Producer Services: A Hub For Stem And An Engine For Job Growth, Eric Thompson, Uyen Tran Mar 2019

Producer Services: A Hub For Stem And An Engine For Job Growth, Eric Thompson, Uyen Tran

Business in Nebraska

The producer services sector, which includes professional and technical services such as accounting, engineering, computer programming, advertising and consulting, is the fastest growing, high-wage segment of the U.S. economy. Producer services employment grew by 15 percent nationwide from 2008 through 2017 but only by 5 percent in Nebraska. Nebraska growth lagged the nation in part because the state has smaller metropolitan areas. Producer service businesses tend to congregate in larger cities. To grasp more opportunities in this growing, high wage sector, Nebraska needs to train more workers in STEM occupations, encourage the development of small businesses in the sector, and …

Process Analysis For Disposal Of Surplus Property, Bryan Gibson, Christopher Van Dyke, Candice Y. Wallace, Jeff Jasper, Steven Douglas Kreis Mar 2019

Process Analysis For Disposal Of Surplus Property, Bryan Gibson, Christopher Van Dyke, Candice Y. Wallace, Jeff Jasper, Steven Douglas Kreis

Kentucky Transportation Center Research Report

The Kentucky Transportation Cabinet (KYTC) frequently acquires property to secure the right of way for transportation projects. Some property may eventually be declared excess and deemed surplus, enabling the Cabinet to dispose of it. Excess property can be declared surplus by an official order of the Secretary or Commissioner of the Department of Highways. Current law and policy require that KYTC undertake a 21-step process to dispose of surplus property, including reviews by the Governor, Finance and Administration Cabinet, and several KYTC personnel. The Cabinet lacks the personnel required to undertake the lengthy disposal process. This report provides background on …

Separating The Privileged Wheat From The Chaff - Using Text Analytics And Machine Learning To Protect Attorney-Client Privilege, Robert Keeling, Nathaniel Hubert-Fliflet, Jianping Zhang, Rishi P. Chhatwal Mar 2019

Separating The Privileged Wheat From The Chaff - Using Text Analytics And Machine Learning To Protect Attorney-Client Privilege, Robert Keeling, Nathaniel Hubert-Fliflet, Jianping Zhang, Rishi P. Chhatwal

Richmond Journal of Law & Technology

The digital age has created unique challenges for parties that engage in large-scale litigation. Safeguarding the attorney-client privilege is a critical task for litigators during discovery—one that becomes more difficult and expensive every year. Document review is now responsible for the vast majority of costs in the average legal matter, and costs are only rising. The volume of digitally-stored data doubles roughly every two years, driving up discovery costs and increasing the risk of inadvertent disclosure of privileged information. As the digital world evolves, the legal community has sought to evolve with it, particularly in the document review process. Keyword …

A Framework For The New Personalization Of Law, Anthony Casey, Anthony Niblett Mar 2019

A Framework For The New Personalization Of Law, Anthony Casey, Anthony Niblett

University of Chicago Law Review

Law has always strived for accurate contextualization, but only with recent technological advances in data processing and communication has this goal become meaningfully achievable at the personal level. While the other essays in this Symposium explore the costs and benefits of personalizing particular areas of law, we present a general framework for thinking about the new personalization of law. We identify two fundamental questions that every personalization project must address: First, how do lawmakers set the objective of a personalized law? Second, how is the content of a personalized law communicated to the citizens who must follow it? We explore …

Rise Of The Robot Lawyers?, Milan Markovic Mar 2019

Rise Of The Robot Lawyers?, Milan Markovic

Faculty Scholarship

The advent of artificial intelligence has provoked considerable speculation about the future of the American workforce, including highly educated professionals such as lawyers and doctors. Although most commentators are alarmed by the prospect of intelligent machines displacing millions of workers, this is not so with respect to the legal sector. Media accounts and some legal scholars envision a future where intelligent machines perform the bulk of legal work, and legal services are less expensive and more accessible. This future is purportedly at hand as lawyers struggle to compete with technologically savvy alternative legal service providers.

This Article challenges the notion …

Mandatory Legal Malpractice Insurance: Exposing Lawyers' Blind Spots, Susan Saab Fortney Mar 2019

Mandatory Legal Malpractice Insurance: Exposing Lawyers' Blind Spots, Susan Saab Fortney

Faculty Scholarship

The legal landscape for lawyers’ professional liability in the United States is changing. In 2018, Idaho implemented a new rule requiring that lawyers carry legal malpractice insurance. The adoption of the Idaho rule was the first move in forty years by a state to require legal malpractice insurance since Oregon mandated lawyer participation in a malpractice insurance regime. Over the last two years, a few states have considered whether their jurisdictions should join Oregon and Idaho in requiring malpractice insurance for lawyers in private practice. To help inform the discussion, the article examines different positions taken in the debate on …

Innovative Financing Solutions For Community Support In The Context Of Land Investments, Sam Szoke-Burke Mar 2019

Innovative Financing Solutions For Community Support In The Context Of Land Investments, Sam Szoke-Burke

Columbia Center on Sustainable Investment Staff Publications

Communities affected by agricultural, forestry, and other resource investments urgently need increased funding for legal and technical support. Without support, communities risk losing access to critical land and resources, suffering human rights violations, or missing opportunities to benefit from investments. A lack of community support can also lead to conflict and challenges that are damaging for companies and host governments.

Donors and support providers have found ways to finance support for communities, but such efforts can only extend so far. Promising new opportunities exist for filling the financing gap, yet they will require sustained efforts by a range of actors. …

Reviewing The Oecd's And The Eu’S Assessment Of Singapore's Development And Expansion Incentive, Frederik Boulogne Mar 2019

Reviewing The Oecd's And The Eu’S Assessment Of Singapore's Development And Expansion Incentive, Frederik Boulogne

Research Collection School Of Accountancy

This paper analyses and describes which norms can be derived from the OECD’s and the EU’s work on preventing harmful taxation that influence how Singapore should design and administer its Development and Expansion Incentive (‘DEI’). This analysis is relief upon in reviewing the Forum on Harmful Tax Practice’s conclusion that the DEI is not harmful and the decision not to place Singapore on the EU’s list of non-cooperative jurisdictions; a decision that suggests that the Council of the European Union considers Singapore to have adequately implemented the minimum anti-BEPS standards, of which BEPS Action 5 is one. These verdicts are, …

New Technology, The Death Of Biglaw Monopoly And The Evolution Of The Computer Professional, Michael Guihot Mar 2019

New Technology, The Death Of Biglaw Monopoly And The Evolution Of The Computer Professional, Michael Guihot

North Carolina Journal of Law & Technology

Much has been written recently about new technology disrupting the traditional law firm model of providing legal services. Susskind and Susskind predicted the failure of professions, including the legal profession, due in large part to the external pressure of disruptive technology. However, concentrating blame on the technology is misguided; it blames the tool used to disrupt rather than the root causes of the disruption. In short, computers do not kill lawyers. Neither is the disruption aimed at the profession as such, but rather at the business models of modern day legal practices that have developed under the auspices of the …

Licensing Knowledge, Claudia E. Haupt Mar 2019

Licensing Knowledge, Claudia E. Haupt

Vanderbilt Law Review

When professionals give advice, they disseminate professional knowledge to their clients. Professional advice is valuable to clients because they gain access to a body of knowledge they do not otherwise possess. To preserve the accuracy, and hence the value, of this knowledge transfer, the First Amendment should protect professional speech against state interference that seeks to alter the content of professional advice in a way that contradicts professional knowledge. But before professionals can give professional advice, they are routinely subject to licensing by the state. This seemingly creates a tension between state involvement in professional licensing and protection against state …

Issue 2: Imagining A Community-Led, Multi-Service Delivery Model For Ontario Child Welfare: A Framework For Collaboration Among African Canadian Community Partners, Jennifer Clarke, Julian Hasford, Leyland Gudge, Sonia Mills-Minster

Journal of Law and Social Policy

This article imagines a new model for child welfare in Ontario, specifically for African Canadian children, youth, and families. Throughout the article, we discuss both what needs to be changed and how those changes can be achieved, including the development and implementation of community-led organizational structures, programs, and services, and the restructuring of government-community relations and funding allocation, to enable African Canadian community-based agencies to deliver preventative, culturally relevant, family-centred supportive services to African Canadians. The article outlines the development of a community-led, multi-service delivery model for Ontario child welfare, and the potential challenges and opportunities for the delivery of …

2019 Nebraska Property Tax School Funding Issues, J. David Aiken Feb 2019

2019 Nebraska Property Tax School Funding Issues, J. David Aiken

Cornhusker Economics

Nebraska agricultural property taxes are among the highest in the United States. Over the last three years, Nebraska farmers and ranchers have paid nearly 31 percent of their net farm income as property taxes (47 percent in 2017). When state and federal taxes are factored in, this represents an effective tax rate of more than 50 percent (over 60 percent in 2017). While no one particularly enjoys paying property taxes (or any other tax), property taxes are especially burdensome for Nebraska farmers and ranchers.

The proposed 2020 constitutional amendment to provide property tax relief would require dramatic state spending cuts, …

Conditional Federal Spending As A Regulatory Device, Albert J. Rosenthal Feb 2019

Conditional Federal Spending As A Regulatory Device, Albert J. Rosenthal

San Diego Law Review

In this Article, Professor Rosenthal notes that the federal spending power is an important tool for shaping our economy, our government, and our society. However, government money is often used to induce or deter conduct by imposing certain restrictions on its receipt. The questions arises of what are the tests for the constitutionality of conditional spending. The author points out that there has not been a single case in which conditional federal spending has been declared invalid by the Supreme Court. He discusses two Supreme Court cases on the topic of government spending. Due to the importance of the topic …

Microgrids: Legal And Regulatory Hurdles For A More Resilient Energy Infrastructure, Raquel Parks Feb 2019

Microgrids: Legal And Regulatory Hurdles For A More Resilient Energy Infrastructure, Raquel Parks

Pace Environmental Law Review

Natural disasters and climate change have made it apparent that energy infrastructure needs to be modernized and microgrids are one type of technology that can help the electricity grid become more resilient, reliable, and efficient. Different states have begun developing microgrid pilot projects including California, New York, Connecticut, and Pennsylvania. The City of Pittsburgh, Pennsylvania is the first city to propose implementing “energy districts” of microgrids that will serve as critical infrastructure, in the first phase, and then expand to commercial and community settings. This large project involves many shareholders including public utilities, government agencies, and private entities. Utilizing microgrids …

“License, Registration, And State Funding, Please”: Overhauling Louisiana’S Traffic-Ticket Funding Scheme Of Public Defenders, Mary Grace Richardson

Louisiana Law Review

The article recommends a funding structure for public defenders in Louisiana that eliminates budget shortfalls by substituting the district-level user-pay system, in which all criminal defendants shoulder the cost of indigent defense through court fees and fines, for a centralized, state-funded general revenue stream.
