this case study highlights the importance of a participatory and transparent long-term strategic planning process, including a comprehensive and properly …
Examining The Mechanisms Of Religious Ecology On Population Health And Material Well-Being, Joseph Andrew Clark
Examining The Mechanisms Of Religious Ecology On Population Health And Material Well-Being, Joseph Andrew Clark
LSU Doctoral Dissertations
A growing body of research has addressed the relationship between community-level religious environments and important aspects of well-being, such as mortality, crime, and social mobility. This research argues that the prevalence of specific religious traditions shapes these important outcomes through a variety of mechanisms. While there is no shortage of mechanisms proposed by authors - such as local attitudes towards public institutions, gender norms, and social networks - these mechanisms remain themselves untested. A notable critique of this literature suggests that without evidence supporting the existence of these mechanisms as described, scholars involved in this research run the risk of …

The purpose of this study was to examine the factors relating to police officers shooting unarmed Black males and to seek to understand what impact, if any, a police officer’s race, age, years of service, or place of residence has on the decision to shoot an armed or unarmed suspect. The study examined whether or not these factors impacted the decision-making process in shoot/don’t shoot scenarios. Thirty sworn police officers participated in the quantitative study that was conducted using a Ti Lab firearms high-fidelity video simulator and a laser-modified Sig Sauer P380 handgun to engage in four shoot/don’t shoot video …
911 Dispatchers: Investigating Their Knowledge Of Eyewitness Evidence Collection, Samantha A. Kosziollek
911 Dispatchers: Investigating Their Knowledge Of Eyewitness Evidence Collection, Samantha A. Kosziollek
Student Theses
911 dispatchers are often the first contact in an emergency, playing a critical role in the investigative process. Presently, a new bill is seeking to nationally reclassify these communications officers, recognizing them as vital first responders, as their initial collection of eyewitness evidence aid in the attainment of crucial information and detailed descriptions of an accident or crime. However, only one study (Kassis, 2017), to date, has examined the training of 911 dispatchers, as well as their self-reported knowledge of the potential influences their language could have on an eyewitness’ memory. While this research highlighted disparities between the perceived role …

Development Of The Casve Cycle Questionnaire: Confirmatory Factor Analysis And Navigator Score, Brianna Werner
Dissertations
A new career decision-making status measure, the CASVE Cycle Questionnaire (CASVE-CQ), grounded in Cognitive Information Processing (CIP) theory, was created as an assessment of the CASVE decision-making cycle, one of the major components of CIP theory. One purpose of the CASVE-CQ is to determine an individual’s standing among the CASVE cycle phases given how many career decision-making tasks he/she has completed. Six factors, which assess the five phases, with initial and final communication scales, were previously established (Werner, 2017). Therefore, the present study focused on the revision of items, development of new items, an exploratory factor analysis, two confirmatory factor …
Determining Readiness To Take The National Council Licensure Examination For Registered Nurses®, Heidi Elizabeth Monroe
Determining Readiness To Take The National Council Licensure Examination For Registered Nurses®, Heidi Elizabeth Monroe
Dissertations
Numerous studies have examined the association between pre-admission and/or during nursing program variables and the outcome on the National Council Licensure Examination for Registered Nurses (NCLEX-RN®; National Council of State Boards of Nursing [NCSBN]; 2015) but very few studies have examined post-graduation variables. This study examined post-graduation variables associated with the outcome on the NCLEX-RN® examination. The purpose of this exploratory field study was twofold. The first aspect was to identify the benchmark score on a post-graduation test (the Kaplan RN Readiness Exam; Sanders, 2014) correlated with passing the NCLEX-RN® examination. The second aspect was to explore factors that the …

Karst Sinkhole Detecting And Mapping Using Airborne Lidar, Su Zhang, Shirley Baros, Susan Bogus
Publications
The focus of this study is to detect sinkhole hazards using airborne light detection and ranging (LiDAR) data. The premise is sinkholes, particularly those close to transportation infrastructure assets, could cause substantial damages to infrastructure assets, and therefore, being able to accurately and rapidly detect them is essential. However, it is expensive, time-consuming, labor-intensive, and unsafe to survey sinkholes using conventional ground observation methods. This research project was focused on developing accurate and rapid airborne LiDAR-based sinkhole detection and mapping methods, and transfer the technologies to transportation engineers for implementation and workforce development. The project team also identified best practices …

Strategies For Prioritizing Needs For Accelerated Construction After Hazard Events, Fernando Moreu, Chao Wang, Xinxing Yuan, Laleh Ghanbari, Claudia Garrido
Publications
There is a need for rapid and responsive infrastructure repair and construction after natural disaster events such as hurricanes, wildfires, and tornadoes. These natural disasters often shut down basic infrastructure systems, as experienced recently in several Region 6 states as well as in other states around the country. Accelerated construction practices are often used in these situations to speed up the traditional, and often slow, project delivery process. However, after a natural disaster, several and different types of transportation infrastructure components are in need of inspection, rehabilitation or reconstruction, and transportation agencies are challenged with the task of prioritizing these …

Part I of the essay explores the issue of data sovereignty comparatively, framing the concept within its global and national contexts, and then discussing the rights of tribal governments and other Indigenous peoples. Part II of the essay examines the various claims that are comprised within the movement toward "Indigenous data sovereignty," as well as the current context of …
Ethical Implications Of Codis, Lucy Grogan
Ethical Implications Of Codis, Lucy Grogan
Masters Theses
CODIS stores and maintains numerous DNA profiles, and is used as a tool by the criminal justice system in order to help solve crime. Deoxyribonucleic Acid, or DNA for short, is the genetic material that an individual inherits from one’s parents (NIH, 2019). Certain portions of this genetic material are selected for use within the CODIS database due to their lack of medically relevant information. There is an immense amount of power associated with DNA and the CODIS database that it is held within, which allows for many ethical issues to arise. In order to create a usable and safe …
Executive Compensation In The Charitable Sector: Beyond The Tax Cuts And Jobs Act, Lauren Rogal
Executive Compensation In The Charitable Sector: Beyond The Tax Cuts And Jobs Act, Lauren Rogal
Vanderbilt Law School Faculty Publications
The Tax Cuts and Jobs Act of 2017 (“TCJA”) reformed charity executive compensation for the first time in decades, introducing an across-the-board excise tax on compensation over $1 million.1 Its enactment represents a significant step toward securing accountability for the use of the charitable tax exemption under Section 501(c)(3) of the Internal Revenue Code. These organizations receive preferential tax treatment to subsidize their provision of socially beneficial outputs that would otherwise be undersupplied. Overcompensation of charity executives subverts this purpose by diverting those subsidies for private gain and undermining public confidence in the charitable sector.
With the enactment of the …

Exploring Smart Infrastructure Concepts To Improve The Reliability And Functionality Of Safety Oriented Connected Vehicle Applications, Anjan Narsingh Rayamajhi
All Dissertations
Cooperative adaptive cruise control (CACC), a form of vehicle platooning, is a well known connected vehicle application. It extends adaptive cruise control (ACC) by incorporating vehicle-to-vehicle communications. A vehicle periodically broadcasts a small message that includes in the least a unique vehicle identifier, its current geo-location, speed, and acceleration. A vehicle might pay attention to the message stream of only the car ahead. While CACC is under intense study by the academic community, the vast majority of the relevant published literature has been limited to theoretical studies that make many simplifying assumptions. The research presented in this dissertation has been …

These interviews were with nineteen of the twenty-four known health care providers who began practice in the county from the mid1980s to 2018, as well as with four administrators.
The study, taking advantage of this comprehensive analysis, provided a more extensive understanding of the root causes underlying the recruitment and …
Municipal Annexation Reform In Texas: How A Victory For Property Rights Jeopardizes The State’S Financial Health, Julie Polansky Bell
Municipal Annexation Reform In Texas: How A Victory For Property Rights Jeopardizes The State’S Financial Health, Julie Polansky Bell
St. Mary's Law Journal
Municipal annexation is the expansion of city boundaries. The greatest motivator behind municipal annexation is maintaining and improving economic prosperity of the annexing authority. The issue of annexation involves a balance of rights between property owners and municipalities of the state. Historically, Texas cities had broad annexation authority under an involuntary annexation scheme. However, in recent years the power has shifted as lawmakers have given property owners greater control over the annexation process. This trend culminated in the passage of the Municipal Annexation Right to Vote Act (MARVA) by the 85th Texas Legislature, which severely limits annexation authority.
Texas municipalities …
