The C.J.E.U. Case Law Relevant To The General Anti-Avoidance Rule (G.A.A.R.) Under The Anti-Tax Avoidance Directive (A.T.A.D.), Blazej Kuzniacki
Research Collection School Of Accountancy
This study concentrates on the Court of Justice of the European Union (C.J.E.U.) case law in order to reconstruct from it an interpretative guidance for the proper understanding and thus the application of the general anti-abuse rule included in Article 6 A.T.A.D. (the A.T.A.D.’s G.A.A.R.). Although Article 6 aims to harmonise general anti-abuse rules in the domain of tax law among all M.S.s, its wide scope and its phraseology raises a plethora of issues, in particular in respect of its proper– E.U. compatible– understating and thus application. The analysis of the relevant C.J.E.U. case law, as undertaken in this paper, …
A Semiotic Reading Of The East Asian-Canadian Restaging Of The Immigrant Experience And Redress In Marty Chan’S The Forbidden Phoenix And David Yees’S Lady In The Red Dress, Rania M Rafik Khalil
A Semiotic Reading Of The East Asian-Canadian Restaging Of The Immigrant Experience And Redress In Marty Chan’S The Forbidden Phoenix And David Yees’S Lady In The Red Dress, Rania M Rafik Khalil
English Language and Literature
The astounding increase in immigration and the rise in intercultural relationships within Canadian society resulted in the last decade in the acceptability of a number of dramatic works by ethnic, immigrant and second generation Canadian playwrights. This paper examines through Ferdinand de Saussure and Charles Sanders Peirce’s theory of semiotics the East-Asian Canadian immigrant experience and the journey of redress in two dramatic works: Marty Chan’s The Forbidden Phoenix (2010) and David Yee’s lady in the red dress (2010). The Forbidden Phoenix and lady in the red dress, address issues related to exclusionary policies against early Chinese immigrants to Canada …
The Psychology Surrounding Legal Standards Of Competency And Representation For Children In U.S. Immigration Court, Natasha Reyes
The Psychology Surrounding Legal Standards Of Competency And Representation For Children In U.S. Immigration Court, Natasha Reyes
CMC Senior Theses
In recent years, immigration detentions have spiked. Further, the Zero Tolerance Policy enacted by President Trump has separated thousands of children from their families. Because many children are without their parents, and immigration court is civil in nature, thousands of children are placed in deportation hearings without representation each year. Child psychological research is at odds with the current deportation practices as psychological research deems children unable to understand the complexities of the court system or the impacts of deportation proceedings. A minimum competency to stand trial must be enacted to protect young children’s due process rights, regardless of citizenship. …
The Ghost Of Modernity: Normative Power Of Modernity As Propaganda, Seoyoon Choi
The Ghost Of Modernity: Normative Power Of Modernity As Propaganda, Seoyoon Choi
CMC Senior Theses
This thesis explores how domestic factions and authoritarian regimes in Japan and Korea in the period from the 1850s to 1970s appropriated the concept of “modernity” to gain normative superiority over their competitors. The appropriating entity revised the concept of modernity to suit its own worldview. Across the case studies, the propaganda of modernity created a hierarchy that privileged those who are “more modern,” encouraged martial masculinity, and attached itself to existing domestic norms, such as ethno- nationalism. Under authoritarian regimes, modernity helped justify the mobilization of capital, manpower, and other critical resources in the name of nation-building or defense. …

Automated Essay Evaluation Using Natural Language Processing And Machine Learning, Harshanthi Ghanta
Theses and Dissertations
The goal of automated essay evaluation is to assign grades to essays and provide feedback using computers. Automated evaluation is increasingly being used in classrooms and online exams. The aim of this project is to develop machine learning models for performing automated essay scoring and evaluate their performance. In this research, a publicly available essay data set was used to train and test the efficacy of the adopted techniques. Natural language processing techniques were used to extract features from essays in the dataset. Three different existing machine learning algorithms were used on the chosen dataset. The data was divided into …
Curtus: An Nlp Tool To Map Job Skills To Academic Courses, Daniel Rockwell
Curtus: An Nlp Tool To Map Job Skills To Academic Courses, Daniel Rockwell
Theses and Dissertations
Many businesses are burdened with the need to train students for the job instead of finding them prepared for it. Few business leaders feel that colleges prepare students for future jobs from day one. It can be a challenge for colleges to determine if their curricula meet the industry needs. Mapping industry needs to academic courses can be advantageous to both parties as it will allow colleges to be aligned with the industry needs and accordingly satisfy those needs and will allow the industry to hire better prepared graduates. In an attempt to address this, a system prototype that uses …
Spinning Charlotte's Web: Resident Perceptions And Neutralizations Of A Slaughterhouse Town, Ashley L. Flaherty
Spinning Charlotte's Web: Resident Perceptions And Neutralizations Of A Slaughterhouse Town, Ashley L. Flaherty
All Graduate Theses, Dissertations, and Other Capstone Projects
Meat production, consumption, and slaughterhouses significantly affect the environment, public health, and non-human animals. Those who live in communities that house slaughterhouses must negotiate what it means to live and work in this community, and be financially supported by the industry. Understanding how people negotiate the roles that the industry plays in their community through semi-structured interviews was the primary purpose of this study. To reconcile the issues the town faces, the respondents in this study used excuses and justifications, specifically techniques of neutralization, to account for both the company's actions and the social issues the city itself faces.
Deafness And Trauma: A Preliminary Investigation Of Trauma Within Deaf Domestic Violence Survivors, Kabrianna A. Tamura
Deafness And Trauma: A Preliminary Investigation Of Trauma Within Deaf Domestic Violence Survivors, Kabrianna A. Tamura
Master of Arts in Criminal Justice Theses
Deaf individuals in the United States face an increased risk of criminal victimization than their hearing counterparts. In particular, Deaf and Hard-of-Hearing are at a significantly higher risk of becoming victims of domestic violence. Unfortunately, the few scholarly studies that exist reveal that survivors within the Deaf population experience significant barriers when attempting to seek mental health treatment. Likewise, there is a significant lack of literature on extant psychometric tools available to measure trauma and PTSD within the Deaf community. This study analyzes the psychometric properties of the PTSD Checklist-5 (PCL-5) and the Impact of Event Scale-Revised (IES-R) in a …

Self-Reflection: A Reclamation Of Identity, Elly Bovarnick
Theses & ETDs
My identity is constantly being questioned and challenged. In response to being othered and exoticized because of being a Jewish woman, I am reclaiming my identity through art. I create sculptures and installations that express the relationship I have with my identity, the relationship I share with my community - other Jewish people and more specifically Jewish women, and the relationship I have with the public- people outside of my community. My work is centered around cultural identity and influenced by how other contemporary artists have created art about their own or others’ identity. Inspired primarily by the authors Mieke …
Segmentation And Intonation In Childhood Apraxia Of Speech, Rachel Platt
Segmentation And Intonation In Childhood Apraxia Of Speech, Rachel Platt
Master's Theses and Capstones
Childhood apraxia of speech (CAS) is a motor speech disorder that affects the programming of spatial and temporal parameters for speech patterns, characterized by sound distortions, segmented units, and deficits with lexical stress. CAS has notable increases in the length of time between speech segments and within syllables than do children with phonological impairments or who are developing typically. This segmentation may impact prosody at the lexical level. Prosody also includes declination of the fundamental frequency (F0) and reset at the intonational level, impacting the intelligibility of speech production.
This study assessed segmentation and intonational effects on prosody across an …

Jean Raspail, Michel Houellebecq, And Jenny Erpenbeck: Acknowledging The Barbarian Within, John C. Hawley
English
This paper seeks to discuss recent sites of contestation of the implications one assigns to migration from Africa and the Middle East to Central and Western Europe. It will be predominantly Eurocentric in its data and analysis, dealing less with the motivations of the migrants and the second generation, and more with the various responses to that migration among Europeans (e.g., what are “they” doing to “us”). The major literary texts involved in the paper will be Michel Houellebecq’s Submission (2015), and Jenny Erpenbeck’s Go, Went, Gone (2015), with initial consideration of Jean Raspail’s The Camp of the Saints (1973). …
Rewriting The Human-Animal Divide: Humanism And Octavia Butler's "Amborg", Aparajita Nanda
Rewriting The Human-Animal Divide: Humanism And Octavia Butler's "Amborg", Aparajita Nanda
English
The relationship of philosophy and the human-animal divide is a long one. One could begin with the anthropocentric assumptions of liberal humanism that go back to the Great Chain of Being, a concept of the nature of the universe that traces its lineage to antiquity. The term designates three defining features of the universe: maximal diversity of life, a serial communication within each group, and a hierarchical division of all living beings from God to the simplest forms of existence (Encyclopedia Britannica 2015). This essay challenges the liberal humanist emphasis on humans as being the central focus of the universe …

Bodies And Heroes (Chapter In Heroic Bodies In Ancient Israel), Brian R. Doak
Faculty Publications - George Fox School of Theology
Excerpt: "In this book I make three overarching arguments about what I am calling the “heroic body” in ancient Israel, particularly as it is represented in the Hebrew Bible but also including relevant iconography and with comparative gestures toward the Bible’s larger Mesopotamian context to the east and also the Greek Mediterranean context to the west."

Section of Urology
Introduction: Clinical reasoning skill is the core of medical competence. Commonly used assessment methods for medical competence have limited ability to evaluate critical thinking and reasoning skills. Script Concordance Test (SCT) and Extended Matching Questions(EMQs) are the evolving tests which are considered to be valid and reliable tools for assessing clinical reasoning and judgment. We performed this pilot study to determine whether SCT and EMQs can differentiate clinical reasoning ability among urology residents, interns and medical students.
Methods: This was a cross-sectional study in which an examination with 48 SCT-based items on eleven clinical scenarios and four themed EMQs with …

Can Asl-Gloss Be Used As An Instructional Tool To Teach Written English To The Deaf?, Emma S. Rathkey
Open Access Dissertations
This study addressed the use of ASL-gloss as a potential method for improving reading ability and comprehension for those with profound deafness through the use of the Gray Silent Reading Test (GRST). ASL-gloss can be described as a written form of American Sign Language. Research suggests that on average, individuals who are deaf are reading at about a third- to fifth-grade level. Presently, there is limited research on the effects of using ASL-gloss with students who are deaf. Participants (n = 31) self-reported as having a profound hearing loss, used ASL as their primary or preferred language, and were over …
Linking Communicative Interaction To Cognitive Functioning: Implications For Older Adults, Denise Calhoun
Linking Communicative Interaction To Cognitive Functioning: Implications For Older Adults, Denise Calhoun
Theses and Dissertations
As the percentage of older adults within the U.S. steadily increases, long-term care options are being impacted with growing numbers of seniors to provide for. The reality of these elevated numbers have sparked an interest in researchers to conduct studies on human development, plasticity in the brain, and training and intervention programs in search for ways to halt or lessen the cognitive and communicative decline, in older adults. As an alternative path to help older adults maintain quality of life, this study proposes to examine the link between communicative interaction and cognitive functioning to educate family members and healthcare providers …

Sifting Through The Arbitrators For The Woman, The Minority, The Newcomer, Douglas Pilawa
Sifting Through The Arbitrators For The Woman, The Minority, The Newcomer, Douglas Pilawa
Case Western Reserve Journal of International Law
This Note examines the process of choosing an arbitrator in international arbitration. Much of the debate and criticism of this process addresses the lack of diversity in arbitral tribunals around the world. Diversity in this context means not only traditional diversity (i.e. gender, race, ethnicity), but also the basic idea of adding "fresh faces " to arbitral tribunals. Yet the ethical obligation to provide a client with the best chance to prevail encourages counsel to choose a familiar, wellknown name with an established "track record" over a littleknown "dark horse. " This tension illustrates a fundamental point of friction in …

A Critical Review Of Current Approaches And Practices In Computing Ethics Education, Sophia Farquhar
A Critical Review Of Current Approaches And Practices In Computing Ethics Education, Sophia Farquhar
Dissertations, Master's Theses and Master's Reports
Recent scandals caused by the results of negligent, malicious, or shortsighted software development practices highlight the need for software developers to consider the ethical implications of their work. Computing ethics has historically been a marginalized area within computing disciplines, so educators in these disciplines do not have a common background for teaching the topic. Computing ethics education, although often a required part of coursework, can vary widely in the method of implementation from university to university.
In this report I summarize the insights I gained from interviewing four educators from three different institutions on their pedagogical approaches to computing ethics. …
Perceptions Of Forest Change In The Governmental Region Of Kaffrine, Senegal, Rhiley E. Allbee
Perceptions Of Forest Change In The Governmental Region Of Kaffrine, Senegal, Rhiley E. Allbee
Dissertations, Master's Theses and Master's Reports
Sénégal is a semi-arid West African country with a diverse ethnic makeup and a rapidly growing population that is largely rural, predominantly employed within the agricultural sector, and heavily reliant on the harvesting of forest products within state owned forests where populations have usufruct rights. The country experienced significant changes in land cover throughout the 20th century due to a series of major droughts and large expansions in agriculture. These changes were partially concentrated throughout the region of Kaffrine, where the wooded savannas of the early 20th century were systematically replaced by agriculture and converted to a shrub …
“Because We Have Chosen A Life Of Peace”: A Quantitative And Qualitative Study Of Vegan Food Narratives, Silke H. Feltz
“Because We Have Chosen A Life Of Peace”: A Quantitative And Qualitative Study Of Vegan Food Narratives, Silke H. Feltz
Dissertations, Master's Theses and Master's Reports
Restaurants, grocery stores, fast food chains, and companies all over the United States introduce the consumer to more vegan products, dishes, and services than ever before. The rise of veganism therefore offers a rhetorical platform that should be studied. This dissertation discusses the rhetoric of veganism by analyzing food narratives of vegans through a critical intersectional lens and consists of three research stages. The first research stage investigates the narratology of Glenn Scott Lacey’s documentary, Vegan: Everyday Stories(2016). In particular, this rhetorical analysis focuses on the evaluative belief system of vegan storytelling by applying narrative and ideological criticism. The …

The result of the series of dancer sonification design exercises led to the development of a novel musical sonification …
Fighting The "Three Evils": A Structural Analysis Of Counter-Terrorism Legal Architecture In China, Enshen Li
Fighting The "Three Evils": A Structural Analysis Of Counter-Terrorism Legal Architecture In China, Enshen Li
Emory International Law Review
In the aftermath of September 11 attacks, China has not been immune to the global trend of destructive terrorism. However, China's perceptions of terrorism and legal responses to it greatly diverge from those of other countries. This Article first seeks to understand the cause, source, and impact of terrorist threats in China, known as 'Three Evils''terrorism, extremism, and separatism, through a critical inquiry of the country's ethnic and religious policies. It then proceeds to delineate China's legal framework for combating the 'Three Evils' to explore the cultural characteristics of the government's approach against these rising threats. Tracing the evolution of …
Improving Word Embeddings Projection For Turkish Hypernym Extraction, Savaş Yildirim
Improving Word Embeddings Projection For Turkish Hypernym Extraction, Savaş Yildirim
Turkish Journal of Electrical Engineering and Computer Sciences
Corpus-driven approaches can automatically explore is-a relations between the word pairs from corpus. This problem is also called hypernym extraction. Formerly, lexico-syntactic patterns have been used to solve hypernym relations. The language-specific syntactic rules have been manually crafted to build the patterns. On the other hand, recent studies have applied distributional approaches to word semantics. They extracted the semantic relations relying on the idea that similar words share similar contexts. Former distributional approaches have applied one-hot bag-of-word (BOW) encoding. The dimensionality problem of BOW has been solved by various neural network approaches, which represent words in very short and dense …
