Alternatives To Investor-State Dispute Settlement, Lise Johnson, Jesse Coleman, Brooke Güven, Lisa E. Sachs Apr 2019

Alternatives To Investor-State Dispute Settlement, Lise Johnson, Jesse Coleman, Brooke Güven, Lisa E. Sachs

Columbia Center on Sustainable Investment Staff Publications

Proponents often explain support for international investment agreements (IIAs) for their ability to: (1) promote investment flows; (2) depoliticize disputes between investors and states; (3) promote the rule of law; and (4) provide compensation for certain harms to investors – objectives of varying degrees of importance to multinational enterprises, home states, host states, and other stakeholders.

While each of these objectives may seem desirable, it is important to consider what exactly they mean and whether IIAs are optimally tailored to achieve them.

This two-part series aims to consider just that. In the first blog installment, we asked of investor-state dispute …

Reshaping Minds Using An Occupational Based Approach, Marisha Griffin

MOT Student Capstones

Human trafficking is defined as the recruitment, harboring, transfer, transporting, and receipt of a person using force or manipulation. Sex trafficking refers to engagement in sexual activity against one's will followed by a lifestyle of physical and mental abuse. There are numerous social determinants that impact the health and wellbeing of youth. Due to a lack of community awareness regarding the risk factors associated with human trafficking, vulnerable youth are submissive to occupational injustice activities. The aim of this qualitative study is to educate Present Age Ministries (PAM) on the role and effectiveness of occupational therapy (OT) to gain approval …

Institutional Independence: Lawyers And The Administrative State, Melissa Mortazavi Apr 2019

Institutional Independence: Lawyers And The Administrative State, Melissa Mortazavi

Fordham Law Review

The institutional structure where federal government lawyers practice is fraught with political and economic pressures that undermine the ability of lawyers to exercise independent professional judgment. A lack of candid legal advice in this space not only removes a pivotal fail-safe between legal and illegal state action but also precariously imbalances the powerful administrative state, exposing it to undue political influence. For these reasons, this Article argues that structural changes to administrative institutions must be made to support and nurture lawyers’ ability to independently determine the bounds of legality. Previous scholarship has examined the role of professional independence for lawyers …

Event Materials

Henry Munroe Campbell was a distinguished lawyer who served as legal counsel to the University of Michigan's Board fo Regents for several years.

Following Mr. Campbell's death in 1926, his law partners met with then University of Michigan Law School Dean Henry M. Bates to discuss a fitting memorial. They decided to establish a case club competition to foster training for law students in appellate advocacy in his honor. The first Henry M. Campbell competition was held in the 1927-28 academic year.

A trust fund to finance the competition was established in 1927 and has been periodically augmented with gifts …

Empowering Women Through Land: An Analysis Of The Barriers In Accessing Land Rights Within Kisumu County, Kenya, Madison Shaffer Apr 2019

Empowering Women Through Land: An Analysis Of The Barriers In Accessing Land Rights Within Kisumu County, Kenya, Madison Shaffer

Independent Study Project (ISP) Collection

This project aims to gain a greater understanding of the current state of women’s land rights in Kisumu County, Kenya. It will discuss current barriers women face in accessing land and how land can impact a woman’s empowerment and in turn, her control over her health. Property rights can provide women with a secure place to live, a place of economic activity and reduce dependence on men. Property ownership can also serve to empower women and “give them greater bargaining power at the household, individual, and community level...increasing agency” (Dworkin,2009). Unfortunately, men have almost always been favored in land rights …

The Utah Unlawful Detainer Statute: A Call For Reform, Margaret Kelly Apr 2019

The Utah Unlawful Detainer Statute: A Call For Reform, Margaret Kelly

Brigham Young University Prelaw Review

Utah’s Unlawful Detainer Statute largely favors landlords in matters of eviction. The current statute allows evicted tenants only 0-3 days to move off a premise, requires evicted tenants to pay triple damages, and gives tenants a limited time to claim their belongings. Compared to other states, Utah is severe in its treatment of evicted tenants. This paper calls for a reform to the Utah Unlawful Detainer Statute, which will make the process of eviction more reasonable for evicted tenants throughout the state.

The Effect Of Mandatory Audit Firm Rotation On Audit Quality, Audit Fees And Audit Market Concentration: Evidence From India, K Raghunandan, R Narayanaswamy Apr 2019

The Effect Of Mandatory Audit Firm Rotation On Audit Quality, Audit Fees And Audit Market Concentration: Evidence From India, K Raghunandan, R Narayanaswamy

Working Papers

In India, the government introduced mandatory audit firm rotation following calls to improve audit quality and auditor independence in the wake of the Satyam accounting scandal. The absence of strong institutional mechanisms to prevent and detect audit failure in a timely manner has led the government to require periodical audit firm rotation. Evidence from firms for the years 2014 to 2017 suggests that mandatory audit firm rotation does not appear to have improved audit quality, reduced audit costs and increased audit market competition.

Services Contribution To Manufacturing Exports And Value-Added: Evidence From India And China, Saunok Chakrabarty, Rupa Chanda

Working Papers

The importance of services inputs in enhancing manufacturing productivity and competitiveness has been well documented in the literature on global value chains and economic development. In this context, we investigate the nature and strength of the interlinkage between the services and manufacturing sectors in India and China, using valueadded and exports data from the OECD Trade-in-Value-Added Database over 2005-15. Three principal observations emerge from our analysis. First, manufacturing value-added in exports is significantly overstated in conventional BOP statistics for both countries; it is much lower when we use the value-added approach. Second, China’s services value-added contribution is concentrated in traditional …

Creative Lawyering For Social Change, Raymond H. Brescia Apr 2019

Creative Lawyering For Social Change, Raymond H. Brescia

Georgia State University Law Review

Lawyers have long played an integral part in efforts to bring about social change. With an increasing desire to see change in the world, regardless of one’s political perspective, there is a growing interest in understanding the role that lawyers can play in bringing about such change. This type of lawyering is complex, however, and faces far more challenges than those the traditional lawyer faces in his or her work. Although all lawyers solve problems on behalf of their clients, the role of the social-change lawyer is more complex because the problems she seeks to address are more complex, mostly …

Deception, Professional Speech, And Cpcs: On Becerra, Abortion, And The First Amendment, Mark Strasser Apr 2019

Deception, Professional Speech, And Cpcs: On Becerra, Abortion, And The First Amendment, Mark Strasser

Buffalo Law Review

In National Institute of Family & Life Advocates v. Becerra, the United States Supreme Court struck down a California law requiring crisis pregnancy centers to post certain signs.1 The Court implied that the case involved a relatively straightforward example of governmental overreaching, with the government allegedly attempting to commandeer private entities and force them to convey the government’s message.2 Yet, the Court omitted important background information when discussing the state’s implicated interests,3 and the Court’s analyses and rationales may have important First Amendment implications. While the Court may have reached the right result, its analyses bode poorly for a reasoned …

Seeing Through The Racist Smog: With A Reading Curriculum Based On Culturally Responsive Teaching And Warm Demander Pedagogy, Maren Swann Apr 2019

Seeing Through The Racist Smog: With A Reading Curriculum Based On Culturally Responsive Teaching And Warm Demander Pedagogy, Maren Swann

School of Education and Leadership Student Capstone Projects

There are countless articles about the Achievement Gap, but few offer concrete solutions. While the teaching force is “whitening,” the percentage of students of color is increasing. A small group of researchers have offered two new pedagogies as a way to help students of color and low-income students succeed: culturally responsive teaching and warm demander pedagogy. While there is literature on these two theories of pedagogy, there are few unit plans. This author created a 3rd grade reading unit entitled Readers Workshop Activist Book Review Unit using culturally responsive teaching, warm demander pedagogy and Wiggin’s and McTighe’s “backwards design” curriculum …

How To Decrease The Immigration Backlog: Expand Representation And End Unnecessary Detention, Kara A. Naseef Apr 2019

How To Decrease The Immigration Backlog: Expand Representation And End Unnecessary Detention, Kara A. Naseef

University of Michigan Journal of Law Reform

This Note recommends federal policy reform and local implementation in order to decrease the immigration backlog and protect the rights of non-citizens in immigration proceedings. Although non-citizens hold many of the fundamental rights and freedoms enumerated in the Constitution, several core rights— including due process and the right to counsel—are not rigorously upheld in the context of immigration proceeding. By carefully regulating expanded access to representation and ending unnecessary immigration detention, the Executive Office of Immigration Review and Congress will ensure the swift administration of justice and protect non-citizens under the federal government’s jurisdiction.

Mr. Try-It Goes To Washington: Law And Policy At The Agricultural Adjustment Administration, Daniel R. Ernst Apr 2019

Mr. Try-It Goes To Washington: Law And Policy At The Agricultural Adjustment Administration, Daniel R. Ernst

Georgetown Law Faculty Publications and Other Works

In December 1933, Jerome Frank, the general counsel of the Agricultural Adjustment Administration but better for writing Law and the Modern Mind (1930), a sensational attack on legal formalism, told an audience at the Association of American Law Schools a parable about two lawyers in the New Deal, each forced to interpret same, ambiguous statutory language. The first lawyer, “Mr. Absolute,” reasoned from the text and canons of statutory interpretation without regard for the desirability of the outcome. “Mr. Try-It,” in contrast, began with the outcome he thought desirable. He then said to himself, “The administration is for it, and …
