Marine Insurance Prohibitions In Contemporary Economic Warfare, Richard L. Kilpatrick, Jr.
Marine Insurance Prohibitions In Contemporary Economic Warfare, Richard L. Kilpatrick, Jr.
International Law Studies
As States and supranational actors increasingly employ economic sanctions to promote security objectives, a recent trend has focused on the regulation of commercial shipping activities. These maritime sanctions have restricted port access for designated vessels, banned the import and export of certain cargo classes, enhanced authorization for vessel inspections, and even justified vessel seizures. Critically, these techniques have also included targeted prohibitions on marine insurance covering designated vessels and cargo. Designed to frustrate sanctioned actors in their attempts to utilize maritime assets for malign purposes, marine insurance prohibitions thwart these efforts and also blunt the ability to generate revenue through …

Testing A Theoretical Model Of Perceived Audience Legitimacy: The Neglected Linkage In The Dialogic Model Of Police–Community Relations, Justin Nix, Justin T. Pickett, Scott E. Wolfe
Criminology and Criminal Justice Faculty Publications
Objectives:
Democratic policing involves an ongoing dialogue between officers and citizens about what it means to wield legitimate authority. Most of the criminological literature on police legitimacy has focused on citizens’ perceptions of this dialogue—that is, audience legitimacy. Consequently, we know little about how officers perceive their legitimacy in the eyes of the public and the antecedents of such perceptions. Pulling together separate strands of literature pertaining to citizen demeanor, hostile media perceptions, and danger perception theory, we propose and test a theoretical model of perceived audience legitimacy.
Method:
We conducted two separate studies: the first a survey of 546 …

Restoring Accountability In Freedom Of Expression Theory: Public Libel Law And Radical Whig Ideology, Randall Stephenson
Osgoode Hall Law Journal
As leading common law jurisdictions grapple with the Internet’s impact on defamation law, comparative legal scholarship has revealed long-standing problems with its underlying theoretical justifications. Specifically, public libel doctrine is commonly supported by appeals to democratic theory in the abstract. Accountability concerns most relevant to adjudicating public libel cases are thus routinely overlooked. Through exploring eighteenth-century libertarian thought, we highlight the foundational importance of accountability and the checking function rationale to democratic theory and governance. …
