The Waiting Game: How States Can Solve The Organ-Donation Crisis, Meredith M. Havekost Mar 2019

The Waiting Game: How States Can Solve The Organ-Donation Crisis, Meredith M. Havekost

Vanderbilt Law Review

Thousands of patients in the United States live in limbo every day waiting for a lifesaving organ transplant, and the gap between the number of people who need a transplant and the number of available organs widens every year. Every state currently allows individuals to unilaterally indicate their intent to donate their organs upon death, but in practice, family members are frequently allowed to override the express intentions of decedents. In addition, the current U.S. "opt-in" system fails to reach its full potential because many eligible decedents never express their desires to become or not to become organ donors, and …

On The Fringes Of The Fourth Amendment: Changing Reasonableness At The Border, Isabelle Hutchinson Mar 2019

On The Fringes Of The Fourth Amendment: Changing Reasonableness At The Border, Isabelle Hutchinson

Student Scholarship

The protection of the U.S.-Mexico border has become a priority for politicians and government officials alike. However, the protection of peoples rights near the border has been largely ignored. Due to the Fourth Amendments border search exception, customs officials and border patrol agents may use lower standards for suspicion in conducting searches and seizures of people in the border region. In determining whether a search or seizure is reasonable, the Fourth Amendment requires balancing of the degree to which the government intrudes on a persons privacy against the governments interest in conducting the search. This Article analyzes the changes in …

Place Matters Continuum Of Care Report, Mara Sanchez Phd, Erica King Msw

Maine Statistical Analysis Center

In 2019 and beyond, Maine policymakers will make decisions about how to support Maine’s youth, families, and communities. Youth involved in the justice or child welfare system that are transitioning to adulthood (ages 14 to 25) are a particularly vulnerable and underserved population. Approximately fourteen thousand young people in Maine between the ages of 16 and 24 are disconnected from school and unemployed, and roughly three thousand of these youth will face homelessness or will return to communities from outof- home treatment, confinement, or multi-system involvement ranging from days to years. At eighteen, some face a chasm of service availability …

2016 - California Land Use And Management - A Resource Management Strategy Of The California Water Plan

Miscellaneous Documents and Reports

Land use planning and management cuts across many resource management strategies. More efficient and effective land use is linked to several resource management strategies including watershed, water use efficiency, groundwater quality, flood management, parks and recreation, climate change adaptive management and agricultural lands stewardship. Directly development away from agricultural lands permits multi-objective management of these lands for agricultural preservation, floodplain management, water quality, habitat conservation, and sustainable development. In addition, planning for more compact and sustainable communities, both urban and rural, will assist in reducing reliance on the state-s water supply, and result in more efficient use of California’s water …

Erecting A Virtual Schoolhouse Gate, Maryam Ahranjani Mar 2019

Erecting A Virtual Schoolhouse Gate, Maryam Ahranjani

Faculty Book Display Case

The very first amendment to the United States Constitution protects the freedom of speech. While the Supreme Court held in 1969 that students “do not shed their constitutional rights at the schoolhouse gate,” since then the Court has limited students' freedom of speech, stopping short of considering the boundaries of off-campus, online speech. Lower court holdings vary, meaning that a student engaging in certain online speech may not be punished at all in one state but would face harsh criminal punishments in another. The lack of a uniform standard leads to dangerously inconsistent punishments and poses the ultimate threat to …

Withdrawing From Nafta, Alison Peck Mar 2019

Withdrawing From Nafta, Alison Peck

Faculty & Staff Scholarship

Since the 2016 campaign, Donald Trump has threatened to withdraw from NAFTA. Can he? The question is complex. For one thing, NAFTA is not a treaty negotiated under the Treaty Clause of the Constitution, but rather a congressional–executive agreement, a creature of dubious con- stitutionality and ill-defined withdrawal and termination parameters. This Article reviews the scope of those restrictions and concludes that unilateral presidential withdrawal from NAFTA, although not without support, is ultimately unlawful. On one hand, unilateral presidential withdrawal would be valid as a matter of international law, and the NAFTA Implementation Act appears to be designed to terminate …

Caring For Aging Prisoners Is Taxing: How Missouri Can Ease Its Prison Health Care Burden, Joellen Grohs Mar 2019

Caring For Aging Prisoners Is Taxing: How Missouri Can Ease Its Prison Health Care Burden, Joellen Grohs

The Business, Entrepreneurship & Tax Law Review

In 1976, the Supreme Court of the United States handed down the decision in Estelle v. Gamble which established the government’s obligation to provide medical care to incarcerated persons. The 1970s is also known as the “Tough-On-Crime Era,” where politicians began to take sides on crime and create mandatory minimum sentences. This led to a dramatic increase in the prison population and, more specifically, the aging prison population. Because of the government’s obligation to provide medical care to inmates based on the decision in Estelle, caring for the aging prison population has become more expensive and more burdensome on the …

Perceptions About Sexual Offenses: Misconceptions, Punitiveness, And Public Sentiment, Laura L. King Mar 2019

Perceptions About Sexual Offenses: Misconceptions, Punitiveness, And Public Sentiment, Laura L. King

Criminal Justice Faculty Publications and Presentations

Decades of research on public opinion about crime reveal varying, yet relatively punitive attitudes that are often riddled with misconceptions. Sparked by the increased media and legislative attention devoted to sex offenders beginning in the 1990s, researchers began to more closely examine public opinion about sexual offenses. Findings suggest the public adheres to several misconceptions about sexual offenses and supports harsh sanctions for offenders. However, further research is warranted to more closely examine the relationships among these variables. Thus, the goal of the present study was to survey Pennsylvania residents to examine the degree to which misconceptions about sexual offenses …

From The “Jewish Clause” To The “Homosexual Clause”: An Analysis Of Beneficiary Restriction Clauses Which Restrict Same-Sex Marriage In Illinois, Julian Valdes Mar 2019

From The “Jewish Clause” To The “Homosexual Clause”: An Analysis Of Beneficiary Restriction Clauses Which Restrict Same-Sex Marriage In Illinois, Julian Valdes

Southern Illinois University Law Journal

This article analyzes the validity of beneficiary restriction clauses in wills aimed at restricting same-sex marriages of the will’s beneficiaries in Illinois. Courts have in the past found some limitations on marriage of beneficiaries to be acceptable and others not under a public policy analysis. Illinois courts, however, have not addressed whether such a clause which restricts its beneficiaries from marrying someone of the same sex is a valid clause under Illinois public policy.

This article addresses the existing scholarship relating to how such an issue could be addressed. After weighing each option, the article proposes a solution for Illinois …

Business, Legal, And Policy Issues In Relation To Increased Private Space Activity, Mark J. Sundahl Mar 2019

Business, Legal, And Policy Issues In Relation To Increased Private Space Activity, Mark J. Sundahl

Law Faculty Articles and Essays

Throughout the history of human activity in outer space, the role of private companies has steadily grown, and, in some cases, companies have even replaced government agencies as the primary actors in space. As private space activity has grown and diversified, the laws and regulations that govern private actors have been forced to evolve in reaction to the new realities of the industry. On the international level, the treaties concluded in the 1960s and 1970s continue to be in force today. However, these treaties only govern state activity in space. The rules regulating private industry are necessarily domestic in nature, …

Toward The Personalization Of Copyright Law, Adi Libson, Gideon Parchomovsky Mar 2019

Toward The Personalization Of Copyright Law, Adi Libson, Gideon Parchomovsky

University of Chicago Law Review

In this Essay, we provide a blueprint for personalizing copyright law in order to reduce the deadweight loss that stems from its universal application to all users, including those who would not have paid for it. We demonstrate how big data can help identify inframarginal users, who would not pay for copyrighted content, and we explain how copyright liability and remedies should be modified in such cases.

The Chilling Effect Of Governance-By-Data On Data Markets, Niva Elkin-Koren, Michal S. Gal Mar 2019

The Chilling Effect Of Governance-By-Data On Data Markets, Niva Elkin-Koren, Michal S. Gal

University of Chicago Law Review

Big data has become an important resource not only for commerce but also for governance. Governance-by-data seeks to take advantage of the bulk of data collected by private firms to make law enforcement more efficient. It can take many forms, including setting enforcement priorities, affecting methods of proof, and even changing the content of legal norms. For instance, car manufacturers can use real-time data on the driving habits of drivers to learn how their cars respond to different driving patterns. If shared with the government, the same data can be used to enforce speed limits or even to craft personalized …
