Defending White Space, Addie C. Rolnick
Defending White Space, Addie C. Rolnick
Cardozo Law Review
Police violence against minorities has generated a great deal of scholarly and public attention. Proposed solutions-ranging from body cameras to greater federal oversight to anti-bias training for police-likewise focus on violence as a problem of policing. Amid this national conversation, however, insufficient attention has been paid to private violence. This Article examines the relationship between race, self-defense laws, and modern residential segregation. The goal is to sketch the contours of an important but undertheorized relationship between residential segregation, private violence, and state criminal law. By describing the interplay between residential segregation and modern self-defense law, this Article reveals how criminal …
Looking Beyond Binaries To Avoid Polarization In The Sex Work Debate, Laura Keenan
Looking Beyond Binaries To Avoid Polarization In The Sex Work Debate, Laura Keenan
Tredway Library Prize for First-Year Research
This paper considers both sides of the debate surrounding sex work--the argument for criminalizing sex work and the contention for legalizing sex work--in relationship to policies aimed at combating sex-trafficking in America as well as globally. A queer theory concept of recognizing and removing linguistically created binaries is applied to this debate to offer a more productive perspective on the matter.

Living Illegal: Being Lgbt In Russia, Jeremy M. Tsuchitani-Watson
Cardozo International & Comparative Law Review
As lesbian, gay, bisexual, transgender, and queer or questioning (LGBTQ) rights around the world continue a wave of progress, it is hard to imagine that the advances are being erased at the same pace. It is even harder to imagine this happening in a democratic society in a developed country. Finally, it is even more astounding that this is happening in a country that is considered a super power. However, it is happening, and has been happening since 2006.
For many reasons, the LGBTQ community has become a target of the Russian government; both the federal government and localized governments. …

This study takes a cultural approach to examine the unstable and contentious nature of Korean democracy. Analyzing an original nationwide survey conducted in 2015, we find that the democratic and participatory culture of the Korean people underlies Korean democracy. This finding suggests substantial tension between the participatory orientation of the public and Korean representative democracy.
Sustainable Public Procurement In The Kuwait Public Sector, Fatimah M A Ai Maraghi
Sustainable Public Procurement In The Kuwait Public Sector, Fatimah M A Ai Maraghi
Business Administration Dissertations
Sustainable Public Procurement (SPP) is the act of integrating the sustainable development concept into the procurement operations undertaken by the government. The extension of sustainability to public procurement is an emerging area of research; the literature provides little evidence on how to address SPP in general, and specifically in a developing country context. This thesis aims to bridge this gap by investigating the practices of SPP in a developing country such as Kuwait. The primary objective of this doctoral thesis is to assess the current SPP policies and practices in the Kuwait public sector organizations and to identify the main …

Trade And The Separation Of Powers, Timothy Meyer, Ganesh Sitaraman
Vanderbilt Law School Faculty Publications
There are two paradigms through which to view trade law and policy within the American constitutional system. One paradigm sees trade law and policy as quintessentially about domestic economic policy. Institutionally, under the domestic economics paradigm, trade law falls within the province of Congress, which has legion Article I authorities over commercial matters. The second paradigm sees trade law as fundamentally about America’s relationship with foreign countries. Institutionally, under the foreign affairs paradigm, trade law is the province of the President, who speaks for the United States in foreign affairs. While both paradigms have operated throughout American history, the domestic …

Weathering The Storm: Utilizing Congressional Investigations To Improve National Hurricane Preparedness, Jennifer Safstrom
Vanderbilt Law School Faculty Publications
During the 2017 hurricane season, three major storms impacted differ- ent regions of the United States. These storms-Hurricanes Harvey, Irma, and Maria-devastated communities in Texas, Florida, and Puerto Rico within the span of a month. These storms were so destructive that the World Meteorological Organization has retired all three storm names, meaning no future hurricane will ever bear the names Harvey, Irma, or Maria again. In response, according to the Government Accountability Office ("GAO"), "19 federal agencies had entered into contracts and obligated over $5.6 billion on those contracts to support efforts related to Hurricanes Harvey, Irma, and Maria" as …

Comparative Summary by Peter Roudik, Director of Legal Research
This report examines the legal approaches of fifteen countries, representing all regions of the world, to the emerging problem of manipulation with “fake news” using mass and social media, especially the impact of fake news on ongoing political processes and elections, and the legislative measures undertaken to counteract the dissemination of false information. Fake news as a phenomenon is not new and has been known since ancient times, but the present-day proliferation of digital and social media platforms, which allow for much broader distribution of information to a global audience, makes …
Planning For The "New Normal": Using Build One Portsmouth To Address Flood Resilience, Alison Wrynn, Sarah Simonetti
Planning For The "New Normal": Using Build One Portsmouth To Address Flood Resilience, Alison Wrynn, Sarah Simonetti
Virginia Coastal Policy Center
Sea level rise, recurrent flooding, and increasingly severe storms are ever-present threats to coastal Virginia. As climate change becomes the “new normal”, creative solutions are needed to adapt to these stark realities.
In response to these climate-related challenges, Governor Ralph Northam issued Executive Order 24, “Increasing Virginia’s Resilience to Sea Level Rise and Natural Hazards,” on November 2, 2018. The Executive Order designated the Secretary of Natural Resources as the Chief Resilience Officer of the Commonwealth, and set forth various actions intended to increase statewide resilience to natural hazards and extreme weather. Later that same month, Portsmouth released its 2018 …
The Creation Of A Virginia Coastal Resilience Development Authority: An Inventory Of State Coastal Resilience Authorities And Funding Mechanisms To Help Guide Virginia, Kristi Gennette
Virginia Coastal Policy Center
In June 2018, Governor Ralph Northam signed legislation creating a cabinet-level position, the Special Assistant to the Governor for Coastal Adaptation and Protection, to lead efforts in addressing coastal resilience and flooding mitigation in Virginia. The following November, Governor Northam signed Executive Order No. 24, which directed the state to increase statewide resilience to natural hazards and extreme weather. This Executive Order directed Virginia to develop a Coastal Resilience Master Plan (CRMP). In order to implement the projects proposed in the CRMP, the Commonwealth will need funding. This paper provides an inventory of various states’ programs for funding coastal resilience …

Economics Faculty Research and Publications
We examine the impact of the Great Recession on public education finance and employment. Five major themes emerge from our work. First, nearly 300,000 school employees lost their jobs. Second, schools that were heavily dependent financially on state governments were particularly vulnerable to the recession. Third, local revenues from the property tax actually increased during the recession, primarily because millage rates rose in response to declining property values. Fourth, inequality in school spending rose sharply during the Great Recession. We argue, however, that we need to be very cautious about this result. School spending inequality has risen steadily since 2000; …

In May of 1963, a police officer in San Benito, Texas, arrested Antonio Mendoza, a Mexican American, for public drunkenness. After beating him, he placed the dazed prisoner in a jail cell. For more than seventeen hours, no one at the jail saw f it to tend to the prisoner’s wounds, provide food or water, or check on his overall well-being. By the time an official checked on him, Mendoza, overcome by fear, pain, or emotional distress—or by some combination of all three—had committed suicide. “The man was found the next morning hanging by a belt from a pipe in …

Mimo Radar Waveform Design And Sparse Reconstruction For Extended Target Detection In Clutter, Christopher Alan Rogers
Mimo Radar Waveform Design And Sparse Reconstruction For Extended Target Detection In Clutter, Christopher Alan Rogers
Electrical & Computer Engineering Theses & Dissertations
This dissertation explores the detection and false alarm rate performance of a novel transmit-waveform and receiver filter design algorithm as part of a larger Compressed Sensing (CS) based Multiple Input Multiple Output (MIMO) bistatic radar system amidst clutter. Transmit-waveforms and receiver filters were jointly designed using an algorithm that minimizes the mutual coherence of the combined transmit-waveform, target frequency response, and receiver filter matrix product as a design criterion. This work considered the Probability of Detection (P D) and Probability of False Alarm (P FA) curves relative to a detection threshold, τ th, Receiver Operating Characteristic (ROC), …

Ultra-Wideband Microstrip Antenna Enhanced Performance Using Metamaterial, Elham K. A Serria
Theses
Antenna engineering is very important in the development of communication systems and the requirements for low profile antennas that cover a wide spectrum of frequencies increase the number of researches in this field. Accordingly, scientists have focused on UWB microstrip antennas that cover the range from 3.1 GHz to 10.6 GHz but others concentrate on enhancing its performance using a special type of materials called metamaterials.
The main objective of this work is to enhance frequency bandwidth, antenna gain, and radiation pattern for the UWB circular microstrip antenna by employing the Split Ring Resonator (SRR) technique, which is one type …

Originalism And A Forgotten Conflict Over Martial Law, Bernadette Meyler
Originalism And A Forgotten Conflict Over Martial Law, Bernadette Meyler
Northwestern University Law Review
This Symposium Essay asks what a largely forgotten conflict over habeas corpus and martial law in mid-eighteenth-century New York can tell us about originalist methods of constitutional interpretation. The episode, which involved Abraham Yates, Jr.—later a prominent Antifederalist—as well as Lord Loudoun, the commander of the British forces in America, and New York Acting Governor James De Lancey, furnishes insights into debates about martial law prior to the Founding and indicates that they may have bearing on originalist interpretations of the Suspension Clause. It also demonstrates how the British imperial context in which the American colonies were situated shaped discussions …
Museums And The Tax Code: A Fraught Friendship, Elisha Muir
Museums And The Tax Code: A Fraught Friendship, Elisha Muir
Theses
Museums benefit immensely from their position in the American tax code and its peculiarities, but the fundamentals of this relationship are often muddled, confusing, and difficult to explain. But with recent alterations to the federal tax code and an atmosphere of apprehension in the field, understanding and explanation are critical to proper decision-making and governance. This thesis addresses that need through multifaceted research and analysis of historical data, expert analysis, and crucially case law at both the federal and state level. The result of this will be to expand the currently anemic body of current literature on the topic and …
Opioid Policing, Barbara A. Fedders
Opioid Policing, Barbara A. Fedders

This Article identifies and explores a new, local law enforcement approach to alleged drug offenders. Initially limited to a few police departments, but now expanding rapidly across the country, this innovation takes one of two primary forms. The first is a diversion program through which officers refer alleged offenders to community-based social services rather than initiate criminal proceedings. The second form offers legal amnesty as well as priority access to drug detoxification programs to users who voluntarily relinquish illicit drugs. Because the upsurge in addiction to — and death from — opioids has spurred this innovation, I refer to it …

A Framework For Test & Evaluation Of Autonomous Systems Along The Virtuality-Reality Spectrum, Nathan D. Gonda
A Framework For Test & Evaluation Of Autonomous Systems Along The Virtuality-Reality Spectrum, Nathan D. Gonda
Computational Modeling & Simulation Engineering Theses & Dissertations
Test & Evaluation of autonomous vehicles presents a challenge as the vehicles may have emergent behavior and it is frequently difficult to ascertain the reason for software decisions. Current Test & Evaluation approaches for autonomous systems place the vehicles in various operating scenarios to observe their behavior. However, this introduces dependencies between design and development lifecycle of the autonomous software and physical vehicle hardware. Simulation-based testing can alleviate the necessity to have physical hardware; however, it can be costly when transitioning the autonomous software to and from a simulation testing environment. The objective of this thesis is to develop a …
Perspectives On Community Policing Of Durban Juveniles Living On The Streets, Dena Cheng
Perspectives On Community Policing Of Durban Juveniles Living On The Streets, Dena Cheng
Independent Study Project (ISP) Collection
The aim of this project is to critically analyze the structure and performance of the South African Police Service (SAPS) at the nexus of juvenile criminal justice and homelessness. Facing issues of social discord, legitimacy, and patterns of corruption following the era of apartheid, SAPS plays a critical role in both preventing as well as eliminating crime. Therefore, this project focuses on a particularly marginalized community, under-aged street children, since the treatment of youth crime and/or criminality in Durban serves as a microcosm of a larger system of practices implemented by SAPS. Through in-depth interviews with local social workers, a …

Small island developing states are arguably the most vulnerable, exposed nations on a global scale to the harmful effects of climate change. Particularly in Samoa, an abundance of environmental, economic, and social impacts have severe impacts on both the country as a whole as well as on an individual level. This study analyzes future mitigation strategies of land use and urban design to recreate Samoa’s capital of Apia as a more climate-resilient city to encourage economic growth and to ensure the well-being of all inhabitants. This planning is based upon current challenges of Samoa driven by climate change such as …

A Framework To Reveal Clandestine Organ Trafficking In The Dark Web And Beyond, Michael P. Heinl, Bo Yu, Duminda Wijesekera
Journal of Digital Forensics, Security and Law
Due to the scarcity of transplantable organs, patients have to wait on long lists for many years to get a matching kidney. This scarcity has created an illicit market place for wealthy recipients to avoid long waiting times. Brokers arrange such organ transplants and collect most of the payment that is sometimes channeled to fund other illicit activities. In order to collect and disburse payments, they often resort to money laundering-like schemes of money transfers. As the low-cost Internet arrives in some of the affected countries, social media and the dark web are used to illegally trade human organs. This …

Toward A Just System For Juveniles, Karl A. Racine, Elizabeth Wilkins
University of the District of Columbia Law Review
Each year as a nation we prosecute over 800,000 children-nearly three percent of the juvenile population2 and detain over 200,000 of them.3 That is, we saddle almost three percent of our youth with the experience of being a defendant in court, with the label of delinquency. And we separate over a quarter of those youth from family and community for some period of time. The overwhelming majority of these children have experienced life-altering trauma in their young lives, and these experiences with the juvenile justice system can exacerbate that trauma.4 Yet,while we are affecting our young people on this massive …

Taxation And Reducing Recidivism: A Legal Comparative Analysis Of Reducing Recidivism In States And A Federal Solution For The Future, Israel X. Nery, Scott B. Astrada
University of the District of Columbia Law Review
In this article, we will focus on employer-based tax incentives for hiring ex-offenders. Central to the discussion will be the Work Opportunity Tax Credit ("WOTC"), which provides a tax credit to employers who hire qualified employees/ex-offenders under the program. Additionally, we will explore various state programs modeled on a tax-based incentive and conduct a comparative assessment of where federal and state programs are effective and where there is potential for reform. Without targeted policy solutions to address employment obstacles, ex-offenders are left facing persistent employment barriers as they attempt to return to their communities and start a new life after …
