In ancient Roman religion and myth, Janus is the god of beginnings, transitions, and endings. He is often depicted as having two faces, one looking to the future and one to the past. The Supreme Court’s Janus v AFSCME case of last Term is fittingly named.Stunning in its disregard of principles of stare decisis, Janus overruled the forty-year-old precedent Abood v Detroit Board of Education.The Janus decision marks the end of the post – New Deal compromise with respect to public sector unions and the First Amendment. In its first 25 years, the Clinical Law Review (CLR) provided a ground-breaking foundation to build a scholarly field inspired and informed by clinical work and to legitimate that scholarship within the academy. The CLR broadened the window for clinicians to put their work in a wider context of other clinicians' experience, and with that context and comparison, to build theory from this common body of endeavor.

An Examination Of The Lethality Assessment Program (Lap): Perspectives On Implementation, Helpseeking, And Victim Empowerment, Margaret E. Johnson

The Lethality Assessment Program (LAP) aims to empower law enforcement officers to screen victims of domestic violence for potential lethality and connect them to service providers. This research surveyed domestic violence victims seeking legal services (n = 141) to assess whether LAP receipt is associated with greater rates of self-protective measures, service use, or empowerment, and to examine victims’ perspectives on the LAP process. Findings indicate no relationship between receipt of the LAP and use of self-protective measures or victim empowerment, mixed evidence between receipt of the LAP and service utilization, and room for improvement regarding how law enforcement …

Client Assistance Programs and Protection and Advocacy Services comprise the nationwide network of congressionally mandated, legally based disability rights agencies. Both of these programs and services were mandated as a response to the need for protection of the rights of persons with disabilities. On December 28, 2017, the federal Department of Health and Human Services ("HHS") settled its fiftieth case involving potential violations of the privacy, security, and breach notification rules ("Rules") that implement the Health Insurance Portability and Accountability Act ("HIPAA") and the Health Information Technology for Economic and Clinical Health Act ("HITECH"). This essay reviews some of Justice Anthony Kennedy’s most significant contributions to First Amendment jurisprudence. These include his calls for absolute protection for pure political speech, his strong protection for commercial speech, his distaste for campaign finance reform laws that censored speech, his general concern for the silencing of sexual expression, his coercion test in Establishment Clause cases, and his significant failure in the public-employee free-speech decision Garcetti v. Although Artificial Intelligence (AI) is already of use to litigants and legal practitioners, we must be cautious and deliberate in incorporating AI into the common law judicial process. Human beings and machine systems process information and reach conclusions in fundamentally different ways, with AI being particularly ill-suited for the rule application and value balancing required of human judges. Nor will “cyborg justice”—hybrid human/AI judicial systems that attempt to marry the best of human and machine decisionmaking and minimize the drawbacks of both—be a panacea. Sexual violence in the workplace amongst female migrant worker is an under-discussed issue, due to lack of reporting, that needs to be explored in more detail. This paper examined the role of NGOs in providing protection to FMW who are survivors of sexual violence, in Thailand, who want to seek justice. This study used qualitative approach by interviewing 3 people from local NGOs and 3 people from international NGOs working in Thailand that provide services to FMW who have faced sexual violence, to deal with the culturally biased and highly patriarchal criminal justice system. การวิจัยเรื่องบทบาทและความรับผิดชบของผู้ประกอบวิชาชีพกฎหมายไทยตามหลักสากล ว่าด้วยมาตรการป้องกันและปราบปรามการฟอกเงิน มีวัตถุประสงค์เพื่อศึกษาบทบาทหน้าที่ของผู้ประกอบวิชาชีพกฎหมายที่อาจส่งผลต่อการปรับใช้มาตรฐานสากล รวมถึงมาตรการ ระเบียบปฏิบัติ และนโยบายกฎหมายระหว่างประเทศว่าด้วยเรื่องการป้องกันและปราบปรามการฟอกเงินในส่วนที่เกี่ยวข้องกับผู้ประกอบวิชาชีพกฎหมาย เพื่อวิเคราะห์ความจำเป็นและความเหมาะสมในการหาแนวทางปฏิบัติของผู้ประกอบวิชาชีพกฎหมายในการป้องกันและปราบปรามการฟอกเงินให้มีประสิทธิภาพมากยิ่งขึ้น โดยการค้นคว้าเอกสารวิชาการ กฎหมาย แลระเบียบต่างๆประกอบกับการเก็บรวบรวมข้อมูลจากการสัมภาษณ์เชิงลึกและการสนทนากลุ่ม เพื่อวิเคราะห์ข้อมูลและหาแนวทางสรุป ผลการวิจัยพบว่าประเทศไทยยังมีความบกพร่องด้านกรอบของกฎหมายตามข้อแนะนำที่ 22 ในส่วนของการกำหนดให้ผู้ประกอบวิชาชีพกฎหมายมีหน้าที่ในการรู้จักตัวตนของลูกความ การตรวจสอบเพื่อทราบข้อเท็จจริง อันจะนำไปสู่การรายงานธุรกรรมที่น่าสงสัย ส่งผลให้มาตรฐานของประเทศไทยอาจไม่สามารถดำเนินการได้อย่างมีประสิทธิภาพและไม่ทัดเทียมมาตรฐานสากล ซึ่งในการพิจารณากำหนดหน้าที่ดังกล่าว ประเทศไทยจำต้องพิจารณาความเหมาะสมระหว่างสิทธิเสรีภาพของข้อมูลส่วนบุคคลกับหน้าที่การรายงานธุรกรรมและการคำนึงถึงประโยชน์สาธารณะหรือความรับผิดชอบต่อสังคมภายใต้จริยธรรมแห่งวิชาชีพ ดังนั้นการป้องกันและปราบปรามการฟอกเงินได้อย่างเบ็ดเสร็จนั้น ผู้วิจัยเห็นว่าประเทศไทยควรตรากฎหมายให้ผู้ประกอบวิชาชีพกฎหมายมีหน้าที่ต้องรายงานตามมาตรฐานของ FATF ในส่วนของสภาทนายความควรกำหนดบทบาทหน้าที่ให้ชัดเจนและมีการขึ้นทะเบียนให้ครอบคลุมทุกประเภทของผู้ประกอบวิชาชีพกฎหมาย เพื่อกำกับดูแลคุณภาพและยกระดับมาตรฐานวิชาชีพ ขณะที่ผู้ประกอบวิชาชีพกฎหมายต้องตระหนักถึงคุณธรรมและจริยธรรมและมีอุดมการณ์ในการให้บริการทางกฎหมาย คำนึงถึงประโยชน์สาธารณะและความรับผิดชอบต่อสังคม และควรมีความรู้ความเข้าใจในความเสี่ยงและความเปราะบางของวิชาชีพที่อาจถูกใช้เป็นเครื่องมือในการฟอกเงิน ทั้งนี้บทบาทหน้าที่ดังกล่าว มิได้เพียงแต่เพื่อแสดงให้เห็นถึงความรับผิดชอบต่อสังคมเท่านั้น แต่เป็นมาตรการที่ผู้ประกอบวิชาชีพกฎหมายได้เป็นส่วนหนึ่งของการป้องกันและปราบปรามการฟอกเงินอย่างมีประสิทธิภาพและยั่งยืนต่อไป

The top leader of an organization influences the organizational culture, and the organizational culture influences the leader. Strategic thinking on the part of the leader is a result of organizational culture and/or will impact organizational culture. This qualitative study is a comparative multiple-case study that examines the relationship between leaders and organizational culture and what the leader’s strategic decision-making and organizational changes indicate about the relationship between leadership and organizational culture. The organizational context of private schools is used to better understand the dynamics between leadership and organizational culture.

This dissertation explores questions related to consumer services using Yelp data from the Phoenix area. Chapter 1 explores competition. Competition is a key feature of the market process assumed to improve market outcomes. But how strong is the relationship between competition and positive consumer experiences, and how does the relationship vary across space? This chapter explores these questions by exploiting Yelp data from thousands of restaurants in the Phoenix area. After controlling for restaurant characteristics, census tract level demographics, census tract fixed effects, and sub-industry fixed effects, the results are consistent with spatial competition positively affecting consumer experiences. This dissertation explores empirical issues concerning public libraries in the United States. In particular, it analyzes the direct and indirect effects to and from public libraries, on different issues such as charitable donations, labor market outcomes, institutions and technical efficiency. Chapter 1 discusses the economics of public libraries and its relevance. In addition, it provides an outline of the dissertation and its main contribution to the literature. If a patient becomes unable to adequately express preferences for medical care, another individual called a “surrogate” may be consulted to make treatment decisions. Surrogates may be asked to indicate patient preferences on the Physician Order for Scope of Treatment (POST), a new type of advance directive completed with patients who are estimated to have less than one year left to live. Research from the shared decision-making literature indicates that collaboration can be a valuable means of enhancing patient satisfaction with their decisions. The metaphor of a ‘marketplace of ideas’ has long pervaded discussions of free speech in and beyond the United States. For early scholars of law and economics (L&E), the similarities and differences between the metaphorical marketplace for ideas and literal markets for goods and services were subjects of much attention. This retrospective study surveyed decision-making and challenges among 78 gay cisgender male couples utilizing in-vitro fertilization (IVF) and a gestational carrier. While most couples (67.1%) found the decision to actively pursue fertility treatment ‘not difficult’, 32.9% felt that it was ‘somewhat difficult’ or ‘very or extremely difficult’. Almost 30% of couples had not undertaken financial planning for treatment, which introduced delays of N2 years for 25.3% of participants. Conceiving twins was ‘important to very important’ in 52.3% of couples, and 84.2% of couples chose to transfer two embryos to ‘increase the odds’ or reach an ideal family size in a …

This short article surveys developments in the law affecting electronic payments and financial services from June 1, 2017 to June 1, 2018. During this period, significant developments occurred that affected the regulation of initial coin offerings (ICOs), the Office of the Comptroller of the Currency’s proposal to issue “special purpose national bank charters” to FinTech companies, the CFPB’s final regulation of prepaid, general-purpose cards, state regulation of payroll cards, and how lawyers taking cryptocurrencies from clients as payment for services or for safekeeping should protect them. While modern gestational surrogacy technology has existed for almost forty years, surrogacy is viewed as a matter of state law because the United States has yet to regulate it at the federal level. Many have advocated for either federal legislation or their own individual states to enact legislation addressing surrogacy, but Georgia is one of many states that still lacks any laws regulating—or even mentioning—surrogacy agreements. The prevalence of bribery in Ghana has increased significantly since the mid-2000s and has received considerable attention in both local and international media, as well as among empirical researchers. Although researchers have examined factors that influence the giving and acceptance of bribes in Ghana, limited theoretical research exists concerning the ways public officials in Ghana defend their corrupt behavior. The purpose of this study was to examine ways bribees in Ghana defend their illegal actions, using Sykes and Matza’s neutralization theory.
