The Ethics Of Non-Lawyer Advocacy: Expectations, Rules, And Complications, John F. Wirenius Apr 2019

The Ethics Of Non-Lawyer Advocacy: Expectations, Rules, And Complications, John F. Wirenius

Cardozo International & Comparative Law Review

The article examines the ethical challenges and legal complexities surrounding nonattorney advocacy in labor relations, particularly under the National Labor Relations Act (NLRA) and similar state statutes. It highlights the tension between holding non-lawyer union representatives to attorney ethical standards and the need for simpler, practical norms. The analysis emphasizes the importance of balancing due process for pro se parties with maintaining the integrity of advocacy roles, suggesting that resorting to fundamental statutory values and reciprocal duties can provide a baseline for ethical conduct.

Lawyers In Government Service—A Foreword, Bruce A. Green Apr 2019

Lawyers In Government Service—A Foreword, Bruce A. Green

Fordham Law Review

Lawyers in government serve in many different roles, both representational and nonrepresentational. Some represent the federal, state, or local government, a particular governmental entity (such as a department of consumer affairs) or agency (such as the NLRB), or public officials in their official capacity. These lawyers render a range of legal services and act as litigators, negotiators, drafters, and counselors. Other lawyers in government serve in nonrepresentative capacities; for example, as elected or appointed officials or as their aides. Scholarship on government lawyers addresses these varied roles and functions from varied perspectives, drawing on different bodies of law and legal …

Mr. Try-It Goes To Washington: Law And Policy At The Agricultural Adjustment Administration, Daniel R. Ernst

Fordham Law Review

In December 1933, Jerome Frank, the general counsel of the Agricultural Adjustment Administration (AAA) but better known for writing Law and the Modern Mind (1930), a sensational attack on legal formalism, told an audience at the Association of American Law Schools a parable about two lawyers in the New Deal, each required to interpret the same ambiguous language of a statute. The first lawyer, “Mr. Absolute,” reasoned from the text and canons of statutory interpretation without regard for the desirability of the outcome. “Mr. Try-It,” in contrast, began with the outcome he thought desirable. He then said to himself, “The …

Law And Nonlegal Norms In Government Lawyers' Ethics: Discretion Meets Legitimacy, W. Bradley Wendel Apr 2019

Law And Nonlegal Norms In Government Lawyers' Ethics: Discretion Meets Legitimacy, W. Bradley Wendel

Fordham Law Review

This Essay is about the role of unwritten norms in the ethical decisionmaking of government lawyers. Because the ethical obligations of lawyers, including government lawyers, are closely tied to the legal rights and obligations of clients, this analysis necessarily depends on understanding the relationship between written law and unwritten norms. As we all know, however, written law leaves gaps, ambiguities, and zones of unregulated discretion. Prosecutors in the United States, for example, have virtually unreviewable discretion to decide who to investigate and charge, what charges to bring, and whether to offer immunity in exchange for cooperation. No one has a …

Unfamiliar Justice: Indigent Criminal Defendants' Experiences With Civil Legal Needs, Lauren Sudeall, Ruth Richardson Apr 2019

Unfamiliar Justice: Indigent Criminal Defendants' Experiences With Civil Legal Needs, Lauren Sudeall, Ruth Richardson

Vanderbilt Law School Faculty Publications

Our legal system - and much of the research conducted on that system - often separates people and issues into civil and criminal silos. However, those two worlds intersect and influence one another in important ways. The qualitative empirical study that forms the basis of this Article bridges the civil-criminal divide by exploring the life circumstances and events of public defender clients to determine how they experience and respond to civil legal problems.

To date, studies addressing civil legal needs more generally have not focused on those individuals enmeshed with the criminal justice system, even though that group offers a …

Tracking Client Outcomes: A Qualitative Assessment Of Civil Legal Aid's Use Of Outcomes Data, With Recommendations, David Udell, Amy Widman

Cardozo Journal of Equal Rights & Social Justice

In virtually all sectors of society, people are using data to improve what they do. Everyone, it seems, is interested in data, and is searching for best strategies to draw on its power. The stakes are high in the civil legal aid community, where strengthened advocacy can enable people to preserve their homes, their relationships with their children, their life savings, their physical and emotional well-being, and even their freedom.

Yet, in the civil legal aid community, awareness of the power of data is just beginning to take root. Traditionally, civil legal aid has been thinly funded, with little infrastructure …

Ethical Concerns In Court-Connected Online Dispute Resolution, Dorcas Quek Anderson Apr 2019

Ethical Concerns In Court-Connected Online Dispute Resolution, Dorcas Quek Anderson

Research Collection Yong Pung How School Of Law

This article examines the burgeoning trend of creating court ODR systems, focusing on the design aspects that are likely to raise ethical challenges. It discusses four salient questions to be considered when designing a court ODR system, and the resulting ethical tensions that are brought to the fore. As a fourth party, the ODR system not only replaces existing court functions, but enlarges the scope of the courts’ intervention in disputes and increases the courts’ interface with the user. Furthermore, certain ethical principles such as transparency, accountability, impartiality and fairness take on greater significance in the court context than in …

The Upgraded Lawyer: Modern Technology And Its Impact On The Legal Profession, Thomas R. Moore Mar 2019

The Upgraded Lawyer: Modern Technology And Its Impact On The Legal Profession, Thomas R. Moore

University of the District of Columbia Law Review

At the peak of the Space Race in 1963, President John F. Kennedy remarked that, despite the great leaps brought by technology, "man is still the most extraordinary computer of all." With the advent of the internet and artificial intelligence, today's technological advancements might have shaken even Kennedy's faith in human superiority. For the legal profession, new technology presents a challenge to traditional notions in the practice of law as well. Clients may grow to expect tech-savviness from their attorneys, especially when their cases involve digital concepts. At the same time, the necessity for flesh-and-blood counsel may be diminished by …

The Eviction Geography Of New Orleans: An Empirical Study To Further Housing Justice, Davida Finger Mar 2019

The Eviction Geography Of New Orleans: An Empirical Study To Further Housing Justice, Davida Finger

University of the District of Columbia Law Review

Low-income tenants in the U.S. have weak bargaining power as well as limited housing and mobility options in the housing market. With no enforceable "right to housing," tenants are stuck-quite literally in the case of uninhabitable property - in unsafe and unhealthy living conditions. Poverty and economic instability make it challenging for tenants either to leave or to force repairs to substandard rental units. The author completed an empirical study of eviction cases in New Orleans in order to quantify the problem of evictions, learn more about where evictions occur throughout the municipality, and better understand who is evicted. The …

Sexual Assault And Robbery Disclosure: An Examination Of Black’S Theory Of The Behavior Of Law, Caitlyn N. Muniz Mar 2019

Sexual Assault And Robbery Disclosure: An Examination Of Black’S Theory Of The Behavior Of Law, Caitlyn N. Muniz

USF Tampa Graduate Theses and Dissertations

The majority of research on victim decision making has focused narrowly on reporting to police neglecting other ways in which victims seek help after a victimization experience. Similarly, this research also focuses on only one crime at a time, typically sexual assault, or focuses broadly on categories of violent crime. This dissertation aims to explore variations in victim help-seeking by examining and comparing various combinations of formal disclosure. Moreover, this study compares two distinctly different yet comparable interpersonal violent crimes: sexual assault and robbery. In so doing, this study employs the Theory of the Behavior of Law to examine whether …
