Employer Perceptions When Applying Criminal History Information To The Hiring Process, Karen S. Levy Mccanna
Employer Perceptions When Applying Criminal History Information To The Hiring Process, Karen S. Levy Mccanna
Walden Dissertations and Doctoral Studies
In recent years, the state of Illinois has joined the "ban the box" movement which typically prohibits employers from inquiring about a prospective employee's criminal history until it has been determined whether the candidate meets the core qualifications for the position. Little, however, is known whether this legislative change has impacted how private employers use criminal history information and to what extent knowledge of criminal history impacts final hiring decisions. Using Kingdon's policy streams concept as a guide, the purpose of this general qualitative study was to understand whether implementation of "ban the box" principles impacts final hiring decisions. Data …

Defending White Space, Addie C. Rolnick
Defending White Space, Addie C. Rolnick

Police violence against minorities has generated a great deal of scholarly and public attention. Proposed solutions—ranging from body cameras to greater federal oversight to anti-bias training for police—likewise focus on violence as a problem of policing. Amid this national conversation, however, insufficient attention has been paid to private violence. This Article examines the relationship between race, self-defense laws, and modern residential segregation. The goal is to sketch the contours of an important but undertheorized relationship between residential segregation, private violence, and state criminal law. By describing the interplay between residential segregation and modern self-defense law, this Article reveals how criminal …

Incapacitating Errors: Sentencing And The Science Of Change, M. Eve Hanan
Scholarly Works
Despite widespread support for shifting sentencing policy from “tough on crime” to “smart on crime,” reflected in legislation like the federal First Step Act, the scope of criminal justice reform has been limited. We continue to engage in practices that permanently incapacitate people while carving out only limited niches of sentencing reform for special groups like first-time nonviolent offenders and adolescents. We cannot, however, be “smart on crime” without a theory of punishment that supports second chances for the broadest range of people convicted of crimes.
This Article posits that the cultural belief that adults do not change poses a …
About A Revolution: Toward Integrated Treatment In Drug And Mental Health Courts, Sara Gordon
About A Revolution: Toward Integrated Treatment In Drug And Mental Health Courts, Sara Gordon
Scholarly Works
This Article examines specialty courts, including drug, alcohol, and mental health courts, which proponents claim created a revolution in criminal justice. Defendants whose underlying crime is the result of a substance use disorder or a mental health disorder can choose to be diverted into a specialty court, where they receive treatment instead of punishment. Many of these individuals, however, do not just suffer from a substance use disorder or a mental health disorder; instead, many have a “co-occurring disorder.” Approximately 8.9 million American adults have co-occurring mental health and substance use disorders, and almost half of individuals who meet diagnostic …

World War Web: Rethinking "Aiding And Abetting" In The Social Media Age, Rebecca J. Cambron
World War Web: Rethinking "Aiding And Abetting" In The Social Media Age, Rebecca J. Cambron
Case Western Reserve Journal of International Law
ISIS's use of social media presents a new challenge for counterterror efforts. The organization aims to recruit followers and incite violence through social media. Given that this is a new medium for terrorist organizations, social media companies have come under fire for indirectly providing ISIS with farreaching platforms to spread its content. The companies, as well as national governments and international entities, have attempted to respond to the threat posed by such content. These responses, however, have proven ineffective. This Note argues that to effectively respond to and combat the threat posed by terrorist speech, national governments should adopt a …
The Dietary Bioaccumulation And Detection Of Engineered Nanosilver In Fish, Nathaniel Clark
The Dietary Bioaccumulation And Detection Of Engineered Nanosilver In Fish, Nathaniel Clark
School of Biological and Marine Sciences Theses
Emerging contaminants, including engineered nanomaterials (ENMs), need to undergo environmental risk assessment, whereby they are tested for properties of persistence in the environment, toxicity or bioaccumulation. To date, little data exists for the bioaccumulation of ENMs in animals, particularly fish, with a focus on alternative methods to in vivo testing. Also, interpretation of data for hazard assessment is hampered by the lack of routine methods to detect the form of materials in the tissues following exposure. Therefore, there were three main aims to the thesis; the first was to determine the dietary accumulation of ENMs into fish, using a tiered …

Evaluating Kentucky State Pension Plans In The 2000s And Best Practices Moving Forward, Sarah Alegria
Evaluating Kentucky State Pension Plans In The 2000s And Best Practices Moving Forward, Sarah Alegria
MPA/MPP/MPFM Capstone Projects
The Commonwealth of Kentucky sponsors three different pension retirement systems. This includes Kentucky Employee Retirement System, Teacher’s Retirement System, and Kentucky’s Judicial Form of Retirement System. Kentucky has one of the worst funded pension retirement plans and is currently facing shortfalls of about $43 billion (PEW, 2013). Between 1998-2008, Commonwealth of Kentucky’s legislators made many detrimental policy decisions that negatively affected its Pension Retirement System. The most impacting includes:
- Enhancements of Benefits in the Nineties
- Changing Final Compensation from the average of five-years to the average of three-years
- Mandated Yearly Cost of Living Adjustments (COLA)
- Not requiring the State to …

Unlocking Access To Health Care: A Federalist Approach To Reforming Occupational Licensing, Gabriel Scheffler
Health Matrix: The Journal of Law-Medicine
Several features of the existing occupational licensing system impede access to health care without providing appreciable protections for patients. Licensing restrictions prevent health care providers from offering services to the full extent of their competency, obstruct the adoption of telehealth, and deter foreign-trained providers from practicing in the United States. Scholars and policymakers have proposed a number of reforms to this system over the years, but these proposals have had a limited impact for political and institutional reasons.
Still, there are grounds for optimism. In recent years, the federal government has taken a range of initial steps to reform licensing …

Warrantless Searches Of Electronic Devices At U.S. Borders: Securing The Nation Or Violating Digital Liberty?, Ahad Khilji
Catholic University Journal of Law and Technology
The steady increase of U.S. citizens traveling with smart phones and other electronic devices has been met with the rise of searches and seizures by CBP officers at U.S borders. Although only less than 0.1% of all travelers may actually be subjected to a search while entering the United States, when comparing the statistics between a six month period in 2016 with the same period in 2017, electronic device searches have almost doubled from 8,383 to 14,993. Approximately one million travelers to the U.S. are inspected by the CBP every day. Out of this population, nearly 2,500 electronic devices are …

The Mythology Of Sanctuary Cities, Kit Johnson
The Mythology Of Sanctuary Cities, Kit Johnson
Faculty Articles
Sanctuary jurisdictions — be they cities, counties, or states — employ various means of disentangling local law enforcement from federal civil immigration enforcement. Much of the criticism directed at these “sanctuary cities” revolves around a set of myths — such as that these jurisdictions are lawless or dangerous. This Essay identifies nine myths about sanctuary cities and subjects each to a fact-based shakedown.

Silenced: Women’S Voices And The European Court Of Human Rights (2019), Tiffany Carpenter
International Studies Undergraduate Honors Theses
This article examines the European Court of Human Rights (ECtHR) and its judgments associated with women’s rights in the areas of reproduction, religious, and refugee expression. As an international court, the ECtHR seeks to resolve disputes related to violations of human rights between an individual and a member state. Although the introduction of the court has been perceived as progressive for global human rights, the ECtHR’s recent judicial recommendationsindicate an absence of recognition or limited advocacy for women’s rights. In addition to analyzing how women’s reproduction, refugee, and religious expression rights have received inadequate support from the ECtHR, this article …

Exploring Tribal, County, And Municipal Cooperation In Minnesota, Mitchell Berg
School of Business Student Theses and Dissertations
The need for tribal, county, and municipal cooperation is ever more important now as political dysfunctionality, partisan gridlock, and federal and state devolution are pushing complex societal problems to be resolved at the local level. However, the desire for tribes and non-tribal local governments to cooperate can be limiting given the past historic indifferences and barriers to cooperation. This need to help tribes and municipalities form better relationships is what prompted Dr. James C. Collard (2006) to create a model for tribal and municipal cooperation. Therefore, the purpose of this dissertation is to examine Dr. Collard’s model, along with the …
