Singapore Convention Series: Why Is There No ‘Seat’ Of Mediation?, Shouyu Chong, Nadja Alexander Feb 2019

Singapore Convention Series: Why Is There No ‘Seat’ Of Mediation?, Shouyu Chong, Nadja Alexander

Research Collection Yong Pung How School Of Law

For dispute resolution practitioners familiar with the concept of the seat of arbitration, it may come as a surprise that the new UN Convention on International Settlement Agreement Resulting from Mediation does not include provisions in relation to the ‘seat’ of mediation. Why, you may ask? The Convention includes no provisions on ‘seat’ simply because there has never been the need for a ‘seat’ of mediation when cross-border disputes are brought before a mediator, and this remains the case. In this blog post, we will develop a hypothetical scenario to explore the issues.

Rooftop Recipes For Relating: Ecologies Of Humans, Animals, And Life, Noha Fikry Feb 2019

Rooftop Recipes For Relating: Ecologies Of Humans, Animals, And Life, Noha Fikry

Theses and Dissertations

This thesis explores the particularly lively rooftops of Cairo through which interspecies intimacies unfold. On these rooftops, various animals (such as chickens, ducks, geese, turkeys, goats, and rabbits) are raised to be later eaten and consumed for sustenance. Throughout the various thesis chapters, I try and expose the various patterned modalities, terms, and codes bringing these different species together in their sustained long-term relationships. I follow these interspecies relations as they narrate wonders of life-and-death, collaborations, various instantiations of home, social gift exchanges, marital rituals, and grieving patterns. These relations involve different tasks, requiring a very specific and complex gendered …

Of Bodies And Borders: Syrian Migration To Egypt Through Sudan, Banan Abdelrahman Feb 2019

Of Bodies And Borders: Syrian Migration To Egypt Through Sudan, Banan Abdelrahman

Theses and Dissertations

This research explores Syrian migration movements to Egypt through the Sudanese smuggling route. By grappling with notions of sovereignty, critical geography, mobile subjectivities, and modes of governance, the thesis unpacks the recent flux on the route through describing the journey itself, as well as the way different bodies cross the border and settle. Through the multiple sites the research was conducted in, it seeks to contribute to growing discussions surrounding new understandings of migration. The thesis followed and traced the migration journey, from its beginnings in Khartoum, through Aswan, and ending in Cairo using various methodologies- namely: engaged ethnography and …

Through The Keyhole: Ethnographic Analysis Of Cyber Violence In Egypt, Radwa Fouda Feb 2019

Through The Keyhole: Ethnographic Analysis Of Cyber Violence In Egypt, Radwa Fouda

Theses and Dissertations

Internet has long existed in Egypt, however sudden scholarly interest came after the 2011 revolution. The global scholarly body tended to couple internet accessibility to the so-called Arab-spring, without studying the other forms and politics of internet as an evolution, and almost none have delved in the dungeons of Cyber violence in the MENA Region, needless to say in Egypt. It focuses mainly on individual-to-individual perpetration of violence, how, when and why people variably define unsolicited intervention with their data as "violence", and how, when and why, they choose other notions to define such incident(s). By doing so, it opens …

Reversing Borrón Y Cuenta Nueva: The Curative Power Of Family Memory In The Novels Of Loida Maritza Perez And Nelly Rosario, Ivonne Gonzalez Feb 2019

Reversing Borrón Y Cuenta Nueva: The Curative Power Of Family Memory In The Novels Of Loida Maritza Perez And Nelly Rosario, Ivonne Gonzalez

Dissertations, Theses, and Capstone Projects

I examine two novels, Geographies of Home by Loida Maritza Perez and Song of the Water Saints by Nelly Rosario, written by Dominican American authors, to determine how they present identity with relation to family history in conjunction with an analysis of my life and the circumstances that have helped define my identity. I explore how the characters in the texts are affected by the loss of family history, the role that gaze and family memory play in reclaiming that which is lost, and how these all shape identity. The families in the novels seem destined to lead desolate lives; …

Rural Adolescent Education Reframed: Can Social Justice, Lewin’S Topology, And Aesthetics Aid Reform Efforts?, Judith F. Upjohn Feb 2019

Rural Adolescent Education Reframed: Can Social Justice, Lewin’S Topology, And Aesthetics Aid Reform Efforts?, Judith F. Upjohn

Dissertations, Theses, and Capstone Projects

The aim of this thesis is to describe and analyze how changes in classroom-level conditions can help underperforming students thrive despite established school structures that discriminate against and exclude those students from learning opportunities.

Every year, millions of US public school students fail to graduate high school (National Center for Education Statistics [NCES], 2018), despite numerous ongoing education reform efforts (Berkshire & Schneider, n.d.; Strauss, 2017). A large percentage of these students attend rural schools (Arnold, Newman, Gaddy, & Dean, 2005; Status of Rural Education, 2018). The rural conditions of adolescent students adversely affect their educational performance and achievement (Howley …

Democratization Of Nepal: Towards Consolidation? Perspectives On Rule Of Law & Civil Liberties, Anil J. Shahi Feb 2019

Democratization Of Nepal: Towards Consolidation? Perspectives On Rule Of Law & Civil Liberties, Anil J. Shahi

Dissertations, Theses, and Capstone Projects

After popular uprisings that started in 1989, Nepal declassed the 200-year old absolute monarchy to a constitutional monarchy in 1990 and entered into an era of parliamentary democracy. The road to democratization was to be proven tumultuous when the Maoists launched an insurgency in 1996. In 2003, citing democratic government’s inability to end the bloody insurgency and political parties’ utter ineptitude in governance, King Gyanendra dismissed the parliament and retook the reign in an attempt to re-establish absolute monarchy. Just three years after, the Maoists and an alliance of seven political parties reached an agreement to end the insurgency, abolish …

Refracting Immigration Rhetoric: The Struggle To Define Identity, Place And Nation In Southern Arizona, Emily Duwel Feb 2019

Refracting Immigration Rhetoric: The Struggle To Define Identity, Place And Nation In Southern Arizona, Emily Duwel

Dissertations, Theses, and Capstone Projects

This thesis examines the refraction of immigration rhetoric in a local context through a collection of letters to the editor of southern Arizona’s largest and only daily newspaper, the Arizona Daily Star, for the period 2006-2010. The purpose is to further insight into the process by which xenophobic nationalism is both contested and legitimated ‘on the ground,’ within a violent paradigm of nativist rhetoric and exclusion. Findings reveal essential disjunctures between and within letter-writers’ conceptions of moral proximity and the social contract—as delimiting those obligations and expectations that inhere between society, the self and the stranger—as well as competing notions …

Development, Expertise, And Infrastructure Between The Ohio River And Cincinnati Riverfront, 1895-Present, Raymond W. Pettit Feb 2019

Development, Expertise, And Infrastructure Between The Ohio River And Cincinnati Riverfront, 1895-Present, Raymond W. Pettit

Dissertations, Theses, and Capstone Projects

As the first major U.S. urban center located west of the Appalachian Mountains, Cincinnati’s early growth depended on the Ohio River, a vital route for the westward drive of U.S. settler colonialism in the first half of the nineteenth century. Over time, with the expansion of railroads and shifting trade routes, the river became less relevant to the success of the city. In this dissertation study, I pick up the history of Cincinnati’s relationship with the Ohio River after it had apparently declined in importance. Through a focus on how Cincinnati elites have advocated for different infrastructural projects along the …

Internal Displacement In The United States: A Result Of Climate Change And U.S. Policy, Ahmad T. Diop Feb 2019

Internal Displacement In The United States: A Result Of Climate Change And U.S. Policy, Ahmad T. Diop

Dissertations, Theses, and Capstone Projects

Abstract

Internal Displacement in the United States: A Result of Climate Change and U.S. Policy by

Ahmad Tidjany Diop

Advisor: Karen Miller

This thesis will focus on arguments for an open border. I demonstrate that open borders are necessary because land is scarce. I focus on the United States, which is currently dealing with internal displacement due to climate change. The moral, human rights, and political claims I will make open borders are reasonable because climate change will make certain parts of the world uninhabitable.

When I say internal displacement I am referring to those displaced in the United States …

The Urban Domestic: Homosocial Domesticity, Literature, And Culture In 19th And 20th Century New York City, Krystyna Michael Feb 2019

The Urban Domestic: Homosocial Domesticity, Literature, And Culture In 19th And 20th Century New York City, Krystyna Michael

Dissertations, Theses, and Capstone Projects

My dissertation, The Urban Domestic: Homosocial Domesticity in the Literature and Culture of 19th- and 20th-Century New York City, explores the relationship between transformations in urban planning and domestic ideology through American literature. Specifically, I take up Walt Whitman and Edith Wharton as two authors with distinctly ambivalent relationships to the hetero-normative nuclear family and the ways New York’s built environment shaped and controlled the nation’s gender and sexual politics. My reading bridges a critical gap between studies of culture and its literary expressions on the one hand, and of architectural design and the urban environment …

Somalia's Struggle To Integrate Traditional And Modern Governance: The 4.5 Formula And 2012 Provisional Constitution, Nasteha Ahmed Feb 2019

Somalia's Struggle To Integrate Traditional And Modern Governance: The 4.5 Formula And 2012 Provisional Constitution, Nasteha Ahmed

Theses and Dissertations

The objective of this project is to assess the impact of Somalia’s 4.5 power sharing formula on the consolidation of post-conflict governance. Per the peace agreement, seats in parliament are awarded to the four major clans which also dominate the election process. This has led to the perpetuation of many of the same social dynamics that lead to conflict in the past. Even though the 4.5 formula was not included in the constitution adopted in 2012, the elections methods from the formula were utilized in 2017 presidential elections. Although the goal is to move towards a one-man-one vote system, the …

Law, Love And Violence: Interfaith Romance In Modern Egypt, Mariam El-Maghlawy Feb 2019

Law, Love And Violence: Interfaith Romance In Modern Egypt, Mariam El-Maghlawy

Theses and Dissertations

For the past few decades, many incidents of sectarian violence have been triggered by rumors of interfaith sexual and romantic relationships between Muslims and Coptic Christians in Egypt. This thesis argues that the ways in which the Egyptian modern state chooses to govern women’s bodies and address the Coptic question has inevitably enabled sectarian violence witnessed today to take on its current form. One of the main implications of the modernization of the Egyptian legal system was the state’s ability to “jam” women, family, sexuality and religion into the private sphere, as opposed to the public sphere. This essentially has …

The Implied Reader And The Recovery Of Childhood: A Study Of J.R.R. Tolkien’S The Hobbit, Georgette Talaat Rizk Feb 2019

The Implied Reader And The Recovery Of Childhood: A Study Of J.R.R. Tolkien’S The Hobbit, Georgette Talaat Rizk

Theses and Dissertations

This thesis argues that J.R.R. Tolkien's The Hobbit uses a storyteller-narrator and a child/adult implied reader to guide child readers towards maturity and allow adult readers to reengage with the world of childhood. The storyteller replicates traditional fairytale and epic storytelling, a tradition which simultaneously engages adults and children. The novel's language, intertexts, themes, humor and the reader's encouraged identification with the hobbit, Bilbo, suggest that the implied reader is both an adult and a child. The novel invites the reader to adopt Bilbo's development of a childlike perspective valuing the immaterial over the material. The life-like nature of time …

The Usage Of Songs In Arabic As A Foreign Language Classes: Teachers' Perceptions And Practices, Yahia Moshtahari

Theses and Dissertations

This study investigates Arabic as a Foreign Language (AFL) teachers' perceptions towards the usefulness of songs in fostering language acquisition in AFL classes, in addition to the practices they employ, and the alignment between teacher perceptions and practices. Perceptions and practices are examined further through a focus on the purposes for using songs in class, the activities teachers use with songs, and the challenges they face with using songs in class. In addition, the study evaluates whether there are any demographic features that distinguish teachers who use songs from those who do not. The aforementioned topics were investigated through an …

Dawsha W Al-Qāhirah: Listening To Power And Possibilities In Cairo’S Everyday, Noor Salama Feb 2019

Dawsha W Al-Qāhirah: Listening To Power And Possibilities In Cairo’S Everyday, Noor Salama

Theses and Dissertations

This thesis explores the notion of 'dawsha' (an Arabic word, indicating noise or sound out of place) as an order-word that stratifies social worlds in Cairo and marks and crystallises differences within aural taxonomies along various axes of difference and marginalisation. It also investigates dawsha as a space and a site for resistance, and for the making and unmaking of relationships in contemporary Cairo.

"Social Engineering": Notes On The Law And Political Economy Of Integration, Olatunde C. A. Johnson Feb 2019

"Social Engineering": Notes On The Law And Political Economy Of Integration, Olatunde C. A. Johnson

Cardozo Law Review

This Article shifts the question of how to achieve integration away from the technocratic questions of planning and policy devices, however important, to the equally important questions of political economyhow to move a legal and political infrastructure that is engineered for segregation towards integration. No doubt this question is not fully answerable in a short Article and perhaps at all. Yet, it might be possible to gather some of what is already known about the dynamics of social change towards integration, build on that knowledge, and find openings in current law, politics, and social movements for charting a future course …

The Street View Of Property, Vanessa Casado-Pérez Feb 2019

The Street View Of Property, Vanessa Casado-Pérez

Faculty Scholarship

Parking on public streets is scarce. The current allocation system for parking spots based on rule of capture coupled with low parking fees creates a tragedy of the commons scenario. The misallocation of parking has consequences for commerce, for access to public spaces, and for pollution and congestion. Municipalities have not widely adopted the solution that economists propose to solve this scarcity problem: increase the price. Politics aside, the reluctance of municipalities to do so may be explained by the unique nature of public property as reflected in well-rooted legal and societal constraints. This unique nature helps explain, for example, …

Elementary School Entrepreneurs, Annie Mcmahon Whitlock Jan 2019

Elementary School Entrepreneurs, Annie Mcmahon Whitlock

Interdisciplinary Journal of Problem-Based Learning

In this paper, I describe the implementation of a project-based economics unit in a fifth-grade classroom in Michigan, titled One Hen. One Hen is a curricular unit designed to teach students about social entrepreneurship as a way for students to learn economic concepts while developing their own civic efficacy by engaging in a project where they design and run their own social business. These findings are part of a larger case study that examines one fifth-grade class’s experience with One Hen and what these students learned about the economic concepts of loans and entrepreneurship. Through the authentic experiences of project-based …

The Many Benefits Of Urban Green Spaces, Junainah Abu Kasim, Mohd Johari Mohd Yusof, Helmi Zulhaidi Mohd Shafri

CSID Journal of Infrastructure Development

Recently, the ideology of greenery city has received global attention which aimed to address the issues of rapid urbanization, population growth and climate change. Urban green spaces (UGS) seem as the most essential asset that could help cities to mitigate the adverse effects of rapid urbanization and urban sprawl in a sustainable way. It plays a vital role in our cities as an urban lung, discharging oxygen to reduce the city’s heat, the wall for harmful air pollution and offer greatest benefits in term of environment, social and economy to a city. However, the presence of UGS as one of …

Uneven Development And Circular Causation, Amanda Devina, Ahmad Gamal Jan 2019

Uneven Development And Circular Causation, Amanda Devina, Ahmad Gamal

CSID Journal of Infrastructure Development

This paper discusses the uneven development and detects the circular causation that occurs in the Kalibata area. Uneven development occurs between the street vendor trade area and Kalibata City trade area. The research method we use are: 1) literature study as theoretical basis to understand the uneven development theory and the occurrence of circular causation; 2) data collection by conducting interviews, observation, and direct mapping; 3) information processing where we used the data obtained to compare the differences in production processes between two regions. Kalibata City (formal area) and street vendor trade area (informal area) have different potential that generates …

Urban Colonization Through Multiple Genetic Lenses: The City‐Fox Phenomenon Revisited, Alexandra L. Decandia, Kristin Brzeski, Elizabeth Heppenheimer, Catherine V. Caro, Glauco Camenisch, Peter Wandeler, Carlos Driscoll Jan 2019

Urban Colonization Through Multiple Genetic Lenses: The City‐Fox Phenomenon Revisited, Alexandra L. Decandia, Kristin Brzeski, Elizabeth Heppenheimer, Catherine V. Caro, Glauco Camenisch, Peter Wandeler, Carlos Driscoll

Michigan Tech Publications, Part 1

Urbanization is driving environmental change on a global scale, creating novel environments for wildlife to colonize. Through a combination of stochastic and selective processes, urbanization is also driving evolutionary change. For instance, difficulty in traversing human‐modified landscapes may isolate newly established populations from rural sources, while novel selective pressures, such as altered disease risk, toxicant exposure, and light pollution, may further diverge populations through local adaptation. Assessing the evolutionary consequences of urban colonization and the processes underlying them is a principle aim of urban evolutionary ecology. In the present study, we revisited the genetic effects of urbanization on red foxes …

Geography Faculty Publications and Presentations

This study explores the spatial distribution of green stormwater infrastructure (GSI) relative to sociodemographic and landscape characteristics in Portland, OR, and Baltimore, MD, USA at census block group (CBG) and census tract scales. GSI density is clustered in Portland, while it is randomly distributed over space in Baltimore. Variables that exhibit relationships with GSI density are varied over space, as well as between cities. In Baltimore, GSI density is significantly associated with presence of green space (+), impervious surface coverage (+), and population density (−) at the CBG scale; though these relationships vary over space. At the census tract scale …
