Misalignment Between Societal Well-Being And Business Profit Maximization: The Case Of New York Taxis Drivers’ Incentive System, Andrew S. Manikas, James R. Kroes, Thomas F. Gattiker Sep 2019

Misalignment Between Societal Well-Being And Business Profit Maximization: The Case Of New York Taxis Drivers’ Incentive System, Andrew S. Manikas, James R. Kroes, Thomas F. Gattiker

IT and Supply Chain Management Faculty Publications and Presentations

Objectives of business sustainability efforts commonly include increasing consumer safety, decreasing resource consumption, and decreasing pollution. Even though there is a societal interest in attaining these goals, business and other economic agents often operate under incentive structures that run counter to these objectives. Taxi drivers operate as economic independents. Their revenue depends on their fares and tips. Moreover they choose how many hours to work, how fast to drive, and which route to take. Using New York City taxi data from 2013, we test the level of alignment between the revenue maximizing behavior of drivers versus safety, conservation and pollution- …

Rural Futures Institute: Publications

Nebraska’s economy remained strong in the beginning of 2019. However, the continued weakness of the agriculture sector had the possibility of hampering the state’s economic growth. In addition, the March flooding had the potential for negative economic effects. Given these challenges, how do rural Nebraskans feel about their community? Are they satisfied with the services provided by their community? How do rural Nebraskans believe they are doing and how do they view their future? How satisfied are they with various items that influence their well-being? Have these views changed over the past 24 years? This paper provides a detailed analysis …

The Rise Of The Viewpoint-Discrimination Principle, Lackland H. Bloom Jr. Sep 2019

The Rise Of The Viewpoint-Discrimination Principle, Lackland H. Bloom Jr.

SMU Law Review Forum

The Supreme Court’s freedom-of-speech jurisprudence is complicated. There are few hard and fast rules. One is that judicially-imposed prior restraints on speech are hardly ever permissible. In recent years, another hard and fast rule appears to have developed. It is that the government may never prohibit speech simply on account of its viewpoint. It remains unclear whether this is a per se prohibition or whether such viewpoint-focused regulation must overcome the all but insurmountable burden of serious strict scrutiny. In any event, any governmental rule that attempts to regulate speech based on its point of view will almost certainly be …

Alienating Citizens, Amanda Frost Sep 2019

Alienating Citizens, Amanda Frost

Northwestern University Law Review

Denaturalization is back. In 1967, the Supreme Court declared that denaturalization for any reason other than fraud or mistake in the naturalization process is unconstitutional, forcing the government to abandon its aggressive denaturalization campaigns. For the last half century, the government denaturalized no more than a handful of people every year. Over the past year, however, the Trump Administration has revived denaturalization. The Administration has targeted 700,000 naturalized American citizens for investigation and has hired dozens of lawyers and staff members to work in a newly created office devoted to investigating and prosecuting denaturalization cases.

Using information gathered from responses …

Revisiting Masterpiece Cakeshop - Free Speech And The First Amendment: Can Political Correctness Be Compelled, Terri R. Day Sep 2019

Revisiting Masterpiece Cakeshop - Free Speech And The First Amendment: Can Political Correctness Be Compelled, Terri R. Day

Hofstra Law Review

This Article questions whether religious objectors, who refuse to provide their services in facilitating a same-sex marriage, are discriminating on the basis of sexual orientation or refusing to adopt a politically correct, albeit legal, view of marriage. If the latter, then, compelling political correctness can have a boomerang effect, creating more LGBTQ discrimination. Given this administration's strong support for religious freedom and two new conservative justices on the Supreme Court, a legislative religious exemption in public accommodation laws may be safer for LGBTQ rights than risking a Supreme Court ruling constitutionally enshrining a religious right to discriminate.

After the Introduction …

Regulatory Reform At The State Level: A Guide To Cutting Red Tape For Governors And Executive Branch Officials, Justin D. Smith Sep 2019

Regulatory Reform At The State Level: A Guide To Cutting Red Tape For Governors And Executive Branch Officials, Justin D. Smith

The Business, Entrepreneurship & Tax Law Review

This article provides recommendations for governors and other executive branch officials to consider when implementing regulatory reform. Studies have shown that regulatory reform is needed because of the substantial impact on the economy, consumers, and businesses. Recent technological advances have allowed regulations to be quantified by a metric known as regulatory restrictions, which counts uses of “shall,” “must,” “may not,” “prohibited,” and “required.” Quantifying regulatory restrictions allows for comparison of the regulatory scope between states. State-level regulatory reform directed by governors has primarily occurred in three waves following elections in 1994, 2010, and 2016. These reforms have achieved significant results …

The Ferguson Effect In Contemporary Policing: Assessing Police Officer Willingness To Engage The Public, Christopher Mercado Sep 2019

The Ferguson Effect In Contemporary Policing: Assessing Police Officer Willingness To Engage The Public, Christopher Mercado

Dissertations, Theses, and Capstone Projects

Researchers suggest that as public scrutiny and video recording of violent/tumultuous police encounters increase, police would back away from proactive enforcement, resulting in an increase in crime—the Ferguson Effect. Recent scholarship refined these concerns over police disengagement with the study of de-policing, while other scholars explored police self-legitimacy, in order to explain law enforcement behavior, given the immediacy and ubiquity of social media and digital communication. This study surveyed 792 law enforcement officers from 10 different police agencies in the United States, to ascertain if police officers’ personal and contextual characteristics influence their decision to either take enforcement action (i.e., …

The Evolution Of Mara Salvatrucha 13 And Barrio 18: Violence, Extortion, And Drug Trafficking In The Northern Triangle Of Central America, Pamela Ruiz

Dissertations, Theses, and Capstone Projects

The Mara Salvatrucha 13 (mara) and Barrio 18 (pandilla) gangs have become a major concern for the governments of the Northern Triangle of Central America (Guatemala, El Salvador, and Honduras) and the United States. In recent years, government officials have attributed violence and the exodus of Central Americans to the developing capacities of gangs. The Mara Salvatrucha 13(MS-13) and Barrio 18 have been identified to strategically implement violence and extortion rackets which have led to transformations in their organizational structures and increased participation in drug trafficking. Furthermore, officials insinuate that gangs have developed capacities to confront security forces that enter …
