Schools As Training Grounds For Harassment, Ann C. Mcginley
Schools As Training Grounds For Harassment, Ann C. Mcginley
Scholarly Works
This article deals with the schools’ role in permitting and encouraging peer sex- and gender-based harassment of children and the law’s role in failing to hold schools accountable for their negligent and intentional behavior in sanctioning it. Part I discusses the evidence of rampant sex- and gender-based harassment in schools. Part II analyzes the problem through the lens of masculinities theory and explains how cultural notions of masculinity create incentives for boys (and some girls) to engage in peer sex- and gender-based harassment.
Part III analyzes court cases and OCR decisions and explains the serious disconnect between the two; it …
Judicial Ethics: A New Paradigm For A New Era, Charles G. Geyh
Judicial Ethics: A New Paradigm For A New Era, Charles G. Geyh
Articles by Maurer Faculty
As the preamble to the Model Code of Judicial Conduct indicates, traditional notions of judicial ethics operate within a rule of law paradigm, which posits that the "three I's" of judicial ethics-independence, impartiality, and integrity-enable judges to uphold the law. In recent decades, however, social science, public opinion, and political commentary suggest that appointed judges abuse their independence by disregarding the law and issuing rulings in accord with their biases and other extralegal impulses, while elected judges disregard the law and issue rulings popular with voters, all of which calls the future of the three I's and judicial ethics itself …
Racism As Self-Love, Grant J. Silva
Racism As Self-Love, Grant J. Silva
Philosophy Faculty Research and Publications
In the United States today, much interpersonal racism is driven by corrupt forms of self-preservation. Drawing from Jean-Jacques Rousseau, I refer to this as self-love racism. The byproduct of socially-induced racial anxieties and perceived threats to one’s physical or social wellbeing, self-love racism is the protective attachment to the racialized dimensions of one’s social status, wealth, privilege, and/or identity. Examples include police officer related shootings of unarmed Black Americans, anti-immigrant sentiment, and the resurgence of unabashed white supremacy. This form of racism is defined less by the introduction of racism into the world and more on the perpetuation of racially …
Self-Control And Moral Security, Jeanette Kennett, Jessica Wolfendale
Self-Control And Moral Security, Jeanette Kennett, Jessica Wolfendale
Philosophy Faculty Research and Publications
Self-control is integral to successful human agency. But the capacity for self-control requires external support. This paper explores the connections between social conditions, self-control, agency, and the self. Part one offers a taxonomy of self-control. Part two examines the external conditions that support successful agency and self-control, and argues that moral security is a critical foundation for agency. Moral security refers to the degree to which an agent believes that her welfare and her projects are valued by others and by her society. Parts three and four explore how narratives about racism and poverty undermine moral security, and limit and …

Jay Sexter Library Publications and Research
The twenty-first century library at a newly opened medical school often differs from those at traditional medical schools. One obvious difference is that the new medical school library tends to be a born-digital library, meaning that the library collection is almost exclusively digital. However, the unique issues related to building a library at a new medical school are not limited to online collections. A unique start-up culture is prevalent, of which newly appointed directors and other library and medical school leaders need to be aware. This special paper provides an overview of best practices experienced in building new medical school …

All-Inclusive List of Electronic Theses and Dissertations
The purpose of the quantitative study was to take the researched components of the teacher-learner relationship and operationalize them into a survey instrument to measure and operationalize the relationship so that it can be studied and improved upon. The seven components of the teacher-learner relationship are empathy, showing care and concern, mutual respect, going above and beyond, passion and enthusiasm, perseverance and patience, and belief in the learners abilities. This quantitative study was based on the theories of emotional intelligence, client-centeredness, and attachment theory. While there is a wealth of literature about what makes a teacher-learner relationship important and what …
Decentralizing Legislation In China’S Law On Legislation Amendment, Wei Cui, Jiang Wan
Decentralizing Legislation In China’S Law On Legislation Amendment, Wei Cui, Jiang Wan
All Faculty Publications
We present a novel account of China’s recent move to decentralize legislation through amending the Law on Legislation (LL). Conventional wisdom pervading both Chinese political discourse and social scientific scholarship on China portrays law as incompatible with experimentation and as only suitable for codifying policies adopted after experimentation. Moreover, the value of legislatures is viewed as lying in their independence from the executive branch. We highlight rationales offered by the Chinese Communist Party for the LL amendment that repudiate these assumptions: the Party proclaimed the intention to promote lawmaking as a central instrument of policy experimentation; moreover, the Party’s intervention …

Wind-induced sea level blowouts, measured as negative storm surge or extreme low water (ELW), produce public safety hazards and impose economic costs (e.g., to shipping). In this paper, we use a regional hydrodynamic numerical model to test the effect of historical environmental change and the time scale, direction, and magnitude of wind forcing on negative and positive surge events in the New York Harbor (NYH). Environmental sensitivity experiments show that dredging of shipping channels is an important factor affecting blowouts while changing ice cover and removal of other roughness elements are unimportant in NYH. Continuously measured water level records since …

Indubitably, history is a branch of knowledge which stretches way back to the beginning of time in human civilization and ipso facto, contributes to the shaping of a society’s past and future as well. As Marcus Mosiah Garvey (1887-1940) puts it, a people without the knowledge of the past History, origin and culture is like a tree without roots. Therefore, since development is a product of change, and the subject matter of history focuses on continuity and change, it follows that development can only be understood and appreciated within the context of history. This article examines the relevance of history …

Parallel connection of converters is a convenient choice when system capacity is to be increased. Parallel-connected voltage source converters, especially neutral point clamped converters, are one of the best choices for its range. However, with the parallel connectivity, the converter possesses a circulating current in its legs, which consequently threatens the safe operation of the system. To alleviate this circulating current problem, in this paper, a double deadbeat (DD) plus repetitive control (RC) scheme is proposed. The RC scheme is employed to mitigate the circulating currents and the DD loop control scheme is employed to achieve a high operating bandwidth …
Characterisation Of Cholesterolcontaining Microparticles In Autoimmunity, Shuai Shuai Hu
Characterisation Of Cholesterolcontaining Microparticles In Autoimmunity, Shuai Shuai Hu
Doctoral
In recent years, it has become apparent that sub-micron scale remnants of cells, called microparticles (MPs), are present in human circulation. MPs contain DNA, RNA, protein and lipids (such as cholesterol). Increased numbers of MPs are observed in autoimmune conditions such as Systemic Lupus Erythematosus (SLE) and Rheumatoid Arthritis (RA). This work aims to address the deficiency in the literature concerning MP cholesterol (MPC) by establishing reference values for MPC in a representative healthy population group, and by investigating the potential of MP cholesterol as a biomarker in autoimmunity.

Hypothesis testing is a prevalent method of inference used to test a claim about a population parameter based on sample data, and it is a central concept in many introductory statistics courses. At the same time, the use of hypothesis testing to interpret experimental data has raised concerns due to common misunderstandings by both scientists and students. With statistics education reform on the rise, as well as an increasing number of students enrolling in introductory statistics courses each year, there is a need for research to investigate students’ understanding of hypothesis testing. In this study we used APOS Theory to …

Survey results were presented to and discussed among teachers in both large and small group settings followed by written individual teacher reflections on the process. …
Promotion And Retention Of English Learners (Ells) In An Large Urban School District: A Policy Advocacy Document, Hanan Matari, Ruqia Ali
Promotion And Retention Of English Learners (Ells) In An Large Urban School District: A Policy Advocacy Document, Hanan Matari, Ruqia Ali
Dissertations
This policy advocacy document argues for a fair and equitable retention and promotion policy for English language learners (ELLs) in elementary grades of a large urban school district. Increasing access and instructional opportunities within bilingual/ESL services combined with more accurate measures of English proficiency would help mitigate random or unfair promotion and retention practices. A needs analysis was conducted on educational, economic, social, political, and moral-ethical dimensions and arguments made in support of the recommended policy (Browder, 1995). This policy solidifies district accountability for the education of all ELL students by mandating schools provide equal opportunity and access to high-quality …
Transformational And Transactional Leadership Outcomes On The City Of Oakland By Demographics, Jason W. Mitchell
Transformational And Transactional Leadership Outcomes On The City Of Oakland By Demographics, Jason W. Mitchell
Doctoral Dissertations
This study utilized a quantitative method, using surveys of workers in the public sector in the City of Oakland to determine the barriers that make it difficult to manage performance and tackle complex issues of that organization. Further, this study delved into the possibility for these leaders to create transactional or transformational environments in this sector. The goal was to find issues that make it difficult for public-sector executives to lead effectively; that is, the goal was to discern factors that prohibit executives from delivering high-quality and efficient services to the public and developing change management. This survey is vital …
Counterfactuals With Latent Information, Dirk Bergemann, Benjamin Brooks, Stephen Morris
Counterfactuals With Latent Information, Dirk Bergemann, Benjamin Brooks, Stephen Morris
Cowles Foundation Discussion Papers
We describe a methodology for making counterfactual predictions in settings where the information held by strategic agents and the distribution of payoff-relevant states of the world are unknown. The analyst observes behavior assumed to be rationalized by a Bayesian model, in which agents maximize expected utility, given partial and differential information about the state. A counterfactual prediction is desired about behavior in another strategic setting, under the hypothesis that the distribution of the state and agents’ information about the state are held fixed. When the data and the desired counterfactual prediction pertain to environments with finitely many states, players, and …

Flipping The Script: Prioritizing The Autistic Voice In The Understanding Of Scriping As “Key To Autistic Identity”, Colleen D. Arnold
Doctoral Dissertations
Traditional research regarding communication differences for autistic individuals, including scripting (“delayed echolalia”) is grounded in the pathology paradigm and thus emphasizes the elimination of scripting, without looking at the features and benefits it serves the individual utilizing it. This study, by prioritizing the autistic voices as the resounding experts on the topic of scripting, attempts to identify the communicative features and benefits of scripting, as well as how the dynamics of the conversation partner impact the exchange, both positively and negatively. Further, the research looks at the features of scripting as described by autistic adults. It also addresses the pressures …
Effects Of Think-Aloud Protocol On The Mathematical Problem-Solving Skills Of Seventh- And Eighth- Grade Students With Learning Disabilities, Nasa Lesley Cole
Effects Of Think-Aloud Protocol On The Mathematical Problem-Solving Skills Of Seventh- And Eighth- Grade Students With Learning Disabilities, Nasa Lesley Cole
Doctoral Dissertations
The purpose of this study was to examine the effect of a cognitive- and metacognitive-strategy instruction on the mathematical problem-solving performance and metacognitive experience of 22 seventh- and eighth-grade students with learning disabilities. When solving mathematical word problems, students with learning disabilities typically lack self-regulation processes (Larson & Gerber, 2002) tend to respond impulsively, to use trial and error, and fail to evaluate or verify their solutions (Bryant, Bryant, & Hammermill, 2000). This study used the Metacognitive Experience Survey (MES), two sets of three mathematical-word-problem probes of varying complexity levels, and think-aloud protocols to measure intervention effect. The first research …
The Exclusionary Rule In The Age Of Blue Data, Andrew Ferguson
The Exclusionary Rule In The Age Of Blue Data, Andrew Ferguson
Scholarly Articles in Law Reviews & Journals
In Herring v. United States, Chief Justice John Roberts reframed the Supreme Court’s understanding of the exclusionary rule: “As laid out in our cases, the exclusionary rule serves to deter deliberate, reckless, or grossly negligent conduct, or in some circumstances recurring or systemic negligence.” The open question remains: how can defendants demonstrate sufficient recurring or systemic negligence to warrant exclusion? The Supreme Court has never answered the question, although the absence of systemic or recurring problems has figured prominently in two recent exclusionary rule decisions. Without the ability to document recurring failures, or patterns of police misconduct, courts can dismiss …

Manufactured Emergencies, Robert Tsai
Manufactured Emergencies, Robert Tsai
Scholarly Articles in Law Reviews & Journals
Emergencies are presumed to be unusual affairs, but the United States has been in one state of emergency or another for the last forty years. That is a concern. The erosion of democratic norms has led not only to the collapse of the traditional conceptual boundary between ordinary rule and emergency governance, but also to the emergence of an even graver problem: the manufactured crisis. In an age characterized by extreme partisanship, institutional gridlock, and technological manipulation of information, it has become exceedingly easy and far more tempting for a President to invoke extraordinary power by ginning up exigencies. To …

Chemical Analysis Of Firearm Discharge Residues Using Laser Induced Breakdown Spectroscopy, Courtney Helen Vander Pyl
Graduate Theses, Dissertations, and Problem Reports (ETD)
According to the Gun Violence Archive, in 2017, firearms were involved in 57,134 criminal incidents in the United States. The detection of firearm discharge residues (FDR), including inorganic and organic gunshot residues, can provide essential information in such investigations. For instance, when the question of suicide or murder arises, estimating the barrel to victim distance plays a critical role in the outcome of the case. In addition, clothing, wounds and other target materials are often inspected to determine if a bullet has produced an entry or exit orifice. Currently, the most common method for distance determination and identification of bullet …
Analyzing Mathematicians' Concept Images Of Differentials, Timothy Shawn Mccarty
Analyzing Mathematicians' Concept Images Of Differentials, Timothy Shawn Mccarty
Graduate Theses, Dissertations, and Problem Reports (ETD)
The differential is a symbol that is common in first- and second-year calculus. It is perhaps expected that a common mathematical symbol would be interpreted universally. However, recent literature that addresses student interpretations of differentials, usually in the context of definite integration, suggests that this is not the case, and that many interpretations are possible. Reviews of textbooks showed that there was not a lot of discussion about differentials, and what interpretations there were depended upon the context in which the differentials were presented. This dissertation explores some of these issues. Since students may not have the experience necessary to …
Death-Defying Morphologies: Mass Extinction And Disparity In The Order Harpetida, James Desmond Beech
Death-Defying Morphologies: Mass Extinction And Disparity In The Order Harpetida, James Desmond Beech
Graduate Theses, Dissertations, and Problem Reports (ETD)
The trilobite order Harpetida has long been easily recognized but poorly understood. This study seeks to better understand the phylogenetic relationships within Harpetida, with a view towards using this group to explore the relationship between extinction intensity and disparity. The harpetid response to the Late Ordovician mass extinction is of particular interest. A discrete morphological character matrix was created from the formal descriptions of harpetids in the published trilobite literature, and refined using first-hand observations of harpetid fossils. The final matrix consists of 76 discrete characters, including 69 cephalic characters, three thoracic characters, and four pygidial characters. This matrix is …

The Parent-Child Interaction Therapy Family Experiences And Feedback Study: A Follow-Up Examination Of Attrition In An Evidence-Based Treatment In Community Settings Statewide, Brittany K. Liebsack
Graduate Theses, Dissertations, and Problem Reports (ETD)
Attrition is a significant problem in child psychotherapy (De Haan, Boon, De Jong, Hoeve, & Vermeiren, 2013) and has serious implications (Barrett et al., 2008). Predictors of attrition include those at the client, therapist, and treatment levels. The current study investigated variables associated with attrition in Parent-Child Interaction Therapy (PCIT), an evidence-based parent training program for families with young children (ages 2.5- to 7-years-old) with disruptive behavior disorders. The sample of 67 caregivers were treated by 25 therapists from 19 different licensed psychiatric outpatient clinics across one state and were part of a larger study (RO1 MH09750; A Statewide Trial …
