Misdemeanor Appeals, Nancy J. King, Michael Heise Oct 2019

Misdemeanor Appeals, Nancy J. King, Michael Heise

Vanderbilt Law School Faculty Publications

We provide the first estimate of the rate of appellate review for misdemeanors, concluding that appellate courts review no more than eight in ten thousand misdemeanor convictions and disturb only one conviction or sentence out of every ten thousand misdemeanor judgments. This level of oversight is much lower than that for felony cases, for reasons we explain. To develop law and regulate error in misdemeanor cases, particularly in prosecutions for the lowest-level offenses, courts may need to provide mechanisms for judicial scrutiny outside the direct appeal process.

Additional findings include new information about the rate of felony trial court review …

Lifestyle factors related to energy balance, such as excess body weight, poor diet, and physical inactivity, are associated with risk of sporadic endometrial cancer (EC) and colorectal cancer (CRC). There are limited data on energy balance-related lifestyle factors and EC or CRC risk among individuals with lynch syndrome, who are at extraordinarily higher risk of developing EC or CRC. We conducted a systematic review of evidence related to weight status, weight change, dietary habits, and physical activity on EC and CRC risk among individuals with lynch syndrome. Findings are reported narratively. We searched Medline, EMBASE, CENTRAL, PubMed, and clinicaltrials.gov up …

Misdemeanor Appeals, Nancy J. King, Michael Heise

Cornell Law Faculty Publications

Misdemeanor cases affect far more people than felony cases, outnumbering felony cases by more than three to one. Yet little empirical information exists on many aspects of misdemeanor prosecutions. This Article provides the first quantitative look at appellate review in misdemeanor cases nationwide. It uses data drawn from a random sample of direct criminal appeals decided by every state appellate court in the nation, unpublished aggregate data on misdemeanor trial court cases provided by the Court Statistics Project, and published state court statistics.

We provide the first estimate of the rate of appellate review for misdemeanors, concluding that appellate courts …

Swagriculture: A Qualitative Examination Of Women’S Participation In Samoa’S Agriculture Industry As Farmers And Growers, Charlotte Crandall Oct 2019

Swagriculture: A Qualitative Examination Of Women’S Participation In Samoa’S Agriculture Industry As Farmers And Growers, Charlotte Crandall

Independent Study Project (ISP) Collection

This study is an examination of how women participate in agriculture in Samoa as farmers and growers, what hardships women encounter and how they overcome these, and the organizations that influence people’s experiences. Censuses have historically undercounted the number of women in agriculture in developing countries, largely due to rigid international definitions of what counts as labor, which overlook cultural nuances, and this study aims to fill this gap in research. Data was collected through nine Talanoa-inspired interviews with women involved with farming or growing in Samoa, and overarching themes were analyzed. The themes have been grouped by the specific …

Logistic And Structural Considerations For The Use Of Psychological First Aid In Humanitarian Emergencies, Taylor Johnson

Independent Study Project (ISP) Collection

Following the IASC recommendations for implementation of psychological first aid (PFA) in 2007, providing PFA in humanitarian emergencies as a method of psychosocial support has become one of the standard interventions in the wake of crises. However, the impact of PFA on future mental health outcomes remains largely unstudied and many structural and logistic factors (e.g. training of PFA providers, reviewing evidence to inform practice, and policy considerations) must be managed in order to ensure appropriate, high-quality PFA in humanitarian emergencies. This research aims to synthesize both primary interview data and the existing literature surrounding PFA in humanitarian emergencies to …

Developing Herd Health Education For And Assessing Risky Practices Of Cow-Calf Producers, Andrew J. Allen, Donald A. Llewellyn, Susan R. Kerr, Tipton D. Hudson, J. Shannon Neibergs, Sarah M. Smith, Dale A. Moore

Journal of Extension

Bovine respiratory disease (BRD) is an often unrecognized problem in cow-calf herds. We describe a program we used to help producers identify and avoid practices that could increase their herds' risk for BRD. The greatest knowledge gains occurred for the topics of costs associated with BRD, BRD risks at the feedlot, and biosecurity measures. Through producer self-assessments, we found that the number of risky practices conducted by producers ranged from none to 22 per operation, averaging 10 per operation. Extension professionals should consider combining producer self-assessment with education on management as an effective strategy for informing producers of risks in …

Health Insurance Program For The Poor, Out-Of-Pocket Costs, And Catastrophic Health Expenditures In India, Shyamkumar Sriram

Theses and Dissertations

Background

India is currently taking steps to provide Universal Health Coverage (UHC) as envisaged in its National Health Policy 2017. Financial protection is considered the backbone of UHC. In India, OOP expenses accounts for about 62.6% of total health expenditure - one of the highest in the world. Out of 1.324 billion people in India, around 12.4% of the population is below the poverty line. Lack of health insurance coverage and inadequate coverage are important reasons for high OOP health expenditures. High OOP health expenditures push many households into poverty. The objective of this research is to examine the effect …

The Development And Implementation Of “Mission Nutrition”: An After-School Nutrition Education Program For Youth Grades Kindergarten Through Fifth, Rachel Maloy

Honors Program: Senior Projects (Public)

Childhood overweight, obesity, and food insecurity are serious problems that are especially prevalent in low-income areas. Belmont Elementary School serves many children from low-income households (classified as a Title I school with 82.6% of students receiving free or reduced-price lunch) and, thus, was a perfect setting for the birth of an original nutrition curriculum.

A six-week after-school nutrition education program called “Mission Nutrition” was developed and implemented at Belmont Elementary School over the course of three and a half years. While originally designed for third through fifth grade students, the program was adapted for kindergarten, first, and second grade students …

Motivational And Physiological Dysregulation Due To Development And Onset Of Obesity Via Melanocortin 4 Receptor +/- Haploinsufficiency, Alex Steiner

Theses and Dissertations

Obesity is one of the leading most health risks around the world, being especially problematic in the United States. A combination of high-fat diets and genetic abnormalities are to blame for the ever-growing number of obese individuals.

Melanocortin 4 receptors are vital for regulating energy expenditure and feeding behaviors; mutations of the receptors have been found to be the leading monogenetic cause of obesity. Using MC4R +/- haploinsufficient rats being fed a range of dietary fat, we investigated the physiological and motivational differences using a locomotor task, an operant task with fixed and progressive ratios, as well as a distraction …

Theses and Dissertations

Human papillomavirus (HPV) is the etiologic agent for cervical cancer with HPV type 16 (HPV16) being found in about 50% of cervical cancers worldwide. HPVs vary in genomic (DNA) sequence not only between types, but also within types, known as variants. Variants of a particular HPV type may differ by up to 2% in nucleotide sequence in the coding region and up to 5% in the noncoding region. Variants within HPV16 have been identified and grouped into six distinct phylogenetic branches, which segregate geographically: European (E), Asian-American (As.A), African-1 (Af-1), African-2 (Af- 2), Asian (As), and North American (NA). However, …

The Association Of Health Insurance And Prescription Drug Coverage On Cost-Related Non-Adherence And Hospitalization Across Age-Related Groups Of Individuals With Copd, Shamika Martin Walls Oct 2019

The Association Of Health Insurance And Prescription Drug Coverage On Cost-Related Non-Adherence And Hospitalization Across Age-Related Groups Of Individuals With Copd, Shamika Martin Walls

Theses and Dissertations

Background: COPD patients have poor adherence to prescribed treatment. Individuals with COPD have higher out-of-pocket treatment cost than individuals without COPD. The significant out of pocket COPD related treatment cost can lead to prescription drug non-adherence especially for individuals without health insurance or prescription drug coverage.

Significance: Since the implementation of Medicare Part D on January 1, 2006, there are no studies that have used national data to evaluate the association of health insurance and prescription drug coverage on cost related non-adherence and hospitalization among individuals 50-64 years old with COPD compared to individuals 65 years and older …
