A major challenge for managing impacts and implementing effective mitigation measures and adaptation strategies for coastal zones affected by future sea level (SL) rise is our limited capacity to predict SL change at the coast on relevant spatial and temporal scales. Predicting coastal SL requires the ability to monitor and simulate a multitude of physical processes affecting SL, from local effects of wind waves and river runoff to remote influences of the large-scale ocean circulation on the coast. Here we assess our current understanding of the causes of coastal SL variability on monthly to multi-decadal timescales, including geodetic, oceanographic and …

Calculating Water Wavelength Using Dispersion Relation And Approximation, Chantelle Lee Jan 2019

Calculating Water Wavelength Using Dispersion Relation And Approximation, Chantelle Lee

Undergraduate Journal of Mathematical Modeling: One + Two

The dispersion relation equation is used to directly compute wave number and wave length to compliment water wave pressure sensor readings. Waves are measured to help coastal engineering to better mitigate coastal infrastructures. Various given wave periods and water depths are used to show how the dispersion relation equation could compute wave length. Also, shallow and deep-water approximations are formulated from the dispersion relation equation and the results are compared.

Punishment And Its Limits, Debra Parkes Jan 2019

Punishment And Its Limits, Debra Parkes

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

The nearly three decades in which Beverley McLachlin was a member of the Supreme Court, including 18 as Chief Justice, witnessed a number of shifts in Canadian penal policy and in the reach and impact of criminal law. During the Harper decade (2006 to 2015) in which the federal Conservatives enjoyed a majority government led by Prime Minister Stephen Harper, criminal justice policy took a turn toward the punitive. The federal government tore a page out of the American legislative handbook and sought to “govern through crime”, albeit in a more restrained Canadian style. Criminologists Anthony Doob and Cheryl Webster …

Constitutional Cohesion And The Right To Public Health, James G. Hodge, Daniel G. Aaron, Haley R. Auger, Ashley Cheff, Joseph Daval Jan 2019

Constitutional Cohesion And The Right To Public Health, James G. Hodge, Daniel G. Aaron, Haley R. Auger, Ashley Cheff, Joseph Daval

Utah Law Faculty Scholarship

Despite years of significant legal improvements stemming from a renaissance in public health law, Americans still face major challenges and barriers in assuring their communal health. Reversals of legal reforms coupled with maligned policies and chronic underfunding contribute to diminished public health outcomes. Underlying preventable morbidity and mortality nationally are realities of our existing constitutional infrastructure. In essence, there is no general obligation of government to protect or promote the public’s health. Under principles of “constitutional cohesion,” structural facets and rights-based principles interwoven within the Constitution protect individuals and groups from governmental vices (i.e., oppression, overreaching, tyranny, and malfeasance). Structural …

Disability And Automation: The Promise Of Cars That Automate Driving Functions, Leslie Francis Jan 2019

Disability And Automation: The Promise Of Cars That Automate Driving Functions, Leslie Francis

Utah Law Faculty Scholarship

Automated vehicles present tremendous possibilities for people with disabilities. They also have the potential to open new legal challenges for antidiscrimination law, tort liability, and privacy considerations. The initial discussions of these vehicles have pointed out their potential significance for people with disabilities, while largely ignoring what they might mean for disability law. This Article sets out first steps on the inviting road ahead for people with disabilities as users of automated means of transport.

Memoir As Witness To Mental Illness, Dora W. Klein Jan 2019

Memoir As Witness To Mental Illness, Dora W. Klein

Faculty Articles

During a trial, a witness's job is to supply the facts by telling the jury what she saw, heard, or otherwise experienced that is relevant to the legal questions the jury must answer. The jury's job is to decide how much weight and credibility to accord a witness's testimony. Jurors are expected, even instructed, to rely on their own knowledge about the world when deciding whether and how much to believe a witness. Most of the time, jurors' own experiences are sufficient to allow them to accurately assess a witness's testimony. However, jurors are sometimes called upon to assess testimony …

Police Surveillance Of Cell Phone Location Data: Supreme Court Versus Public Opinion, Emma W. Marshall, Jennifer L. Groscup, Eve Brank, Analay Perez, Lori A. Hoetger Jan 2019

Police Surveillance Of Cell Phone Location Data: Supreme Court Versus Public Opinion, Emma W. Marshall, Jennifer L. Groscup, Eve Brank, Analay Perez, Lori A. Hoetger

Center on Children, Families, and the Law: Faculty Publications

The Fourth Amendment to the United States Constitution protects individuals from unreasonable searches and seizures. As technology evolves, courts must examine Fourth Amendment concerns implicated by the introduction of new and enhanced police surveillance techniques. Recent Supreme Court cases have demonstrated a trend towards reconsidering the mechanical application of traditional Fourth Amendment doctrine to define the scope of constitutional protections for modern technological devices and personal data. The current research examined whether public opinion regarding privacy rights in electronic communications is in accordance with these Supreme Court rulings. Results suggest that cell phone location data is perceived as more private …

Youth Suffrage: In Support Of The Second Wave, Mae Quinn, Caridad Dominguez, Chelsey Omega, Abrafi Osei-Kofi, Carlye Owens

Journal Articles

The 100th anniversary of the 19th Amendment to the United States Constitution is an appropriate moment to reflect on the history—and consider the future—of the right to vote in the United States. High school and college classes teach the nation’s suffrage story as integral to our identity, focusing on the enfranchisement of women under the 19th Amendment and African Americans pursuant to the 15th Amendment.1 Constitutional law courses also present the 15th Amendment as foundational knowledge for the legal profession.2 Critical legal theory and women’s legal history texts frequently cover the 19th Amendment as central to understanding the first wave …

Reframing Radical Religion, Vanita Saleema Snow

Journal Articles

Like a thief in the night,1 politicians have stolen religion for their deceptive vices, using the term “radicalization” or “terrorism” to meet their needs.2 See Sahar F. Aziz, Caught in a Preventive Dragnet: Selective Counterterrorism in a Post-9/11 America, 47 GONZ. L. REV. 429, 481 (2012) (discussing how a police report equates “Muslim religiosity with radicalization toward terrorism”); David A. Bosworth, American Crusade: The Religious Roots of the War on Terror, 7 BARRY L. REV. 65, 65 (2006) (noting that American news and popular culture often portray religious people as “narrow-minded bigots out to destroy everything good and decent”); Ned …

The Use Of State-Sponsored Torture For National Security: A Debate On The Permissibility Of Torture In The Name Of Public Safety, Matthew Fisher Jan 2019

The Use Of State-Sponsored Torture For National Security: A Debate On The Permissibility Of Torture In The Name Of Public Safety, Matthew Fisher

Honors Program Theses

Can the United States government’s use of state-sponsored torture ever be justified for national security purposes? This question is a taboo subject that frequently elicits passionate responses from individuals who argue both for and against its use in upholding national security. This vigorous debate challenges moral, ethical, legal, and even pragmatic ideals in seeking to determine if state use of torture can ever be a part of America’s national security strategy. These considerations, and others, have inspired this research project and the specific research question which seeks to determine whether the United States government’s use of state-sponsored torture for national …
