Access To Law Or Access To Lawyers? Master's Programs In The Public Educational Mission Of Law Schools, Mark Burge
Access To Law Or Access To Lawyers? Master's Programs In The Public Educational Mission Of Law Schools, Mark Burge
Faculty Scholarship
The general decline in juris doctor (“J.D.”) law school applicants and enrollment over the last decade has coincided with the rise of a new breed of law degree. Whether known as a master of jurisprudence, juris master, master of legal studies, or other names, these graduate degrees all have a target audience in common: adult professionals who neither are nor seek to become practicing attorneys. Inside legal academia and among the practicing bar, these degrees have been accompanied by expressed concerns that they detract from the traditional core public mission of law schools—educating lawyers. This Article argues that non-lawyer master’s …

Even Some International Law Is Local: Implementation Of Treaties Through Subnational Mechanisms, Charlotte Ku, William H. Henning, David P. Stewart, Paul F. Diehl
Faculty Scholarship
Multilateral treaties today rarely touch on subjects where there is no domestic law in the United States, In the U.S. federal system, this domestic law may not be national law, but law of the constituent States of the United States. However, in light of the U.S. Constitution Article VI, treaties in their domestic application unavoidably federalize the subjects they address. The most sensitive issues arise when a treaty focuses on matters primarily or exclusively dealt with in the United States at the State or local level. Although U.S. practice allows for some flexibility to accommodate State/local interests, the federal government …
Deconstructing Perceptions Of The Border Patrol At The U.S.-Mexico Border, Claire H. Woodward
Deconstructing Perceptions Of The Border Patrol At The U.S.-Mexico Border, Claire H. Woodward
Student Publications
The U.S.-Mexico border is a space for public debate on the legal and political aspects of immigration. Politicization of the southern border has resulted in polarized public opinion regarding immigration, leading to discrepancies between public perceptions of the Border Patrol and agents’ perceptions of their job. Agents’ work requires emotional labor, and lack of training for difficult encounters, pressure within the agency to detach from emotions, and public outcry lead to dissonance in agent perceptions of their own role in immigration enforcement. In addition, economic, ethnic, and gender-based factors contribute to agent identities, which intersect with perceptions of their roles …
When We’Re Connected To A Community, We’Re Less Likely To Be At War With It: The Effect Of Strong Civil Society On Civil War Onset And Incidence, Benjamin R. Pontz
When We’Re Connected To A Community, We’Re Less Likely To Be At War With It: The Effect Of Strong Civil Society On Civil War Onset And Incidence, Benjamin R. Pontz
Student Publications
I argue that a strong civil society suggests the existence of institutions that provide alternate mechanisms to reduce grievance as well as opportunities for public problem solving, which, in turn, should result in a decreased probability of civil war onset as well as decreased civil war incidence (a proxy for civil war duration). Controlling for per capita GDP, ethnic fractionalization, regime type, and population -- the measures that tend to have the strongest association with civil war onset and incidence -- I find that the presence of strong civil society does, indeed, have a negative and statistically significant association with …
College Campus Sexual Assault And Retention Rates, Abigail R. Hauer
College Campus Sexual Assault And Retention Rates, Abigail R. Hauer
Student Publications
Increased media attention on college crime, specifically sexual assault, has led to greater prioritization of campus safety when deciding whether to continue attending a college. This, coupled with society’s view of a four-year college education as a necessity to succeed in the labor market, creates a potential tradeoff between safety on campus and future employment success. To analyze such tradeoff, I use data from the US Department of Education from 2014 to 2017 to examine whether college campus sexual assault at four-year American institutions impacts retention rates. Such results have implications for college policies to combat sexual assault on campus …

Rangeland Management During Drought: Assessing Social–Ecological And Cognitive Indicators Of Ranchers’ Adaptive Capacity, Tonya Haigh
School of Natural Resources: Dissertations, Theses, and Student Research
Rangeland managers face challenges to adapt to climate extremes, and research is needed on how to support their adaptive capacity for managing climate risk. This study evaluates adaptive capacity using an integrated vulnerability and resilience conceptual model and three cognitive behavioral models. Overarching research questions focus on the relationship between protective action and impacts and the best predictors of taking action in response to drought. Three studies address these questions, using quantitative data collected from two post-drought surveys of rangeland-based livestock managers in the Northern Great Plains of the U.S. The studies find evidence of the roles of social-ecological sources …

Understanding The Spatiotemporal Development Of Human Settlement In Hurricane-Prone Areas On The Us Atlantic And Gulf Coasts Using Nighttime Remote Sensing, Xiao Huang, Cuizhen Wang, Junyu Lu
Faculty Publications
Hurricanes, as one of the most devastating natural hazards, have posed a great threat to people in coastal areas. A better understanding of the spatiotemporal dynamics of human settlement in hurricane-prone areas largely benefits sustainable development. This study uses the nighttime light (NTL) data from the Defense Meteorological Satellite Program’s Operational Linescan System (DMSP/OLS) to examine human settlement development in areas with different levels of hurricane proneness from 1992 to 2013. The DMSP/OLS NTL data from six satellites were intercalibrated and desaturated with the Advanced Very High Resolution Radiometer (AVHRR) and Moderate Resolution Imaging Spectroradiometer (MODIS) optical imagery to derive …

Intersections are locations with higher likelihood of crash occurences and sources of traffic congestion as they act as bottlenecks compared with other parts of the roadway networks. Consequently, connected and automated vehicles (CAVs) can help to improve the efficiency of the roadways by reducing traffic congestion and traffic delays. Since CAVs are expected to take control from drivers (human control) in making many important decisions, thus they are expected to minimize driver (human) errors in driving tasks. Therefore, CAVs potential benefits of eliminating driver error include an increase in safety (crash reduction), smooth vehicle flow to reduce emissions, and reduce …
Engaging The Safety System Of The Brain: Training For Teachers Of Immigrants Who Have Experienced Trauma, Lindsey Grace Crifasi
Engaging The Safety System Of The Brain: Training For Teachers Of Immigrants Who Have Experienced Trauma, Lindsey Grace Crifasi
School of Education and Leadership Student Capstone Projects
Research has shown that trauma makes changes in our brain chemistry. In the space of teaching and learning, these changes can inhibit students from reaching their goals effectively. This research focused on addressing the questions: What are the key aspects of trauma-informed teaching, specifically for the immigrant population? What happens to the brain when it is dealing with trauma, Post Traumatic Stress Disorder (PTSD) or grief and how does that affect learning? With inspiration from Dr. Bessel van der Kolk’s book The Body Keeps the Score: Brain, Mind, Body and the Healing of Trauma and studies into the Polyvagal Theory …
How To Say Nothing And Everything At The Same Time: A White Teacher, Students Of Color, And The Trial And Error Of Building Relationships Of Opportunity With Envoy, Melissa Bougie
School of Education and Leadership Student Capstone Projects
This capstone project focuses on how ENVoY classroom management might impact student teacher relationships and academic success in diverse high school classrooms. The project takes the form of a blog that outlines ENVoY classroom management techniques as well as discusses the philosophy of educational equity that exists behind the techniques. It includes my own analysis and research as well as interviews of ENVoY Demonstration Teachers. Due to the opportunity gaps between white students and students of color that often exist in diverse high schools, it is important to consider what might contribute to closing these gaps. Classroom management is one …
Lawmakers As Job Buyers, Edward W. De Barbieri
Lawmakers As Job Buyers, Edward W. De Barbieri
Fordham Law Review
In 2013, Washington State authorized the largest state tax incentive for private industry in U.S. history. It is not remarkable for a state legislature to use tax benefits to retain a major employer—in this case, the global aerospace manufacturer Boeing. Laws across all states and thousands of cities routinely incentivize companies such as Amazon to relocate or remain in particular areas. Notably, however, Washington did not recover any of the subsidies it authorized despite Boeing’s significant post-incentive workforce reductions. This story leads to several important questions: (1) How effective are state and local legislatures at influencing business-location decisions?; (2) Do …
Auctioning Airspace, Brent Skorup
Auctioning Airspace, Brent Skorup
North Carolina Journal of Law & Technology
The commercialization of air taxis and autonomous passenger drones will one day congest urban airspace. Operators expect that, once flights are autonomous and the cost of service falls, high-traffic urban “vertiports” could see hundreds of air taxi takeoffs and landings per hour. Low-altitude airspace—between 200 feet and 5,000 feet above ground level—offers a relatively blank slate to explore new regulatory models for air traffic management and avoid command-and-control mistakes made in the past in aviation. Regulators’ current proposals would centralize air taxi traffic management into a single system to coordinate air taxi traffic, but this approach likely creates technology lock-in …

Moses Flavius Vespasianus: Investigating Mosaic Themes In The Bellum Iudaicum Of Josephus In The Context Of The Emperor Vespasian, Sean Tobin
History & Classics Undergraduate Theses
According to the autobiographical work that he wrote, Titus Flavius Josephus, born Yosef ben Matityahu, was born in the year 37, the same year Caligula ascended to the imperial throne in Rome. He was born in the Roman province of Judaea to a priestly, aristocratic family and raised in Jerusalem in the privilege and wealth associated with such a family. Following the war between the Romans and the Jews in 66 and his capture by the Romans at the siege of Jotapata, he became a prisoner of the future emperor, Vespasian, later winning his favor by prophesying his rise to …

Leveraging Geographical And Spectral Information For Efficient Cellular Systems, Matthew Tonnemacher
Electrical Engineering Theses and Dissertations
With the unprecedented increase in mobile data demand and limited usable spectrum to provide for it, a paradigm shift towards spectrum sharing is a promising solution. However, there are many challenges that limit current spectrum sharing practices. One challenge is that proper spectrum sharing requires engaging devices to have an understanding of the impact they have on the ecosystem while transmitting in terms of spacial interference footprint and the implications to devices in their interference range. Another is that operators, especially licensed ones, have strict quality of service requirements for their subscribers, discouraging them from allowing unlicensed access of their …
The Role Of Introductory Geoscience Courses In Preparing Teachers—And All Students—For The Future: Are We Making The Grade?, Anne E. Egger
The Role Of Introductory Geoscience Courses In Preparing Teachers—And All Students—For The Future: Are We Making The Grade?, Anne E. Egger
Geological Sciences Faculty Scholarship
Introductory geoscience courses enroll hundreds of thousands of students a year, most of whom do not major in the geosciences. For many, including future K–12 teachers, an introductory course is the only place they will encounter Earth science at the college level. New standards for K–12 science education have profound implications for teacher preparation, particularly in Earth science. The new standards call for taking a systems approach, highlighting how humans interact with Earth, making use of science and engineering practices, and engaging students in discourse. Analysis of responses to the National Geoscience Faculty Survey (n = 813 in 2004; …

Distribution And Abundance Of Vibrio Parahaemolyticus In Surficial Estuarine Sediment From North Inlet, Sc, Usa, India Briana Gartmon
Theses and Dissertations
Vibrio parahaemolyticus is a ubiquitous coastal organism that causes gastroenteritis (vibriosis) after ingestion of mishandled or undercooked seafood. Cases of vibriosis have increased rapidly in the past decade. V. parahaemolyticus densities have historically been associated with an increase in sea surface water temperatures, but recent shellfish bed closures in fall and winter months in cooler regions (the Baltic Sea, the Pacific NW, and New England) suggest that there may be additional environmental parameters that affect densities of V. parahaemolyticus. The vertical distribution of V. parahaemolyticus was assessed in the pristine North Inlet Estuary (SC, USA). The goal of this …

Legitimacy In International Dispute Resolution In The Age Of Anti-Globalization, Nationalism, And Isolationism: How Geographical And Legal Cultural Diversity On The International Bench Can Promote Regional And International Cooperation, Alina Ng Boyte
Cardozo International & Comparative Law Review
The article argues that implicit biases, such as availability bias, affect heuristic, and endowment effect, significantly impede international cooperation and effective problem-solving in the global legal system. By addressing these cognitive errors, international legal institutions can foster trust, promote collaboration, and achieve socially just outcomes. The analysis highlights the role of legal frameworks and distributive justice in overcoming these biases, using the example of global efforts to eliminate child labor as a successful case study.

How To Improve High-Risk High School Student Achievement And Well-Being Through Using Best Practices, Particularly In An Alternative Setting, Laura Lopez Dahl
School of Education and Leadership Student Capstone Projects
Many high-risk students struggle in education and find it difficult to be successful in mainstream educational settings. Alternative educational programs (AEP) are used as an intervention for students who are struggling in the mainstream setting and are at risk for failure. Students in AEP programs have an opportunity to overcome their barriers and achieve graduation as opposed to dropping out or getting their general education diploma (GED). Many of the students in these programs struggle with adverse childhood experiences (ACE) and have had negative educational experiences. This capstone project addresses the research question: How to improve high-risk high school achievement …

Dipl 6704 Na Economic Development Of Africa, Fredline M'Cormack-Hale Phd
Diplomacy Syllabi
Of the four major less developed regions in the world (East and South Asia, Latin America and Africa), Sub-Saharan Africa (hereafter SSA) has performed the worst economically since 1975. Explaining this poor economic development has occupied development theorists, aid agencies, international institutions and African governments and people alike. The purpose of this course is to examine the reasons advanced to explain the under-development of Africa through a primarily political economy framework, as the African continent is testament to the fact that economic development is affected by political contexts. We will explore explanations that include history (the legacy of a colonial …

Distribution And Dispersal Potential Of The Endemic Tree Loblolly Bay (Gordonia Lasianthus) In The Southeastern United States Coastal Plain And Implications For Conservation In The Context Of Forecast Climate Scenarios., Herrick Hermann Klaus Brown
Theses and Dissertations
Plant communities in the Southeastern United States Coastal Plain constitute a rich assemblage of species from neighboring floristic provinces and include over 1,000 species endemic to the region. Conservation of these unique landscapes requires a better understanding of potential impacts from human activity and a changing climate. As a model species, the endemic tree Loblolly Bay (Gordonia lasianthus) is representative of Carolina Bays, pocosins, and isolated wetland habitats that accentuate Longleaf Pine ecosystems which dominate the focus area. Seed-dispersal events in Loblolly Bay are limited to periods of relatively low humidity primarily during the months of October to December, and …
