Affordable Renewables - Unjust And Unreasonable?, Grace Brosofsky Dec 2019

Affordable Renewables - Unjust And Unreasonable?, Grace Brosofsky

Cornell Law Review

The Federal Energy Regulatory Commission (FERC)-an independent agency tasked with ensuring 'just and reasonable" energy rates-has begun to use energy market payment systems to prop up fossil fuels. FERC has issued orders that prevent renewables from competing with fossil fuels by forcing renewables to bid into energy markets at artificially high rates. FERC has argued that state clean energy subsidies distort energy markets by "suppressing prices" and pushing "needed" fossil fuel generators out of the market. According to FERC, a federal intervention is necessary to protect "market integrity" and ensure that consumers can access reliable electricity.

This Note argues that …

INDOMINABLE, Kathleen A Fox

The reformation of the feminine portrait from that of idealistic sexual beauty into a portrait of strength, community, longevity, transformation, and inane human foundational essence of societal value. This collection of portraits illustrates the uniqueness that is often overlooked for the fast, idealistic and instantly read images of women hailed as beautiful. These women contain a space they have earned with their strength of character, spirit, and unwillingness to be moved from their places of significance. Created with an expressive abstractive edge to traditional portraiture, these female portraits refuse to be easily glossed over, for their …

Dissertations

Robert Muczynski (1929-2010) was a composer, pianist, and educator whose work is starting to garner more attention and interest from scholars, performers, and audiences.

Muczynski’s musical output covers a variety of genres from works for solo instruments to orchestral works and film scores. He was especially devoted to writing for piano. This is well represented in his musical output. Among his forty-eight compositions with opus numbers, seventeen works are for solo piano. He also wrote a piano concerto (No.1, Op.7), and twelve chamber works featuring the piano. Although his music has increased in popularity, it is less discussed when compared …

The Histoplasma Capsulatum Ddr48 Gene Is Required For Survival Within Macrophages And Resistance To Oxidative Stress And Antifungal Drugs, Logan Blancett Dec 2019

The Histoplasma Capsulatum Ddr48 Gene Is Required For Survival Within Macrophages And Resistance To Oxidative Stress And Antifungal Drugs, Logan Blancett

Dissertations

Histoplasma capsulatum(Hc)is a systemic, dimorphic fungal pathogen that affects upwards of 500,000 individuals in the United States annually. Hc grows as a multicellular mold at environmental temperatures; whereas, upon inhalation into a human or other mammalian host, it transforms into a unicellular, pathogenic yeast. The research presented in this dissertation is focused on characterizing the DNA damage-responsive gene HcDDR48. HcDDR48was originally isolated via a subtractive DNA library enriched for transcripts enriched in the mold-phase of Hcgrowth. Upon further analysis we found that HcDDR48is not just expressed in the mold morphotype, but both growth programs …

Strategic Hiring And Research Productivity At U.S. Research Universities, David S. Mooneyhan Dec 2019

Strategic Hiring And Research Productivity At U.S. Research Universities, David S. Mooneyhan

Dissertations

Research universities provide new knowledge that advance technology and links the United States’ science and knowledge system with the world (Altbach, 2011). Public research universities play a significant role in regional and national economic development. Universities rely on funding from multiple sources to operate effectively. However, in recent years, public research universities in the United States have experienced declines in state funding (Hyman & Jacobs, 2010; Webber, 2017).

To offset declines in funding, public research universities may seek to increase research productivity through the hiring of faculty to address strategic institutional research goals. Strategic hiring is one approach used by …

Generally, there have been conflicts in the world regarding media coverage especially on #SyrianRefugees in Western media. It is undebatable that the Western states have political stability and peace; thus, they remain better hosts for asylum seekers and other refugees who come in search of greener pastures. However, current trends have hindered such countries from being ideal hubs because citizens have basic fears including those related to national security. Refugee situations have attracted lots of controversies over the years to the point that the concern is evident in the media. This dissertation explores the crisis of Syrian refugees and the …

Relationship Between Self-Development, Mentorship, And Senior Military Officer Moral Judgment, Garry Thompson Dec 2019

Relationship Between Self-Development, Mentorship, And Senior Military Officer Moral Judgment, Garry Thompson

Dissertations

Despite a renewed emphasis on ethics programs across the Department of Defense (DOD) since 2007, the number of senior officer ethical failures increased by 13% from 2015 to 2017 (Copp, 2017). If the trend of ethical failures and misconduct continue, the military faces a further decline in public confidence (DoDOIG, 2017). The 2017 DOD Inspector General report noted the trend of senior leader ethical failures might foster negative public perceptions regarding military leader’s overall dedication, sacrifice, ethics, and character (DoDOIG, 2017).

A review of military literature revealed the importance of mentorship and self-development in professional development; however, gaps between …

The Usage And Impact Of Outpatient Commitment Orders On Suicide And Suicide Attempt Rates In Mississippi, Sam Mauldin Dec 2019

The Usage And Impact Of Outpatient Commitment Orders On Suicide And Suicide Attempt Rates In Mississippi, Sam Mauldin

Dissertations

Rates of self-harm and suicide in the United States have not decreased since 1980 and remained relatively constant through the start of the 21st Century. The most recent data indicate that suicide rates in the United States have risen by about 2% a year from 2006 through 2016, although suicide rates have decreased in other countries during the same timeframe. Finding a viable intervention to slow rates of self-harm and suicide is needed in the United States. The need for closer patient observation has been cited as an underutilized intervention for the reduction of attempts of self-harm and suicide. …

Unveiling Identities: A Cultural Study Of The Portrayal Of Leading Women In Zhang Yimou Films, Patrick Mcguire Dec 2019

Unveiling Identities: A Cultural Study Of The Portrayal Of Leading Women In Zhang Yimou Films, Patrick Mcguire

Dissertations

It is imperative to recognize the ongoing collaborations of filmmakers from different countries. Film director Zhang Yimou, cited in this work, has reached out beyond his Chinese borders in recruiting both cast and crew on many of his latest features. But the field of film studies appears to have limited their investigations of such cross-cultural analyses, in particular the subjective analysis of the female lead character in film. Subjective and culturally wired as such, researchers bring forth conscious observations from their socialized unconscious minds.

This textual analysis begins with a comparison of two Chinese films, particularly observing their similar female …

The Changing News Paradigm Of South Mississippi’S Sun Herald As Seen Through The Eyes Of Its Journalists: 1968-2018, Judy Day Isbell

Dissertations

From the earliest days of the American democracy, one of the key tenets of the new government was rule by an informed electorate. This notion of rule of the people, by the people, for the people was established in the first article of the United States Constitution when the houses of Congress were carefully designed, and the idea of a knowledgeable constituency was emphasized in the first amendment when among such basic freedoms as speech, religion and assembly was freedom of the press.

Newspapers in America have changed significantly since the writing of that constitution, but most particularly in the …

Virtual Briefing At The Supreme Court, Jeffrey L. Fisher, Allison Orr Larsen Dec 2019

Virtual Briefing At The Supreme Court, Jeffrey L. Fisher, Allison Orr Larsen

Cornell Law Review

The open secret of Supreme Court advocacy in a digital era is that there is a new way to argue to the Justices. Today's Supreme Court arguments are developed online: they are dissected and explored in blog posts, fleshed out in popular podcasts, and analyzed and re-analyzed by experts who do not represent the parties or have even filed a brief in the case at all. This "virtual briefing" (as we call it) is intended to influence the Justices and their law clerks but exists completely outside of traditional briefing rules. This article describes virtual briefing and makes a case …

Changes Are Not Enough: Problems Persist With Ncaa's Adjudicative Policy, Elizabeth Lombard Dec 2019

Changes Are Not Enough: Problems Persist With Ncaa's Adjudicative Policy, Elizabeth Lombard

Notre Dame Law Review

Recently, the critical eye of the public has focused on the adjudicative and enforcement policy of the National Collegiate Athletic Association (NCAA). Social media sites serve as a testament to the rampant shock and confusion that the general population has harbored with regard to the enforcement and adjudication process on the heels of recent, high-profile cases. Witnessing verified sports reporters and outlets refer to the NCAA as powerless or questioning its purpose or existence altogether is evidence of the NCAA’s trying times in the court of public opinion. On the one hand, and rightfully so, one might think that this …

Please Tweet Responsibly: The Social And Professional Ethics Of Public Defenders Using Client Information In Social Media Advocacy, Nicole Smith Futrell Dec 2019

Please Tweet Responsibly: The Social And Professional Ethics Of Public Defenders Using Client Information In Social Media Advocacy, Nicole Smith Futrell

Publications and Research

Every day the criminal legal system hauls poor and marginalized individuals through a process wrought with trauma, indignity, and abuse. Public defenders representing the criminally accused view their clients and the system from a unique vantage point: they bear witness to the human costs of a system that falls far short of its purported norms and ideals. For the public defender who works within this reality day in and day out, fighting for each individual client might feel limited in its wider impact. Some public defenders have found that using online and social media platforms, such as Twitter, to provide …

Stock Price Using Domain Specific Lexicons, Zane Turner Dec 2019

Stock Price Using Domain Specific Lexicons, Zane Turner

Computer Science and Computer Engineering Undergraduate Honors Theses

Sentiment analysis is a broad and expanding field that aims to extract and classifying opinions from textual data. Lexicon-based approaches are based on using a sentiment lexicon, a list of words each mapped to a sentiment score, to rate the sentiment of a text chunk. Our work focuses on predicting stock price change using a sentiment lexicon built from financial conference call logs. We introduce a method to generate a sentiment lexicon based upon an existing probabilistic approach. By using a domain-specific lexicon, we outperform traditional techniques and demonstrate that domain-specific sentiment lexicons provide higher accuracy than generic sentiment lexicons …

Bottlenecks Or Growth Zones? A Study Of The Chirundu And Beitbridge Border Economies, Anna Ngarachu, Christopher Wood, Heinrich Krogman, Elisha Tshuma, Dale Mudenda

Southern African Journal of Policy and Development

Land borders in the Southern African Development Community (SADC) region are critical zones for unlocking regional value chains, trade and economic development. The Beitbridge and Chirundu border posts represent important links in the North–South Corridor. They are vital in both regional development and bilateral initiatives. It is at these borders that many issues related to regional integration intersect. Understanding the major complications that prevent competitive trade and undermine trade facilitation initiatives is, therefore, essential. This policy brief examines the causes of standing time – a major contributor to transport costs in sub-Saharan Africa – and discusses the softer issues such …

Tax Policy For The Wider Cryptoverse, Arild B. Doerge Dec 2019

Tax Policy For The Wider Cryptoverse, Arild B. Doerge

Student Scholarship

The rapid rise of Bitcoin and other “cryptoassets” offers many interesting technological capabilities but also comes with uncertainty and volatility in the markets for these assets. The diversity of types of cryptoassets is increasing rapidly, while public understanding and government policy have generally been slow to take account of this diversity. In regard to taxation policy related to cryptoassets, current IRS guidance merely categorizes cryptoassets as general property. The policy implications of this classification run contrary to fundamental goals of tax policy by inhibiting how people use cryptoassets, making compliance more complex and ambiguous than necessary, and taxing cryptoasset transactions …

Senate Bill 1383 Stinks, Steffani Fausone Dec 2019

Senate Bill 1383 Stinks, Steffani Fausone

Student Scholarship

Climate change is no longer a prediction; it is a reality. Part of the climate change conversation revolves around increased methane emissions, focusing on the agricultural industry as a culprit. To address these concerns, the California legislature recently passed Senate Bill 1383, which aims to reduce methane emissions from one agricultural industry in particular--dairies. This far-fetched bill is the first in the country to attempt to regulate methane from dairy cattle. With so much uncertainty surrounding this bill's effects, this Comment argues that the bill will hurt the dairy industry more than it helps combat climate change. This Comment also …

Beneficial Mutations For Carotenoid Production Identified From Laboratory-Evolved Saccharomyces Cerevisiae, Avinash Godara, Maria Alejandra Gomez Rodriguez, Joshua Weatherston, George Peabody, Hung-Jen Wu, Katy Kao Dec 2019

Beneficial Mutations For Carotenoid Production Identified From Laboratory-Evolved Saccharomyces Cerevisiae, Avinash Godara, Maria Alejandra Gomez Rodriguez, Joshua Weatherston, George Peabody, Hung-Jen Wu, Katy Kao

Faculty Publications

Adaptive laboratory evolution (ALE) is a powerful tool used to increase strain fitness in the presence of environmental stressors. If production and strain fitness can be coupled, ALE can be used to increase product formation. In earlier work, carotenoids hyperproducing mutants were obtained using an ALE strategy. Here, de novo mutations were identified in hyperproducers, and reconstructed mutants were explored to determine the exact impact of each mutation on production and tolerance. A single mutation in YMRCTy1-3 conferred increased carotenoid production, and when combined with other beneficial mutations led to further increased β-carotene production. Findings also suggest that the ALE …

Analysis Of Essential Programs And Services Components: English Language Learners Report Of Findings, Lisa Morris Phd, Amy F. Johnson Phd

Multi-language Learners

The Essential Programs and Services (EPS) funding formula allocates additional resources for each student who is identified as needing supplemental English language instruction. The additional funds are calculated using a weighting procedure that adjusts the student count upward by a certain amount in order to increase the district’s allocation. The weight is an estimate of the added cost of educating EL students relative to their non-EL peers.
