The Federal Bank Robbery Act: Why The Current Split Involving The Use Of Force Requirement For Attempted Bank Robbery Is Really An Exception, Paul Piaskoski
The Federal Bank Robbery Act: Why The Current Split Involving The Use Of Force Requirement For Attempted Bank Robbery Is Really An Exception, Paul Piaskoski
Journal of Criminal Law and Criminology
The Federal Bank Robbery Act had been on the books for seventy years by the time the federal appellate courts began to openly quarrel about the necessary elements of attempted bank robbery under the first paragraph of the Act, 18 U.S.C. § 2113(a). Specifically, the circuits disagree as to whether proof of actual force is required to sustain a conviction of attempted bank robbery, or if attempted force is sufficient for a conviction. Legal scholars have repeatedly framed this split in authority as a consequence of competing methods of statutory interpretation. In this Comment, however, I argue that it is …

Connecticut Thrives: Reimagining Community Health Workers - A Gap Analysis For Pediatric Behavioral Health In Connecticut And Proposed Workforce Recommendations, Mary Katherine Preuschoff Montgomery
Public Health Theses
Children and families across the United States are facing incredible obstacles as they navigate siloed systems, like healthcare and education, to achieve overall health. This program projection analyzes current local and national trends in pediatric mental and behavioral health services in order to make a recommendation for the state of Connecticut to achieve more supportive and holistic care for children, with behavioral health needs, and their families. The program projected here is: Connecticut Thrives. This program is intended to work with existing state structures to utilize Community Health Workers for the intended purpose of ensuring seamless healthcare. Taking a social …

John Paul Ii's Theology Of The Body: The Human Person, Self-Gift, And The Sacramental Dimension Of Human Love, Mitchell Johansson
University Libraries Award for Undergraduate Research
This thesis is a philosophical defense of certain proposals John Paul II outlined and argued for in his work A Theology of the Body. The format of this thesis will be the following, arranged into four parts. In part one, I will give a very brief historical introduction to John Paul II and his work. Then I will sketch the philosophical matrix which the Theology of the Body enters, and introduce the synthetic methodology that John Paul II employs. The second part will elaborate and explain John Paul II’s metaphysics and phenomenology of the human person, the theological dimension of …

Turkish Journal of Medical Sciences
Background/aim: The multidimensional evaluation of patients with chronic neck pain is important for planning the treatment program. The aim of this study was to investigate the validity and reliability of the Turkish version of the Neck Bournemouth Questionnaire (NBQ).Materials and methods: The internal construct validity of the NBQ was examined by the fit of the data to the Rasch measurement model. External validity of the NBQ was evaluated by testing for expected associations of Rasch transformed NBQ score with the corresponding variables through the process of convergent validity. The reliability of the NBQ in terms of both internal consistency and …
“Visiting Iniquity Of Fathers Against Sons” In Exodus, Thomas Egger
“Visiting Iniquity Of Fathers Against Sons” In Exodus, Thomas Egger
Doctor of Philosophy Dissertation
Egger, Thomas J. “‘Visiting Iniquity of Fathers against Sons’ in Exodus.” Ph.D. diss., Concordia Seminary, 2018. 665 pp.
In two of the most important passages in Exodus (20:5 and 34:7), Yahweh describes himself as “visiting iniquity of fathers against sons, even against members of the third and fourth generations.” Missing in nearly every treatment of this phrase has been any sustained consideration of the phrase within the context of the Exodus narrative itself. Apart from such interpretive grounding, “visiting iniquity of fathers against sons” has shown itself susceptible to widely varied and contradictory readings and, especially, maximally problematizing readings which …

A Cup Of Colonialism: A Qualitative Analysis Of Starbucks And Fair Trade Coffee, Katie Grandelli
A Cup Of Colonialism: A Qualitative Analysis Of Starbucks And Fair Trade Coffee, Katie Grandelli
Undergraduate Research Awards
Coffee has long fueled the minds of many people in the world, but only recently have discussions on its production and sourcing methods started to come to light with the advent of the fair trade movement. Within the modern fair trade coffee movements, great weight is placed on the analysis of the lingering effects of colonialism in the coffee industry. In this paper, I argue that the effects of colonialism are perpetuated by Starbucks because of their lack of educational efforts towards consumers on the motivations and goals of fair trade coffee movements.
Taking Laughter Seriously At The Supreme Court, Matthew Sag
Taking Laughter Seriously At The Supreme Court, Matthew Sag
Faculty Publications & Other Works
Laughter in Supreme Court oral arguments has been misunderstood, treated as either a lighthearted distraction from the Court's serious work, or interpreted as an equalizing force in an otherwise hierarchical environment. Examining the more than nine thousand instances of laughter witnessed at the Court since 1955, this Article shows that the Justices of the Supreme Court use courtroom humor as a tool of advocacy and a signal of their power and status. As the Justices have taken on a greater advocacy role in the modern era, they have also provoked more laughter. The performative nature of courtroom humor is apparent …

Engaging Persons With Mental Illness And/Or Substance Use Disorder In Care Coordination Services: An Improvement Project At A Federally Qualified Community Health Center, Elizabeth A. Hale
DNP Scholarly Projects
Background: Mental health and substance use disorders seldom occur in isolation. They frequently accompany each other, as well as a substantial number of chronic general medical illnesses. Consequently, mental health conditions, substance-use disorders, and general health conditions are frequently co-occurring, and coordination of all of these types of health care is essential to improved health outcomes (Institute of Medicine, 2006). The U.S. system of healthcare is failing to identify, engage, and effectively treat people who are suffering from behavioral health conditions (Blanco, Coye, Knickman, Krishnan, Krystal, Pincus, Rauch, Simon, Vitiello, 2016). Because of poor coordination and lack of engagement, …

JUSTICE Oliver Wendell Holmes Jr.'s “marketplace of ideas” analogy continues to deeply influence First Amendment doctrine. It provides a rational substratum upon which the political or self-realization characterizations of free speech are built. However, typically overlooked is the Social Darwinistic root of the Justice's thought. He championed the spread of ideas and the political sway of majority opinions. That analytical insight is key to many of the Supreme Court's free speech precedents. On the one hand, the concept is invaluable for defending free discussions about philosophy, political science, the arts, humanities, pedagogy, and social sciences. In these areas, the …

Curriculum and Instruction Faculty Publications and Presentations
The role of language in mathematics teaching and learning is increasingly highlighted by standards and reform movements in the US. However, little is known about teachers’, and especially early career teachers’ (ECTs) practices and understandings related to language in mathematics instruction. This multiple case study explored the language-related understandings and practices of six ECTs in diverse elementary classrooms. Using iterative cycles of analysis, we found that all ECTs regularly attended to students’ mathematical vocabulary use and development. Yet, there was variability in ECTs’ focus on how to teach mathematical vocabulary, expectations for students’ precise use of mathematical terminology, and the …

Teacher Perspectives Of The Implementation Of The Journeys Early Literacy Program, Milton Bernard Reese
Teacher Perspectives Of The Implementation Of The Journeys Early Literacy Program, Milton Bernard Reese
Walden Dissertations and Doctoral Studies
A small rural school district in the southwestern part of the United States required teachers to provide highly effective literacy instruction by implementing an evidence-based reading program called Journeys. With consistently low reading achievement, it was unclear whether teachers were implementing Journeys as prescribed. The purpose of this qualitative case study was to explore teacher implementation of the Journeys program for students at an elementary school in the district. The theoretical framework used to guide the study was Clay’s emergent literacy theory. The conceptual framework included 5 strands of the Journeys reading curriculum, which was derived from Clay’s theory. A …

This study examined the mental health burden of LGBTQ asylum seekers and associated psychosocial risk factors with a focus on barriers to social integration. This study also characterized LGBTQ asylum seekers’ interest in interventions aimed at alleviating mental distress and social isolation. Respondents (n = 308) completed an online survey which included the Refugee Health Screener (RHS-15), the NIH loneliness scale, and an adapted scale of sexual identity disclosure. Most respondents (80.20%) screened positive for mental distress. Loneliness (OR = 1.14, 95% CI = 1.09, 1.19) and LGBTQ identity disclosure (OR = 3.46, 95% CI = 1.01, 12.02) were associated …
Unsettling Refuge: Syrian Refugees’ Account Of Life In Denmark, Malene H. Jacobsen
Unsettling Refuge: Syrian Refugees’ Account Of Life In Denmark, Malene H. Jacobsen
Theses and Dissertations--Geography
This doctoral dissertation examines the lived experiences of refuge in Denmark from the perspectives of Syrian refugees. Situated within feminist political geography, it moves beyond examining geopolitics merely from the perspective of the law, the state, and policy makers. Instead, it seeks to grasp the ways in which geopolitics are encountered, experienced, and negotiated on the ground – by the people who are most affected by state policies and practices. It draws on more than ten months of ethnographic fieldwork in Denmark with Syrian refugees, including semi-structured interviews, focus groups, and participant observations, as well as interviews with state and …
But What Has Helga Crane To Do With The West Indies? Plantation Afterlives In The Black Atlantic, Rachel Mckenzie Carr
But What Has Helga Crane To Do With The West Indies? Plantation Afterlives In The Black Atlantic, Rachel Mckenzie Carr
Theses and Dissertations--English
“But What Has Helga Crane to Do with the West Indies? Plantation Afterlives in the Black Atlantic” situates the emergence of the southern gothic in modernist American and Caribbean works as a response to the shifting cultural narrative of the plantation in the twentieth century. In this project, I argue that the plantation seeps out of its place and time to haunt landscapes it may never have touched and times in which slavery is long over. While the plantation system is broadly recognized as a literary, political, and cultural force in nineteenth-century literary studies, I conceive it is also a …
Limón Patwa: A Perceptual Study To Measure Language Attitudes Toward Speakers Of Patwa In Costa Rica, Robert Bell
Limón Patwa: A Perceptual Study To Measure Language Attitudes Toward Speakers Of Patwa In Costa Rica, Robert Bell
Theses and Dissertations--Linguistics
The primary purpose for this research is to examine and identify the social functions of Limón Patwa, a closely related language to Jamaican Patwa spoken by the Afro-Caribbean community of Costa Rica. There is a unique relationship regarding the language contact between Spanish and LP, where the maintenance of this English based language can certainly be complicated by a Spanish language dominant environment. Studying the historical migration of this Afro-Caribbean population to Costa Rica in the 1800s sheds light on the systemic oppression and the lack of integration into Costa Rican society that Afro-Costa Ricans faced in the midst of …
Shifting Personas: A Case Study Of Taylor Swift, Lela R. Lyon
Shifting Personas: A Case Study Of Taylor Swift, Lela R. Lyon
Theses and Dissertations--Linguistics
This thesis analyzes how Taylor Swift has changed the way she expresses her Southern identity, specifically her dialectal features, over the course of her career and through her switch from country music to pop music. There were two processes to assess the change in Swift’s speech: the production of /ai/ tokens in interviewed speech and the perception of dialectal change by fans in the comment sections of the interviews on YouTube. Seven interviews on YouTube and their comment sections were used as the data source for this study. Production of /ai/ was measured through an auditory analysis to determine whether …
Undergraduate Mathematics Students’ Connections Between Their Group Homomorphism And Linear Transformation Concept Images, Jeffrey Slye
Undergraduate Mathematics Students’ Connections Between Their Group Homomorphism And Linear Transformation Concept Images, Jeffrey Slye
Theses and Dissertations--Mathematics
It is well documented that undergraduate students struggle with the more formal and abstract concepts of vector space theory in a first course on linear algebra. Some of these students continue on to classes in abstract algebra, where they learn about algebraic structures such as groups. It is clear to the seasoned mathematician that vector spaces are in fact groups, and so linear transformations are group homomorphisms with extra restrictions. This study explores the question of whether or not students see this connection as well. In addition, I probe the ways in which students’ stated understandings are the same or …
In Black And White: Richmond’S Monument Avenue Recontextualized Through The Photographic Archive, Charlsa Anne Hensley
In Black And White: Richmond’S Monument Avenue Recontextualized Through The Photographic Archive, Charlsa Anne Hensley
Theses and Dissertations--Art and Visual Studies
The release of the Monument Avenue Commission Report in July, 2018 was the culmination of over one year of research and collaboration with community members of Richmond, Virginia on how the city should approach the contentious history of Monument Avenue’s five Confederate centerpieces. What the monuments have symbolized within the predominately rich, white neighborhood and outside of its confines has been a matter of debate ever since they were unveiled, but the recent publicity accorded to Confederate monuments has led to considerations by historians, city leaders, and the public regarding recontextualization of Confederate monuments.
Recontextualization of the monuments should not …

Modulation Of Inflammatory Cytokine, Chemokine, And Toll-Like Receptor Genes And Transcriptome Analysis Of Equine Endothelial Cells Following Infection With Equid Herpesvirus-1, And Equine Arteritis Virus., Saranajith Wangisa Dunuwille
Theses and Dissertations--Veterinary Science
EHV-1 is a double-stranded DNA virus whereas EAV is a positive sense, single-stranded RNA virus. Therefore, genetically, they are very different from one another. However, both these viruses are endotheliotropic and thus, infect and replicates in equine endothelial cells resulting in vasculitis. Vasculitis is central to the pathogenesis of these two viruses. Thus, the main objective of this thesis was to investigate the inflammatory and innate immune responses of EECs that contribute towards the development of vasculitis following infection with EHV-1 and EAV in-vitro. Since proinflammatory cytokines and chemokines produced by endothelial cells play a significant role in the …

Developmental Sequelae In Language, Empathy, Self-Control, And Psychopathy From Infancy To Middle Adolescence, Magda Javakhishvili
Theses and Dissertations--Family Sciences
The present empirical work aims to discern the underlying mechanisms of purported developmental links among several key human characteristics including language skills, self-control, empathy, and psychopathic traits. Accordingly, three interrelated studies are carried out testing the longitudinal associations of various kinds (e.g., direct, indirect, bidirectional) among these constructs. All three studies are conceptually framed in consideration of the extant research and relevant theories. They employ the data set provided by the National Institute of Child Health and Human Development of Early Child Care and Youth Development Study of N = 1,364 children followed from infancy through middle adolescence.

Contractual Incapacity And The Americans With Disabilities Act, Sean M. Scott
Contractual Incapacity And The Americans With Disabilities Act, Sean M. Scott
Dickinson Law Review (2017-Present)
The doctrine of contractual incapacity allows people with mental disabilities to avoid their contractual liability. Its underlying premise is that the law has an obligation to protect people with such disabilities both from themselves and from unscrupulous people who would take advantage of them; mental incapacity provides this protection by rendering certain contracts unenforceable. The Disability Rights Movement (“DRM”), however, has challenged such protective legal doctrines, as they rest on outmoded concepts about people with mental disabilities.
This essay argues that the mental incapacity doctrine undermines the goals of the DRM and the legislative goals of the Americans with Disabilities …
The Anonymity Heuristic: How Surnames Stop Identifying People When They Become Trademarks, Russell W. Jacobs
The Anonymity Heuristic: How Surnames Stop Identifying People When They Become Trademarks, Russell W. Jacobs
Dickinson Law Review (2017-Present)
This Article explores the following question central to trademark law: if a homograph has both a surname and a trademark interpretation will consumers consider those interpretations as intrinsically overlapping or the surname and trademark as completely separate and unrelated words? While trademark jurisprudence typically has approached this question from a legal perspective or with assumptions about consumer behavior, this Article builds on the Law and Behavioral Science approach to legal scholarship by drawing from the fields of psychology, linguistics, economics, anthropology, sociology, and marketing.
The Article concludes that consumers will regard the two interpretations as separate and unrelated, processing surname …
