The Limits Of Legal Evolution: Knowledge And Normativity In Theories Of Legal Change, Liam Mchugh-Russell Jan 2019

The Limits Of Legal Evolution: Knowledge And Normativity In Theories Of Legal Change, Liam Mchugh-Russell

PhD Dissertations

Over the last forty years, legal theory and policy advice have come to draw heavily from an ‘evolutionary’ jurisprudence that explains legal transformation by drawing inspiration from the theoretical successes of Darwinian natural selection. This project seeks to enrich and critique this tradition using an analytical perspective that emphasizes the material consequences of concepts and ideas. Existing theories of legal evolution depend on a positivist epistemology that strictly distinguishes the objects of social life — interests, institutions, systems — from knowledge about those objects. My dissertation explores how knowledge, and especially non-legal expertise, acts as an independent site and locus …

Tourism And Justice On Catalina Island: Burdens, Power, And Decision-Making, Katherine Canfield Jan 2019

Tourism And Justice On Catalina Island: Burdens, Power, And Decision-Making, Katherine Canfield

Open Access Dissertations

The uneven distribution of the benefits and burdens of tourism development is creating an experience of social injustice for residents today on tourism-dependent Catalina Island, off the coast of California. While there is a great breadth of work covering archaeology and ecology of the island, there is minimal research related to recent human experience on the island (Higgins & Mehta, 2018; Hofmeister & Voss, 2017; Teeter et al., 2013). The island has been developed as a privately owned and managed tourism resort since 1880, and this private status has allowed for fluctuating involvement of island residents in decision-making and prolonged …

Word Sense Disambiguation Using Semantic Kernels With Class-Based Term Values, Ayşe Berna Altinel, Murat Can Gani̇z, Bi̇lge Şi̇pal, Eren Can Erkaya, Onur Can Yücedağ, Muhammed Ali̇ Doğan Jan 2019

Word Sense Disambiguation Using Semantic Kernels With Class-Based Term Values, Ayşe Berna Altinel, Murat Can Gani̇z, Bi̇lge Şi̇pal, Eren Can Erkaya, Onur Can Yücedağ, Muhammed Ali̇ Doğan

Turkish Journal of Electrical Engineering and Computer Sciences

In this study, we propose several semantic kernels for word sense disambiguation (WSD). Our approaches adapt the intuition that class-based term values help in resolving ambiguity of polysemous words in WSD. We evaluate our proposed approaches with experiments, utilizing various sizes of training sets of disambiguated corpora (SensEval). With these experiments we try to answer the following questions: 1.) Do our semantic kernel formulations yield higher classification performance than traditional linear kernel?, 2.) Under which conditions a kernel design performs better than others?, 3.) Does the addition of class labels into standard term-document matrix improve the classification accuracy?, 4.) Is …

“Making It Your Own By Adapting It To What’S Important To You”: Plurilingual Critical Literacies To Promote L2 Japanese Users’ Sense Of Ownership Of Japanese, Noriko Iwasaki, Yuri Kumagai Jan 2019

“Making It Your Own By Adapting It To What’S Important To You”: Plurilingual Critical Literacies To Promote L2 Japanese Users’ Sense Of Ownership Of Japanese, Noriko Iwasaki, Yuri Kumagai

East Asian Languages & Cultures: Faculty Publications

The dichotomy between native speaker (NS) and non-native speaker (NNS) remains ubiquitous across different language-learning contexts despite increasing mobility and multilingualism of society. L2 Japanese learners in particular may find themselves positioned as subordinate to NSs because of the myth of Japan being a homogeneous nation of one race and one language. To help L2 Japanese students counter such positioning and gain a sense of ownership, we implemented “plurilingual critical literacies” in a Japanese language course in the U.S. Critical literacy aims to cultivate students’ awareness that power relationships are at play in language use, and plurilingual pedagogy valorizes students’ …

Second Persons And The Constitution Of The First Person, Jay L. Garfield Jan 2019

Second Persons And The Constitution Of The First Person, Jay L. Garfield

Philosophy: Faculty Publications

Philosophers and Cognitive Scientists have become accustomed to distinguishing the first person perspective from the third person perspective on reality or experience. This is sometimes meant to mark the distinction between the “objective” or “intersubjective” attitude towards things and the “subjective” or “personal” attitude. Sometimes, it is meant to mark the distinction between knowledge and mere opinion. Sometimes it is meant to mark the distinction between an essentially private and privileged access to an inner world and a merely inferential or speculative access to that world. No doubt there are other uses as well. But I don't care about this …

Artificial Intelligence And Role-Reversible Judgment, Kiel Brennan-Marquez, Stephen E. Henderson Jan 2019

Artificial Intelligence And Role-Reversible Judgment, Kiel Brennan-Marquez, Stephen E. Henderson

Faculty Articles

As intelligent machines begin more generally outperforming human experts, why should humans remain ‘in the loop’ of decision-making? One common answer focuses on outcomes: relying on intuition and experience, humans are capable of identifying interpretive errors—sometimes disastrous errors—that elude machines. Though plausible today, this argument will wear thin as technology evolves. Here, we seek out sturdier ground: a defense of human judgment that focuses on the normative integrity of decision-making. Specifically, we propose an account of democratic equality as ‘role-reversibility.’ In a democracy, those tasked with making decisions should be susceptible, reciprocally, to the impact of decisions; there ought to …

Migration, Regionalism, And National Identity Conflicts In Contemporary Spain (2019), Hillary Sturgeon Jan 2019

Migration, Regionalism, And National Identity Conflicts In Contemporary Spain (2019), Hillary Sturgeon

International Studies Undergraduate Honors Theses

The creation of a centralized national identity becomes a challenge when a nation faces strong, alternative identities that conflict or do not clearly align with the socio-cultural norms of the national one. In the case of Spain, these alternative identities include both regional identitiesand external national identities. This project directly looks at the Catalan independence referendum of 2017, the shifting immigration demographics and patterns in Spain, and Spanish citizens’ willingness to accept alternative identities into the national framework in order to better understand the current challenges to the consolidation of a Spanish national identity. This paper will argue that Spain …

Speech Interfaces And Pilot Performance: A Meta-Analysis, Kenneth A. Ward Jan 2019

Speech Interfaces And Pilot Performance: A Meta-Analysis, Kenneth A. Ward

International Journal of Aviation, Aeronautics, and Aerospace

As the aviation industry modernizes, new technology and interfaces must support growing aircraft complexity without increasing pilot workload. Natural language processing presents just such a simple and intuitive interface, yet the performance implications for use by pilots remain unknown. A meta-analysis was conducted to understand performance effects of using speech and voice interfaces in a series of pilot task analogs. The inclusion criteria selected studies that involved participants performing a demanding primary task, such as driving, while interacting with a vehicle system to enter numbers, dial radios, or enter a navigation destination. Compared to manual system interfaces, voice interfaces reduced …

Global Aviation System: Towards Sustainable Development, Marina P. Bonser Dr.

International Journal of Aviation, Aeronautics, and Aerospace

Aviation around the world has integrated into a global system. As the integration process continues, more aspects and levels of it need to be lead towards the sustainable development of the whole system via advancing strategic management, global communication proficiency, and technological expertise. It becomes essential to enrich global language (English) proficiency with cross-cultural communication competence not only for communication in the air but also for airport security, passenger and cargo services, aircraft and equipage engineering, building, and maintenance. Nowadays lower levels of management need more advanced strategic thinking and problem solving skills, and higher levels of management need global …

“I Wasn’T Expecting It”: High School Experiences And Navigating Belonging In The Transition To College, Carly Offidani-Bertrand, Gabriel M. Velez, Claudia Benz, Micere Keels

College of Education Faculty Research and Publications

For emerging adults transitioning to college, normative social and contextual shifts present challenges that are largely a productive aspect of development. But not all students have the same experiences, nor do all students manage similar experiences in similar ways. Black and Latinx emerging adults transitioning to Historically White Institutions must adjust not only to college life but also to feeling different and, sometimes, isolated. There is a dearth of qualitative work examining how students of color make meaning of their racial-ethnic experiences on campus. Our article draws on a mixed-methods study of Black and Latinx emerging adults’ transition to college …

White Pre-Service Teachers’ Perceptions And Their Development Of Culturally Relevant Literacy Practices, Lakia M. Scott, Elena M. Venegas Jan 2019

White Pre-Service Teachers’ Perceptions And Their Development Of Culturally Relevant Literacy Practices, Lakia M. Scott, Elena M. Venegas

Bilingual and Literacy Studies Faculty Publications

Existent literature purports that providing White teacher candidates with increased exposure to urban schools in order to create culturally competent educators has failed. These findings reflect the notion that teacher ideologies and overall perspectives about working with diverse student groups must be harnessed in a genuine ethic of care and intentionality for students of color. However, few studies have taken the approach of examining the development of culturally relevant pedagogy through context-specific field experiences using content-specific courses. This study examines the perspectives of twenty-five White pre-service teachers from a predominately White, private university regarding their initial perceptions and gained conceptual …

Magnifying English Language Learners' Success Through Culturally Relevant Teaching And Learning Frameworks: Acknowledging The Multidimensional Implications On Language, Literacy, And Learning, Isela Almaguer

Bilingual and Literacy Studies Faculty Publications

There is a need to amplify the voices of English language learners through authentic language and literacy learning using a multifaceted culturally relevant and responsive teaching and learning framework that encompasses social justice. Specifically, framing the chapter through the lens of the sociocultural theory to better recognize, acknowledge, and understand the influence of culturally relevant learning. Culture plays a crucial role in forming identity and agency, so we must rethink the effect of culturally relevant pedagogy by linking principles of learning to the cultural realities of children, families, and communities on literacy. English language learners require more empowering and engaging …

A Theory Of Democratic Christian Appeals, Andrew Macphail Jan 2019

A Theory Of Democratic Christian Appeals, Andrew Macphail

Honors Papers

The conventional wisdom in American politics associates Christian appeals with the Republican Party. However, the fact is, many prominent Democratic politicians identify as Christian along with many Democratic voters. This paper draws upon extant research in political psychology to propose a theory of how Christian appeals from Democratic politicians might positively influence liberal voters’ political decision-making. The first section provides a brief overview of Christian social activism in the United States in order to establish the compatibility between progressivism and Christianity throughout American history. The second section outlines the theory that proposes how Democratic politicians could use Christian appeals to …

Destierro And Desengaño: The Disabled Body In Golden Age Spanish Portraiture, Colin C. Sanborn Jan 2019

Destierro And Desengaño: The Disabled Body In Golden Age Spanish Portraiture, Colin C. Sanborn

Honors Papers

This paper analyzes the role of the disabled body in Golden Age Spanish court portraiture, focusing in particular on Diego Velázquez's work for Philip IV. Although this body of work has been examined extensively, few scholars have investigated what it implies about 17th-century Spaniards' conception of human divergence, and fewer still have done so without falling back on outdated models of disability. I thus hope to demonstrate through this thesis both disability's continued cultural importance and the utility of an analysis grounded in contemporary disability theory. Expanding upon Tobin Siebers' concept of "disability aesthetics" and Rosemarie Garland-Thomson's theory of "misfitting," …

Initial Coin Offerings: The Role Of Subjective Information In Whitepapers, Jiahang Zhang Jan 2019

Initial Coin Offerings: The Role Of Subjective Information In Whitepapers, Jiahang Zhang

Honors Papers

Initial coin offerings (ICOs) are an unregulated form of financing that raises funds by issuing crypto tokens using blockchain technology. In this paper, I explore the relationship between the level of mispricing at ICOs and the subjectivity in whitepapers, which are documents released before ICOs that provide details on the features of the tokens. The subjective information is examined by indices of confidence, tone, and readability. The model in this paper analyzes a sample of 258 ICOs that ended during January to October 2018. I find that the confidence score of a whitepaper is negatively associated with the daily excess …

Human Embodiment And Christian Worship: God's Revelation Through The Human Body In Scripture, Theology, And Liturgy, Carter J. C. Stepper Jan 2019

Human Embodiment And Christian Worship: God's Revelation Through The Human Body In Scripture, Theology, And Liturgy, Carter J. C. Stepper

Theology Projects & Theses

This research will demonstrate that bodily existence is essential to human nature and that Christian worship practices must go hand-in-hand with a sound understanding of human embodiment in order to be faithful to the essence of Christianity. The following thesis demonstrates that the biblical understanding is that humanity was created as a body enlivened by the breath of God and intended to be the sacred sanctuary where God’s presence will dwell. In the incarnation of Jesus Christ, God’s goal to make humanity the sanctuary for his presence is fulfilled. Jesus Christ is the image of God, who redeems and represents …

Exhibit Panels

When people talk about the future of Appalachia, they typically mean economic futures: What will happen to coal jobs? How will Appalachia diversify its economy? What about poverty? Stereotypes about our region represent our people as disinterested in education, and hostile to innovation, technology, and sustainability. We see a different story. This part of the exhibit looks at ways that Appalachians are taking their strong sense of culture, their linguistic distinctiveness, and their relationship to the natural world to imagine new futures in diverse industries, sustainable practices, and stronger education systems.
