Other Faculty of Arts, Humanities and Business Theses

The Turkish Embassy Letters is considered both inaugural and atypical of women’s travel writing, and scholarship is largely orientated around Montagu’s focus on women and their lives in the different countries she travelled to and stayed in between 1716 – 18. While this dissertation maintains a primary engagement with gender, it evaluates the text’s participation in myriad discourses and genres of the Restoration and early Augustan period. The cultural conditions that saw a significant growth in female participation in the world of print and, thereby, in intellectual exchange with men - often in writings loosely operating within a ‘Republic of …

Reading Victorian Working-Class Expectations Of Fatherhood In Trials Of Paternal Negligence, Alesha Lister Jan 2019

Reading Victorian Working-Class Expectations Of Fatherhood In Trials Of Paternal Negligence, Alesha Lister

SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)

This article examines the complex dynamics of class and gender in criminal proceedings against of men charged with feloniously causing the death of their children through neglect of their paternal duties. The intersection of ideas about respectability, masculinity and fatherhood are explored through a range of archival material generated by trials of men charged with fatally neglecting their children at the Central Criminal Court of London between 1800 and 1913. I argue that the behaviour of men accused of neglect-based homicide not only fell short of middle-class expectations of fatherhood but contravened customary expectations of fatherhood within London's working-class communities. …

Teaching Primary Students About War, Anthony Potts, Nina Maadad

Australian Journal of Teacher Education

This article examines Australians at War: Primary Schools Education Resource and what it teaches students. This resource, for grades 4-6 students, has as its learning outcomes: knowledge of Australia’s involvement in various conflicts; students’ empathising with the experiences of war; the use of a variety of sources about war; engaging with people about war and their experiences of war; and reflecting on Australia’s wartime involvement in the development of identity and heritage. The article first locates the teaching approaches used in the resource within the research on history teaching and the political and public debates on what we should teach …

Drawing As Language, Rebecca B. Whitson Jan 2019

Drawing As Language, Rebecca B. Whitson

Theses and Dissertations

All too often, the “I can’t draw” sentiment is believed by both the frustrated adolescent and adult alike. This is especially evident within the school environment. This paper aims to discuss how visual art --specifically drawing-- is structured, formed and expressed as a type of language, similar to a verbal, written, or physical one. This may give hope to even the most reluctant drawer that they can learn how to draw, opening another means of communication. An individual attains fluency when they are adept at drawing through the use of expression, technical, and observational skills, through practice and motivation, and …

William Bernard Cooke, George Cooke, And J.M.W. Turner: Business Of The Topographical Print Series, Saskia C. Turpijn Jan 2019

William Bernard Cooke, George Cooke, And J.M.W. Turner: Business Of The Topographical Print Series, Saskia C. Turpijn

Theses and Dissertations

The organization of eighteenth and nineteenth-century British printmaking and publishing was based on economic principles and occurred in the collaborative sphere of the engraver’s studio. Print designers, engravers, printers, and publishers formed a professional network that operated on economic principles, publishing prints that served to generate income for its participants. These ventures faced great challenges in the lengthy and laborious processes of engraving and publishing, and in financing the project for the duration of that time.

This project examines the economic structure of early nineteenth-century prints. Using comprehensive accounting records, it analyzes two well-known topographical print series. The profitable Southern …

Rising Confusion About "Arising Under" Jurisdiction In Patent Cases, Paul Gugliuzza Jan 2019

Rising Confusion About "Arising Under" Jurisdiction In Patent Cases, Paul Gugliuzza

Faculty Scholarship

By statute, all cases “arising under” patent law must be heard exclusively by the federal courts (not state courts) and, on appeal, by the Federal Circuit (not the twelve regional circuits). But not all cases involving patents “arise under” patent law. As recently as 2013, the Supreme Court ruled that the mere need to apply patent law in, for example, a malpractice case involving a patent lawyer, is insufficient to trigger exclusive jurisdiction. Rather, the Court held, for a case that does not involve claims of patent infringement to arise under patent law, the patent issue must be “important . …

A Validation And Feasibility Study Of The Non-Invasive Measurement Of Oxygen Delivery And Consumption After Elective Major Abdominal Surgery., Adam Kimble Jan 2019

A Validation And Feasibility Study Of The Non-Invasive Measurement Of Oxygen Delivery And Consumption After Elective Major Abdominal Surgery., Adam Kimble

Peninsula Medical School Theses

Major surgery triggers a physiological stress response that results in an increase in post-operative metabolic demand and oxygen consumption (V̇O2), which must be met by an increased oxygen delivery (DO2). Historical studies described the increase in V̇O2 in patients after major surgery and presented evidence that the inability to meet this increase oxygen demand and the temporal pattern of this oxygen deficit appears to differ according to whether patients survive, or develop complications or not. The survival and complication profile of patients in modern practice is different from that previously described, And the methods employed in these historical studies were …

Evaluating Constitutional Hardball: Two Fallacies And A Research Agenda, Joseph Fishkin, David E. Pozen Jan 2019

Evaluating Constitutional Hardball: Two Fallacies And A Research Agenda, Joseph Fishkin, David E. Pozen

Faculty Scholarship

This Reply addresses the responses by Professors David Bernstein and Jed Shugerman to our essay Asymmetric Constitutional Hardball. Bernstein's response, we argue, commits the common fallacy of equating reciprocity with symmetry: assuming that because constitutional hardball often "takes two" to play, both sides must be playing it in a similar manner. Shugerman's response, on the other hand, helps combat the common fallacy of equating aggressiveness with wrongfulness: assuming that because all acts of constitutional hardball strain norms of governance, all are similarly damaging to democracy. We suggest that whereas Bernstein's approach would set back the burgeoning effort to study constitutional …

Immigrant Sanctuary As The 'Old Normal': A Brief History Of Police Federalism, Trevor George Gardner Jan 2019

Immigrant Sanctuary As The 'Old Normal': A Brief History Of Police Federalism, Trevor George Gardner

Scholarship@WashULaw

Three successive presidential administrations have opposed immigrant sanctuary policy, at various intervals characterizing state and local government restrictions on police participation in federal immigration enforcement as reckless, aberrant, and unpatriotic. This Article finds these claims to be ahistorical in light of the long and singular history of a field this Article identifies as “police federalism.” For nearly all of U.S. history, Americans within and outside of the political and juridical fields flatly rejected federal policies that would make state and local police subordinate to the federal executive. Drawing from Bourdieusian social theory, this Article conceptualizes the sentiment driving this longstanding …

Kindergarten Parent Engagement And Student Reading Literacy In Title I Schools: A Systematic Literature Review And Meta-Synthesis, Stacy L. M. Mcdonald Jan 2019

Kindergarten Parent Engagement And Student Reading Literacy In Title I Schools: A Systematic Literature Review And Meta-Synthesis, Stacy L. M. Mcdonald

Theses and Dissertations

The purpose of this study was to systematically review research on the relationship between parent engagement and student reading outcomes in Title I schools at Kindergarten level. The following research questions guided this study:

  1. What is the relationship between parent engagement and student reading literacy outcomes in low socioeconomic students in kindergarten? Findings show that parent engagement brings parents together with the school staff working with one another to promote a child’s reading literacy. Parent engagement includes the parent as an active member who shares responsibility for a child’s achievement. A need for teacher professional development for teachers on building …

Originalism And The Law Of The Past, William Baude, Stephen E. Sachs Jan 2019

Originalism And The Law Of The Past, William Baude, Stephen E. Sachs

Faculty Scholarship

Originalism has long been criticized for its “law office history” and other historical sins. But a recent “positive turn” in originalist thought may help make peace between history and law. On this theory, originalism is best understood as a claim about our modern law — which borrows many of its rules, constitutional or otherwise, from the law of the past. Our law happens to be the Founders’ law, unless lawfully changed.

This theory has three important implications for the role of history in law. First, whether and how past law matters today is a question of current law, not of …

To Be The Body Of Christ: Discipleship (Solidarity) And Eucharist, M. Shawn Copeland Jan 2019

To Be The Body Of Christ: Discipleship (Solidarity) And Eucharist, M. Shawn Copeland

Institute of Liturgical Studies Occasional Papers

In this presentation, I explore the relation between discipleship as solidarity and Eucharist. To this end, the Gospel of Luke sets the scriptural parameters, as the story of the disciples on the way to Emmaus and their experience of recognizing Jesus at table in the breaking of bread is narrated only in this Gospel. Written in the final decades of the first century and addressed to a community of mixed social and economic standing, Luke’s narrative has come under critique for its tendency to convey double-messages and its ambiguity toward women and the poor. New Testament scholar Sharon Ringe has …

A Deep Dive Into The Land Development Dynamics Of A Complex Landscape, Pariya Pourmohammadi Jan 2019

A Deep Dive Into The Land Development Dynamics Of A Complex Landscape, Pariya Pourmohammadi

Land development is a complex and dynamic process simultaneously interacting with numerous environmental, cultural and economic procedures. In this research we studied past, present and future of land transformation in Appalachia. This dissertation is organized in three-essay format and each essay is focused on one aspect of land development processes in a sub-region in the Appalachian region. In the first essay, deep learning techniques are used to build predictive models for the land development. This study presets deconvolutional neural networks models in predicting land development. On the second essay, spatial data analysis and remote sensing are used to investigate the …

Recent Changes In The Zooplankton Communities Of Arctic Tundra Ponds In Response To Warmer Temperatures And Nutrient Enrichment, Mariana Vargas Medrano Jan 2019

Recent Changes In The Zooplankton Communities Of Arctic Tundra Ponds In Response To Warmer Temperatures And Nutrient Enrichment, Mariana Vargas Medrano

Open Access Theses & Dissertations

Warming is altering Arctic freshwater ecosystems, enriching the water column, increasing primary productivity and shifting the composition, dominance and the timing of emergence and reproduction of zooplankton communities. Historic data from arctic tundra ponds near UtqiaÄ¡vik, AK have given us valuable insight into changes that have occurred in recent times. A change of dominance from cyclopoid copepods to Daphnia middendorffiana has occurred over a 40 year period. Daphnia are more common, abundant and larger, which may be explained by increased primary productivity stimulated by nutrient release from permafrost thaw. Copepods and fairy shrimp emerged earlier from the overwintering states, which …
