The Double-Edged Sword Of Parens Patriae: Status Offenders And The Punitive Reach Of The Juvenile Justice System, Madison C. Jaros Jul 2019

The Double-Edged Sword Of Parens Patriae: Status Offenders And The Punitive Reach Of The Juvenile Justice System, Madison C. Jaros

Notre Dame Law Review

This Note will argue that, despite the fact that adjudication as a status offender has the potential to lead to punitive outcomes, the rehabilitative rationale of parens patriae that lies behind the status offender designation ensures that juveniles charged under this category are not afforded the procedural protections that they are due under the Constitution’s Due Process Clause. This conundrum—that the rehabilitative rationale meant to protect juveniles actually leaves them more vulnerable to punishment—is not confined to the status offender context. Instead, the juvenile system as a whole suffers from the failures that result from promises of rehabilitation made by …

Improving The Transferability Of Suspended Solid Estimation In Wetland And Deltaic Waters With An Empirical Hyperspectral Approach, Daniel Jensen, Marc Simard, Kyle Cavanaugh, Yongwei Sheng, Cédric G. Fichot, Tamlin Pavelsky, Robert Twilley Jul 2019

Improving The Transferability Of Suspended Solid Estimation In Wetland And Deltaic Waters With An Empirical Hyperspectral Approach, Daniel Jensen, Marc Simard, Kyle Cavanaugh, Yongwei Sheng, Cédric G. Fichot, Tamlin Pavelsky, Robert Twilley

Faculty Publications

The deposition of suspended sediment is an important process that helps wetlands accrete surface material and maintain elevation in the face of sea level rise. Optical remote sensing is often employed to map total suspended solids (TSS), though algorithms typically have limited transferability in space and time due to variability in water constituent compositions, mixtures, and inherent optical properties. This study used in situ spectral reflectances and their first derivatives to compare empirical algorithms for estimating TSS using hyperspectral and multispectral data. These algorithms were applied to imagery collected by NASA’s Airborne Visible/Infrared Imaging Spectrometer-Next Generation (AVIRIS-NG) over coastal Louisiana, …

Ambient-Intelligent Decision Support System For Smart Manufacturing, Mahdi Fathi, Marzieh Khakifirooz, Yiannis Ampatzidis, Panos M. Pardalos

BCoE Publications

Ambient Intelligence (AmI) refers to a networked environment of computing devices for implementing a "smart" system. AmI is built using sensors and actuators connected through real-time networks. The data and signals captured from sensors are ambiguous for both human and machine. Artificial Intelligence (AI) is merged into an ambient environment to translate data and signals into a language understandable by human users and can help transform an operational setting from machine-centered to human-centered. However, the implementation of AI technology into an ambient environment requires quantitative modeling approaches to emphasize system requirements analysis and more detailed design specifications. This article tries …

Moving Beyond Medical Debt, Brook E. Gotberg, Michael D. Sousa Jul 2019

Moving Beyond Medical Debt, Brook E. Gotberg, Michael D. Sousa

Faculty Publications

In recent years it has become clear that medical costs are imposing severe financial burdens on American families, sometimes to the point that bankruptcy becomes the only escape from crippling debt. When evaluating the well-established connection between outstanding medical debt and consumer bankruptcy, most existing empirical studies attempt to quantify the percentage of consumer bankruptcies that are "caused" by unmanageable medical indebtedness. This Article addresses what we believe to be a more significant line of empirical inquiry, namely, the connection between health insurance coverage and consumer bankruptcy as a more precise measurement of how national health insurance programs may or …

Authors’ Response: An Enquiry Concerning Constitutional Understanding, Gary S. Lawson, Guy I. Seidman Jul 2019

Authors’ Response: An Enquiry Concerning Constitutional Understanding, Gary S. Lawson, Guy I. Seidman

Faculty Scholarship

One of Professor Lawson’s first students, alluding to a 1985 article with the provocative title “Why Professor [Marty] Redish Is Wrong about Abstention,” declared that his ambition was to inspire someone to write an article entitled “Why [the student] Is Wrong about XXX.” The student claimed that, regardless of what filled in the “XXX,” this event would be the pinnacle of academic accomplishment.

If that view is even close to the mark, then having an entire conference devoted to explaining why Professors Lawson and Seidman are wrong about the Constitution is an extraordinary honor. In all seriousness, we are genuinely …

High School Science And Social Studies Teachers' Self-Efficacy Regarding Literacy Instruction: A Transcendental Phenomenological Study, Jennifer L. Ryan Jul 2019

High School Science And Social Studies Teachers' Self-Efficacy Regarding Literacy Instruction: A Transcendental Phenomenological Study, Jennifer L. Ryan

Doctoral Dissertations and Projects

The purpose of this transcendental phenomenological study was to explore high school teachers’ self-efficacy regarding the incorporation of literacy instruction in high school science and social studies classes in a rural, public school district. In this qualitative research study, self-efficacy was generally defined as the teachers’ belief in how well they succeed at the task of including literacy instruction into their content area lessons. Albert Bandura’s (1997) self-efficacy theory and Shulman's (1986) pedagogical content knowledge (PCK) theory guided this study as it explored the teachers’ beliefs in their teaching abilities. Literacy instruction was defined as explicit instruction in word study, …

The Diffusion Of Legal Innovation--Insights From Mathematical Modeling, Michal Shur-Ofry, Gadi Fibich, Shira Green Jul 2019

The Diffusion Of Legal Innovation--Insights From Mathematical Modeling, Michal Shur-Ofry, Gadi Fibich, Shira Green

Cornell International Law Journal

Do countries adopt legal rules due to independent, top-down processes, or do laws spread among nations in a manner that resembles the diffusion of new products and innovations in a social network? We empirically examine this question by employing an influential mathematical model based on sociological diffusion theory and frequently used for analyzing the diffusion of innovations (the Bass model). Our findings indicate that more often than not, the temporal diffusion of legal rules displays a good fit to the Bass model and suggest that this model can provide new insights in studying the diffusion of laws. Particularly, applying the …

Organ Donations: Why The Gift Of Life Ideology Is Losing Lives, Dylan Fukai Jul 2019

Organ Donations: Why The Gift Of Life Ideology Is Losing Lives, Dylan Fukai

UC Law SF International Law Review

As people around the world continue to die on organ transplant waiting lists, the international community sits idly by, hoping that human kindness will solve the growing need for organs. Current altruistic systems have proven to be inadequate to close the gap between the high demand for organs and the limited supply of legally available organs. The international community’s aversion toward legal organ sales and the current issues stemming from the illegal organ market continue to impede progress toward saving lives. However, some nations have begun to transition from strictly altruistic organ transplantation systems. One example of a non-altruistic organ …

Assessing Macroeconomic Stability And Labour Market Efficiency In Kosovo: A Competitiveness Approach, Diandra Nela Jul 2019

Assessing Macroeconomic Stability And Labour Market Efficiency In Kosovo: A Competitiveness Approach, Diandra Nela

Theses and Dissertations

The stability of the macroeconomic environment is important for business and for overall competitiveness of a country. Firms cannot make informed decisions when inflation is out of control. The government cannot provide services efficiently if it has to make high-interest payments on its past debts. Relatedly, the efficiency and flexibility of the labour market are critical for ensuring that workers are allocated to their most efficient production in the economy. Labour markets must have the flexibility to shift workers from one economic activity to another rapidly and at low cost to allow for wage fluctuations without social disruption. The labour …

State Preemption Of Local Authority: Explaining Patterns Of State Adoption Of Preemption Measures, Luke Fowler, Stephanie L. Witt Jul 2019

State Preemption Of Local Authority: Explaining Patterns Of State Adoption Of Preemption Measures, Luke Fowler, Stephanie L. Witt

Public Policy and Administration Faculty Publications and Presentations

State preemption of local policymaking has attracted increasing attention from scholars, public officials, and citizens, as states have prevented local governments from boosting the minimum wage, regulating firearms, and barring certain forms of discrimination, among other policies. Although scholars have examined the legal dimensions of state preemption and analyzed preemption in specific areas, we lack a comprehensive account of which states have adopted preemption laws and why some states are more active than others in adopting them. Using a dataset drawing on preemption legislation in seventeen policy areas, we test support for competing explanations for variation in adoption of state …

Naturalistic Explanations Of The Origin Of The Book Of Mormon, Brian C. Hales Jul 2019

Naturalistic Explanations Of The Origin Of The Book Of Mormon, Brian C. Hales

BYU Studies

In early 1830, an unknown farmer in upstate New York burst upon the world’s book-publishing scene. The Book of Mormon rolled off the Grandin Press in Palmyra, New York, with Joseph Smith listed as “author and proprietor” on the title page. That same year, a few other authors produced new titles, including The Fortunes of Perkin Warbeck by Mary Shelley, Letters and Journals of Lord Byron by Thomas Moore, and Six Sermons on the Study of the Holy Scriptures by Samuel Lee. If grouped with books classified as “fiction” in 1830, the Book of Mormon may have been the longest, …

Feminist-Infused Participatory Action Research To Promote Female Students’ Self- Efficacy In Mathematics, Nicole Hreno Jul 2019

Feminist-Infused Participatory Action Research To Promote Female Students’ Self- Efficacy In Mathematics, Nicole Hreno

Theses and Dissertations

Prompted by the manifestations of decreased levels of mathematical self-efficacy among the female students in my district, the purpose of this study was to investigate the source of self-efficacy development that was most influential among our female students and engage in praxis to combat these gender inequities. Grounded in critical feminist theory, I engaged six teacher-researchers in participatory action research through qualitative methodologies. Using questionnaires to examine the worldviews of our female students, the emergent study was guided by these voices which were previously silenced. The interventions employed were a direct result of the females’ expressed mathematical experiences, leading us …

Is Duration Of Hospital Participation In Meaningful Use Associated With Value In Medicare?, Yanick N. Brice, Karen E. Joynt Maddox

Open Access Publications

Objectives: "Meaningful Use" (MU) of electronic health records (EHRs) is a measure used by Medicare to determine whether hospitals are comprehensively using electronic tools. Whether hospitals' engagement in value-based initiatives such as MU is associated with value-defined as high quality and low costs-is unknown. Our objectives were to describe hospital participation in MU, and determine whether duration of participation is associated with value.

Materials and Methods: We linked national Medicare data with MU and other hospital-level and market data. We analyzed bivariate relationships to characterize duration of participation. We estimated inverse probability-weighted multilevel logistic regressions to evaluate whether duration of …

Vouchers And Affordable Housing: The Limits Of Choice In The Political Economy Of Place, Rigel C. Oliveri Jul 2019

Vouchers And Affordable Housing: The Limits Of Choice In The Political Economy Of Place, Rigel C. Oliveri

Faculty Publications

America's housing segregation problem, and the direct role of government and private actors in creating it, is well documented. What to do about it is less clear. And even when consensus develops about particular strategies, they can be difficult to implement because of significant headwinds that impede change. These headwinds-including market forces, government policies, and private prejudices-continue to stymie progress, and even well-intentioned reform efforts can fail at best and lead to negative consequences at worst. This piece seeks not to provide answers, but rather to describe one such set of reforms and headwinds and to propose some modest policy …

Conceptualising Children's Rights In Digital Spaces: Emerging Issues And Challenges, Aratrika Choudhuri Jul 2019

Conceptualising Children's Rights In Digital Spaces: Emerging Issues And Challenges, Aratrika Choudhuri

Socio-Legal Review

The transnational and ostensibly age-blind digital spaces, facilitating new socio-cultural interconnections, recasting of identities, and commiserations of creative output, posits a distinctive set of opportunities, benefits and risks for present-day "digital natives". This paper seeks to transcend mainstream protectionist rhetoric framing conceptualizations of children 's rights in digital spaces, and to proffer more empowering, holistic and inclusive approaches towards effectuating their virtual citizenship. By undertaking interdisciplinary analyses, this paper seeks to delineate a sound normative and epistemological framework that conceptualizes digital spaces as actuating children 's rights. Further, this paper seeks to examine the key issues and challenges in realizing, …

Temporal And Spatial Dynamics Of Competitive Parapatry In Chewing Lice, David J. Hafner, Mark S. Hafner, Theresa A. Spradling, Jessica E. Light, James W. Demastes

Faculty Work

We synthesize observations from 1979 to 2016 of a contact zone involving two subspecies of pocket gophers (Thomomys bottae connectens and T. b. opulentus) and their respective chewing lice (Geomydoecus aurei and G. centralis) along the Rio Grande Valley in New Mexico, U.S.A., to test predictions about the dynamics of the zone. Historically, the natural flood cycle of the Rio Grande prevented contact between the two subspecies of pocket gophers. Flood control measures completed in the 1930s permitted contact, thus establishing the hybrid zone between the pocket gophers and the contact zone between their lice (without hybridization). Since that time, …

Redrawing Maps The Right Way, Jeffrey M. Wice, Frank M. Strigari

Redistricting Resources

The U.S. Supreme Court’s recent Rucho v. Common Cause decision has closed the federal court door to partisan gerrymandering cases, but the fighting over redistricting plans is far from over. Plans considered “too partisan” may face challenges in state courts in the future, and those alleged to be racial gerrymanders can still be challenged in federal and state courts.
