Subverting Democracy To Save Democracy: Canada’S Extra-Constitutional Approaches To Battling “Fake News”, Michael Karanicolas

Canadian Journal of Law and Technology

Nearly a decade after the first Twitter and Facebook revolutions, the early narratives pointing to social media as a great agent of democratization1 have given way to a more nuanced understanding of the impact of the Internet on our political discourse. While there is no question that Internet access provides tremendous expressive benefits, scholars are increasingly questioning whether this information diet is ultimately healthy for society. An analogy to sugars, fats and salts has emerged, where just as an appetite for rich foods served our species well when resources were scarce, but have become a liability in an age of …

The United States, The International Criminal Court, And The Situation In Afghanistan, Sara L. Ochs Dec 2019

The United States, The International Criminal Court, And The Situation In Afghanistan, Sara L. Ochs

Notre Dame Law Review Reflection

The United States has always had a very complicated and tense relationship with the International Criminal Court (ICC) and with international criminal law generally. Yet, under the Trump administration, the U.S.–ICC relationship has deteriorated to an unprecedented level. Within the last few years, the U.S. government has launched a full-scale attack on the ICC—denouncing its legitimacy, authority, and achievements, blocking investigations, and loudly withdrawing all once-existing support for the court.

These hostilities bubbled over following the November 2017 request by the ICC Chief Prosecutor, Fatou Bensouda, for the court to open an investigation into alleged war crimes and crimes against …

Going Rogue: Mobile Research Applications And The Right To Privacy, Stacey A. Tovino

Notre Dame Law Review

This Article investigates whether nonsectoral state laws may serve as a viable source of privacy and security standards for mobile health research participants and other health data subjects until new federal laws are created or enforced. In particular, this Article (1) catalogues and analyzes the nonsectoral data privacy, security, and breach notification statutes of all fifty states and the District of Columbia; (2) applies these statutes to mobile-app-mediated health research conducted by independent scientists, citizen scientists, and patient researchers; and (3) proposes substantive amendments to state law that could help protect the privacy and security of all health data subjects, …

Improving Human Rights Compliance In Supply Chains, Kishanthi Parella Dec 2019

Improving Human Rights Compliance In Supply Chains, Kishanthi Parella

Notre Dame Law Review

Corporations try to convince us that they are good global citizens: “brands take stands” by engaging in cause philanthropy; CEOs of prominent corporations tackle a variety of issues; and social values drive marketing strategies for goods and services. But despite this rhetoric, corporations regularly fall short in their conduct. This is especially true in supply chains where a number of human rights abuses frequently occur. One solution is for corporations to engage in meaningful human rights due diligence that involves monitoring human rights, reporting on social and environmental performance, undertaking impact assessments, and consulting with groups whose human rights they …

Companion Dog Acquisition And Mental Well-Being: A Community-Based Three-Arm Controlled Study, Lauren Powell, Kate M. Edwards, Paul D. Mcgreevy, Adrian Bauman, Anthony L. Podberscek, Brendon Neilly, Catherine Sherrington, Emmanuel Stamatakis

Human-Animal Relationships Collection

Background

Dog ownership is suggested to improve mental well-being, although empirical evidence among community dog owners is limited. This study examined changes in human mental well-being following dog acquisition, including four measures: loneliness, positive and negative affect, and psychological distress.

Methods

We conducted an eight-month controlled study involving three groups (n = 71): 17 acquired a dog within 1 month of baseline (dog acquisition); 29 delayed dog acquisition until study completion (lagged control); and 25 had no intentions of acquiring a dog (community control). All participants completed the UCLA Loneliness Scale (possible scores 0–60), Positive and Negative Affect Schedule …

Evaluation Of Antibacterial Activities For Three Commonly Used Antibiotics Produced By Different Manufactures On Female Urinary Tract Infection Uropathogens In Kalar City., Mohammed H. Fatah

Polytechnic Journal

Health professional staff often claims information about trying to differentiate the used antibiotics based on the manufacturers that produce the drug, which may lead to a differentiation in the prescribing of the antibiotics by a physician. Numerous antibiotics produced by different manufactures, under different brands names are available in pharmacies for urinary tract infection (UTI) treatment; this study proceeds to find out and evaluates antibacterial activities of three most used antibiotics, produced by different antibiotic producers on uropathogens in Kalar city. Kirby–Bauer disk diffusion method is employed to assess antibacterial effectiveness of Amikacin (Ak), Levoflaxocilin (Lv) and Nitrofuratoin (Nr) against …

Regulating Bite Mark Evidence: Lesbian Vampires And Other Myths Of Forensic Odontology, Jennifer D. Oliva, Valena E. Beety Dec 2019

Regulating Bite Mark Evidence: Lesbian Vampires And Other Myths Of Forensic Odontology, Jennifer D. Oliva, Valena E. Beety

Washington Law Review

This is the third piece in a trilogy that examines and evaluates the standards that American courts apply to admit forensic “science” evidence proffered by prosecutors in criminal trials. The first two articles in the trilogy expose the criminal courts’ on-going practice of admitting false forensic evidence that is virtually always excluded in civil cases. They also advance a panoply of procedural and evidentiary solutions aimed at reforming this legally unviable discrepancy. Those solutions are court-centric insofar as they advocate for, among other things, open and early criminal discovery, pre-trial Daubert hearings to challenge evidence and experts, and court-appointment of …

Multidrug Resistance Regulators Mara, Soxs, Rob, And Rama Repress Flagellar Gene Expression And Motility In Salmonella Enterica Serovar Typhimurium, Srinivas Thota, Lon Chubiz Dec 2019

Multidrug Resistance Regulators Mara, Soxs, Rob, And Rama Repress Flagellar Gene Expression And Motility In Salmonella Enterica Serovar Typhimurium, Srinivas Thota, Lon Chubiz

Biology Department Faculty Works

Production of flagella is costly and subject to global multilayered regulation, which is reflected in the hierarchical control of flagellar production in many bacterial species. For Salmonella enterica serovar Typhimurium and its relatives, global regulation of flagellar production primarily occurs through the control of flhDC transcription and mRNA translation. In this study, the roles of the homologous multidrug resistance regulators MarA, SoxS, Rob, and RamA (constituting the mar-sox-rob regulon in S. Typhimurium) in regulating flagellar gene expression were explored. Each of these regulators was found to inhibit flagellar gene expression, production of flagella, and motility. To different degrees, repression via …

Asian-American Visibility: Movement Toward Authenticity And Exposing The White Gaze, Nora Tsou Dec 2019

Asian-American Visibility: Movement Toward Authenticity And Exposing The White Gaze, Nora Tsou

Senior Theses

Asian-Americans have a historical legacy and a multiplicity of narratives that are often rendered absent in American culture. Our oppression is not commonly spoken about, but it is relevant. By decentering Eurocentric thought as the only valid philosophy, herein this study I perform Asian-American philosophy through an analysis of philosophical and sociological texts on race. I continuously echo George Yancy and Gloria Anzaldua, philosophers of race, respectively, on the African-American and Latin-American experience, for their philosophy has greatly lead me to understanding my own. In order to conceptualize what oppressive struggles Asian-Americans face, I delve into research that exposes these …

Sex At Any Cost: How Gender Inequality, Capitalism, And Pornography Are Driving A $99 Billion Industry, Gina Vucci Dec 2019

Sex At Any Cost: How Gender Inequality, Capitalism, And Pornography Are Driving A $99 Billion Industry, Gina Vucci

Senior Theses

There are more slaves today than at any other time in human history. The International Labour Organization (ILO) estimates that there are more than 40 million slaves worldwide. This paper accompanies a 6-part webinar series of the same title that explores how gender inequality, capitalism, and pornography are driving a $99 billion illegal industry. The paper begins by defining what human trafficking is and includes both forced labor and commercial sexual exploitation. Six primary forms of human trafficking are explored, including domestic servitude, bonded labor, child slavery, sex trafficking, and forced marriage. Next, the paper explores who the victims of …

School Counseling Toward A Mission Of “Ib For All” School Counseling Toward A Mission Of “Ib For All”, Nancy Chae, Susanne P. Gray-Rice Dec 2019

School Counseling Toward A Mission Of “Ib For All” School Counseling Toward A Mission Of “Ib For All”, Nancy Chae, Susanne P. Gray-Rice

School of Leadership and Education Sciences: Faculty Scholarship

Although the International Baccalaureate Organization (IBO) recognizes the importance of school counselors, there is limited guidance about the expectations and roles of school counselors in serving the diverse needs of students in IB schools. With the IBO’s movement toward a mission of “IB for All” to address equitable access to academic rigor, this also aligns with school counselors’ ethical responsibilities as advocates, collaborators, and leaders to promote access and equity for all students. The authors (a) highlight the work of one school counseling program that developed and implemented initiatives, using the U.S.- based ASCA National Model (ASCA, 2019a) as a …
